1313 1 AN ACT concerning liquor.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Liquor Control Act of 1934 is amended by
1717 5 changing Sections 5-1, 5-3, and 6-29 as follows:

9090 17 No person, firm, partnership, corporation, or other legal
9191 18 business entity that is engaged in the manufacturing of wine
9292 19 may concurrently obtain and hold a wine-maker's license and a
9393 20 wine manufacturer's license.
9494 21 (a) A manufacturer's license shall allow the manufacture,
9595 22 importation in bulk, storage, distribution and sale of
9696 23 alcoholic liquor to persons without the State, as may be
9797 24 permitted by law and to licensees in this State as follows:
9898 25 Class 1. A Distiller may make sales and deliveries of
9999 26 alcoholic liquor to distillers, rectifiers, importing

110110 1 distributors, distributors and non-beverage users and to no
111111 2 other licensees.
112112 3 Class 2. A Rectifier, who is not a distiller, as defined
113113 4 herein, may make sales and deliveries of alcoholic liquor to
114114 5 rectifiers, importing distributors, distributors, retailers
115115 6 and non-beverage users and to no other licensees.
116116 7 Class 3. A Brewer may make sales and deliveries of beer to
117117 8 importing distributors and distributors and may make sales as
118118 9 authorized under subsection (e) of Section 6-4 of this Act,
119119 10 including any alcoholic liquor that subsection (e) of Section
120120 11 6-4 authorizes a brewer to sell in its original package only to
121121 12 a non-licensee for pick-up by a non-licensee either within the
122122 13 interior of the brewery premises or at outside of the brewery
123123 14 premises at a curb-side or parking lot adjacent to the brewery
124124 15 premises, subject to any local ordinance.
125125 16 Class 4. A first class wine-manufacturer may make sales
126126 17 and deliveries of up to 50,000 gallons of wine to
127127 18 manufacturers, importing distributors and distributors, and to
128128 19 no other licensees. If a first-class wine-manufacturer
129129 20 manufactures beer, it shall also obtain and shall only be
130130 21 eligible for, in addition to any current license, a class 1
131131 22 brewer license, shall not manufacture more than 930,000
132132 23 gallons of beer per year, and shall not be a member of or
133133 24 affiliated with, directly or indirectly, a manufacturer that
134134 25 produces more than 930,000 gallons of beer per year. If the

148148 3 manufacture more than 50,000 gallons of spirits per year, and
149149 4 shall not be a member of or affiliated with, directly or
150150 5 indirectly, a manufacturer that produces more than 50,000
151151 6 gallons of spirits per year. A first-class wine-manufacturer
152152 7 shall be permitted to sell wine manufactured at the
153153 8 first-class wine-manufacturer premises to non-licensees.
154154 9 Class 5. A second class Wine manufacturer may make sales
155155 10 and deliveries of more than 50,000 gallons of wine to
156156 11 manufacturers, importing distributors and distributors and to
157157 12 no other licensees.
158158 13 Class 6. A first-class wine-maker's license shall allow
159159 14 the manufacture of up to 50,000 gallons of wine per year, and
160160 15 the storage and sale of such wine to distributors in the State
161161 16 and to persons without the State, as may be permitted by law. A
162162 17 person who, prior to June 1, 2008 (the effective date of Public
163163 18 Act 95-634), is a holder of a first-class wine-maker's license
164164 19 and annually produces more than 25,000 gallons of its own wine
165165 20 and who distributes its wine to licensed retailers shall cease
166166 21 this practice on or before July 1, 2008 in compliance with
167167 22 Public Act 95-634. If a first-class wine-maker manufactures
168168 23 beer, it shall also obtain and shall only be eligible for, in
169169 24 addition to any current license, a class 1 brewer license,
170170 25 shall not manufacture more than 930,000 gallons of beer per

190190 9 first-class wine-maker holding a class 1 brewer license or a
191191 10 class 1 craft distiller license shall not be eligible for a
192192 11 wine-maker's premises license but shall be permitted to sell
193193 12 wine manufactured at the first-class wine-maker premises to
194194 13 non-licensees.
195195 14 Class 7. A second-class wine-maker's license shall allow
196196 15 the manufacture of up to 150,000 gallons of wine per year, and
197197 16 the storage and sale of such wine to distributors in this State
198198 17 and to persons without the State, as may be permitted by law. A
199199 18 person who, prior to June 1, 2008 (the effective date of Public
200200 19 Act 95-634), is a holder of a second-class wine-maker's
201201 20 license and annually produces more than 25,000 gallons of its
202202 21 own wine and who distributes its wine to licensed retailers
203203 22 shall cease this practice on or before July 1, 2008 in
204204 23 compliance with Public Act 95-634. If a second-class
205205 24 wine-maker manufactures beer, it shall also obtain and shall
206206 25 only be eligible for, in addition to any current license, a

218218 1 3,720,000 gallons of beer per year, and shall not be a member
219219 2 of or affiliated with, directly or indirectly, a manufacturer
220220 3 that produces more than 3,720,000 gallons of beer per year. If
221221 4 a second-class wine-maker manufactures spirits, it shall also
222222 5 obtain and shall only be eligible for, in addition to any
223223 6 current license, a class 2 craft distiller license, shall not
224224 7 manufacture more than 100,000 gallons of spirits per year, and
225225 8 shall not be a member of or affiliated with, directly or
226226 9 indirectly, a manufacturer that produces more than 100,000
227227 10 gallons of spirits per year.
228228 11 Class 8. A limited wine-manufacturer may make sales and
229229 12 deliveries not to exceed 40,000 gallons of wine per year to
230230 13 distributors, and to non-licensees in accordance with the
231231 14 provisions of this Act.
232232 15 Class 9. A craft distiller license, which may only be held
233233 16 by a class 1 craft distiller licensee or class 2 craft
234234 17 distiller licensee but not held by both a class 1 craft
235235 18 distiller licensee and a class 2 craft distiller licensee,
236236 19 shall grant all rights conveyed by either: (i) a class 1 craft
237237 20 distiller license if the craft distiller holds a class 1 craft
238238 21 distiller license; or (ii) a class 2 craft distiller licensee
239239 22 if the craft distiller holds a class 2 craft distiller
240240 23 license.
241241 24 Class 10. A class 1 craft distiller license, which may
242242 25 only be issued to a licensed craft distiller or licensed
243243 26 non-resident dealer, shall allow the manufacture of up to

268268 15 first-class wine-manufacturer license or a first-class
269269 16 wine-maker's license, shall not manufacture more than 50,000
270270 17 gallons of wine per year, and shall not be a member of or
271271 18 affiliated with, directly or indirectly, a manufacturer that
272272 19 produces more than 50,000 gallons of wine per year. A class 1
273273 20 craft distiller licensee may make sales and deliveries to
274274 21 importing distributors and distributors and to retail
275275 22 licensees in accordance with the conditions set forth in
276276 23 paragraph (19) of subsection (a) of Section 3-12 of this Act.
277277 24 However, the aggregate amount of spirits sold to non-licensees
278278 25 and sold or delivered to retail licensees may not exceed 5,000

290290 1 A class 1 craft distiller licensee may sell up to 5,000
291291 2 gallons of such spirits to non-licensees to the extent
292292 3 permitted by any exemption approved by the State Commission
293293 4 pursuant to Section 6-4 of this Act. A class 1 craft distiller
294294 5 license holder may store such spirits at a non-contiguous
295295 6 licensed location, but at no time shall a class 1 craft
296296 7 distiller license holder directly or indirectly produce in the
297297 8 aggregate more than 50,000 gallons of spirits per year.
298298 9 A class 1 craft distiller licensee may hold more than one
299299 10 class 1 craft distiller's license. However, a class 1 craft
300300 11 distiller that holds more than one class 1 craft distiller
301301 12 license shall not manufacture, in the aggregate, more than
302302 13 50,000 gallons of spirits by distillation per year and shall
303303 14 not sell, in the aggregate, more than 5,000 gallons of such
304304 15 spirits to non-licensees in accordance with an exemption
305305 16 approved by the State Commission pursuant to Section 6-4 of
306306 17 this Act.
307307 18 Class 11. A class 2 craft distiller license, which may
308308 19 only be issued to a licensed craft distiller or licensed
309309 20 non-resident dealer, shall allow the manufacture of up to
310310 21 100,000 gallons of spirits per year provided that the class 2
311311 22 craft distiller licensee does not manufacture more than a
312312 23 combined 100,000 gallons of spirits per year and is not a
313313 24 member of or affiliated with, directly or indirectly, a
314314 25 manufacturer that produces more than 100,000 gallons of

327327 2 addition to any current license, a class 2 brewer license,
328328 3 shall not manufacture more than 3,720,000 gallons of beer per
329329 4 year, and shall not be a member of or affiliated with, directly
330330 5 or indirectly, a manufacturer that produces more than
331331 6 3,720,000 gallons of beer per year. If a class 2 craft
332332 7 distiller manufactures wine, it shall also obtain and shall
333333 8 only be eligible for, in addition to any current license, a
334334 9 second-class wine-maker's license, shall not manufacture more
335335 10 than 150,000 gallons of wine per year, and shall not be a
336336 11 member of or affiliated with, directly or indirectly, a
337337 12 manufacturer that produces more than 150,000 gallons of wine
338338 13 per year. A class 2 craft distiller licensee may make sales and
339339 14 deliveries to importing distributors and distributors, but
340340 15 shall not make sales or deliveries to any other licensee. If
341341 16 the State Commission provides prior approval, a class 2 craft
342342 17 distiller licensee may annually transfer up to 100,000 gallons
343343 18 of spirits manufactured by that class 2 craft distiller
344344 19 licensee to the premises of a licensed class 2 craft distiller
345345 20 wholly owned and operated by the same licensee. A class 2 craft
346346 21 distiller may transfer spirits to a distilling pub wholly
347347 22 owned and operated by the class 2 craft distiller subject to
348348 23 the following limitations and restrictions: (i) the transfer
349349 24 shall not annually exceed more than 5,000 gallons; (ii) the
350350 25 annual amount transferred shall reduce the distilling pub's
351351 26 annual permitted production limit; (iii) all spirits

362362 1 transferred shall be subject to Article VIII of this Act; (iv)
363363 2 a written record shall be maintained by the distiller and
364364 3 distilling pub specifying the amount, date of delivery, and
365365 4 receipt of the product by the distilling pub; and (v) the
366366 5 distilling pub shall be located no farther than 80 miles from
367367 6 the class 2 craft distiller's licensed location.
368368 7 A class 2 craft distiller shall, prior to transferring
369369 8 spirits to a distilling pub wholly owned by the class 2 craft
370370 9 distiller, furnish a written notice to the State Commission of
371371 10 intent to transfer spirits setting forth the name and address
372372 11 of the distilling pub and shall annually submit to the State
373373 12 Commission a verified report identifying the total gallons of
374374 13 spirits transferred to the distilling pub wholly owned by the
375375 14 class 2 craft distiller.
376376 15 A class 2 craft distiller license holder may store such
377377 16 spirits at a non-contiguous licensed location, but at no time
378378 17 shall a class 2 craft distiller license holder directly or
379379 18 indirectly produce in the aggregate more than 100,000 gallons
380380 19 of spirits per year.
381381 20 Class 12. A class 1 brewer license, which may only be
382382 21 issued to a licensed brewer or licensed non-resident dealer,
383383 22 shall allow the manufacture of up to 930,000 gallons of beer
384384 23 per year provided that the class 1 brewer licensee does not
385385 24 manufacture more than a combined 930,000 gallons of beer per
386386 25 year and is not a member of or affiliated with, directly or
387387 26 indirectly, a manufacturer that produces more than 930,000

414414 17 accordance with the conditions set forth in paragraph (18) of
415415 18 subsection (a) of Section 3-12 of this Act. If the State
416416 19 Commission provides prior approval, a class 1 brewer may
417417 20 annually transfer up to 930,000 gallons of beer manufactured
418418 21 by that class 1 brewer to the premises of a licensed class 1
419419 22 brewer wholly owned and operated by the same licensee.
420420 23 Class 13. A class 2 brewer license, which may only be
421421 24 issued to a licensed brewer or licensed non-resident dealer,

447447 14 manufacture more than 150,000 gallons of wine per year, and
448448 15 shall not be a member of or affiliated with, directly or
449449 16 indirectly, a manufacturer that produces more than 150,000
450450 17 gallons of wine a year. A class 2 brewer licensee may make
451451 18 sales and deliveries to importing distributors and
452452 19 distributors, but shall not make sales or deliveries to any
453453 20 other licensee. If the State Commission provides prior
454454 21 approval, a class 2 brewer licensee may annually transfer up
455455 22 to 3,720,000 gallons of beer manufactured by that class 2
456456 23 brewer licensee to the premises of a licensed class 2 brewer
457457 24 wholly owned and operated by the same licensee.
458458 25 A class 2 brewer may transfer beer to a brew pub wholly

483483 14 annually submit to the State Commission a verified report
484484 15 identifying the total gallons of beer transferred to the brew
485485 16 pub wholly owned by the class 2 brewer.
486486 17 Class 14. A class 3 brewer license, which may be issued to
487487 18 a brewer or a non-resident dealer, shall allow the manufacture
488488 19 of no more than 465,000 gallons of beer per year and no more
489489 20 than 155,000 gallons at a single brewery premises, and shall
490490 21 allow the sale of no more than 6,200 gallons of beer from each
491491 22 in-state or out-of-state class 3 brewery premises, or 18,600
492492 23 gallons in the aggregate, to retail licensees, class 1
493493 24 brewers, class 2 brewers, and class 3 brewers as long as the
494494 25 class 3 brewer licensee does not manufacture more than a
495495 26 combined 465,000 gallons of beer per year and is not a member

517517 12 designated licensed premises, and may sell beer as otherwise
518518 13 provided in this Act.
519519 14 (a-1) A manufacturer which is licensed in this State to
520520 15 make sales or deliveries of alcoholic liquor to licensed
521521 16 distributors or importing distributors and which enlists
522522 17 agents, representatives, or individuals acting on its behalf
523523 18 who contact licensed retailers on a regular and continual
524524 19 basis in this State must register those agents,
525525 20 representatives, or persons acting on its behalf with the
526526 21 State Commission.
527527 22 Registration of agents, representatives, or persons acting
528528 23 on behalf of a manufacturer is fulfilled by submitting a form
529529 24 to the Commission. The form shall be developed by the
530530 25 Commission and shall include the name and address of the
531531 26 applicant, the name and address of the manufacturer he or she

548548 7 misdemeanor. Fraud, misrepresentation, false statements,

550550 9 facts in the securing of a registration are grounds for
551551 10 suspension or revocation of the registration. The State
552552 11 Commission shall post a list of registered agents on the
553553 12 Commission's website.
554554 13 (b) A distributor's license shall allow (i) the wholesale
555555 14 purchase and storage of alcoholic liquors and sale of
556556 15 alcoholic liquors to licensees in this State and to persons
557557 16 without the State, as may be permitted by law; (ii) the sale of
558558 17 beer, cider, mead, or any combination thereof to brewers,
559559 18 class 1 brewers, and class 2 brewers that, pursuant to
560560 19 subsection (e) of Section 6-4 of this Act, sell beer, cider,
561561 20 mead, or any combination thereof to non-licensees at their
562562 21 breweries; (iii) the sale of vermouth to class 1 craft
563563 22 distillers and class 2 craft distillers that, pursuant to
564564 23 subsection (e) of Section 6-4 of this Act, sell spirits,
565565 24 vermouth, or both spirits and vermouth to non-licensees at
566566 25 their distilleries; or (iv) as otherwise provided in this Act.

592592 15 manufacturers in the preparation and bottling of alcoholic
593593 16 liquors. The importing distributor's license shall permit such
594594 17 licensee to purchase alcoholic liquor from Illinois licensed
595595 18 non-resident dealers and foreign importers only. No person
596596 19 licensed as an importing distributor shall be granted a
597597 20 non-resident dealer's license.
598598 21 (d) A retailer's license shall allow the licensee to sell
599599 22 and offer for sale at retail, only in the premises specified in
600600 23 the license, alcoholic liquor for use or consumption, but not
601601 24 for resale in any form. Except as provided in Section 6-16,
602602 25 6-29, or 6-29.1, nothing in this Act shall deny, limit,

616616 3 ordinance. For the purposes of this Section, "shipping" means
617617 4 the movement of alcoholic liquor from a licensed retailer to a
618618 5 consumer via a common carrier. Except as provided in Section
619619 6 6-16, 6-29, or 6-29.1, nothing in this Act shall deny, limit,
620620 7 remove, or restrict the ability of a holder of a retailer's
621621 8 license to deliver alcoholic liquor to the purchaser for use
622622 9 or consumption. The delivery shall be made only within 12
623623 10 hours from the time the alcoholic liquor leaves the licensed
624624 11 premises of the retailer for delivery. For the purposes of
625625 12 this Section, "delivery" means the movement of alcoholic
626626 13 liquor purchased from a licensed retailer to a consumer
627627 14 through the following methods:
628628 15 (1) delivery within licensed retailer's parking lot,
629629 16 including curbside, for pickup by the consumer;
630630 17 (2) delivery by an owner, officer, director,
631631 18 shareholder, or employee of the licensed retailer; or
632632 19 (3) delivery by a third-party contractor, independent
633633 20 contractor, or agent with whom the licensed retailer has
634634 21 contracted to make deliveries of alcoholic liquors.
635635 22 Under subsection (1), (2), or (3), delivery shall not
636636 23 include the use of common carriers.
637637 24 Any retail license issued to a manufacturer shall only
638638 25 permit the manufacturer to sell beer at retail on the premises

656656 7 1,000,000 inhabitants, a home rule unit may not regulate the
657657 8 delivery of alcoholic liquor inconsistent with this
658658 9 subsection. This paragraph is a limitation under subsection
659659 10 (i) of Section 6 of Article VII of the Illinois Constitution on
660660 11 the concurrent exercise by home rule units of powers and
661661 12 functions exercised by the State.
662662 13 Notwithstanding any other provision of this subsection
663663 14 (d), a retail licensee may sell alcoholic liquors to a special
664664 15 event retailer licensee for resale to the extent permitted
665665 16 under subsection (e).
666666 17 (e) A special event retailer's license (not-for-profit)
667667 18 shall permit the licensee to purchase alcoholic liquors from
668668 19 an Illinois licensed distributor (unless the licensee
669669 20 purchases less than $500 of alcoholic liquors for the special
670670 21 event, in which case the licensee may purchase the alcoholic
671671 22 liquors from a licensed retailer) and shall allow the licensee
672672 23 to sell and offer for sale, at retail, alcoholic liquors for
673673 24 use or consumption, but not for resale in any form and only at
674674 25 the location and on the specific dates designated for the
675675 26 special event in the license. An applicant for a special event

700700 15 statement to that effect; (ii) submit with the application
701701 16 proof satisfactory to the State Commission that the applicant
702702 17 will provide dram shop liability insurance in the maximum
703703 18 limits; and (iii) show proof satisfactory to the State
704704 19 Commission that the applicant has obtained local authority
705705 20 approval.
706706 21 Nothing in this Act prohibits an Illinois licensed
707707 22 distributor from offering credit or a refund for unused,
708708 23 salable alcoholic liquors to a holder of a special event
709709 24 retailer's license or the special event retailer's licensee
710710 25 from accepting the credit or refund of alcoholic liquors at
711711 26 the conclusion of the event specified in the license.

732732 11 lounge or dining car operated on an electric, gas or steam
733733 12 railway in this State; and provided further, that railroad
734734 13 licensees exercising the above powers shall be subject to all
735735 14 provisions of Article VIII of this Act as applied to importing
736736 15 distributors. A railroad license shall also permit the
737737 16 licensee to sell or dispense alcoholic liquors on any club,
738738 17 buffet, lounge or dining car operated on an electric, gas or
739739 18 steam railway regularly operated by a common carrier in this
740740 19 State, but shall not permit the sale for resale of any
741741 20 alcoholic liquors to any licensee within this State. A license
742742 21 shall be obtained for each car in which such sales are made.
743743 22 (g) A boat license shall allow the sale of alcoholic
744744 23 liquor in individual drinks, on any passenger boat regularly
745745 24 operated as a common carrier on navigable waters in this State
746746 25 or on any riverboat operated under the Illinois Gambling Act,
747747 26 which boat or riverboat maintains a public dining room or

806806 13 Upon approval from the State Commission, a wine-maker's
807807 14 premises license shall allow the licensee to sell and offer
808808 15 for sale at (i) the wine-maker's licensed premises and (ii) at
809809 16 up to 2 additional locations for use and consumption and not
810810 17 for resale. Each location shall require additional licensing
811811 18 per location as specified in Section 5-3 of this Act. A
812812 19 wine-maker's premises licensee shall secure liquor liability
813813 20 insurance coverage in an amount at least equal to the maximum
814814 21 liability amounts set forth in subsection (a) of Section 6-21
815815 22 of this Act.
816816 23 (j) An airplane license shall permit the licensee to
817817 24 import alcoholic liquors into this State from any point in the
818818 25 United States outside this State and to store such alcoholic
819819 26 liquors in this State; to make wholesale purchases of

835835 6 of alcoholic liquors to be sold or dispensed on an airplane;
836836 7 and provided further, that airplane licensees exercising the
837837 8 above powers shall be subject to all provisions of Article
838838 9 VIII of this Act as applied to importing distributors. An
839839 10 airplane licensee shall also permit the sale or dispensing of
840840 11 alcoholic liquors on any passenger airplane regularly operated
841841 12 by a common carrier in this State, but shall not permit the
842842 13 sale for resale of any alcoholic liquors to any licensee
843843 14 within this State. A single airplane license shall be required
844844 15 of an airline company if liquor service is provided on board
845845 16 aircraft in this State. The annual fee for such license shall
846846 17 be as determined in Section 5-3.
847847 18 (k) A foreign importer's license shall permit such
848848 19 licensee to purchase alcoholic liquor from Illinois licensed
849849 20 non-resident dealers only, and to import alcoholic liquor
850850 21 other than in bulk from any point outside the United States and
851851 22 to sell such alcoholic liquor to Illinois licensed importing
852852 23 distributors and to no one else in Illinois; provided that (i)
853853 24 the foreign importer registers with the State Commission every
854854 25 brand of alcoholic liquor that it proposes to sell to Illinois
855855 26 licensees during the license period, (ii) the foreign importer

872872 7 (l) (i) A broker's license shall be required of all
873873 8 persons who solicit orders for, offer to sell or offer to
874874 9 supply alcoholic liquor to retailers in the State of Illinois,
875875 10 or who offer to retailers to ship or cause to be shipped or to
876876 11 make contact with distillers, craft distillers, rectifiers,
877877 12 brewers or manufacturers or any other party within or without
878878 13 the State of Illinois in order that alcoholic liquors be
879879 14 shipped to a distributor, importing distributor or foreign
880880 15 importer, whether such solicitation or offer is consummated
881881 16 within or without the State of Illinois.
882882 17 No holder of a retailer's license issued by the Illinois
883883 18 Liquor Control Commission shall purchase or receive any
884884 19 alcoholic liquor, the order for which was solicited or offered

903903 2 (ii) A broker's license shall be required of a person

907907 6 to be shipped from this State and delivered to residents
908908 7 outside of this State by an express company, common carrier,
909909 8 or contract carrier. This Section does not apply to any person

912912 11 A broker's license under this subsection (l) shall not
913913 12 entitle the holder to buy or sell any alcoholic liquors for his
914914 13 own account or to take or deliver title to such alcoholic
915915 14 liquors.
916916 15 This subsection (l) shall not apply to distributors,
917917 16 employees of distributors, or employees of a manufacturer who
918918 17 has registered the trademark, brand or name of the alcoholic
919919 18 liquor pursuant to Section 6-9 of this Act, and who regularly
920920 19 sells such alcoholic liquor in the State of Illinois only to
921921 20 its registrants thereunder.
922922 21 Any agent, representative, or person subject to
923923 22 registration pursuant to subsection (a-1) of this Section
924924 23 shall not be eligible to receive a broker's license.
925925 24 (m) A non-resident dealer's license shall permit such
926926 25 licensee to ship into and warehouse alcoholic liquor into this
927927 26 State from any point outside of this State, and to sell such

954954 17 (n) A brew pub license shall allow the licensee to only (i)
955955 18 manufacture up to 155,000 gallons of beer per year only on the
956956 19 premises specified in the license, (ii) make sales of the beer
957957 20 manufactured on the premises or, with the approval of the
958958 21 Commission, beer manufactured on another brew pub licensed
959959 22 premises that is wholly owned and operated by the same
960960 23 licensee to importing distributors, distributors, and to
961961 24 non-licensees for use and consumption, (iii) store the beer
962962 25 upon the premises, (iv) sell and offer for sale at retail from

990990 17 A person who holds a class 2 brewer license may
991991 18 simultaneously hold a brew pub license if the class 2 brewer
992992 19 (i) does not, under any circumstance, sell or offer for sale
993993 20 beer manufactured by the class 2 brewer to retail licensees;
994994 21 (ii) does not hold more than 3 brew pub licenses in this State;
995995 22 (iii) does not manufacture more than a combined 3,720,000
996996 23 gallons of beer per year, including the beer manufactured at
997997 24 the brew pub; and (iv) is not a member of or affiliated with,
998998 25 directly or indirectly, a manufacturer that produces more than

10241024 15 A brew pub licensee may apply for a class 3 brewer license
10251025 16 and, upon: (i) meeting all applicable qualifications of this
10261026 17 Act, and relinquishing all commonly owned brew pub or retail
10271027 18 licenses, shall be issued a class 3 brewer license. Nothing in
10281028 19 this Act shall prohibit the issuance of a class 3 brewer
10291029 20 license if the applicant:
10301030 21 (1) has a valid retail license on or before May 1,
10311031 22 2021;
10321032 23 (2) has an ownership interest in at least two brew
10331033 24 pubs licenses on or before May 1, 2021;
10341034 25 (3) the brew pub licensee applies for a class 3 brewer

10601060 15 licensed or unlicensed. A caterer retailer license shall allow
10611061 16 the holder, a distributor, or an importing distributor to
10621062 17 transfer any inventory to and from the holder's retail
10631063 18 premises and shall allow the holder to purchase alcoholic
10641064 19 liquor from a distributor or importing distributor to be
10651065 20 delivered directly to an off-site event.
10661066 21 Nothing in this Act prohibits a distributor or importing
10671067 22 distributor from offering credit or a refund for unused,
10681068 23 salable beer to a holder of a caterer retailer license or a
10691069 24 caterer retailer licensee from accepting a credit or refund
10701070 25 for unused, salable beer, in the event an act of God is the

11001100 19 payment from the caterer retailer licensee prior to the
11011101 20 distributor or importing distributor transferring inventory to
11021102 21 the caterer retailer premises.
11031103 22 For purposes of this subsection (o), an "act of God" means
11041104 23 an unforeseeable event, such as a rain or snow storm, hail, a
11051105 24 flood, or a similar event, that is the sole cause of the
11061106 25 cancellation of an off-site, outdoor event.

11381138 21 use permit license must also submit with the application proof

12071207 18 include an acknowledgement consenting to the jurisdiction of
12081208 19 the Commission, the Illinois Department of Revenue, and the
12091209 20 courts of this State concerning the enforcement of this Act
12101210 21 and any related laws, rules, and regulations, including
12111211 22 authorizing the Department of Revenue and the Commission to
12121212 23 conduct audits for the purpose of ensuring compliance with
12131213 24 Public Act 95-634, and an acknowledgement that the wine

12421242 17 is the agent of the winery shipper's license holder and, as
12431243 18 such, a winery shipper's license holder is responsible for the
12441244 19 acts and omissions of the third-party provider acting on
12451245 20 behalf of the license holder. A third-party provider, except
12461246 21 for a common carrier, that engages in shipping wine into
12471247 22 Illinois on behalf of a winery shipper's license holder shall
12481248 23 consent to the jurisdiction of the State Commission and the
12491249 24 State. Any third-party, except for a common carrier, holding
12501250 25 such an appointment shall, by February 1 of each calendar year

13101310 13 shipper licensee shall be taxed in the same manner as a
13111311 14 manufacturer of wine. A licensee who is not otherwise required
13121312 15 to register under the Retailers' Occupation Tax Act must
13131313 16 register under the Use Tax Act to collect and remit use tax to
13141314 17 the Department of Revenue for all gallons of wine that are sold
13151315 18 by the licensee and shipped to persons in this State. If a
13161316 19 licensee fails to remit the tax imposed under this Act in
13171317 20 accordance with the provisions of Article VIII of this Act,
13181318 21 the winery shipper's license shall be revoked in accordance
13191319 22 with the provisions of Article VII of this Act. If a licensee
13201320 23 fails to properly register and remit tax under the Use Tax Act

13391339 6 (r) must comply with the requirements of Section 6-29 of this

13411341 8 Pursuant to paragraph (5.1) or (5.3) of subsection (a) of
13421342 9 Section 3-12, the State Commission may receive, respond to,

13451345 12 As used in this subsection, "third-party provider" means
13461346 13 any entity that provides fulfillment house services, including
13471347 14 warehousing, packaging, distribution, order processing, or
13481348 15 shipment of wine, but not the sale of wine, on behalf of a
13491349 16 licensed winery shipper.
13501350 17 (s) A craft distiller tasting permit license shall allow
13511351 18 an Illinois licensed class 1 craft distiller or class 2 craft
13521352 19 distiller to transfer a portion of its alcoholic liquor
13531353 20 inventory from its class 1 craft distiller or class 2 craft
13541354 21 distiller licensed premises to the premises specified in the
13551355 22 license hereby created and to conduct a sampling, only in the
13561356 23 premises specified in the license hereby created, of the
13571357 24 transferred alcoholic liquor in accordance with subsection (c)
13581358 25 of Section 6-31 of this Act. The transferred alcoholic liquor

14861486 9 license must provide the State Commission with a true copy of
14871487 10 its current license in any state in which it is licensed as a
14881488 11 manufacturer of beer. An applicant for a brewer shipper's
14891489 12 license must also complete an application form that provides
14901490 13 any other information the State Commission deems necessary.
14911491 14 The application form shall include all addresses from which
14921492 15 the applicant for a brewer shipper's license intends to ship
14931493 16 beer, including the name and address of any third party,
14941494 17 except for a common carrier, authorized to ship beer on behalf
14951495 18 of the licensee. The application form shall include an
14961496 19 acknowledgment consenting to the jurisdiction of the State
14971497 20 Commission, the Department of Revenue, and the courts of this
14981498 21 State concerning the enforcement of this Act and any related
14991499 22 laws, rules, and regulations, including authorizing the
15001500 23 Department of Revenue and the State Commission to conduct
15011501 24 audits for the purpose of ensuring compliance, and an
15021502 25 acknowledgment that the brewer shipper's licensee is in

15301530 17 such, a brewer shipper's license holder is responsible for the
15311531 18 acts and omissions of the third-party provider acting on
15321532 19 behalf of the license holder. A third-party provider, except
15331533 20 for a common carrier, that engages in shipping beer into
15341534 21 Illinois on behalf of a brewer shipper's license holder shall

15611561 12 after the request is made. Any books, records, supporting
15621562 13 papers, and documents containing information and data relating
15631563 14 to a statement under this paragraph shall be kept and
15641564 15 preserved for a period of 3 years, unless their destruction
15651565 16 sooner is authorized, in writing, by the Director of Revenue,
15661566 17 and shall be open and available to inspection by the Director
15671567 18 of Revenue or the State Commission or any duly authorized
15681568 19 officer, agent, or employee of the State Commission or the
15691569 20 Department of Revenue, at all times during business hours of
15701570 21 the day. Any person who violates any provision of this
15711571 22 paragraph or any rule of the State Commission for the
15721572 23 administration and enforcement of the provisions of this
15731573 24 paragraph is guilty of a Class C misdemeanor. In case of a
15741574 25 continuing violation, each day's continuance thereof shall be

15901590 5 has been deemed by the State Commission to have violated the
15911591 6 provisions of this Act with regard to any brewer shipper's
15921592 7 licensee.
15931593 8 A brewer shipper's licensee must pay to the Department of
15941594 9 Revenue the State liquor gallonage tax under Section 8-1 for
15951595 10 all beer that is sold by the licensee and shipped to a person
15961596 11 in this State. For the purposes of Section 8-1, a brewer
15971597 12 shipper licensee shall be taxed in the same manner as a
15981598 13 manufacturer of beer. A licensee who is not otherwise required
15991599 14 to register under the Retailers' Occupation Tax Act must
16001600 15 register under the Use Tax Act to collect and remit use tax to
16011601 16 the Department of Revenue for all gallons of beer that are sold
16021602 17 by the licensee and shipped to persons in this State. If a
16031603 18 licensee fails to remit the tax imposed under this Act in
16041604 19 accordance with the provisions of Article VIII of this Act,
16051605 20 the brewer shipper's license shall be revoked in accordance
16061606 21 with the provisions of Article VII of this Act. If a licensee
16071607 22 fails to properly register and remit tax under the Use Tax Act
16081608 23 or the Retailers' Occupation Tax Act for all beer that is sold
16091609 24 by the brewer shipper and shipped to persons in this State, the
16101610 25 brewer shipper's license shall be revoked in accordance with
16111611 26 the provisions of Article VII of this Act.

19481948 1 permitted an in-state maker of wine or beer pursuant to

19521952 5 Supreme Court decision decided on May 16, 2005 in Granholm

19541954 7 (2) To reaffirm that the General Assembly's findings

19571957 10 newspapers, mailings, and the Internet directly to
19581958 11 consumers of this State poses a serious threat to the
19591959 12 State's efforts to further temperance and prevent youth
19601960 13 from accessing alcoholic liquor and the expansion of youth
19611961 14 access to additional types of alcoholic liquors.
19621962 15 (3) To maintain the State's broad powers granted by
19631963 16 Section 2 of the Twenty-First Amendment to the United
19641964 17 States Constitution to control the importation or sale of
19651965 18 alcoholic liquor and its right to structure its alcoholic
19661966 19 liquor distribution system.
19671967 20 (4) To ensure that the General Assembly, by
19681968 21 authorizing limited direct shipment of wine or beer to
19691969 22 meet the directives of the United States Supreme Court,
19701970 23 does not intend to impair or modify the State's
19711971 24 distribution of wine or beer through distributors or
19721972 25 importing distributors, but only to permit limited
19731973 26 shipment of wine or beer for personal use.

19841984 1 (5) To provide that, in the event that a court of
19851985 2 competent jurisdiction declares or finds that this
19861986 3 Section, which is enacted to conform Illinois law to the
19871987 4 United States Supreme Court decision, is invalid or
19881988 5 unconstitutional, the Illinois General Assembly at its
19891989 6 earliest general session shall conduct hearings and study
19901990 7 methods to conform to any directive or order of the court
19911991 8 consistent with the temperance and revenue collection
19921992 9 purposes of this Act.
19931993 10 (b) Notwithstanding any other provision of law, a wine
19941994 11 shipper licensee may ship, for personal use and not for
19951995 12 resale, not more than 12 cases of wine per year to any resident
19961996 13 of this State who is 21 years of age or older.
19971997 14 (b-2) Notwithstanding any other provision of law, a brewer
19981998 15 shipper's licensee may ship, for personal use and not for
19991999 16 resale, not more than 12 cases of beer per year to any resident
20002000 17 of this State who is 21 years of age or older.
20012001 18 (b-3) Notwithstanding any other provision of law, sale and
20022002 19 shipment by a winery shipper's or brewer shipper's shipper
20032003 20 licensee pursuant to this Section shall be deemed to
20042004 21 constitute a sale in this State.
20052005 22 (b-5) The shipping container of any wine or beer shipped
20062006 23 under this Section shall be clearly labeled with the following
20072007 24 words: "CONTAINS ALCOHOL. SIGNATURE OF A PERSON 21 YEARS OF
20082008 25 AGE OR OLDER REQUIRED FOR DELIVERY. PROOF OF AGE AND IDENTITY
20092009 26 MUST BE SHOWN BEFORE DELIVERY.". This warning must be

20202020 1 prominently displayed on the packaging. A licensee shall
20212021 2 require the transporter or common carrier that delivers the
20222022 3 wine or beer to obtain the signature of a person 21 years of
20232023 4 age or older at the delivery address at the time of delivery.
20242024 5 At the expense of the licensee, the licensee shall receive a
20252025 6 delivery confirmation from the express company, common
20262026 7 carrier, or contract carrier indicating the location of the
20272027 8 delivery, time of delivery, and the name and signature of the
20282028 9 individual 21 years of age or older who accepts delivery. The
20292029 10 Commission shall design and create a label or approve a label
20302030 11 that must be affixed to the shipping container by the
20312031 12 licensee.
20322032 13 (c) No broker within this State shall solicit consumers to
20332033 14 engage in direct wine or beer shipments under this Section.
20342034 15 (d) It is not the intent of this Section to impair the
20352035 16 distribution of wine or beer through distributors or importing
20362036 17 distributors, but only to permit shipments of wine or beer for
20372037 18 personal use.
