4-AN ACT concerning revenue.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The Illinois Housing Development Act is amended
8-by adding Section 35 as follows:
9-(20 ILCS 3805/35 new)
10-Sec. 35. Property Tax Payment Plan Task Force.
11-(a) In counties with 3,000,000 or more inhabitants, the
12-annual tax sale has a disproportionately negative impact on
13-minority communities. The loss of owner-occupied homes
14-following the annual tax sale results in a loss of home equity
15-for impacted households and negatively impacts the ability of
16-those households to build generational wealth. The creation of
17-a well-designed payment plan program that allows
18-owner-occupants to repay delinquent property taxes has the
19-potential to help homeowners who are unable to afford their
20-property taxes avoid the tax sale and the potential loss of
21-their home while also ensuring that property taxes are
22-collected for the benefit of local taxing districts. Such a
23-payment plan program will result in a more equitable and
24-effective property tax system.
25-(b) The Property Tax Payment Plan Task Force is hereby
26-created. The Task Force shall consist of the following

34-(1) one member, who shall serve as co-chairperson of
35-the Task Force, appointed by the President of the Senate;
36-(2) one member, who shall serve as co-chairperson of
37-the Task Force, appointed by the Speaker of the House of
38-Representatives;
39-(3) one member appointed by the Minority Leader of the
40-Senate;
41-(4) one member appointed by the Minority Leader of the
42-House of Representatives;
43-(5) the Executive Director of the Illinois Housing
44-Development Authority or his or her designee;
45-(6) the Cook County Treasurer or his or her designee;
46-(7) the Cook County Clerk or his or her designee;
47-(8) the President of the Cook County Board of
48-Commissioners or his or her designee;
49-(9) up to 2 members, appointed by the co-chairpersons
50-of the Task Force, representing nonprofit affordable
51-housing organizations in counties with 3,000,000 or more
52-inhabitants, housing counseling organizations in counties
53-with 3,000,000 or more inhabitants, or homeownership
54-organizations in counties with 3,000,000 or more
55-inhabitants;
56-(10) up to 2 members, appointed by the co-chairpersons
57-of the Task Force, representing community, neighborhood,
58-or resident associations in counties with 3,000,000 or

35+2 (1) one member, who shall serve as co-chairperson of
36+3 the Task Force, appointed by the President of the Senate;

62-(11) up to 2 members, appointed by the co-chairpersons
63-of the Task Force, representing public interest
64-organizations from counties with 3,000,000 or more
65-inhabitants or civic organizations from counties with
66-3,000,000 or more inhabitants;
67-(12) the Village President of the Village of Hazel
68-Crest or his or her designee;
69-(13) the Mayor of the City of Harvey or his or her
70-designee;
71-(14) the Village President of the Village of Richton
72-Park or his or her designee; and
73-(15) up to 3 members, appointed by the co-chairpersons
74-of the Task Force, representing taxing districts, other
75-than municipalities, with properties that are the most
76-highly represented in the annual tax sale in counties with
77-3,000,000 or more inhabitants.
78-At the discretion of both of the Co-Chairpersons of the
79-Task Force, additional individuals may participate as
80-nonvoting members of the Task Force.
81-Members of the Task Force shall be appointed no later than
82-30 days after the effective date of this amendatory Act of the
83-103rd General Assembly. If any members are not appointed
84-within that 30-day period, the appointing authority shall be
85-deemed to have waived the right to make that appointment.
86-Vacancies in the Task Force, other than a vacancy occurring

89-because of a waiver by the appointing authority under this
90-subsection, shall be filled by the original appointing
91-authority.
92-(c) Members of the Task Force shall serve without
93-compensation. The Illinois Housing Development Authority shall
94-provide administrative support to the Task Force as needed.
95-(d) The members of the Task Force are exempt from any
96-training, disclosure, or filing requirements under the State
97-Officials and Employees Ethics Act, the Illinois Governmental
98-Ethics Act, or any other applicable State law or rule imposing
99-such requirements.
100-(e) Once all of the members have been appointed, the Task
101-Force shall meet not less than 4 times to carry out the duties
102-prescribed in this Section. Members of the Task Force may
103-attend those meetings virtually.
104-(f) The Task Force shall study and make recommendations
105-for the implementation of one or more payment plan options in
106-counties with 3,000,000 or more inhabitants to prevent
107-eligible tax-delinquent owner-occupied properties in those
108-counties from being sold at the annual tax sale. The Task Force
109-shall take into consideration the impact of the payment plan
110-option on homeowners, taxpayers, local agencies responsible
111-for the collection of property taxes, and local taxing
112-districts. These recommendations may be used to recommend
113-legislation in the 103rd General Assembly or a subsequent
114-General Assembly.

117-(g) A report detailing the Task Force's findings,
118-conclusions, and recommendations shall be submitted to the
119-General Assembly no later than November 15, 2023. The Task
120-Force is dissolved upon submission of the report.
121-(h) This Section is repealed on January 1, 2025.
122-Section 99. Effective date. This Act takes effect upon
123-becoming law.
