13	13	1 AN ACT concerning health.
14	14	2 Be it enacted by the People of the State of Illinois,
15	15	3 represented in the General Assembly:
16	16	4 Section 1. Short title. This Act may be cited as the Access
17	17	5 to Public Health Data Act.
18	18	6 Section 5. Definition. In this Act, "public health data"
19	19	7 includes, but is not limited to, birth and death certificate
20	20	8 data, hospital discharge data, adverse pregnancy outcomes
21	21	9 reporting system (APORS) data, cancer registry data, syndromic
22	22	10 surveillance data, and prescription monitoring program (PMP)
23	23	11 data.
24	24	12 Section 10. Access to public health data; certified local
25	25	13 health departments; safeguards.
26	26	14 (a) Notwithstanding any other provision of State law to
27	27	15 the contrary, the Department of Public Health, the Department
28	28	16 of Human Services, and the Department of Healthcare and Family
29	29	17 Services shall, at the request of a certified local health
30	30	18 department in this State, make any and all public health data
31	31	19 related to residents of that certified local health
32	32	20 department's jurisdiction available to that certified local

73	73	1 executive director, chief operating officer, chief medical
74	74	2 officer, or equivalent executive leader of a certified local
75	75	3 health department has express authority to request and receive
76	76	4 such data.
77	77	5 (b) A certified local health department shall have access
78	78	6 to data under this Act only for the purposes identified in this
79	79	7 Act. The Department of Public Health, the Department of Human
80	80	8 Services, the Department of Healthcare and Family Services,
81	81	9 and the requesting certified local health department shall
82	82	10 protect the privacy and security of data obtained under this
83	83	11 Act in accordance with applicable federal and State law and
84	84	12 shall apply appropriate administrative, physical, and
85	85	13 technical safeguards to ensure the privacy and security of the
86	86	14 data and protect the data from unauthorized access, use, or
87	87	15 disclosure. Appropriate safeguards include, but are not
88	88	16 limited to, authentication and authorization of users prior to
89	89	17 gaining access to data obtained under this Act.
90	90	18 (c) A certified local health department shall apply
91	91	19 appropriate controls to ensure that access to data under this
92	92	20 Act is provided on a minimum, necessary basis and limited to
93	93	21 only those persons whose public health duties and
94	94	22 responsibilities require such access. Any data obtained under
95	95	23 this Act and in the possession of a certified local health
96	96	24 department shall be exempt from inspection and copying under
97	97	25 subsection (pp) of Section 7 of the Freedom of Information
98	98	26 Act. Any data obtained under this Act shall not be admissible

109	109	1 as evidence nor discoverable in any action of any kind in any
110	110	2 court or before any tribunal, board, agency, or person. The
111	111	3 access to or disclosure of any information or data by a
112	112	4 certified local health department under this Act shall not
113	113	5 waive or have any effect upon its nondiscoverability or
114	114	6 inadmissibility. The identity of any individual identified in
115	115	7 data obtained under this Act shall be confidential and shall
116	116	8 not be disclosed publicly or in any action of any kind.
117	117	9 Section 15. Data use agreements. A disclosing State
118	118	10 department and the requesting certified local health
119	119	11 department shall enter into a data use agreement to ensure
120	120	12 appropriate, effective, and efficient use of data obtained
121	121	13 under this Act by the certified local health department,
122	122	14 though no data use agreement shall, in a manner inconsistent
123	123	15 with the purpose or requirements of this Act, impede certified
124	124	16 local health department access to any public health data
125	125	17 available to the Department of Public Health, the Department
126	126	18 of Human Services, or the Department of Healthcare and Family
127	127	19 Services, nor shall it require indemnification as a
128	128	20 prerequisite to access.
129	129	21 Section 20. Standard request data forms. Within 60 days
130	130	22 after the effective date of this Act, the Department of Public
131	131	23 Health, the Department of Human Services, and the Department
132	132	24 of Healthcare and Family Services shall develop a standard

145	145	3 content, format, method of transfer, analytic and statistical
146	146	4 methods, scope of use, and requirements for safeguarding the

148	148	6 Section 25. Latest available data. The Department of
149	149	7 Public Health, the Department of Human Services, and the
150	150	8 Department of Healthcare and Family Services must provide the
151	151	9 latest available data for each certified local health
152	152	10 department request within 90 business days after receiving the
153	153	11 data request form.
154	154	12 Section 30. Rules. The Department of Public Health, the
155	155	13 Department of Human Services, and the Department of Healthcare
156	156	14 and Family Services may adopt any rules necessary to implement
157	157	15 this Act.

176	176	2 disclosure under this Section, but also contains information
177	177	3 that is not exempt from disclosure, the public body may elect
178	178	4 to redact the information that is exempt. The public body
179	179	5 shall make the remaining information available for inspection
180	180	6 and copying. Subject to this requirement, the following shall
181	181	7 be exempt from inspection and copying:
182	182	8 (a) Information specifically prohibited from
183	183	9 disclosure by federal or State law or rules and
184	184	10 regulations implementing federal or State law.
185	185	11 (b) Private information, unless disclosure is required
186	186	12 by another provision of this Act, a State or federal law,
187	187	13 or a court order.
188	188	14 (b-5) Files, documents, and other data or databases
189	189	15 maintained by one or more law enforcement agencies and
190	190	16 specifically designed to provide information to one or
191	191	17 more law enforcement agencies regarding the physical or
192	192	18 mental status of one or more individual subjects.
193	193	19 (c) Personal information contained within public
194	194	20 records, the disclosure of which would constitute a
195	195	21 clearly unwarranted invasion of personal privacy, unless
196	196	22 the disclosure is consented to in writing by the
197	197	23 individual subjects of the information. "Unwarranted
198	198	24 invasion of personal privacy" means the disclosure of
199	199	25 information that is highly personal or objectionable to a
200	200	26 reasonable person and in which the subject's right to

211	211	1 privacy outweighs any legitimate public interest in
212	212	2 obtaining the information. The disclosure of information
213	213	3 that bears on the public duties of public employees and
214	214	4 officials shall not be considered an invasion of personal
215	215	5 privacy.
216	216	6 (d) Records in the possession of any public body
217	217	7 created in the course of administrative enforcement
218	218	8 proceedings, and any law enforcement or correctional
219	219	9 agency for law enforcement purposes, but only to the
220	220	10 extent that disclosure would:
221	221	11 (i) interfere with pending or actually and
222	222	12 reasonably contemplated law enforcement proceedings
223	223	13 conducted by any law enforcement or correctional
224	224	14 agency that is the recipient of the request;
225	225	15 (ii) interfere with active administrative
226	226	16 enforcement proceedings conducted by the public body
227	227	17 that is the recipient of the request;
228	228	18 (iii) create a substantial likelihood that a
229	229	19 person will be deprived of a fair trial or an impartial
230	230	20 hearing;
231	231	21 (iv) unavoidably disclose the identity of a
232	232	22 confidential source, confidential information
233	233	23 furnished only by the confidential source, or persons
234	234	24 who file complaints with or provide information to
235	235	25 administrative, investigative, law enforcement, or
236	236	26 penal agencies; except that the identities of

247	247	1 witnesses to traffic accidents, traffic accident
248	248	2 reports, and rescue reports shall be provided by
249	249	3 agencies of local government, except when disclosure
250	250	4 would interfere with an active criminal investigation
251	251	5 conducted by the agency that is the recipient of the
252	252	6 request;
253	253	7 (v) disclose unique or specialized investigative
254	254	8 techniques other than those generally used and known
255	255	9 or disclose internal documents of correctional
256	256	10 agencies related to detection, observation, or
257	257	11 investigation of incidents of crime or misconduct, and
258	258	12 disclosure would result in demonstrable harm to the
259	259	13 agency or public body that is the recipient of the
260	260	14 request;
261	261	15 (vi) endanger the life or physical safety of law
262	262	16 enforcement personnel or any other person; or
263	263	17 (vii) obstruct an ongoing criminal investigation
264	264	18 by the agency that is the recipient of the request.
265	265	19 (d-5) A law enforcement record created for law
266	266	20 enforcement purposes and contained in a shared electronic
267	267	21 record management system if the law enforcement agency
268	268	22 that is the recipient of the request did not create the
269	269	23 record, did not participate in or have a role in any of the
270	270	24 events which are the subject of the record, and only has
271	271	25 access to the record through the shared electronic record
272	272	26 management system.

356	356	2 expressed, or policies or actions are formulated, except
357	357	3 that a specific record or relevant portion of a record
358	358	4 shall not be exempt when the record is publicly cited and
359	359	5 identified by the head of the public body. The exemption
360	360	6 provided in this paragraph (f) extends to all those
361	361	7 records of officers and agencies of the General Assembly
362	362	8 that pertain to the preparation of legislative documents.
363	363	9 (g) Trade secrets and commercial or financial
364	364	10 information obtained from a person or business where the
365	365	11 trade secrets or commercial or financial information are
366	366	12 furnished under a claim that they are proprietary,
367	367	13 privileged, or confidential, and that disclosure of the
368	368	14 trade secrets or commercial or financial information would
369	369	15 cause competitive harm to the person or business, and only
370	370	16 insofar as the claim directly applies to the records
371	371	17 requested.
372	372	18 The information included under this exemption includes
373	373	19 all trade secrets and commercial or financial information
374	374	20 obtained by a public body, including a public pension
375	375	21 fund, from a private equity fund or a privately held
376	376	22 company within the investment portfolio of a private
377	377	23 equity fund as a result of either investing or evaluating
378	378	24 a potential investment of public funds in a private equity
379	379	25 fund. The exemption contained in this item does not apply
380	380	26 to the aggregate financial performance information of a

391	391	1 private equity fund, nor to the identity of the fund's
392	392	2 managers or general partners. The exemption contained in
393	393	3 this item does not apply to the identity of a privately
394	394	4 held company within the investment portfolio of a private
395	395	5 equity fund, unless the disclosure of the identity of a
396	396	6 privately held company may cause competitive harm.
397	397	7 Nothing contained in this paragraph (g) shall be
398	398	8 construed to prevent a person or business from consenting
399	399	9 to disclosure.
400	400	10 (h) Proposals and bids for any contract, grant, or
401	401	11 agreement, including information which if it were
402	402	12 disclosed would frustrate procurement or give an advantage
403	403	13 to any person proposing to enter into a contractor
404	404	14 agreement with the body, until an award or final selection
405	405	15 is made. Information prepared by or for the body in
406	406	16 preparation of a bid solicitation shall be exempt until an
407	407	17 award or final selection is made.
408	408	18 (i) Valuable formulae, computer geographic systems,
409	409	19 designs, drawings, and research data obtained or produced
410	410	20 by any public body when disclosure could reasonably be
411	411	21 expected to produce private gain or public loss. The
412	412	22 exemption for "computer geographic systems" provided in
413	413	23 this paragraph (i) does not extend to requests made by
414	414	24 news media as defined in Section 2 of this Act when the
415	415	25 requested information is not otherwise exempt and the only
416	416	26 purpose of the request is to access and disseminate

431	431	5 (i) test questions, scoring keys, and other
432	432	6 examination data used to administer an academic
433	433	7 examination;
434	434	8 (ii) information received by a primary or
435	435	9 secondary school, college, or university under its
436	436	10 procedures for the evaluation of faculty members by
437	437	11 their academic peers;
438	438	12 (iii) information concerning a school or
439	439	13 university's adjudication of student disciplinary
440	440	14 cases, but only to the extent that disclosure would
441	441	15 unavoidably reveal the identity of the student; and
442	442	16 (iv) course materials or research materials used
443	443	17 by faculty members.
444	444	18 (k) Architects' plans, engineers' technical

719	719	5 (1) When a request is made to inspect or copy a public
720	720	6 record that contains information that is exempt from
721	721	7 disclosure under this Section, but also contains information
722	722	8 that is not exempt from disclosure, the public body may elect
723	723	9 to redact the information that is exempt. The public body
724	724	10 shall make the remaining information available for inspection
725	725	11 and copying. Subject to this requirement, the following shall
726	726	12 be exempt from inspection and copying:
727	727	13 (a) Information specifically prohibited from
728	728	14 disclosure by federal or State law or rules and
729	729	15 regulations implementing federal or State law.

1265	1265	12 (1) When a request is made to inspect or copy a public
1266	1266	13 record that contains information that is exempt from
1267	1267	14 disclosure under this Section, but also contains information
1268	1268	15 that is not exempt from disclosure, the public body may elect
1269	1269	16 to redact the information that is exempt. The public body
1270	1270	17 shall make the remaining information available for inspection
1271	1271	18 and copying. Subject to this requirement, the following shall
