1111 1 AN ACT concerning safety.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The Environmental Protection Act is amended by
1515 5 adding Section 9.19 as follows:

1717 7 Sec. 9.19. Fleet Electrification Incentive Program.
1818 8 (a) In this Section:
1919 9 "Class 6 truck" means a truck categorized by the Federal
2020 10 Highway Administration, using gross vehicle weight ratings, as
2121 11 a Class 6 vehicle.
2222 12 "Class 7 truck" means a truck categorized by the Federal
2323 13 Highway Administration, using gross vehicle weight ratings, as
2424 14 a Class 7 vehicle.
2525 15 "Class 8 truck" means a truck categorized by the Federal
2626 16 Highway Administration, using gross vehicle weight ratings, as
2727 17 a Class 8 vehicle.
2828 18 (b) The Agency shall establish a Fleet Electrification
2929 19 Incentive Program to provide private fleet owners and
3030 20 operators in Illinois grants to promote their use of electric
3131 21 Class 6 trucks, electric Class 7 trucks, and electric Class 8
3232 22 trucks. The Program shall offer qualifying applicants a grant
3333 23 of $200,000 per electric Class 6 truck, electric Class 7

6868 1 truck, or electric Class 8 truck purchased or leased for a
6969 2 private fleet by the fleet's owner or operator.
7070 3 (c) The Agency shall award grants under the Fleet
7171 4 Electrification Incentive Program on a competitive basis
7272 5 according to the availability of funding. To be eligible to
7373 6 receive a grant under the Program an applicant must, at a
7474 7 minimum, satisfy all of the following criteria:
7575 8 (1) The electric Class 6 truck, electric Class 7
7676 9 truck, or electric Class 8 truck must be registered in
7777 10 Illinois or recognized under the International
7878 11 Registration Plan.
7979 12 (2) The fleet owner or operator must be domiciled in
8080 13 Illinois.
8181 14 (3) If the electric Class 6 truck, electric Class 7
8282 15 truck, or electric Class 8 truck is leased by the fleet
8383 16 owner or operator, the term of the lease must be at least
8484 17 36 months.
8585 18 In providing grants under the Program, the Agency may give
8686 19 weight to applications based upon the potential impact of the
8787 20 geographic locations and routes of the applicant's fleet on
8888 21 pollution affecting environmental justice communities.
8989 22 In providing grants under the Program, the Agency shall
9090 23 give priority to applicants who have negotiated and entered
9191 24 into a collective bargaining agreement at the time of
9292 25 application for the grant.
9393 26 (d) A grant provided under the Program is limited to a

104104 1 maximum award of $200,000 to purchase or lease one electric
105105 2 Class 6 truck, electric Class 7 truck, or electric Class 8
106106 3 truck. However, a fleet owner or operator may submit one
107107 4 application for each diesel Class 6 truck, diesel Class 7
108108 5 truck, or diesel Class 8 truck eligible to be replaced under
109109 6 the Program and that is owned by the fleet owner or operator. A
110110 7 fleet owner or operator may be awarded multiple grants under
111111 8 the Program.
112112 9 (e) The Agency shall notify an applicant when the
113113 10 applicant's grant request has been granted preliminary
114114 11 approval by the Agency. After an applicant receives
115115 12 notification that the applicant's grant request has been
116116 13 granted preliminary approval by the Agency, the applicant
117117 14 shall submit a proof of purchase, lease, or other binding
118118 15 contract regarding the electric Class 6 truck, electric Class
119119 16 7 truck, or electric Class 8 truck in order to be awarded the
120120 17 grant. The preliminary approval of the grant request may be
121121 18 renewed at 3-month intervals for up to 18 months, pending
122122 19 receipt of the applicant's proof of purchase, lease, or other
123123 20 binding contract regarding the purchase or leasing of the
124124 21 electric Class 6 truck, electric Class 7 truck, or electric
125125 22 Class 8 truck.
126126 23 (f) A fleet owner or operator who receives a grant under
127127 24 this Section must retain title or right of use of the electric
128128 25 Class 6 truck, electric Class 7 truck, or electric Class 8
129129 26 truck incentivized under the Program for a minimum of 60

140140 1 consecutive months after the purchase date or lease date of
141141 2 the electric Class 6 truck, electric Class 7 truck, or
142142 3 electric Class 8 truck. Resale or sublease of the electric
143143 4 Class 6 truck, electric Class 7 truck, or electric Class 8
144144 5 truck for financial gain within 60 months after the purchase
145145 6 date or lease date is prohibited.
146146 7 (g) Upon approval of an initial application for a grant
147147 8 under the Program, the applicant may participate in a vehicle
148148 9 replacement program through which:
149149 10 (1) a diesel Class 6 truck, diesel Class 7 truck, or
150150 11 diesel Class 8 truck from the applicant's existing fleet
151151 12 is scrapped; or
152152 13 (2) ownership of the oldest diesel Class 6 truck,
153153 14 diesel Class 7 truck, or diesel Class 8 truck in the
154154 15 applicant's existing fleet is transferred to another fleet
155155 16 owner or operator who agrees to scrap their oldest diesel
156156 17 Class 6 truck, diesel Class 7 truck, or diesel Class 8
157157 18 truck upon receipt.
158158 19 The electric Class 6 truck, electric Class 7 truck, or
159159 20 electric Class 8 truck for which the grant is awarded must be
160160 21 predominantly used in the same general location in Illinois as
161161 22 the fleet owner's or operators' scrapped or transferred diesel
162162 23 Class 6 truck, diesel Class 7 truck, or diesel Class 8 was used
163163 24 by the fleet owner or operator.
164164 25 (h) Notwithstanding any other provision of this Section:
165165 26 (1) a fleet owner or operator shall scrap a diesel

176176 1 Class 6 truck, diesel Class 7 truck, or diesel Class 8
177177 2 truck for which a grant is awarded under this Section if
178178 3 the model year of the diesel Class 6 truck, diesel Class 7
179179 4 truck, or diesel Class 8 truck is 2009 or older; and
180180 5 (2) if the diesel Class 6 truck, diesel Class 7 truck,
181181 6 or diesel Class 8 truck for which a grant is awarded under
182182 7 this Section has a model year of 2010 or newer, the fleet
183183 8 owner or operator must keep, donate, or sell that diesel
184184 9 Class 6 truck, diesel Class 7 truck, or diesel Class 8
185185 10 truck.
186186 11 (i) The deployment of the electric Class 6 truck, electric
187187 12 Class 7 truck, or electric Class 8 truck in the applicant's
188188 13 fleet is required within 24 months after receipt of notice of
189189 14 approval of the applicant's Program application. Total
190190 15 completion of the project for which the electric Class 6
191191 16 truck, electric Class 7 truck, or electric Class 8 truck is
192192 17 purchased or leased must occur within 36 months after receipt
193193 18 of grant funds under the Program.
194194 19 (j) An applicant who is awarded a grant under this Section
195195 20 must agree to participate in annual surveys regarding metrics
196196 21 as determined by the Agency, such as average daily mileage,
197197 22 kilowatts consumed, and emissions reduction data.
