1111 1 AN ACT concerning finance.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Illinois Procurement Code is amended by
1515 5 changing Section 33-5 as follows:

1717 7 Sec. 33-5. Definitions. In this Article:
1818 8 "Construction management services" includes:
1919 9 (1) services provided in the planning and
2020 10 pre-construction phases of a construction project
2121 11 including, but not limited to, consulting with, advising,
2222 12 assisting, and making recommendations to the Board and
2323 13 architect, engineer, or licensed land surveyor on all
2424 14 aspects of planning for project construction; reviewing
2525 15 all plans and specifications as they are being developed
2626 16 and making recommendations with respect to construction
2727 17 feasibility, availability of material and labor, time
2828 18 requirements for procurement and construction, and
2929 19 projected costs; making, reviewing, and refining budget
3030 20 estimates based on the Board's program and other available
3131 21 information; making recommendations to the Board and the
3232 22 architect or engineer regarding the division of work in
3333 23 the plans and specifications to facilitate the bidding and

6868 1 awarding of contracts; soliciting the interest of capable
6969 2 contractors and taking bids on the project; analyzing the
7070 3 bids received; and preparing and maintaining a progress
7171 4 schedule during the design phase of the project and
7272 5 preparation of a proposed construction schedule; and
7373 6 (2) services provided in the construction phase of the
7474 7 project including, but not limited to, maintaining
7575 8 competent supervisory staff to coordinate and provide
7676 9 general direction of the work and progress of the
7777 10 contractors on the project; directing the work as it is
7878 11 being performed for general conformance with working
7979 12 drawings and specifications; establishing procedures for
8080 13 coordinating among the Board, architect or engineer,
8181 14 contractors, and construction manager with respect to all
8282 15 aspects of the project and implementing those procedures;
8383 16 maintaining job site records and making appropriate
8484 17 progress reports; implementing labor policy in conformance
8585 18 with the requirements of the public owner; reviewing the
8686 19 safety and equal opportunity programs of each contractor
8787 20 for conformance with the public owner's policy and making
8888 21 recommendations; reviewing and processing all applications
8989 22 for payment by involved contractors and material suppliers
9090 23 in accordance with the terms of the contract; making
9191 24 recommendations and processing requests for changes in the
9292 25 work and maintaining records of change orders; scheduling
9393 26 and conducting job meetings to ensure orderly progress of

104104 1 the work; developing and monitoring a project progress
105105 2 schedule, coordinating and expediting the work of all
106106 3 contractors and providing periodic status reports to the
107107 4 owner and the architect or engineer; and establishing and
108108 5 maintaining a cost control system and conducting meetings
109109 6 to review costs.
110110 7 "Construction manager" means any individual, sole
111111 8 proprietorship, firm, partnership, corporation, or other legal
112112 9 entity providing construction management services for the
113113 10 Board and prequalified by the State in accordance with 30 ILCS
114114 11 500/33-10.
115115 12 "Board" means the Capital Development Board or, to the
116116 13 extent that the services are to be procured by for a public
117117 14 institution of higher education, the public institution of
118118 15 higher education.
