1  AN ACT concerning gaming.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The Illinois Lottery Law is amended by changing
5  Sections 9.3, 20, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11,
6  and 21.13 and by adding Sections 21.4, 21.15, 21.16, and 21.17
7  as follows:
8  (20 ILCS 1605/9.3)
9  Sec. 9.3. Expenditure and distribution of lottery
10  proceeds.
11  (a) Beginning July 1, 2022, except as provided in Sections
12  21.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and
13  21.13, 21.15, and 21.16 of this Law Act and Section 25-70 of
14  the Sports Wagering Act, the Department shall distribute all
15  proceeds of lottery tickets and shares sold in the following
16  priority and manner:
17  (1) The payment of prizes and retailer bonuses.
18  (2) The payment of costs incurred in the operation and
19  administration of the Lottery, including the payment of
20  sums due to the private manager under the management
21  agreement with the Department and including costs of
22  administering the Lottery sports wagering program pursuant
23  to Section 25-70 of the Sports Wagering Act.

1  (3) On the last day of each month or as soon thereafter
2  as possible, the State Comptroller shall direct and the
3  State Treasurer shall transfer from the State Lottery Fund
4  to the Common School Fund the Department's estimate of net
5  lottery proceeds.
6  (4) If an amount in excess of the annual net lottery
7  proceeds is transferred for a fiscal year, then the
8  Department shall offset the monthly transfers of estimated
9  net lottery proceeds during the following fiscal year by
10  that excess amount. If an amount less than the annual net
11  lottery proceeds is transferred for a fiscal year, then
12  after the related annual fiscal year audit is completed
13  following such fiscal year, the Department shall direct
14  the deposit of any remaining annual net lottery proceeds
15  from such fiscal year, subject to payments under
16  paragraphs (1) and (2), into the Common School Fund as
17  soon thereafter as possible.
18  (b) The net lottery proceeds shall be determined by
19  deducting from total annual lottery proceeds the expenditures
20  required by paragraphs (1) and (2) of subsection (a). The
21  total annual lottery proceeds and annual net lottery proceeds
22  shall be determined according to generally accepted accounting
23  principles for governmental entities and verified by an annual
24  fiscal year audit.

2  Sec. 20. State Lottery Fund.
3  (a) There is created in the State Treasury a special fund
4  to be known as the State Lottery Fund. Such fund shall consist
5  of all revenues received from (1) the sale of lottery tickets
6  or shares, (net of commissions, fees representing those
7  expenses that are directly proportionate to the sale of
8  tickets or shares at the agent location, and prizes of less
9  than $600 which have been validly paid at the agent level), (2)
10  application fees, and (3) all other sources including moneys
11  credited or transferred thereto from any other fund or source
12  pursuant to law. Interest earnings of the State Lottery Fund
13  shall be credited to the Common School Fund.
14  (a-5) The receipt and distribution of moneys under Section
15  21.4 of this Act shall be in accordance with Section 21.4.
16  (b) The receipt and distribution of moneys under Section
17  21.5 of this Law Act shall be in accordance with Section 21.5.
18  (c) The receipt and distribution of moneys under Section
19  21.6 of this Law Act shall be in accordance with Section 21.6.
20  (d) The receipt and distribution of moneys under Section
21  21.7 of this Law Act shall be in accordance with Section 21.7.
22  (e) The receipt and distribution of moneys under Section
23  21.8 of this Law Act shall be in accordance with Section 21.8.
24  (f) The receipt and distribution of moneys under Section
25  21.9 of this Law Act shall be in accordance with Section 21.9.

1  21.10 of this Law Act shall be in accordance with Section
2  21.10.
3  (h) The receipt and distribution of moneys under Section
4  21.11 of this Law Act shall be in accordance with Section
5  21.11.
6  (i) (Blank). The receipt and distribution of moneys under
7  Section 21.12 of this Act shall be in accordance with Section
8  21.12.
9  (j) The receipt and distribution of moneys under Section
10  21.13 of this Law Act shall be in accordance with Section
11  21.13.
12  (k) The receipt and distribution of moneys under Section
13  25-70 of the Sports Wagering Act shall be in accordance with
14  Section 25-70 of the Sports Wagering Act.
15  (l) The receipt and distribution of moneys under Section
16  21.15 of this Law shall be in accordance with Section 21.15.
17  (m) The receipt and distribution of moneys under Section
18  21.16 of this Law shall be in accordance with Section 21.16.

22  Sec. 21.4. Joint Special Instant Scratch-off game.
23  (a) The Department shall offer a joint special instant
24  scratch-off game for the benefit of the special causes
25  identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10,

1  21.11, 21.13, 21.15, and 21.16. The operation of the game
2  shall be governed by this Section and any rules adopted by the
3  Department. The game shall commence on January 1, 2024 or as
4  soon thereafter, at the discretion of the Director, as is
5  reasonably practical and shall be discontinued on January 1,
6  2027. If any provision of this Section is inconsistent with
7  any other provision in the Act, then this Section governs.
8  (b) Once the joint special instant scratch-off game is
9  used to fund a special cause, the game will be used to fund the
10  special cause for the remainder of the special causes'
11  existence per the causes' respective Section of this Act.
12  (c) New specialty tickets and causes authorized by this
13  Act shall be funded by the joint special instant scratch-off
14  game. New specialty tickets and causes after February 1, 2024
15  must have a sunset date. The Department shall be limited to
16  supporting no more than 10 causes in total at any given time.
17  (d) Net revenue received from the sale of the joint
18  special instant scratch-off game for the purposes of this
19  Section shall be divided equally among the special causes the
20  game benefits. The Department shall transfer the net revenue
21  into the special fund identified for each special cause in
22  accordance with the special cause's respective Section of this
23  Act. As used in this Section, "net revenue" means the total
24  amount for which tickets have been sold less the sum of the
25  amount paid out in prizes and to retailers, and direct and
26  estimated administrative expenses incurred in operation of the

3  Sec. 21.5. Carolyn Adams Ticket For The Cure.
4  (a) The Department shall offer a special instant
5  scratch-off game with the title of "Carolyn Adams Ticket For
6  The Cure". The game shall commence on January 1, 2006 or as
7  soon thereafter, in the discretion of the Director, as is
8  reasonably practical, and shall be discontinued on December
9  31, 2026. The operation of the game shall be governed by this
10  Act and any rules adopted by the Department. The Department
11  must consult with the Carolyn Adams Ticket For The Cure Board,
12  which is established under Section 2310-347 of the Department
13  of Public Health Powers and Duties Law of the Civil
14  Administrative Code of Illinois, regarding the design and
15  promotion of the game. If any provision of this Section is
16  inconsistent with any other provision of this Act, then this
17  Section governs.
18  (b) The Carolyn Adams Ticket For The Cure Grant Fund is
19  created as a special fund in the State treasury. The net
20  revenue from the Carolyn Adams Ticket For The Cure special
21  instant scratch-off game shall be deposited into the Fund for
22  appropriation by the General Assembly solely to the Department
23  of Public Health for the purpose of making grants to public or
24  private entities in Illinois for the purpose of funding breast
25  cancer research, and supportive services for breast cancer

1  survivors and those impacted by breast cancer and breast
2  cancer education. In awarding grants, the Department of Public
3  Health shall consider criteria that includes, but is not
4  limited to, projects and initiatives that address disparities
5  in incidence and mortality rates of breast cancer, based on
6  data from the Illinois Cancer Registry, and populations facing
7  barriers to care. The Department of Public Health shall,
8  before grants are awarded, provide copies of all grant
9  applications to the Carolyn Adams Ticket For The Cure Board,
10  receive and review the Board's recommendations and comments,
11  and consult with the Board regarding the grants. For purposes
12  of this Section, the term "research" includes, without
13  limitation, expenditures to develop and advance the
14  understanding, techniques, and modalities effective in the
15  detection, prevention, screening, and treatment of breast
16  cancer and may include clinical trials. The grant funds may
17  not be used for institutional, organizational, or
18  community-based overhead costs, indirect costs, or levies.
19  Moneys received for the purposes of this Section,
20  including, without limitation, net revenue from the special
21  instant scratch-off game and gifts, grants, and awards from
22  any public or private entity, must be deposited into the Fund.
23  Any interest earned on moneys in the Fund must be deposited
24  into the Fund.
25  As used in this subsection, For purposes of this
26  subsection, "net revenue" means the total amount for which

2  prizes and to retailers, and direct and estimated the actual
3  administrative expenses of the Department solely related to
4  the Ticket For The Cure game.
5  (c) During the time that tickets are sold for the Carolyn
6  Adams Ticket For The Cure game, the Department shall not
7  unreasonably diminish the efforts devoted to marketing any
8  other instant scratch-off lottery game.
9  (d) The Department may adopt any rules necessary to
10  implement and administer the provisions of this Section.

13  Sec. 21.6. Scratch-off for Illinois veterans.
14  (a) The Department shall offer a special instant
15  scratch-off game for the benefit of Illinois veterans. The
16  game shall commence on January 1, 2006 or as soon thereafter,
17  at the discretion of the Director, as is reasonably practical.
18  The operation of the game shall be governed by this Act and any
19  rules adopted by the Department. If any provision of this
20  Section is inconsistent with any other provision of this Act,
21  then this Section governs.
22  (b) The Illinois Veterans Assistance Fund is created as a
23  special fund in the State treasury. The net revenue from the
24  Illinois veterans scratch-off game shall be deposited into the
25  Fund for appropriation by the General Assembly solely to the

1  Department of Veterans' Affairs for making grants, funding
2  additional services, or conducting additional research
3  projects relating to each of the following:
4  (i) veterans' behavioral health services;
5  (ii) veterans' homelessness;
6  (iii) the health insurance costs of veterans;
7  (iv) veterans' disability benefits, including but not
8  limited to, disability benefits provided by veterans
9  service organizations and veterans assistance commissions
10  or centers;
11  (v) the long-term care of veterans; provided that,
12  beginning with moneys appropriated for fiscal year 2008,
13  no more than 20% of such moneys shall be used for health
14  insurance costs;
15  (vi) veteran employment and employment training; and
16  (vii) veterans' emergency financial assistance,
17  including, but not limited to, past due utilities,
18  housing, and transportation costs.
19  In order to expend moneys from this special fund,
20  beginning with moneys appropriated for fiscal year 2008, the
21  Director of Veterans' Affairs shall appoint a 3-member funding
22  authorization committee. The Director shall designate one of
23  the members as chairperson. The committee shall meet on a
24  quarterly basis, at a minimum, and shall authorize expenditure
25  of moneys from the special fund by a two-thirds vote.
26  Decisions of the committee shall not take effect unless and

1  until approved by the Director of Veterans' Affairs. Each
2  member of the committee shall serve until a replacement is
3  named by the Director of Veterans' Affairs. One member of the
4  committee shall be a member of the Veterans' Advisory Council.
5  Moneys collected from the special instant scratch-off game
6  shall be used only as a supplemental financial resource and
7  shall not supplant existing moneys that the Department of
8  Veterans' Affairs may currently expend for the purposes set
9  forth in items (i) through (v).
10  Moneys received for the purposes of this Section,
11  including, without limitation, net revenue from the special
12  instant scratch-off game and from gifts, grants, and awards
13  from any public or private entity, must be deposited into the
14  Fund. Any interest earned on moneys in the Fund must be
15  deposited into the Fund.
16  As used in this subsection, For purposes of this
17  subsection, "net revenue" means the total amount for which
18  tickets have been sold less the sum of the amount paid out in
19  the prizes and to retailers, and direct and estimated the
20  actual administrative expenses of the Department solely
21  related to the scratch-off game under this Section.
22  (c) During the time that tickets are sold for the Illinois
23  veterans scratch-off game, the Department shall not
24  unreasonably diminish the efforts devoted to marketing any
25  other instant scratch-off lottery game.

4  Sec. 21.7. Scratch-out Multiple Sclerosis scratch-off
5  game.
6  (a) The Department shall offer a special instant
7  scratch-off game for the benefit of research pertaining to
8  multiple sclerosis. The game shall commence on July 1, 2008 or
9  as soon thereafter, in the discretion of the Director, as is
10  reasonably practical. The operation of the game shall be
11  governed by this Act and any rules adopted by the Department.
12  If any provision of this Section is inconsistent with any
13  other provision of this Act, then this Section governs.
14  (b) The Multiple Sclerosis Research Fund is created as a
15  special fund in the State treasury. The net revenue from the
16  scratch-out multiple sclerosis scratch-off game created under
17  this Section shall be deposited into the Fund for
18  appropriation by the General Assembly to the Department of
19  Public Health for the purpose of making grants to
20  organizations in Illinois that conduct research pertaining to
21  the repair and prevention of damage caused by an acquired
22  demyelinating disease of the central nervous system.
23  Moneys received for the purposes of this Section,
24  including, without limitation, net revenue from the special
25  instant scratch-off game and from gifts, grants, and awards

4  For purposes of this Section, the term "research"
5  includes, without limitation, expenditures to develop and
6  advance the understanding, techniques, and modalities
7  effective for maintaining function, mobility, and strength
8  through preventive physical therapy or other treatments and to
9  develop and advance the repair, and also the prevention, of
10  myelin, neuron, and axon damage caused by an acquired
11  demyelinating disease of the central nervous system and the
12  restoration of function, including but not limited to, nervous
13  system repair or neuroregeneration.
14  The grant funds may not be used for institutional,
15  organizational, or community-based overhead costs, indirect
16  costs, or levies.
17  As used in this subsection, For purposes of this
18  subsection, "net revenue" means the total amount for which
19  tickets have been sold less the sum of the amount paid out in
20  the prizes and to retailers, and direct and estimated the
21  actual administrative expenses of the Department solely
22  related to the scratch-off game under this Section.
23  (c) During the time that tickets are sold for the
24  scratch-out multiple sclerosis scratch-off game, the
25  Department shall not unreasonably diminish the efforts devoted
26  to marketing any other instant scratch-off lottery game.

5  Sec. 21.8. Quality of Life scratch-off game.
6  (a) The Department shall offer a special instant
7  scratch-off game with the title of "Quality of Life". The game
8  shall commence on July 1, 2007 or as soon thereafter, in the
9  discretion of the Director, as is reasonably practical, and
10  shall be discontinued on December 31, 2025. The operation of
11  the game is governed by this Act and by any rules adopted by
12  the Department. The Department must consult with the Quality
13  of Life Board, which is established under Section 2310-348 of
14  the Department of Public Health Powers and Duties Law of the
15  Civil Administrative Code of Illinois, regarding the design
16  and promotion of the game. If any provision of this Section is
17  inconsistent with any other provision of this Act, then this
18  Section governs.
19  (b) The Quality of Life Endowment Fund is created as a
20  special fund in the State treasury. The net revenue from the
21  Quality of Life special instant scratch-off game must be
22  deposited into the Fund for appropriation by the General
23  Assembly solely to the Department of Public Health for the
24  purpose of HIV/AIDS-prevention education and for making grants
25  to public or private entities in Illinois for the purpose of

1  funding organizations that serve the highest at-risk
2  categories for contracting HIV or developing AIDS. Grants
3  shall be targeted to serve at-risk populations in proportion
4  to the distribution of recent reported Illinois HIV/AIDS cases
5  among risk groups as reported by the Illinois Department of
6  Public Health. The recipient organizations must be engaged in
7  HIV/AIDS-prevention education and HIV/AIDS healthcare
8  treatment. The Department must, before grants are awarded,
9  provide copies of all grant applications to the Quality of
10  Life Board, receive and review the Board's recommendations and
11  comments, and consult with the Board regarding the grants.
12  Organizational size will determine an organization's
13  competitive slot in the "Request for Proposal" process.
14  Organizations with an annual budget of $300,000 or less will
15  compete with like size organizations for 50% of the Quality of
16  Life annual fund. Organizations with an annual budget of
17  $300,001 to $700,000 will compete with like organizations for
18  25% of the Quality of Life annual fund, and organizations with
19  an annual budget of $700,001 and upward will compete with like
20  organizations for 25% of the Quality of Life annual fund. The
21  lottery may designate a percentage of proceeds for marketing
22  purposes. The grant funds may not be used for institutional,
23  organizational, or community-based overhead costs, indirect
24  costs, or levies.

2  must commence on July 1, 2014 or as soon thereafter, at the
3  discretion of the Director, as is reasonably practical. The
4  operation of the game is governed by this Act and by any rules
5  adopted by the Department. If any provision of this Section is
6  inconsistent with any other provision of this Act, then this
7  Section governs.
8  (b) The Special Olympics Illinois and Special Children's
9  Charities Fund is created as a special fund in the State
10  treasury. The net revenue from the Go For The Gold special
11  instant scratch-off game must be deposited into the Special
12  Olympics Illinois and Special Children's Charities Fund for
13  appropriation by the General Assembly solely to the Department
14  of Human Services, which must distribute the moneys as
15  follows: (i) 75% of the moneys to Special Olympics Illinois to
16  support the statewide training, competitions, and programs for
17  future Special Olympics athletes; and (ii) 25% of the moneys
18  to Special Children's Charities to support the City of
19  Chicago-wide training, competitions, and programs for future
20  Special Olympics athletes. The moneys may not be used for
21  institutional, organizational, or community-based overhead
22  costs, indirect costs, or levies.
23  Moneys received for the purposes of this Section,
24  including, without limitation, net revenue from the special
25  instant scratch-off game and gifts, grants, and awards from

20  (a) The Department shall offer a special instant
21  scratch-off game for the benefit of State police memorials.

3  (b) The net revenue from the State police memorials
4  scratch-off game shall be deposited into the Criminal Justice
5  Information Projects Fund and distributed equally, as soon as
6  practical but at least on a monthly basis, to the Chicago
7  Police Memorial Foundation Fund, the Police Memorial Committee
8  Fund, and the Illinois State Police Memorial Park Fund. Moneys
9  transferred to the funds under this Section shall be used,
10  subject to appropriation, to fund grants for building and
11  maintaining memorials and parks; holding annual memorial
12  commemorations; giving scholarships to children of officers
13  killed or catastrophically injured in the line of duty, or
14  those interested in pursuing a career in law enforcement;
15  providing financial assistance to police officers and their
16  families when a police officer is killed or injured in the line
17  of duty; and providing financial assistance to officers for
18  the purchase or replacement of bulletproof vests to be used in
19  the line of duty.
20  As used in this subsection, For purposes of this
21  subsection, "net revenue" means the total amount for which
22  tickets have been sold less the sum of the amount paid out in
23  the prizes and to retailers, and direct and estimated the
24  actual administrative expenses of the Department solely

10  (a) The Department shall offer a special instant

14  The operation of the game shall be governed by this Act and any
15  rules adopted by the Department. If any provision of this
16  Section is inconsistent with any other provision of this Act,

18  (b) The Homelessness Prevention Revenue Fund is created as
19  a special fund in the State treasury. The net revenue from the
20  scratch-off game to fund homelessness prevention programs
21  shall be deposited into the Homelessness Prevention Revenue
22  Fund. Subject to appropriation, moneys in the Fund shall be
23  used by the Department of Human Services solely for grants to
24  homelessness prevention and assistance projects under the
25  Homelessness Prevention Act.

12  governed by this Act and any rules adopted by the Department.
13  The Department must consult with UNCF Illinois regarding the
14  design and promotion of the game.
15  (b) The UNCF Scholarship Fund is created as a special fund
16  in the State treasury. The net revenue from the special
17  instant scratch-off game sold for the benefit of the United
18  Negro College Fund Illinois in support of education
19  scholarships to university and college students shall be
20  deposited into the fund for appropriation by the General
21  Assembly solely to the Student Assistance Commission for the
22  purpose of funding UNCF Illinois Scholarship awards to
23  university and college students. Funding shall be used solely
24  for scholarship awards and not to cover any administrative
25  costs of the United Negro College Fund, Inc., a 501(c)(3)

10  Assistance Act regarding the design and promotion of the game.
11  (b) The operation of any games under this Section shall be
12  governed by this Act, and any rules shall be adopted by the
13  Department.
14  (c) For purposes of this Section, "net revenue" means the
15  total amount for which tickets have been sold less the sum of
16  the amount paid out in prizes and the actual administrative
17  expenses of the Department solely related to the Illinois
18  DREAM scratch-off game.
19  (d) During the time that tickets are sold for the Illinois

4  (a) There is hereby created the Illinois Lottery Special
5  Instant Scratch-off Task Force.
6  (b) The Task Force shall study the joint special instant
7  scratch-off game offered under Section 21.4 and make
8  recommendations on:
9  (1) maximizing revenue for this State as well as
10  various special causes;
11  (2) whether to expand the program to additional
12  causes;
13  (3) establishing criteria for special causes;
14  (4) the impact on revenue of the joint special instant
15  scratch-off game; and
16  (5) other issues related to the joint special instant
17  scratch-off game.
18  (c) The Task Force may request testimony from any person
19  or entity that may assist in increasing understanding of the
20  joint special instant scratch-off game.
21  (d) The Task Force shall consist of the following members:
22  (1) the Director of the Lottery, or his or her
23  designee;
24  (2) 2 members, appointed by the Speaker of the House
25  of Representatives, one of whom shall be named co-chair of
26  the Task Force;

2  House of Representatives;

4  Senate, one of whom shall be named co-chair of the Task

7  Senate; and
8  (6) 2 members, appointed by the Governor.
9  (e) Members of the Task Force shall serve without
10  compensation for the duration of the Task Force, but may be
11  reimbursed for reasonable travel expenses and in compliance
12  with the Secretary of State's travel rules required for
13  attendance at meetings.
14  (f) As soon as practicable, but no later than September 1,
15  2023, all members shall be appointed to the Task Force. As soon
16  as practicable after all members have been appointed, the Task
17  Force shall hold its first meeting. The Task Force shall meet a
18  minimum of 4 times.
19  (g) The Department of the Lottery shall provide
20  administrative support and other support to the Task Force.
21  (h) By January 1, 2025, the Task Force shall submit a
22  report to the Governor and General Assembly reporting findings
23  and recommendations regarding the joint special instant
24  scratch-off games.
25  (i) This Section is repealed on January 1, 2027.

2  (b) The Illinois DREAM Fund Commission is charged with all
3  of the following responsibilities:
4  (1) Administering this Section and raising funds for
5  the Illinois DREAM Fund.
6  (2) Establishing a not-for-profit entity charged with
7  raising funds for the administration of this Section, any
8  educational or training programs the Commission is tasked
9  with administering, and funding scholarships to students
10  who are the children of immigrants to the United States.
11  (3) Publicizing the availability of scholarships from
12  the Illinois DREAM Fund.
13  (4) Selecting the recipients of scholarships funded
14  through the Illinois DREAM Fund.
15  (5) Researching issues pertaining to the availability
16  of assistance with the costs of higher education for the
17  children of immigrants and other issues regarding access
18  for and the performance of the children of immigrants
19  within higher education.
20  (6) Overseeing implementation of the other provisions
21  of this amendatory Act of the 97th General Assembly.
22  (7) Establishing and administering training programs
23  for high school counselors and counselors, admissions
24  officers, and financial aid officers of public
25  institutions of higher education. The training programs

2  the children of immigrants, including, but not limited to,
3  in-state tuition and scholarship programs. The Illinois
4  DREAM Fund Commission may also establish a public
5  awareness campaign regarding educational opportunities
6  available to college bound students who are the children
7  of immigrants.
8  The Illinois DREAM Fund Commission shall establish, by
9  rule, procedures for accepting and evaluating applications for
10  scholarships from the children of immigrants and issuing
11  scholarships to selected student applicants.
12  (c) To receive a scholarship under this Section, a student
13  must meet all of the following qualifications:
14  (1) Have resided with his or her parents or guardian
15  while attending a public or private high school in this
16  State.
17  (2) Have graduated from a public or private high
18  school or received the equivalent of a high school diploma
19  in this State.
20  (3) Have attended school in this State for at least 3
21  years as of the date he or she graduated from high school
22  or received the equivalent of a high school diploma.
23  (4) Have at least one parent who immigrated to the
24  United States.
25  (d) The Illinois Student Assistance Commission shall
26  establish an Illinois DREAM Fund to provide scholarships under
