1313 1 AN ACT concerning health.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 1. Short title. This Act may be cited as the Access
1717 5 to Public Health Data Act.
1818 6 Section 5. Definition. In this Act, "public health data"
1919 7 includes, but is not limited to, birth and death certificate
2020 8 data, hospital discharge data, adverse pregnancy outcomes
2121 9 reporting system (APORS) data, cancer registry data, syndromic
2222 10 surveillance data, and prescription monitoring program (PMP)
2323 11 data.
2424 12 Section 10. Access to public health data; certified local
2525 13 health departments; safeguards.
2626 14 (a) Notwithstanding any other provision of State law to
2727 15 the contrary, the Department of Public Health, the Department
2828 16 of Human Services, and the Department of Healthcare and Family
2929 17 Services shall, at the request of a certified local health
3030 18 department in this State, make any and all public health data
3131 19 related to residents of that certified local health
3232 20 department's jurisdiction available to that certified local

7373 1 executive director, chief operating officer, chief medical

7777 5 (b) A certified local health department shall have access
7878 6 to data under this Act only for the purposes identified in this
7979 7 Act. The Department of Public Health, the Department of Human
8080 8 Services, the Department of Healthcare and Family Services,
8181 9 and the requesting certified local health department shall
8282 10 protect the privacy and security of data obtained under this
8383 11 Act in accordance with applicable federal and State law and
8484 12 shall apply appropriate administrative, physical, and
8585 13 technical safeguards to ensure the privacy and security of the
8686 14 data and protect the data from unauthorized access, use, or
8787 15 disclosure. Appropriate safeguards include, but are not
8888 16 limited to, authentication and authorization of users prior to
8989 17 gaining access to data obtained under this Act.
9090 18 (c) A certified local health department shall apply
9191 19 appropriate controls to ensure that access to data under this
9292 20 Act is provided on a minimum, necessary basis and limited to
9393 21 only those persons whose public health duties and
9494 22 responsibilities require such access. Any data obtained under
9595 23 this Act and in the possession of a certified local health
9696 24 department shall be exempt from inspection and copying under
9797 25 subsection (pp) of Section 7 of the Freedom of Information
9898 26 Act. Any data obtained under this Act shall not be admissible

109109 1 as evidence nor discoverable in any action of any kind in any
110110 2 court or before any tribunal, board, agency, or person. The
111111 3 access to or disclosure of any information or data by a
112112 4 certified local health department under this Act shall not
113113 5 waive or have any effect upon its nondiscoverability or
114114 6 inadmissibility. The identity of any individual identified in
115115 7 data obtained under this Act shall be confidential and shall
116116 8 not be disclosed publicly or in any action of any kind.
117117 9 Section 15. Data use agreements. A disclosing State
118118 10 department and the requesting certified local health
119119 11 department shall enter into a data use agreement to ensure
120120 12 appropriate, effective, and efficient use of data obtained
121121 13 under this Act by the certified local health department,
122122 14 though no data use agreement shall, in a manner inconsistent
123123 15 with the purpose or requirements of this Act, impede certified
124124 16 local health department access to any public health data
125125 17 available to the Department of Public Health, the Department
126126 18 of Human Services, or the Department of Healthcare and Family
127127 19 Services, nor shall it require indemnification as a
128128 20 prerequisite to access.
129129 21 Section 20. Standard request data forms. Within 60 days
130130 22 after the effective date of this Act, the Department of Public
131131 23 Health, the Department of Human Services, and the Department

144144 2 departments, the terms of which shall be limited to data
145145 3 content, format, method of transfer, analytic and statistical
146146 4 methods, scope of use, and requirements for safeguarding the

148148 6 Section 25. Latest available data. The Department of
149149 7 Public Health, the Department of Human Services, and the
150150 8 Department of Healthcare and Family Services must provide the
151151 9 latest available data for each certified local health
152152 10 department request within 90 business days after receiving the
153153 11 data request form.
154154 12 Section 30. Rules. The Department of Public Health, the
155155 13 Department of Human Services, and the Department of Healthcare
156156 14 and Family Services may adopt any rules necessary to implement
157157 15 this Act.
158158 16 Section 900. The Freedom of Information Act is amended by

175175 1 record that contains information that is exempt from
176176 2 disclosure under this Section, but also contains information
177177 3 that is not exempt from disclosure, the public body may elect
178178 4 to redact the information that is exempt. The public body
179179 5 shall make the remaining information available for inspection
180180 6 and copying. Subject to this requirement, the following shall
181181 7 be exempt from inspection and copying:
182182 8 (a) Information specifically prohibited from
183183 9 disclosure by federal or State law or rules and
184184 10 regulations implementing federal or State law.
185185 11 (b) Private information, unless disclosure is required
186186 12 by another provision of this Act, a State or federal law,
187187 13 or a court order.
188188 14 (b-5) Files, documents, and other data or databases
189189 15 maintained by one or more law enforcement agencies and
190190 16 specifically designed to provide information to one or
191191 17 more law enforcement agencies regarding the physical or
192192 18 mental status of one or more individual subjects.
193193 19 (c) Personal information contained within public
194194 20 records, the disclosure of which would constitute a
195195 21 clearly unwarranted invasion of personal privacy, unless
196196 22 the disclosure is consented to in writing by the
197197 23 individual subjects of the information. "Unwarranted
198198 24 invasion of personal privacy" means the disclosure of
199199 25 information that is highly personal or objectionable to a

211211 1 privacy outweighs any legitimate public interest in
212212 2 obtaining the information. The disclosure of information
213213 3 that bears on the public duties of public employees and
214214 4 officials shall not be considered an invasion of personal
215215 5 privacy.
216216 6 (d) Records in the possession of any public body
217217 7 created in the course of administrative enforcement
218218 8 proceedings, and any law enforcement or correctional
219219 9 agency for law enforcement purposes, but only to the
220220 10 extent that disclosure would:
221221 11 (i) interfere with pending or actually and
222222 12 reasonably contemplated law enforcement proceedings
223223 13 conducted by any law enforcement or correctional
224224 14 agency that is the recipient of the request;
225225 15 (ii) interfere with active administrative
226226 16 enforcement proceedings conducted by the public body
227227 17 that is the recipient of the request;
228228 18 (iii) create a substantial likelihood that a
229229 19 person will be deprived of a fair trial or an impartial
230230 20 hearing;
231231 21 (iv) unavoidably disclose the identity of a
232232 22 confidential source, confidential information
233233 23 furnished only by the confidential source, or persons
234234 24 who file complaints with or provide information to
235235 25 administrative, investigative, law enforcement, or
236236 26 penal agencies; except that the identities of

247247 1 witnesses to traffic accidents, traffic accident
248248 2 reports, and rescue reports shall be provided by
249249 3 agencies of local government, except when disclosure
250250 4 would interfere with an active criminal investigation
251251 5 conducted by the agency that is the recipient of the
252252 6 request;
253253 7 (v) disclose unique or specialized investigative
254254 8 techniques other than those generally used and known
255255 9 or disclose internal documents of correctional
256256 10 agencies related to detection, observation, or
257257 11 investigation of incidents of crime or misconduct, and
258258 12 disclosure would result in demonstrable harm to the
259259 13 agency or public body that is the recipient of the
260260 14 request;
261261 15 (vi) endanger the life or physical safety of law
262262 16 enforcement personnel or any other person; or
263263 17 (vii) obstruct an ongoing criminal investigation
264264 18 by the agency that is the recipient of the request.
265265 19 (d-5) A law enforcement record created for law
266266 20 enforcement purposes and contained in a shared electronic
267267 21 record management system if the law enforcement agency
268268 22 that is the recipient of the request did not create the
269269 23 record, did not participate in or have a role in any of the
270270 24 events which are the subject of the record, and only has
271271 25 access to the record through the shared electronic record

355355 1 memoranda, and other records in which opinions are
356356 2 expressed, or policies or actions are formulated, except
357357 3 that a specific record or relevant portion of a record
358358 4 shall not be exempt when the record is publicly cited and
359359 5 identified by the head of the public body. The exemption
360360 6 provided in this paragraph (f) extends to all those
361361 7 records of officers and agencies of the General Assembly
362362 8 that pertain to the preparation of legislative documents.
363363 9 (g) Trade secrets and commercial or financial
364364 10 information obtained from a person or business where the
365365 11 trade secrets or commercial or financial information are
366366 12 furnished under a claim that they are proprietary,
367367 13 privileged, or confidential, and that disclosure of the
368368 14 trade secrets or commercial or financial information would
369369 15 cause competitive harm to the person or business, and only
370370 16 insofar as the claim directly applies to the records
371371 17 requested.
372372 18 The information included under this exemption includes
373373 19 all trade secrets and commercial or financial information
374374 20 obtained by a public body, including a public pension
375375 21 fund, from a private equity fund or a privately held
376376 22 company within the investment portfolio of a private
377377 23 equity fund as a result of either investing or evaluating
378378 24 a potential investment of public funds in a private equity
379379 25 fund. The exemption contained in this item does not apply

391391 1 private equity fund, nor to the identity of the fund's
392392 2 managers or general partners. The exemption contained in
393393 3 this item does not apply to the identity of a privately
394394 4 held company within the investment portfolio of a private
395395 5 equity fund, unless the disclosure of the identity of a
396396 6 privately held company may cause competitive harm.
397397 7 Nothing contained in this paragraph (g) shall be
398398 8 construed to prevent a person or business from consenting
399399 9 to disclosure.
400400 10 (h) Proposals and bids for any contract, grant, or
401401 11 agreement, including information which if it were
402402 12 disclosed would frustrate procurement or give an advantage
403403 13 to any person proposing to enter into a contractor
404404 14 agreement with the body, until an award or final selection
405405 15 is made. Information prepared by or for the body in
406406 16 preparation of a bid solicitation shall be exempt until an
407407 17 award or final selection is made.
408408 18 (i) Valuable formulae, computer geographic systems,
409409 19 designs, drawings, and research data obtained or produced
410410 20 by any public body when disclosure could reasonably be
411411 21 expected to produce private gain or public loss. The
412412 22 exemption for "computer geographic systems" provided in
413413 23 this paragraph (i) does not extend to requests made by
414414 24 news media as defined in Section 2 of this Act when the
415415 25 requested information is not otherwise exempt and the only
416416 26 purpose of the request is to access and disseminate

429429 3 (j) The following information pertaining to

431431 5 (i) test questions, scoring keys, and other
432432 6 examination data used to administer an academic
433433 7 examination;
434434 8 (ii) information received by a primary or
435435 9 secondary school, college, or university under its
436436 10 procedures for the evaluation of faculty members by
437437 11 their academic peers;
438438 12 (iii) information concerning a school or
439439 13 university's adjudication of student disciplinary
440440 14 cases, but only to the extent that disclosure would
441441 15 unavoidably reveal the identity of the student; and
442442 16 (iv) course materials or research materials used
443443 17 by faculty members.
444444 18 (k) Architects' plans, engineers' technical
445445 19 submissions, and other construction related technical
446446 20 documents for projects not constructed or developed in
447447 21 whole or in part with public funds and the same for
448448 22 projects constructed or developed with public funds,

450450 24 distribution stations and other transmission and

718718 4 Sec. 7. Exemptions.
719719 5 (1) When a request is made to inspect or copy a public
720720 6 record that contains information that is exempt from
721721 7 disclosure under this Section, but also contains information
722722 8 that is not exempt from disclosure, the public body may elect
723723 9 to redact the information that is exempt. The public body
724724 10 shall make the remaining information available for inspection
725725 11 and copying. Subject to this requirement, the following shall
726726 12 be exempt from inspection and copying:
727727 13 (a) Information specifically prohibited from
728728 14 disclosure by federal or State law or rules and
729729 15 regulations implementing federal or State law.
730730 16 (b) Private information, unless disclosure is required
731731 17 by another provision of this Act, a State or federal law,
732732 18 or a court order.
733733 19 (b-5) Files, documents, and other data or databases
734734 20 maintained by one or more law enforcement agencies and

767767 18 reasonably contemplated law enforcement proceedings
768768 19 conducted by any law enforcement or correctional
769769 20 agency that is the recipient of the request;
770770 21 (ii) interfere with active administrative

12651265 12 (1) When a request is made to inspect or copy a public
