1212 1 AN ACT concerning local government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Metropolitan Water Reclamation District Act
1616 5 is amended by changing Sections 4 and 4.13 as follows:
1717 6 (70 ILCS 2605/4) (from Ch. 42, par. 323)
1818 7 Sec. 4. The commissioners elected under this Act
1919 8 constitute a board of commissioners for the district by which
2020 9 they are elected, which board of commissioners is the
2121 10 corporate authority of the sanitary district, and, in addition
2222 11 to all other powers specified in this Act, shall establish the
2323 12 policies and goals of the sanitary district. The executive
2424 13 director, in addition to all other powers specified in this
2525 14 Act, shall manage and control all the affairs and property of
2626 15 the sanitary district and shall regularly report to the Board
2727 16 of Commissioners on the activities of the sanitary district in
2828 17 executing the policies and goals established by the board. At
2929 18 the regularly scheduled meeting of odd numbered years
3030 19 following the induction of new commissioners the board of
3131 20 commissioners shall elect from its own number a president and
3232 21 a vice-president to serve in the absence of the president, and
3333 22 the chairman of the committee on finance. The board shall
3434 23 provide by rule when a vacancy occurs in the office of the

7171 1 president, vice-president, or the chairman of the committee on

7373 3 The board shall appoint from outside its own number the
7474 4 executive director and treasurer for the district.
7575 5 The executive director must be a resident of the sanitary
7676 6 district and a citizen of the United States. He must be
7777 7 selected solely upon his administrative and technical
7878 8 qualifications and without regard to his political
7979 9 affiliations.
8080 10 In the event of illness or other prolonged absence, death
8181 11 or resignation creating a vacancy in the office of the
8282 12 executive director, or treasurer, the board of commissioners
8383 13 may appoint an acting officer from outside its own number, to
8484 14 perform the duties and responsibilities of the office during
8585 15 the term of the absence or vacancy.
8686 16 The executive director, with the advice and consent of the
8787 17 board of commissioners, shall appoint the director of
8888 18 engineering, director of maintenance and operations, director
8989 19 of human resources, director of procurement and materials
9090 20 management, clerk, general counsel, director of monitoring and
9191 21 research, and director of information technology and may
9292 22 appoint a director of diversity, equity, inclusion, and
9393 23 justice. These constitute the heads of the Department of
9494 24 Engineering, Maintenance and Operations, Human Resources,
9595 25 Procurement and Materials Management, Finance, Law, Monitoring
9696 26 and Research, and Information Technology, and, if created by

110110 4 this Act. All such department heads are under the direct
111111 5 supervision of the executive director.
112112 6 The executive director, with the advice and consent of the
113113 7 board of commissioners, may appoint a deputy executive
114114 8 director. The deputy executive director must be selected
115115 9 solely upon administrative and technical qualifications and
116116 10 without regard to political affiliations and shall serve under
117117 11 the direct supervision of the executive director.
118118 12 The executive director, with the advice and consent of the
119119 13 board of commissioners, shall appoint a public and
120120 14 intergovernmental affairs officer and an administrative
121121 15 services officer. The public and intergovernmental affairs
122122 16 officer and administrative services officer shall serve under
123123 17 the direct supervision of the executive director.
124124 18 The director of human resources must be qualified under
125125 19 Section 4.2a of this Act.
126126 20 The director of procurement and materials management must
127127 21 be selected in accordance with Section 11.16 of this Act.
128128 22 In the event of illness or other prolonged absence, death,

143143 1 research, public and intergovernmental affairs officer,

146146 4 justice, the executive director shall appoint an acting
147147 5 officer to perform the duties and responsibilities of the
148148 6 office during the term of the absence or vacancy. Any such
149149 7 officers appointed in an acting capacity are under the direct
150150 8 supervision of the executive director.
151151 9 All appointive officers and acting officers shall give
152152 10 bond as may be required by the board.
153153 11 The executive director, treasurer, acting executive
154154 12 director, and acting treasurer hold their offices at the
155155 13 pleasure of the board of commissioners.
156156 14 The acting director of engineering, acting director of
157157 15 maintenance and operations, acting director of human
158158 16 resources, acting director of procurement and materials
159159 17 management, acting clerk, acting general counsel, acting
160160 18 director of monitoring and research, acting public and
161161 19 intergovernmental affairs officer, acting administrative
162162 20 services officer, and acting director of information
163163 21 technology, and acting director of diversity, equity,
164164 22 inclusion, and justice hold their offices at the pleasure of
165165 23 the executive director.
166166 24 The director of engineering, director of maintenance and
167167 25 operations, director of human resources, director of
168168 26 procurement and materials management, clerk, general counsel,

179179 1 director of monitoring and research, public and
180180 2 intergovernmental affairs officer, administrative services
181181 3 officer, and director of information technology, director of
182182 4 diversity, equity, inclusion, and justice, and deputy
183183 5 executive director may be removed from office for cause by the
184184 6 executive director. Prior to removal, such officers are
185185 7 entitled to a public hearing before the executive director at
186186 8 which hearing they may be represented by counsel. Before the
187187 9 hearing, the executive director shall notify the board of
188188 10 commissioners of the date, time, place and nature of the
189189 11 hearing.
190190 12 In addition to the general counsel appointed by the
191191 13 executive director, the board of commissioners may appoint
192192 14 from outside its own number an attorney, or retain counsel, to
193193 15 advise the board of commissioners with respect to its powers
194194 16 and duties and with respect to legal questions and matters of
195195 17 policy for which the board of commissioners is responsible.
196196 18 The executive director is the chief administrative officer
197197 19 of the district, has supervision over and is responsible for
198198 20 all administrative and operational matters of the sanitary
199199 21 district including the duties of all employees which are not
200200 22 otherwise designated by law, and is the appointing authority
201201 23 as specified in Section 4.11 of this Act.
202202 24 The board of commissioners shall appoint from outside its
203203 25 own number an Inspector General or enter into an
204204 26 intergovernmental agreement with another unit of local

215215 1 government for the appointment of an Inspector General. The
216216 2 board of commissioners shall establish minimum qualifications
217217 3 and duties for the Inspector General by ordinance or
218218 4 intergovernmental agreement.
219219 5 The board, through the budget process, shall set the
220220 6 compensation of all the officers and employees of the sanitary
221221 7 district. Any incumbent of the office of president may appoint
222222 8 an administrative aide which appointment remains in force
223223 9 during his incumbency unless revoked by the president.
224224 10 Effective upon the election in January, 1985 of the
225225 11 president and vice-president of the board of commissioners and
226226 12 the chairman of the committee on finance, the annual salary of
227227 13 the president shall be $37,500 and shall be increased to
228228 14 $39,500 in January, 1987, $41,500 in January, 1989, $50,000 in
229229 15 January, 1991, and $60,000 in January, 2001; the annual salary
230230 16 of the vice-president shall be $35,000 and shall be increased
231231 17 to $37,000 in January, 1987, $39,000 in January, 1989, $45,000
232232 18 in January, 1991, and $55,000 in January, 2001; the annual
233233 19 salary of the chairman of the committee on finance shall be
234234 20 $32,500 and shall be increased to $34,500 in January, 1987,
235235 21 $36,500 in January, 1989, $45,000 in January, 1991, and
236236 22 $55,000 in January, 2001.
237237 23 The annual salaries of the other members of the Board
238238 24 shall be as follows:
239239 25 For the three members elected in November, 1980,
240240 26 $26,500 per annum for the first two years of the term;

262262 12 For three members elected in November, 1988, $34,000
263263 13 for each of the first two years of the term and $36,000 for
264264 14 each year thereafter.
265265 15 For members elected in November, 1990, 1992, 1994,
266266 16 1996, or 1998, $40,000.
267267 17 For members elected in November, 2000 and thereafter,
268268 18 $50,000.
269269 19 Notwithstanding the other provisions of this Section, the
270270 20 board, prior to January 1, 2007 and with a two-thirds vote, may
271271 21 increase the annual rate of compensation at a separate flat
272272 22 amount for each of the following: the president, the
273273 23 vice-president, the chairman of the committee on finance, and
274274 24 the other members; the increased annual rate of compensation
275275 25 shall apply to all such officers and members whose terms as

287287 1 compensation is adopted by the board.
288288 2 The board of commissioners has full power to pass all
289289 3 necessary ordinances, orders, rules, resolutions and
290290 4 regulations for the proper management and conduct of the
291291 5 business of the board of commissioners and the corporation and
292292 6 for carrying into effect the object for which the sanitary
293293 7 district is formed. All ordinances, orders, rules, resolutions
294294 8 and regulations passed by the board of commissioners must,
295295 9 before they take effect, be approved by the president of the
296296 10 board of commissioners. If he approves thereof, he shall sign
297297 11 them, and such as he does not approve he shall return to the
298298 12 board of commissioners with his objections in writing at the
299299 13 next regular meeting of the board of commissioners occurring
300300 14 after the passage thereof. Such veto may extend to any one or
301301 15 more items or appropriations contained in any ordinance making
302302 16 an appropriation, or to the entire ordinance. If the veto
303303 17 extends to a part of such ordinance, the residue takes effect.
304304 18 If the president of such board of commissioners fails to
305305 19 return any ordinance, order, rule, resolution or regulation
306306 20 with his objections thereto in the time required, he is deemed
307307 21 to have approved it, and it takes effect accordingly. Upon the
308308 22 return of any ordinance, order, rule, resolution, or
309309 23 regulation by the president, the vote by which it was passed
310310 24 must be reconsidered by the board of commissioners, and if
311311 25 upon such reconsideration two-thirds of all the members agree
312312 26 by yeas and nays to pass it, it takes effect notwithstanding

324324 2 It is the policy of this State that all powers granted,
325325 3 either expressly or by necessary implication, by this Act or
326326 4 any other Illinois statute to the District may be exercised by
327327 5 the District notwithstanding effects on competition. It is the
328328 6 intention of the General Assembly that the "State action
329329 7 exemption" to the application of federal antitrust statutes be
330330 8 fully available to the District to the extent its activities
331331 9 are authorized by law as stated herein.
