Provides that on July 1, 2024, the State Superintendent of Education shall convene a Performance Evaluation Advisory Committee for the purpose of maintaining and improving the State evaluator training and pre-qualification program in this State. Provides that the Committee shall be staffed by the State Board of Education. Sets forth the membership of the Committee. Provides that members of the Committee shall be nominated by program providers and appointed by the State Superintendent. Provides that the Committee shall meet initially at the call of the State Superintendent and shall select one member as chairperson at its initial meeting. Provides that the Committee shall meet at least quarterly and may also meet at the call of the chairperson of the Committee. Provides that the Committee shall advise the State Board of Education on the continued implementation of the evaluator training and pre-qualification program in this State, which may include the development and delivery of the program's existing and new administrators' academies, gathering feedback from program instructors and participants, sharing best practices, consulting with the State Board on any proposed rule changes regarding evaluator training, and other subjects as determined by the chairperson of the Committee. 1111 1 AN ACT concerning education.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The School Code is amended by changing Section
1515 5 24A-7 as follows:
1616 6 (105 ILCS 5/24A-7) (from Ch. 122, par. 24A-7)
1717 7 Sec. 24A-7. Rules.
1818 8 (a) The State Board of Education is authorized to adopt
1919 9 such rules as are deemed necessary to implement and accomplish
2020 10 the purposes and provisions of this Article, including, but
2121 11 not limited to, rules:
2222 12 (1) relating to the methods for measuring student
2323 13 growth (including, but not limited to, limitations on the
2424 14 age of usable data; the amount of data needed to reliably
2525 15 and validly measure growth for the purpose of teacher and
2626 16 principal evaluations; and whether and at what time annual
2727 17 State assessments may be used as one of multiple measures
2828 18 of student growth);
2929 19 (2) defining the term "significant factor" for
3030 20 purposes of including consideration of student growth in
3131 21 performance ratings;
3232 22 (3) controlling for such factors as student
3333 23 characteristics (including, but not limited to, students

6969 2 student attendance, and student mobility so as to best
7070 3 measure the impact that a teacher, principal, school and
7171 4 school district has on students' academic achievement;
7272 5 (4) establishing minimum requirements for district
7373 6 teacher and principal evaluation instruments and
7474 7 procedures; and
7575 8 (5) establishing a model evaluation plan for use by
7676 9 school districts in which student growth shall comprise
7777 10 50% of the performance rating.
7878 11 Notwithstanding any other provision in this Section, such
7979 12 rules shall not preclude a school district having 500,000 or
8080 13 more inhabitants from using an annual State assessment as the
8181 14 sole measure of student growth for purposes of teacher or
8282 15 principal evaluations.
8383 16 (b) The State Superintendent of Education shall convene a
8484 17 Performance Evaluation Advisory Council, which shall be
8585 18 staffed by the State Board of Education. Members of the
8686 19 Council shall be selected by the State Superintendent and
8787 20 include, without limitation, representatives of teacher unions
8888 21 and school district management, persons with expertise in
8989 22 performance evaluation processes and systems, as well as other
9090 23 stakeholders. The Council shall meet at least quarterly and
9191 24 may also meet at the call of the chairperson of the Council,
9292 25 following August 18, 2017 (the effective date of Public Act
9393 26 100-211) until June 30, 2024. The Council shall advise the

105105 2 performance evaluations in this State, which may include
106106 3 gathering public feedback, sharing best practices, consulting
107107 4 with the State Board on any proposed rule changes regarding
108108 5 evaluations, and other subjects as determined by the
109109 6 chairperson of the Council.
110110 7 (c) On July 1, 2024, the State Superintendent of Education
111111 8 shall convene a Performance Evaluation Advisory Committee for
112112 9 the purpose of maintaining and improving the evaluator
113113 10 training and pre-qualification program in this State under
114114 11 Section 24A-3. The Committee shall be staffed by the State
115115 12 Board of Education. Members of the Committee shall include,
116116 13 without limitation, representatives from providers of the
117117 14 evaluator retraining and pre-qualification program in this
118118 15 State, which include teacher unions, school district
119119 16 management, including a school district organized under
120120 17 Article 34, and a statewide organization representing regional
121121 18 offices of education. Members of the Committee shall be
122122 19 nominated by the providers and appointed by the State
123123 20 Superintendent.
124124 21 The Committee shall meet initially at the call of the
125125 22 State Superintendent and shall select one member as
126126 23 chairperson at its initial meeting. The Committee shall meet
127127 24 at least quarterly and may also meet at the call of the
128128 25 chairperson of the Committee.

148148 9 (d) Prior to the applicable implementation date, the these
149149 10 rules shall not apply to teachers assigned to schools
150150 11 identified in an agreement entered into between the board of a
151151 12 school district operating under Article 34 of this Code and
152152 13 the exclusive representative of the district's teachers in
153153 14 accordance with Section 34-85c of this Code.
