                            103RD GENERAL ASSEMBLY State of Illinois 2023 and 2024 HB3929 Introduced , by Rep. Dave Severin SYNOPSIS AS INTRODUCED:  425 ILCS 30/5 new  Amends the Fireworks Regulation Act of Illinois. Provides that the storage, possession, sale, and use of ground and handheld sparkling devices shall be permitted at all times throughout the State. Requires regulation of ground and handheld sparkling devices, including their storage and sale, to be consistent with the standards set forth in the National Fire Protection Association's Code for the Manufacture, Transportation, Storage and Retail Sales of Fireworks and Pyrotechnic Articles, 2006 edition. Provides that the amendatory provisions do not apply to the City of Chicago. Defines "ground and handheld sparkling devices". 1  AN ACT concerning safety.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Fireworks Regulation Act of Illinois is
5  amended by adding Section 5 as follows:
6  (425 ILCS 30/5 new)
7  Sec. 5. Storage, possession, sale, and use of ground and
8  handheld sparkling devices.
9  (a) The storage, possession, sale, and use of ground and
10  handheld sparkling devices shall be permitted at all times
11  throughout the State.
12  (b) The regulation of ground and handheld sparkling
13  devices, including their storage and sale, shall be consistent
14  with the standards set forth in the National Fire Protection
15  Association's Code for the Manufacture, Transportation,
16  Storage and Retail Sales of Fireworks and Pyrotechnic Articles
17  (NFPA 1124), 2006 edition.
18  (c) Subsections (a) and (b) do not apply to the City of
19  Chicago.
20  (d) In this Section, "ground and handheld sparkling
21  device" means:
22  (1) toy pistols that use caps containing fewer than
23  20/100 grains of explosive mixture;

1  (2) toy guns that use paper caps containing 25/100
2  grains or fewer of explosive compound;
3  (3) wood stick or wire sparklers containing not more
4  than 100 grams of pyrotechnic mixture per item;
5  (4) handheld or ground-based sparkling devices that
6  are nonexplosive and nonaerial, sometimes producing a
7  crackling or whistling effect, and containing 75 grams or
8  fewer of pyrotechnic composition per tube or a total of
9  500 grams or fewer for multiple tubes;
10  (5) snakes and glow worms;
11  (6) smoke devices; and
12  (7) trick noisemakers, including, but not limited to,
13  party poppers, snappers, and drop pops, each containing
14  25/100 grains or fewer of explosive mixture.
