1111 1 AN ACT concerning health.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 1. Short title.
1515 5 (a) This Act may be cited as the Tickborne Disease
1616 6 Prevention and Protection Act.
1717 7 (b) This Act may be referred to as the Gabby Galbo
1818 8 Tickborne Disease Prevention and Protection Law.
1919 9 Section 5. Legislative findings. The General Assembly
2020 10 finds that:
2121 11 (1) Tickborne diseases, including, but not limited to,
2222 12 Lyme disease, Spotted Fever Group Rickettsiosis,
2323 13 Ehrlichiosis, and anaplasmosis, afflict humans and other
2424 14 animals and are caused by infectious agents transmitted by
2525 15 tick bites.
2626 16 (2) In the past decade, tickborne diseases have been
2727 17 reported more frequently in Illinois.
2828 18 (3) Anyone participating in an outdoor activity,
2929 19 especially in an area with tall grasses, shrubs,
3030 20 low-hanging branches, or leaf mold, has a higher chance of
3131 21 contracting tick bites, but it is possible to encounter a
3232 22 tick bite anywhere.
3333 23 (4) Tick bites can occur throughout the year,

6969 2 (5) In 2018, the American Academy of Pediatrics'
7070 3 Committee on Infectious Diseases determined that a course
7171 4 of treatment with doxycycline is safe to prescribe to
7272 5 young children with any infection responsive to it,
7373 6 specifically including early tickborne diseases.
7474 7 Section 10. Definitions. As used in this Act:
7575 8 "Tickborne disease" means any disease carried or caused by
7676 9 a tick.
7777 10 "Department" means the Department of Public Health.
7878 11 Section 15. Tickborne disease; protocols and best
7979 12 practices.
8080 13 (a) The Department, in conjunction with the National
8181 14 Institutes of Health, the medical entomology lab of the
8282 15 Prairie Research Institute's Illinois Natural History Survey,
8383 16 and a statewide association representing physicians, shall
8484 17 develop mandatory protocols and best practices for
8585 18 identifying, diagnosing, and treating tickborne diseases in
8686 19 Illinois. The Department shall study the diseases carried by
8787 20 ticks in Illinois and the number of people infected by ticks in
8888 21 Illinois to provide data to the public on the incidence of
8989 22 tickborne disease and locations of exposure in Illinois, by
9090 23 county. The Department shall require local health departments,
9191 24 health care professionals, and laboratories to report to each

102102 1 other and the Department, within the period specified in the
103103 2 Control of Communicable Diseases Code for reporting to local
104104 3 health departments, each case of a tickborne disease in the
105105 4 local health department in whose jurisdiction the case is
106106 5 reported. The Department shall also train local health
107107 6 departments to respond to tickborne disease-related inquiries
108108 7 from the public.
109109 8 (b) To raise awareness about and promote the prevention of
110110 9 tickborne disease, the protocols and best practices developed
111111 10 by the Department under subsection (a):
112112 11 (1) shall be published on a designated and publicly
113113 12 accessible webpage, shall include up-to-date information
114114 13 about the prevention, detection, and treatment of all
115115 14 tickborne disease, and shall illustrate the prevalence of
116116 15 tickborne disease using historical mapping;
117117 16 (2) shall reference peer-reviewed scientific research
118118 17 articles;
119119 18 (3) shall incorporate guidance and recommendations
120120 19 from the federal Centers for Disease Control and
121121 20 Prevention, the Agency for Healthcare Research and
122122 21 Quality's National Guideline Clearinghouse, and any other
123123 22 persons or entities determined by the Department to have
124124 23 particular expertise in tickborne disease; and
125125 24 (4) shall be distributed to physicians, other health
126126 25 care professionals and providers, and persons subject to
127127 26 an increased risk of contracting tickborne disease.

138138 1 (c) The Department shall prepare a report of all efforts
139139 2 undertaken by the Department under this Act. The report shall
140140 3 be posted on the Department's website and distributed to local
141141 4 health departments and to any other facilities as determined
142142 5 by the Department.
143143 6 Section 20. Mandatory continuing medical education
144144 7 training; tickborne disease. The Department, in conjunction
145145 8 with the medical entomology lab of the Prairie Research
146146 9 Institute's Illinois Natural History Survey and a statewide
147147 10 association representing physicians, shall develop a mandatory
148148 11 accredited continuing medical education course that describes
149149 12 the protocols and best practices for identifying, diagnosing,
150150 13 and treating tickborne diseases in Illinois.
