16	16	1 AN ACT concerning elections.
17	17	2 Be it enacted by the People of the State of Illinois,
18	18	3 represented in the General Assembly:
19	19	4 Section 5. The Election Code is amended by changing
20	20	5 Sections 4-8, 5-7, and 6-35 and by adding Sections 4-106,
21	21	6 5-106, and 6-106 as follows:

23	23	8 Sec. 4-8. The county clerk shall provide a sufficient
24	24	9 number of blank forms for the registration of electors, which
25	25	10 shall be known as registration record cards and which shall
26	26	11 consist of loose leaf sheets or cards, of suitable size to
27	27	12 contain in plain writing and figures the data hereinafter
28	28	13 required thereon or shall consist of computer cards of
29	29	14 suitable nature to contain the data required thereon. The
30	30	15 registration record cards, which shall include an affidavit of
31	31	16 registration as hereinafter provided, shall be executed in
32	32	17 duplicate.
33	33	18 The registration record card shall contain the following
34	34	19 and such other information as the county clerk may think it
35	35	20 proper to require for the identification of the applicant for

85	85	3 Residence. The name and number of the street, avenue, or

90	90	8 dwelling of the applicant. Where the location cannot be

94	94	12 mailing address. In the case of a homeless individual, the
95	95	13 individual's voting residence that is his or her mailing
96	96	14 address shall be included on his or her registration record
97	97	15 card.
98	98	16 Term of residence in the State of Illinois and precinct.
99	99	17 This information shall be furnished by the applicant stating
100	100	18 the place or places where he resided and the dates during which
101	101	19 he resided in such place or places during the year next
102	102	20 preceding the date of the next ensuing election.
103	103	21 Nativity. The state or country in which the applicant was

105	105	23 Citizenship. Whether the applicant is native born or
106	106	24 naturalized. If naturalized, the court, place, and date of

195	195	2 shall extend its hours for inspection of registration cards
196	196	3 and other records of the election authority during the period
197	197	4 beginning with the filing of petitions under Sections 7-10,
198	198	5 8-8, 10-6 or 28-3 and continuing through the termination of
199	199	6 electoral board hearings on any objections to petitions
200	200	7 containing signatures of registered voters in the jurisdiction
201	201	8 of the election authority. The extension shall be for a period
202	202	9 of hours sufficient to allow adequate opportunity for
203	203	10 examination of the records but the election authority is not
204	204	11 required to extend its hours beyond the period beginning at
205	205	12 its normal opening for business and ending at midnight. If the
206	206	13 business hours are so extended, the election authority shall
207	207	14 post a public notice of such extended hours. Registration
208	208	15 record cards may also be inspected, upon approval of the
209	209	16 officer in charge of the cards, during the 27 days immediately
210	210	17 preceding any election. Registration record cards shall also
211	211	18 be open to inspection by certified judges and poll watchers
212	212	19 and challengers at the polling place on election day, but only
213	213	20 to the extent necessary to determine the question of the right
214	214	21 of a person to vote or to serve as a judge of election. At no
215	215	22 time shall poll watchers or challengers be allowed to
216	216	23 physically handle the registration record cards.
217	217	24 Updated copies of computer tapes or computer discs or
218	218	25 other electronic data processing information containing voter

230	230	1 clerk within 10 days after December 15 and May 15 each year and
231	231	2 within 10 days after each registration period is closed to the
232	232	3 State Board of Elections in a form prescribed by the Board. For
233	233	4 the purposes of this Section, a registration period is closed
234	234	5 27 days before the date of any regular or special election.
235	235	6 Registration information shall include, but not be limited to,
236	236	7 the following information: name, sex, residence, telephone
237	237	8 number, if any, age, party affiliation, if applicable,
238	238	9 precinct, ward, township, county, and representative,
239	239	10 legislative and congressional districts. In the event of
240	240	11 noncompliance, the State Board of Elections is directed to
241	241	12 obtain compliance forthwith with this nondiscretionary duty of
242	242	13 the election authority by instituting legal proceedings in the
243	243	14 circuit court of the county in which the election authority
244	244	15 maintains the registration information. The costs of
245	245	16 furnishing updated copies of tapes or discs shall be paid at a
246	246	17 rate of $.00034 per name of registered voters in the election
247	247	18 jurisdiction, but not less than $50 per tape or disc and shall
248	248	19 be paid from appropriations made to the State Board of
249	249	20 Elections for reimbursement to the election authority for such
250	250	21 purpose. The State Board shall furnish copies of such tapes,
251	251	22 discs, other electronic data or compilations thereof to state
252	252	23 political committees registered pursuant to the Illinois
253	253	24 Campaign Finance Act or the Federal Election Campaign Act and
254	254	25 to governmental entities, at their request and at a reasonable
255	255	26 cost. To protect the privacy and confidentiality of voter

266	266	1 registration information, the disclosure of electronic voter
267	267	2 registration records to any person or entity other than to a
268	268	3 State or local political committee and other than to a
269	269	4 governmental entity for a governmental purpose is specifically
270	270	5 prohibited except as described in Section 4-106 or as follows:
271	271	6 subject to security measures adopted by the State Board of
272	272	7 Elections which, at a minimum, shall include the keeping of a
273	273	8 catalog or database, available for public view, including the
274	274	9 name, address, and telephone number of the person viewing the
275	275	10 list as well as the time of that viewing, any person may view
276	276	11 the centralized statewide voter registration list on a
277	277	12 computer screen at the Springfield office of the State Board
278	278	13 of Elections, during normal business hours other than during
279	279	14 the 27 days before an election, but the person viewing the list
280	280	15 under this exception may not print, duplicate, transmit, or
281	281	16 alter the list. Copies of the tapes, discs, or other
282	282	17 electronic data shall be furnished by the county clerk to
283	283	18 local political committees and governmental entities at their
284	284	19 request and at a reasonable cost. Reasonable cost of the
285	285	20 tapes, discs, et cetera for this purpose would be the cost of
286	286	21 duplication plus 15% for administration. The individual
287	287	22 representing a political committee requesting copies of such
288	288	23 tapes shall make a sworn affidavit that the information shall
289	289	24 be used only for bona fide political purposes, including by or
290	290	25 for candidates for office or incumbent office holders. Such
291	291	26 tapes, discs or other electronic data shall not be used under

303	303	2 for purposes of commercial solicitation or other business
304	304	3 purposes. If such tapes contain information on county
305	305	4 residents related to the operations of county government in
306	306	5 addition to registration information, that information shall
307	307	6 not be used under any circumstances for commercial
308	308	7 solicitation or other business purposes. The prohibition in
309	309	8 this Section against using the computer tapes or computer
310	310	9 discs or other electronic data processing information
311	311	10 containing voter registration information for purposes of
312	312	11 commercial solicitation or other business purposes shall be
313	313	12 prospective only from the effective date of this amended Act
314	314	13 of 1979. Any person who violates this provision shall be
315	315	14 guilty of a Class 4 felony.
316	316	15 The State Board of Elections shall promulgate, by October
317	317	16 1, 1987, such regulations as may be necessary to ensure
318	318	17 uniformity throughout the State in electronic data processing
319	319	18 of voter registration information. The regulations shall
320	320	19 include, but need not be limited to, specifications for
321	321	20 uniform medium, communications protocol and file structure to
322	322	21 be employed by the election authorities of this State in the
323	323	22 electronic data processing of voter registration information.
324	324	23 Each election authority utilizing electronic data processing
325	325	24 of voter registration information shall comply with such
326	326	25 regulations on and after May 15, 1988.

377	377	1 Section may furnish in accordance with this Section electronic
378	378	2 voter registration records at a reasonable cost to any person
379	379	3 who makes a sworn affidavit that the list will be used solely
380	380	4 for bona fide election purposes and shall not be used for
381	381	5 commercial purposes. Electronic voter registration records
382	382	6 furnished to members of the public shall not disclose the
383	383	7 email address, birth day, birth month, Illinois driver's
384	384	8 license number, Illinois identification card number, street
385	385	9 number, or social security number of any voter, but shall
386	386	10 disclose birth year. The reasonable cost of voter registration
387	387	11 records furnished under this Section shall be the cost of
388	388	12 duplication plus a 15% fee for administration. No sooner than
389	389	13 14 days after a request for voter registration records is made
390	390	14 under this Section, the State Board of Elections shall
391	391	15 publicly disclose the request on a publicly accessible website
392	392	16 regardless of whether the request was approved or denied.

394	394	18 charge or at a reduced charge, as determined by the State Board
395	395	19 of Elections, if the person requesting the records makes the
396	396	20 request on behalf of an entity that is exempt from income
397	397	21 taxation under Section 501(c)(3) of the Internal Revenue Code
398	398	22 of 1986, states the specific purpose for the request, and
399	399	23 indicates that a waiver or reduction of the fee is in the
400	400	24 public interest. A waiver or reduction of the fee is in the

1049	1049	15 data shall be furnished by the Board of Election Commissioners
1050	1050	16 to local political committees and governmental entities at
1051	1051	17 their request and at a reasonable cost. Reasonable cost of the
1052	1052	18 tapes, discs, et cetera for this purpose would be the cost of
1053	1053	19 duplication plus 15% for administration. The individual
1054	1054	20 representing a political committee requesting copies of such
1055	1055	21 tapes shall make a sworn affidavit that the information shall
1056	1056	22 be used only for bona fide political purposes, including by or

1080	1080	10 prospective only from the effective date of this amended Act
1081	1081	11 of 1979. Any person who violates this provision shall be
1082	1082	12 guilty of a Class 4 felony.
1083	1083	13 The State Board of Elections shall promulgate, by October
1084	1084	14 1, 1987, such regulations as may be necessary to ensure
1085	1085	15 uniformity throughout the State in electronic data processing
1086	1086	16 of voter registration information. The regulations shall
1087	1087	17 include, but need not be limited to, specifications for
1088	1088	18 uniform medium, communications protocol and file structure to
1089	1089	19 be employed by the election authorities of this State in the
1090	1090	20 electronic data processing of voter registration information.
1091	1091	21 Each election authority utilizing electronic data processing
1092	1092	22 of voter registration information shall comply with such
1093	1093	23 regulations on and after May 15, 1988.
