2020 1 AN ACT concerning State government.
2121 2 Be it enacted by the People of the State of Illinois,
2222 3 represented in the General Assembly:
2323 4 Section 5. The Illinois Lottery Law is amended by changing
2424 5 Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12,
2525 6 and 21.13 and by adding Section 21.4 as follows:

2727 8 Sec. 21.4. Joint special instant scratch-off game.
2828 9 (a) The Department shall offer a joint special instant
2929 10 scratch-off game for the benefit of the special causes
3030 11 identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10,
3131 12 21.11, 21.12, and 21.13. The operation of the game shall be
3232 13 governed by this Section and any rules adopted by the
3333 14 Department. The game shall commence on July 1, 2023 or as soon
3434 15 thereafter, at the discretion of the Director, as is
3535 16 reasonably practical. If any provision of this Section is
3636 17 inconsistent with any other provision in the Act, then this
3737 18 Section governs.
3838 19 (b) Once the joint special instant scratch-off game is
3939 20 used to fund a special cause, the game shall be used to fund
4040 21 the special cause for the remainder of the special causes'
4141 22 existence per the causes' respective Section of this Act.

9595 1 this Act to fund a special cause shall be funded by the joint

103103 9 game benefits. The Department shall transfer the net revenue
104104 10 into the special fund identified for each cause in accordance
105105 11 with the cause's respective Section of this Act. For the
106106 12 purpose of this subsection, "net revenue" means the total
107107 13 amount for which tickets have been sold less the sum of the
108108 14 amount paid out in prizes and to retailers, and direct and
109109 15 estimated administrative expenses incurred in operation of the
110110 16 ticket.

112112 18 Sec. 21.5. Carolyn Adams Ticket For The Cure.
113113 19 (a) The Department shall offer a special instant
114114 20 scratch-off game with the title of "Carolyn Adams Ticket For
115115 21 The Cure". The game shall commence on January 1, 2006 or as
116116 22 soon thereafter, in the discretion of the Director, as is
117117 23 reasonably practical, and shall be discontinued on December
118118 24 31, 2026. The operation of the game shall be governed by this
119119 25 Act and any rules adopted by the Department. The Department

130130 1 must consult with the Carolyn Adams Ticket For The Cure Board,
131131 2 which is established under Section 2310-347 of the Department
132132 3 of Public Health Powers and Duties Law of the Civil
133133 4 Administrative Code of Illinois, regarding the design and
134134 5 promotion of the game. If any provision of this Section is
135135 6 inconsistent with any other provision of this Act, then this
136136 7 Section governs.
137137 8 (b) The Carolyn Adams Ticket For The Cure Grant Fund is
138138 9 created as a special fund in the State treasury. The net
139139 10 revenue from the Carolyn Adams Ticket For The Cure special
140140 11 instant scratch-off game shall be deposited into the Fund for
141141 12 appropriation by the General Assembly solely to the Department
142142 13 of Public Health for the purpose of making grants to public or
143143 14 private entities in Illinois for the purpose of funding breast
144144 15 cancer research, and supportive services for breast cancer
145145 16 survivors and those impacted by breast cancer and breast
146146 17 cancer education. In awarding grants, the Department of Public
147147 18 Health shall consider criteria that includes, but is not
148148 19 limited to, projects and initiatives that address disparities
149149 20 in incidence and mortality rates of breast cancer, based on
150150 21 data from the Illinois Cancer Registry, and populations facing
151151 22 barriers to care. The Department of Public Health shall,
152152 23 before grants are awarded, provide copies of all grant
153153 24 applications to the Carolyn Adams Ticket For The Cure Board,
154154 25 receive and review the Board's recommendations and comments,
155155 26 and consult with the Board regarding the grants. For purposes

167167 2 limitation, expenditures to develop and advance the
168168 3 understanding, techniques, and modalities effective in the
169169 4 detection, prevention, screening, and treatment of breast
170170 5 cancer and may include clinical trials. The grant funds may
171171 6 not be used for institutional, organizational, or
172172 7 community-based overhead costs, indirect costs, or levies.
173173 8 Moneys received for the purposes of this Section,
174174 9 including, without limitation, net revenue from the special
175175 10 instant scratch-off game and gifts, grants, and awards from
176176 11 any public or private entity, must be deposited into the Fund.
177177 12 Any interest earned on moneys in the Fund must be deposited
178178 13 into the Fund.
179179 14 For purposes of this subsection, "net revenue" means the
180180 15 total amount for which tickets have been sold less the sum of
181181 16 the amount paid out in prizes and the actual administrative
182182 17 expenses of the Department solely related to the Ticket For
183183 18 The Cure game.
184184 19 (c) During the time that tickets are sold for the Carolyn
185185 20 Adams Ticket For The Cure game, the Department shall not
186186 21 unreasonably diminish the efforts devoted to marketing any
187187 22 other instant scratch-off lottery game.
188188 23 (d) The Department may adopt any rules necessary to
189189 24 implement and administer the provisions of this Section.

203203 3 (a) The Department shall offer a special instant
204204 4 scratch-off game for the benefit of Illinois veterans. The
205205 5 game shall commence on January 1, 2006 or as soon thereafter,
206206 6 at the discretion of the Director, as is reasonably practical.
207207 7 The operation of the game shall be governed by this Act and any
208208 8 rules adopted by the Department. If any provision of this
209209 9 Section is inconsistent with any other provision of this Act,
210210 10 then this Section governs.
211211 11 (b) The Illinois Veterans Assistance Fund is created as a
212212 12 special fund in the State treasury. The net revenue from the
213213 13 Illinois veterans scratch-off game shall be deposited into the
214214 14 Fund for appropriation by the General Assembly solely to the
215215 15 Department of Veterans' Affairs for making grants, funding
216216 16 additional services, or conducting additional research
217217 17 projects relating to each of the following:
218218 18 (i) veterans' behavioral health services;
219219 19 (ii) veterans' homelessness;
220220 20 (iii) the health insurance costs of veterans;
221221 21 (iv) veterans' disability benefits, including but not
222222 22 limited to, disability benefits provided by veterans
223223 23 service organizations and veterans assistance commissions
224224 24 or centers;
225225 25 (v) the long-term care of veterans; provided that,
226226 26 beginning with moneys appropriated for fiscal year 2008,

237237 1 no more than 20% of such moneys shall be used for health
238238 2 insurance costs;
239239 3 (vi) veteran employment and employment training; and
240240 4 (vii) veterans' emergency financial assistance,
241241 5 including, but not limited to, past due utilities,
242242 6 housing, and transportation costs.
243243 7 In order to expend moneys from this special fund,
244244 8 beginning with moneys appropriated for fiscal year 2008, the
245245 9 Director of Veterans' Affairs shall appoint a 3-member funding
246246 10 authorization committee. The Director shall designate one of
247247 11 the members as chairperson. The committee shall meet on a
248248 12 quarterly basis, at a minimum, and shall authorize expenditure
249249 13 of moneys from the special fund by a two-thirds vote.
250250 14 Decisions of the committee shall not take effect unless and
251251 15 until approved by the Director of Veterans' Affairs. Each
252252 16 member of the committee shall serve until a replacement is
253253 17 named by the Director of Veterans' Affairs. One member of the
254254 18 committee shall be a member of the Veterans' Advisory Council.
255255 19 Moneys collected from the special instant scratch-off game
256256 20 shall be used only as a supplemental financial resource and
257257 21 shall not supplant existing moneys that the Department of
258258 22 Veterans' Affairs may currently expend for the purposes set
259259 23 forth in items (i) through (v).
260260 24 Moneys received for the purposes of this Section,
261261 25 including, without limitation, net revenue from the special
262262 26 instant scratch-off game and from gifts, grants, and awards

291291 19 (a) The Department shall offer a special instant
292292 20 scratch-off game for the benefit of research pertaining to
293293 21 multiple sclerosis. The game shall commence on July 1, 2008 or
294294 22 as soon thereafter, in the discretion of the Director, as is
295295 23 reasonably practical. The operation of the game shall be
296296 24 governed by this Act and any rules adopted by the Department.

309309 2 (b) The Multiple Sclerosis Research Fund is created as a

311311 4 scratch-out multiple sclerosis scratch-off game created under
312312 5 this Section shall be deposited into the Fund for
313313 6 appropriation by the General Assembly to the Department of
314314 7 Public Health for the purpose of making grants to
315315 8 organizations in Illinois that conduct research pertaining to
316316 9 the repair and prevention of damage caused by an acquired
317317 10 demyelinating disease of the central nervous system.
318318 11 Moneys received for the purposes of this Section,
319319 12 including, without limitation, net revenue from the special
320320 13 instant scratch-off game and from gifts, grants, and awards
321321 14 from any public or private entity, must be deposited into the
322322 15 Fund. Any interest earned on moneys in the Fund must be
323323 16 deposited into the Fund.
324324 17 For purposes of this Section, the term "research"
325325 18 includes, without limitation, expenditures to develop and
326326 19 advance the understanding, techniques, and modalities
327327 20 effective for maintaining function, mobility, and strength
328328 21 through preventive physical therapy or other treatments and to
329329 22 develop and advance the repair, and also the prevention, of
330330 23 myelin, neuron, and axon damage caused by an acquired
331331 24 demyelinating disease of the central nervous system and the
332332 25 restoration of function, including but not limited to, nervous
333333 26 system repair or neuroregeneration.

384384 6 (b) The Quality of Life Endowment Fund is created as a
385385 7 special fund in the State treasury. The net revenue from the
386386 8 Quality of Life special instant scratch-off game must be
387387 9 deposited into the Fund for appropriation by the General
388388 10 Assembly solely to the Department of Public Health for the
389389 11 purpose of HIV/AIDS-prevention education and for making grants
390390 12 to public or private entities in Illinois for the purpose of
391391 13 funding organizations that serve the highest at-risk
392392 14 categories for contracting HIV or developing AIDS. Grants
393393 15 shall be targeted to serve at-risk populations in proportion
394394 16 to the distribution of recent reported Illinois HIV/AIDS cases
395395 17 among risk groups as reported by the Illinois Department of
396396 18 Public Health. The recipient organizations must be engaged in
397397 19 HIV/AIDS-prevention education and HIV/AIDS healthcare
398398 20 treatment. The Department must, before grants are awarded,
399399 21 provide copies of all grant applications to the Quality of
400400 22 Life Board, receive and review the Board's recommendations and
401401 23 comments, and consult with the Board regarding the grants.
402402 24 Organizational size will determine an organization's
403403 25 competitive slot in the "Request for Proposal" process.

417417 3 $300,001 to $700,000 will compete with like organizations for

419419 5 an annual budget of $700,001 and upward will compete with like
420420 6 organizations for 25% of the Quality of Life annual fund. The
421421 7 lottery may designate a percentage of proceeds for marketing
422422 8 purposes. The grant funds may not be used for institutional,
423423 9 organizational, or community-based overhead costs, indirect
424424 10 costs, or levies.
425425 11 Grants awarded from the Fund are intended to augment the
426426 12 current and future State funding for the prevention and
427427 13 treatment of HIV/AIDS and are not intended to replace that
428428 14 funding.
429429 15 Moneys received for the purposes of this Section,
430430 16 including, without limitation, net revenue from the special
431431 17 instant scratch-off game and gifts, grants, and awards from
432432 18 any public or private entity, must be deposited into the Fund.
433433 19 Any interest earned on moneys in the Fund must be deposited
434434 20 into the Fund.
435435 21 For purposes of this subsection, "net revenue" means the
436436 22 total amount for which tickets have been sold less the sum of
437437 23 the amount paid out in prizes and the actual administrative
438438 24 expenses of the Department solely related to the Quality of
439439 25 Life game.

468468 18 (b) The Special Olympics Illinois and Special Children's
469469 19 Charities Fund is created as a special fund in the State
470470 20 treasury. The net revenue from the Go For The Gold special
471471 21 instant scratch-off game must be deposited into the Special
472472 22 Olympics Illinois and Special Children's Charities Fund for
473473 23 appropriation by the General Assembly solely to the Department
474474 24 of Human Services, which must distribute the moneys as
475475 25 follows: (i) 75% of the moneys to Special Olympics Illinois to

537537 16 Police Memorial Foundation Fund, the Police Memorial Committee
538538 17 Fund, and the Illinois State Police Memorial Park Fund. Moneys
539539 18 transferred to the funds under this Section shall be used,
540540 19 subject to appropriation, to fund grants for building and
541541 20 maintaining memorials and parks; holding annual memorial
542542 21 commemorations; giving scholarships to children of officers
543543 22 killed or catastrophically injured in the line of duty, or
544544 23 those interested in pursuing a career in law enforcement;
545545 24 providing financial assistance to police officers and their
546546 25 families when a police officer is killed or injured in the line

606606 15 (c) During the time that tickets are sold for the
607607 16 scratch-off game to fund homelessness prevention programs, the
608608 17 Department shall not unreasonably diminish the efforts devoted
609609 18 to marketing any other instant scratch-off lottery game.
610610 19 (d) The Department may adopt any rules necessary to
611611 20 implement and administer the provisions of this Section.
612612 21 (e) Nothing in this Section shall be construed to affect
613613 22 any revenue that any Homelessness Prevention line item
614614 23 receives through the General Revenue Fund or the Illinois
615615 24 Affordable Housing Trust Fund.
