11	11	1 AN ACT concerning finance.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Illinois Procurement Code is amended by
15	15	5 changing Section 33-5 as follows:
16	16	6 (30 ILCS 500/33-5)
17	17	7 Sec. 33-5. Definitions. In this Article:
18	18	8 "Construction management services" includes:
19	19	9 (1) services provided in the planning and
20	20	10 pre-construction phases of a construction project
21	21	11 including, but not limited to, consulting with, advising,
22	22	12 assisting, and making recommendations to the Board and
23	23	13 architect, engineer, or licensed land surveyor on all
24	24	14 aspects of planning for project construction; reviewing
25	25	15 all plans and specifications as they are being developed
26	26	16 and making recommendations with respect to construction
27	27	17 feasibility, availability of material and labor, time
28	28	18 requirements for procurement and construction, and
29	29	19 projected costs; making, reviewing, and refining budget
30	30	20 estimates based on the Board's program and other available
31	31	21 information; making recommendations to the Board and the
32	32	22 architect or engineer regarding the division of work in
33	33	23 the plans and specifications to facilitate the bidding and

68	68	1 awarding of contracts; soliciting the interest of capable
69	69	2 contractors and taking bids on the project; analyzing the
70	70	3 bids received; and preparing and maintaining a progress
71	71	4 schedule during the design phase of the project and
72	72	5 preparation of a proposed construction schedule; and
73	73	6 (2) services provided in the construction phase of the
74	74	7 project including, but not limited to, maintaining
75	75	8 competent supervisory staff to coordinate and provide
76	76	9 general direction of the work and progress of the
77	77	10 contractors on the project; directing the work as it is
78	78	11 being performed for general conformance with working
79	79	12 drawings and specifications; establishing procedures for
80	80	13 coordinating among the Board, architect or engineer,
81	81	14 contractors, and construction manager with respect to all
82	82	15 aspects of the project and implementing those procedures;
83	83	16 maintaining job site records and making appropriate
84	84	17 progress reports; implementing labor policy in conformance
85	85	18 with the requirements of the public owner; reviewing the
86	86	19 safety and equal opportunity programs of each contractor
87	87	20 for conformance with the public owner's policy and making
88	88	21 recommendations; reviewing and processing all applications
89	89	22 for payment by involved contractors and material suppliers
90	90	23 in accordance with the terms of the contract; making
91	91	24 recommendations and processing requests for changes in the
92	92	25 work and maintaining records of change orders; scheduling
93	93	26 and conducting job meetings to ensure orderly progress of

104	104	1 the work; developing and monitoring a project progress
105	105	2 schedule, coordinating and expediting the work of all
106	106	3 contractors and providing periodic status reports to the
107	107	4 owner and the architect or engineer; and establishing and
108	108	5 maintaining a cost control system and conducting meetings
109	109	6 to review costs.
110	110	7 "Construction manager" means any individual, sole
111	111	8 proprietorship, firm, partnership, corporation, or other legal
112	112	9 entity providing construction management services for the
113	113	10 Board and prequalified by the State in accordance with 30 ILCS
114	114	11 500/33-10.
115	115	12 "Board" means the Capital Development Board or, to the
116	116	13 extent that the services are to be procured by for a public
117	117	14 institution of higher education, the public institution of
118	118	15 higher education.
