11	11	1 AN ACT concerning safety.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The Fireworks Regulation Act of Illinois is
15	15	5 amended by adding Section 5 as follows:
16	16	6 (425 ILCS 30/5 new)
17	17	7 Sec. 5. Storage, possession, sale, and use of ground and
18	18	8 handheld sparkling devices.
19	19	9 (a) The storage, possession, sale, and use of ground and
20	20	10 handheld sparkling devices shall be permitted at all times
21	21	11 throughout the State.
22	22	12 (b) The regulation of ground and handheld sparkling
23	23	13 devices, including their storage and sale, shall be consistent
24	24	14 with the standards set forth in the National Fire Protection
25	25	15 Association's Code for the Manufacture, Transportation,
26	26	16 Storage and Retail Sales of Fireworks and Pyrotechnic Articles
27	27	17 (NFPA 1124), 2006 edition.
28	28	18 (c) Subsections (a) and (b) do not apply to the City of
29	29	19 Chicago.
30	30	20 (d) In this Section, "ground and handheld sparkling
31	31	21 device" means:
32	32	22 (1) toy pistols that use caps containing fewer than
33	33	23 20/100 grains of explosive mixture;

68	68	1 (2) toy guns that use paper caps containing 25/100
69	69	2 grains or fewer of explosive compound;
70	70	3 (3) wood stick or wire sparklers containing not more
71	71	4 than 100 grams of pyrotechnic mixture per item;
72	72	5 (4) handheld or ground-based sparkling devices that
73	73	6 are nonexplosive and nonaerial, sometimes producing a
74	74	7 crackling or whistling effect, and containing 75 grams or
75	75	8 fewer of pyrotechnic composition per tube or a total of
76	76	9 500 grams or fewer for multiple tubes;
77	77	10 (5) snakes and glow worms;
78	78	11 (6) smoke devices; and
79	79	12 (7) trick noisemakers, including, but not limited to,
80	80	13 party poppers, snappers, and drop pops, each containing
81	81	14 25/100 grains or fewer of explosive mixture.
