4-AN ACT concerning regulation.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The Hospital Licensing Act is amended by
8-changing Section 6.26 as follows:
9-(210 ILCS 85/6.26)
10-Sec. 6.26. Immunization against influenza virus and
11-pneumococcal disease.
12-(a) Every hospital shall adopt an influenza and
13-pneumococcal immunization policy that includes, but need not
14-be limited to, the following:
15-(1) Procedures for identifying patients age 50 65 or
16-older for influenza immunization and 65 or older for
17-pneumococcal immunization and, at the discretion of the
18-facility, other patients at risk.
19-(2) Procedures for offering immunization against
20-influenza virus when available between September 1 and
21-April 1, and against pneumococcal disease upon admission
22-or discharge, to patients in accordance with the
23-recommendations of the Advisory Committee on Immunization
24-Practices of the Centers for Disease Control and
25-Prevention that are most recent to the time of
26-vaccination, unless contraindicated.

33-(3) Procedures for ensuring that patients offered
34-immunization, or their guardians, receive information
35-regarding the risks and benefits of vaccination.
36-The hospital shall provide a copy of its influenza and
37-pneumococcal immunization policy to the Department upon
38-request.
39-(b) A home rule unit may not regulate immunization against
40-influenza virus and pneumococcal disease in a manner
41-inconsistent with the regulation of such immunizations under
42-this Section. This subsection is a limitation under subsection
43-(i) of Section 6 of Article VII of the Illinois Constitution on
44-the concurrent exercise by home rule units of powers and
45-functions exercised by the State.
