Short title. This Act may be cited as the 5 Microfiber Filter Rebate Act. 6 Section 5. Definitions. As used in this Act: 7 "Agency" means the Environmental Protection Agency. 8 "Microfiber washing machine filter" or "microfiber filter" 9 means a washing machine filter that (i) is capable of reducing 10 by at least 90% the mass of microfibers that would otherwise be 11 emitted by the washing machine as a result of the operation of 12 the washing machine and (ii) has a mesh size that is capable of 13 capturing microfibers larger than 50 microns. 14 Section 10. Microfiber filter rebate program. 15 (a) No later than one year after the effective date of this 16 Act and subject to appropriation, the Agency shall establish 17 and implement a program to provide rebates to residents of the 18 State for the purchase of a microfiber washing machine filter 19 or a replacement microfiber washing machine filter. LRB103 37638 JAG 67765 b LRB103 37638 JAG 67765 b LRB103 37638 JAG 67765 b A BILL FOR New Act LRB103 37638 JAG 67765 b HB5658 LRB103 37638 JAG 67765 b HB5658- 2 -LRB103 37638 JAG 67765 b HB5658 - 2 - LRB103 37638 JAG 67765 b HB5658 - 2 - LRB103 37638 JAG 67765 b 1 State. 2 (b) The Agency shall issue a one-time rebate to any 3 resident of the State who purchases an eligible microfiber 4 washing machine filter or replacement filter, as determined by 5 the Agency, submits a complete application for the rebate, in 6 a manner and form determined by the Agency, and meets the 7 requirements set forth in this Section and in any rules 8 adopted by the Agency under subsection (f). 9 (c) The amount of the rebate shall not exceed the lesser 10 of: 11 (1) the cost of the microfiber washing machine filter 12 or replacement filter; or 13 (2) $100. 14 (d) The Agency shall determine the types or brands of 15 microfiber washing machine filters and replacement filters 16 that are eligible for the rebate provided under this Section 17 and the manner and form for residents to apply for and, if 18 eligible, receive a rebate under this Section. 19 (e) The Agency shall advertise the availability of rebates 20 under this Section on its website and update the information 21 as necessary. 22 (f) The Agency shall adopt rules as may be necessary for 23 the implementation of the rebate program established under 24 this Section. 25 (g) No later than 2 years after the effective date of this 26 Act, and annually thereafter, the Agency shall prepare and HB5658 - 2 - LRB103 37638 JAG 67765 b HB5658- 3 -LRB103 37638 JAG 67765 b HB5658 - 3 - LRB103 37638 JAG 67765 b HB5658 - 3 - LRB103 37638 JAG 67765 b 1 submit to the Governor and, in accordance with Section 3.1 of 2 the General Assembly Organization Act, to the General 3 Assembly, a report that includes, at a minimum: 4 (1) a summary of the effectiveness of the rebate 5 program in encouraging the purchase of microfiber washing 6 machine filters and replacement filters and minimizing 7 microfiber pollution in the State; 8 (2) the total number of rebates provided during the 9 year; 10 (3) the total amount of money spent on the provision 11 of rebates during the year; 12 (4) the amount of funding still available for the 13 provision of rebates in future years; 14 (5) recommendations to improve the effectiveness of 15 the rebate program; and 16 (6) recommendations concerning whether additional 17 funding is needed to continue the rebate program.
