319 1 AN ACT concerning education.
420 2 Be it enacted by the People of the State of Illinois,
521 3 represented in the General Assembly:
622 4 Section 5. The University of Illinois Act is amended by
723 5 changing Section 7e-5 as follows:

925 7 Sec. 7e-5. In-state tuition charge.
1026 8 (a) Notwithstanding any other provision of law to the
11-9 contrary, for tuition purposes until July 1, 2026, the Board
12-10 of Trustees shall deem an individual an Illinois resident,
13-11 until the individual establishes a residence outside of this
14-12 State, if all of the following conditions are met:
15-13 (1) The individual resided with his or her parent or
16-14 guardian while attending a public or private high school
17-15 in this State.
18-16 (2) The individual graduated from a public or private
19-17 high school or received the equivalent of a high school
20-18 diploma in this State.
21-19 (3) The individual attended school in this State for
22-20 at least 3 years as of the date the individual graduated
23-21 from high school or received the equivalent of a high
24-22 school diploma.
25-23 (4) The individual registers as an entering student in
27+9 contrary, for tuition purposes through the 2024-2025 academic
28+10 year, the Board of Trustees shall deem an individual an
29+11 Illinois resident, until the individual establishes a
30+12 residence outside of this State, if all of the following
31+13 conditions are met:
32+14 (1) The individual resided with his or her parent or
33+15 guardian while attending a public or private high school
34+16 in this State.
35+17 (2) The individual graduated from a public or private
36+18 high school or received the equivalent of a high school
37+19 diploma in this State.
38+20 (3) The individual attended school in this State for
39+21 at least 3 years as of the date the individual graduated
40+22 from high school or received the equivalent of a high

35-2 (5) In the case of an individual who is not a citizen
36-3 or a permanent resident of the United States, the
37-4 individual provides the University with an affidavit
38-5 stating that the individual will file an application to
39-6 become a permanent resident of the United States at the
40-7 earliest opportunity the individual is eligible to do so.
41-8 This subsection (a) applies only to tuition for a term or
42-9 semester that begins on or after May 20, 2003 (the effective
43-10 date of Public Act 93-7) but before July 1, 2026. Any revenue
44-11 lost by the University in implementing this subsection (a)
45-12 shall be absorbed by the University Income Fund.
46-13 (a-5) Notwithstanding any other provision of law to the
47-14 contrary, beginning July 1, 2026, an individual, other than an
48-15 individual who has a non-immigrant alien status that precludes
49-16 an intent to permanently reside in the United States under
50-17 subsection (a) of Section 1101 of Title 8 of the United States
51-18 Code, shall be charged tuition by the Board of Trustees at the
52-19 same rate as an Illinois resident if the individual meets all
53-20 of the requirements of either paragraph (1) or (2):
54-21 (1) The individual:
55-22 (A) attended a public or private high school in
56-23 this State for at least 2 years before enrolling at the
57-24 University;
58-25 (B) graduated from a public or private high school
59-26 in this State or received the equivalent of a high

71-2 (C) attended high school while residing in this

77-8 earliest opportunity if the individual is eligible to
78-9 do so and is not a citizen or lawful permanent resident
79-10 of the United States.
80-11 (2) The individual:
81-12 (A) attended any of the following for at least 2
82-13 years and attended for a cumulative total of at least 3
83-14 years before enrolling at the University:
84-15 (i) a public or private high school in this
85-16 State;
86-17 (ii) a public community college in a community
87-18 college district organized under the Public
88-19 Community College Act; or
89-20 (iii) a combination of those educational
90-21 institutions set forth in subdivisions (i) and
91-22 (ii) of this subparagraph (A);
92-23 (B) has at the time of enrollment:
93-24 (i) graduated from a public or private high
94-25 school in this State or received the equivalent of
95-26 a high school diploma in this State; and

111-6 (C) attended an educational institution set forth
112-7 in subdivision (i) or (ii) of subparagraph (A) of this
113-8 paragraph (2) while residing in this State and has not
114-9 established residency outside of this State before
115-10 enrolling at the University; and
116-11 (D) agrees to swear and affirm to the University
117-12 that the individual will file an application to become
118-13 a permanent resident of the United States at the
119-14 earliest opportunity if the individual is eligible to
120-15 do so and is not a citizen or lawful permanent resident
121-16 of the United States.
122-17 (b) If a person is on active military duty and stationed in
123-18 Illinois, then the Board of Trustees shall deem that person
124-19 and any of his or her dependents Illinois residents for
125-20 tuition purposes. Beginning with the 2009-2010 academic year,
126-21 if a person is on active military duty and is stationed out of
127-22 State, but he or she was stationed in this State for at least 3
128-23 years immediately prior to being reassigned out of State, then

143-2 active military duty being reassigned or (ii) remains
144-3 continuously enrolled at the University. Beginning with the
145-4 2013-2014 academic year, if a person is utilizing benefits
146-5 under the federal Post-9/11 Veterans Educational Assistance
147-6 Act of 2008 or any subsequent variation of that Act, then the
148-7 Board of Trustees shall deem that person an Illinois resident
149-8 for tuition purposes. Beginning with the 2015-2016 academic
150-9 year, if a person is utilizing benefits under the federal
151-10 All-Volunteer Force Educational Assistance Program, then the
152-11 Board of Trustees shall deem that person an Illinois resident
153-12 for tuition purposes. Beginning with the 2019-2020 academic
154-13 year, per the federal requirements for maintaining approval
155-14 for veterans' education benefits under 38 U.S.C. 3679(c), if a
156-15 person is on active military duty or is receiving veterans'
157-16 education benefits, then the Board of Trustees shall deem that
158-17 person an Illinois resident for tuition purposes for any
159-18 academic quarter, semester, or term, as applicable.
160-19 (c) The Board of Trustees may adopt a policy to implement
161-20 and administer this Section and may adopt a policy for the
162-21 classification of in-state residents, for tuition purposes,
163-22 based on residency in this State.
164-23 (d) The General Assembly finds and declares that this
165-24 Section is a State law within the meaning of subsection (d) of
166-25 Section 1621 of Title 8 of the United States Code.

137+10 (2) The individual satisfies any of the following:
138+11 (A) The individual graduated from a public or
139+12 nonpublic high school or received the equivalent of a
140+13 high school diploma in this State.
141+14 (B) The individual attained an associate degree
142+15 from a community college organized under the Public
143+16 Community College Act.
144+17 (C) The individual completed a General Education
145+18 Core Curriculum package under the Illinois
146+19 Articulation Initiative Act for students transferring
147+20 from a community college organized under the Public
148+21 Community College Act.
149+22 (3) The individual is a current student of or is
150+23 registering as an entering student in the University.
151+24 (4) The individual attests, if the individual is not a
152+25 citizen or a lawful permanent resident of the United

1280-1 (D) agrees to swear and affirm to the University
1281-2 that the individual will file an application to become
1282-3 a permanent resident of the United States at the
1283-4 earliest opportunity if the individual is eligible to
1284-5 do so and is not a citizen or lawful permanent resident
1285-6 of the United States.
1286-7 (2) The individual:
1287-8 (A) attended any of the following for at least 2
1288-9 years and attended for a cumulative total of at least 3
1289-10 years before enrolling at the University:
1290-11 (i) a public or private high school in this
1291-12 State;
1292-13 (ii) a public community college in a community
1293-14 college district organized under the Public
1294-15 Community College Act; or
1295-16 (iii) a combination of those educational
1296-17 institutions set forth in subdivisions (i) and
1297-18 (ii) of this subparagraph (A);
1298-19 (B) has at the time of enrollment:
1299-20 (i) graduated from a public or private high
1300-21 school in this State or received the equivalent of
1301-22 a high school diploma in this State; and

1322-7 (D) agrees to swear and affirm to the University

1327-12 of the United States.
1328-13 (b) If a person is on active military duty and stationed in
1329-14 Illinois, then the Board shall deem that person and any of his
1330-15 or her dependents Illinois residents for tuition purposes.
1331-16 Beginning with the 2009-2010 academic year, if a person is on
1332-17 active military duty and is stationed out of State, but he or
1333-18 she was stationed in this State for at least 3 years
1334-19 immediately prior to being reassigned out of State, then the
1335-20 Board shall deem that person and any of his or her dependents
1336-21 Illinois residents for tuition purposes, as long as that
1337-22 person or his or her dependent (i) applies for admission to the
1338-23 University within 18 months of the person on active military
1339-24 duty being reassigned or (ii) remains continuously enrolled at
1340-25 the University. Beginning with the 2013-2014 academic year, if

1352-1 Veterans Educational Assistance Act of 2008 or any subsequent
1353-2 variation of that Act, then the Board shall deem that person an
1354-3 Illinois resident for tuition purposes. Beginning with the
1355-4 2015-2016 academic year, if a person is utilizing benefits
1356-5 under the federal All-Volunteer Force Educational Assistance
1357-6 Program, then the Board shall deem that person an Illinois
1358-7 resident for tuition purposes. Beginning with the 2019-2020
1359-8 academic year, per the federal requirements for maintaining
1360-9 approval for veterans' education benefits under 38 U.S.C.
1361-10 3679(c), if a person is on active military duty or is receiving
1362-11 veterans' education benefits, then the Board of Trustees shall
1363-12 deem that person an Illinois resident for tuition purposes for
1364-13 any academic quarter, semester, or term, as applicable.
1365-14 (c) The Board may adopt a policy to implement and
1366-15 administer this Section and may adopt a policy for the
1367-16 classification of in-state residents, for tuition purposes,
1368-17 based on residency in this State.
1369-18 (d) The General Assembly finds and declares that this
1370-19 Section is a State law within the meaning of subsection (d) of
1371-20 Section 1621 of Title 8 of the United States Code.

1386-1 Sec. 35-88. In-state tuition charge.
1387-2 (a) Notwithstanding any other provision of law to the
1388-3 contrary, for tuition purposes until July 1, 2026, the Board
1389-4 shall deem an individual an Illinois resident, until the
1390-5 individual establishes a residence outside of this State, if
1391-6 all of the following conditions are met:
1392-7 (1) The individual resided with his or her parent or
1393-8 guardian while attending a public or private high school
1394-9 in this State.
1395-10 (2) The individual graduated from a public or private
1396-11 high school or received the equivalent of a high school
1397-12 diploma in this State.
1398-13 (3) The individual attended school in this State for
1399-14 at least 3 years as of the date the individual graduated
1400-15 from high school or received the equivalent of a high
1401-16 school diploma.
1402-17 (4) The individual registers as an entering student in
1403-18 the University not earlier than the 2003 fall semester.
1404-19 (5) In the case of an individual who is not a citizen
1405-20 or a permanent resident of the United States, the
1406-21 individual provides the University with an affidavit
1407-22 stating that the individual will file an application to
1408-23 become a permanent resident of the United States at the
1409-24 earliest opportunity the individual is eligible to do so.
1410-25 This subsection (a) applies only to tuition for a term or
1411-26 semester that begins on or after May 20, 2003 (the effective

1422-1 date of Public Act 93-7) but before July 1, 2026. Any revenue
1423-2 lost by the University in implementing this subsection (a)
1424-3 shall be absorbed by the University Income Fund.
1425-4 (a-5) Notwithstanding any other provision of law to the
1426-5 contrary, beginning July 1, 2026, an individual, other than an
1427-6 individual who has a non-immigrant alien status that precludes
1428-7 an intent to permanently reside in the United States under
1429-8 subsection (a) of Section 1101 of Title 8 of the United States
1430-9 Code, shall be charged tuition by the Board at the same rate as
1431-10 an Illinois resident if the individual meets all of the
1432-11 requirements of either paragraph (1) or (2):
1433-12 (1) The individual:
1434-13 (A) attended a public or private high school in
1435-14 this State for at least 2 years before enrolling at the
1436-15 University;
1437-16 (B) graduated from a public or private high school
1438-17 in this State or received the equivalent of a high
1439-18 school diploma in this State;
1440-19 (C) attended high school while residing in this
1441-20 State and has not established residency outside of
1442-21 this State before enrolling at the University; and
1443-22 (D) agrees to swear and affirm to the University
1444-23 that the individual will file an application to become
1445-24 a permanent resident of the United States at the
1446-25 earliest opportunity if the individual is eligible to
