4-AN ACT concerning education.
5-Be it enacted by the People of the State of Illinois,
6-represented in the General Assembly:
7-Section 5. The University of Illinois Act is amended by
8-changing Section 7e-5 as follows:
9-(110 ILCS 305/7e-5)
10-Sec. 7e-5. In-state tuition charge.
11-(a) Notwithstanding any other provision of law to the
12-contrary, for tuition purposes until July 1, 2026, the Board
13-of Trustees shall deem an individual an Illinois resident,
14-until the individual establishes a residence outside of this
15-State, if all of the following conditions are met:
16-(1) The individual resided with his or her parent or
17-guardian while attending a public or private high school
18-in this State.
19-(2) The individual graduated from a public or private
20-high school or received the equivalent of a high school
21-diploma in this State.
22-(3) The individual attended school in this State for
23-at least 3 years as of the date the individual graduated
24-from high school or received the equivalent of a high
25-school diploma.
26-(4) The individual registers as an entering student in

34-(5) In the case of an individual who is not a citizen
35-or a permanent resident of the United States, the
36-individual provides the University with an affidavit
37-stating that the individual will file an application to
38-become a permanent resident of the United States at the
39-earliest opportunity the individual is eligible to do so.
40-This subsection (a) applies only to tuition for a term or
41-semester that begins on or after May 20, 2003 (the effective
42-date of Public Act 93-7) but before July 1, 2026. Any revenue
43-lost by the University in implementing this subsection (a)
44-shall be absorbed by the University Income Fund.
45-(a-5) Notwithstanding any other provision of law to the
46-contrary, beginning July 1, 2026, an individual, other than an
47-individual who has a non-immigrant alien status that precludes
48-an intent to permanently reside in the United States under
49-subsection (a) of Section 1101 of Title 8 of the United States
50-Code, shall be charged tuition by the Board of Trustees at the
51-same rate as an Illinois resident if the individual meets all
52-of the requirements of either paragraph (1) or (2):
53-(1) The individual:
54-(A) attended a public or private high school in
55-this State for at least 2 years before enrolling at the
56-University;
57-(B) graduated from a public or private high school
58-in this State or received the equivalent of a high

77-(ii) a public community college in a community
78-college district organized under the Public
79-Community College Act; or
80-(iii) a combination of those educational
81-institutions set forth in subdivisions (i) and
82-(ii) of this subparagraph (A);
83-(B) has at the time of enrollment:
84-(i) graduated from a public or private high
85-school in this State or received the equivalent of
86-a high school diploma in this State; and

89-(ii) earned an associate degree from or
90-completed at least 60 credit hours of graded,
91-transferable coursework at a public community
92-college in a community college district organized
93-under the Public Community College Act;
94-(C) attended an educational institution set forth
95-in subdivision (i) or (ii) of subparagraph (A) of this
96-paragraph (2) while residing in this State and has not
97-established residency outside of this State before
98-enrolling at the University; and
99-(D) agrees to swear and affirm to the University
100-that the individual will file an application to become
101-a permanent resident of the United States at the
102-earliest opportunity if the individual is eligible to
103-do so and is not a citizen or lawful permanent resident
104-of the United States.
105-(b) If a person is on active military duty and stationed in
106-Illinois, then the Board of Trustees shall deem that person
107-and any of his or her dependents Illinois residents for
108-tuition purposes. Beginning with the 2009-2010 academic year,
109-if a person is on active military duty and is stationed out of
110-State, but he or she was stationed in this State for at least 3
111-years immediately prior to being reassigned out of State, then
112-the Board of Trustees shall deem that person and any of his or
113-her dependents Illinois residents for tuition purposes, as
114-long as that person or his or her dependent (i) applies for

120-2013-2014 academic year, if a person is utilizing benefits
121-under the federal Post-9/11 Veterans Educational Assistance
122-Act of 2008 or any subsequent variation of that Act, then the
123-Board of Trustees shall deem that person an Illinois resident
124-for tuition purposes. Beginning with the 2015-2016 academic
125-year, if a person is utilizing benefits under the federal
126-All-Volunteer Force Educational Assistance Program, then the
127-Board of Trustees shall deem that person an Illinois resident
128-for tuition purposes. Beginning with the 2019-2020 academic
129-year, per the federal requirements for maintaining approval
130-for veterans' education benefits under 38 U.S.C. 3679(c), if a
131-person is on active military duty or is receiving veterans'
132-education benefits, then the Board of Trustees shall deem that
133-person an Illinois resident for tuition purposes for any
134-academic quarter, semester, or term, as applicable.
135-(c) The Board of Trustees may adopt a policy to implement
136-and administer this Section and may adopt a policy for the
137-classification of in-state residents, for tuition purposes,
138-based on residency in this State.
139-(d) The General Assembly finds and declares that this
140-Section is a State law within the meaning of subsection (d) of
141-Section 1621 of Title 8 of the United States Code.

1215+6 contrary, for tuition purposes until July 1, 2026, the Board
1216+7 shall deem an individual an Illinois resident, until the
1217+8 individual establishes a residence outside of this State, if
1218+9 all of the following conditions are met:
1219+10 (1) The individual resided with his or her parent or
1220+11 guardian while attending a public or private high school
1221+12 in this State.
1222+13 (2) The individual graduated from a public or private
1223+14 high school or received the equivalent of a high school
1224+15 diploma in this State.
1225+16 (3) The individual attended school in this State for
1226+17 at least 3 years as of the date the individual graduated
1227+18 from high school or received the equivalent of a high
1228+19 school diploma.
1229+20 (4) The individual registers as an entering student in
1230+21 the University not earlier than the 2003 fall semester.
1231+22 (5) In the case of an individual who is not a citizen
1232+23 or a permanent resident of the United States, the
1233+24 individual provides the University with an affidavit

1247+4 This subsection (a) applies only to tuition for a term or
1248+5 semester that begins on or after May 20, 2003 (the effective
1249+6 date of Public Act 93-7) but before July 1, 2026. Any revenue
1250+7 lost by the University in implementing this subsection (a)
1251+8 shall be absorbed by the University Income Fund.
1252+9 (a-5) Notwithstanding any other provision of law to the
1253+10 contrary, beginning July 1, 2026, an individual, other than an
1254+11 individual who has a non-immigrant alien status that precludes
1255+12 an intent to permanently reside in the United States under
1256+13 subsection (a) of Section 1101 of Title 8 of the United States
1257+14 Code, shall be charged tuition by the Board at the same rate as
1258+15 an Illinois resident if the individual meets all of the
1259+16 requirements of either paragraph (1) or (2):
1260+17 (1) The individual:
1261+18 (A) attended a public or private high school in
1262+19 this State for at least 2 years before enrolling at the
1263+20 University;

1328+13 (b) If a person is on active military duty and stationed in
1329+14 Illinois, then the Board shall deem that person and any of his
1330+15 or her dependents Illinois residents for tuition purposes.
1331+16 Beginning with the 2009-2010 academic year, if a person is on
1332+17 active military duty and is stationed out of State, but he or
1333+18 she was stationed in this State for at least 3 years
1334+19 immediately prior to being reassigned out of State, then the
1335+20 Board shall deem that person and any of his or her dependents
1336+21 Illinois residents for tuition purposes, as long as that
1337+22 person or his or her dependent (i) applies for admission to the
1338+23 University within 18 months of the person on active military
1339+24 duty being reassigned or (ii) remains continuously enrolled at
1340+25 the University. Beginning with the 2013-2014 academic year, if

1352+1 Veterans Educational Assistance Act of 2008 or any subsequent
1353+2 variation of that Act, then the Board shall deem that person an
1354+3 Illinois resident for tuition purposes. Beginning with the
1355+4 2015-2016 academic year, if a person is utilizing benefits
1356+5 under the federal All-Volunteer Force Educational Assistance
1357+6 Program, then the Board shall deem that person an Illinois
1358+7 resident for tuition purposes. Beginning with the 2019-2020
1359+8 academic year, per the federal requirements for maintaining
1360+9 approval for veterans' education benefits under 38 U.S.C.
1361+10 3679(c), if a person is on active military duty or is receiving
1362+11 veterans' education benefits, then the Board of Trustees shall
1363+12 deem that person an Illinois resident for tuition purposes for
1364+13 any academic quarter, semester, or term, as applicable.
1365+14 (c) The Board may adopt a policy to implement and
1366+15 administer this Section and may adopt a policy for the
1367+16 classification of in-state residents, for tuition purposes,
1368+17 based on residency in this State.
1369+18 (d) The General Assembly finds and declares that this
1370+19 Section is a State law within the meaning of subsection (d) of
1371+20 Section 1621 of Title 8 of the United States Code.
