12	12	1 AN ACT concerning education.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The School Code is amended by changing Sections
16	16	5 21B-20 and 21B-40 as follows:

19	19	8 Sec. 21B-20. Types of licenses. The State Board of
20	20	9 Education shall implement a system of educator licensure,
21	21	10 whereby individuals employed in school districts who are
22	22	11 required to be licensed must have one of the following
23	23	12 licenses: (i) a professional educator license; (ii) an
24	24	13 educator license with stipulations; (iii) a substitute
25	25	14 teaching license; or (iv) until June 30, 2028, a short-term
26	26	15 substitute teaching license. References in law regarding
27	27	16 individuals certified or certificated or required to be
28	28	17 certified or certificated under Article 21 of this Code shall
29	29	18 also include individuals licensed or required to be licensed
30	30	19 under this Article. The first year of all licenses ends on June
31	31	20 30 following one full year of the license being issued.
32	32	21 The State Board of Education, in consultation with the
33	33	22 State Educator Preparation and Licensure Board, may adopt such
34	34	23 rules as may be necessary to govern the requirements for

72	72	2 (1) Professional Educator License. Persons who (i)
73	73	3 have successfully completed an approved educator
74	74	4 preparation program and are recommended for licensure by
75	75	5 the Illinois institution offering the educator preparation
76	76	6 program, (ii) have successfully completed the required
77	77	7 testing under Section 21B-30 of this Code, (iii) have
78	78	8 successfully completed coursework on the psychology of,
79	79	9 the identification of, and the methods of instruction for
80	80	10 the exceptional child, including, without limitation,
81	81	11 children with learning disabilities, (iv) have
82	82	12 successfully completed coursework in methods of reading
83	83	13 and reading in the content area, and (v) have met all other
84	84	14 criteria established by rule of the State Board of
85	85	15 Education shall be issued a Professional Educator License.
86	86	16 All Professional Educator Licenses are valid until June 30
87	87	17 immediately following 5 years of the license being issued.
88	88	18 The Professional Educator License shall be endorsed with
89	89	19 specific areas and grade levels in which the individual is
90	90	20 eligible to practice. For an early childhood education
91	91	21 endorsement, an individual may satisfy the student
92	92	22 teaching requirement of his or her early childhood teacher
93	93	23 preparation program through placement in a setting with
94	94	24 children from birth through grade 2, and the individual
95	95	25 may be paid and receive credit while student teaching. The
96	96	26 student teaching experience must meet the requirements of

108	108	2 teacher preparation program.
109	109	3 Individuals can receive subsequent endorsements on the
110	110	4 Professional Educator License. Subsequent endorsements
111	111	5 shall require a minimum of 24 semester hours of coursework
112	112	6 in the endorsement area and passage of the applicable
113	113	7 content area test, unless otherwise specified by rule.
114	114	8 (2) Educator License with Stipulations. An Educator
115	115	9 License with Stipulations shall be issued an endorsement
116	116	10 that limits the license holder to one particular position
117	117	11 or does not require completion of an approved educator
118	118	12 program or both.
119	119	13 An individual with an Educator License with
120	120	14 Stipulations must not be employed by a school district or
121	121	15 any other entity to replace any presently employed teacher
122	122	16 who otherwise would not be replaced for any reason.
123	123	17 An Educator License with Stipulations may be issued
124	124	18 with the following endorsements:
125	125	19 (A) (Blank).
126	126	20 (B) Alternative provisional educator. An
127	127	21 alternative provisional educator endorsement on an
128	128	22 Educator License with Stipulations may be issued to an
129	129	23 applicant who, at the time of applying for the
130	130	24 endorsement, has done all of the following:
131	131	25 (i) Graduated from a regionally accredited

144	144	2 (ii) Successfully completed the first phase of
145	145	3 the Alternative Educator Licensure Program for
146	146	4 Teachers, as described in Section 21B-50 of this
147	147	5 Code.
148	148	6 (iii) Passed a content area test, as required
149	149	7 under Section 21B-30 of this Code.
150	150	8 The alternative provisional educator endorsement is
151	151	9 valid for 2 years of teaching and may be renewed for a
152	152	10 third year by an individual meeting the requirements set
153	153	11 forth in Section 21B-50 of this Code.
154	154	12 (C) Alternative provisional superintendent. An
155	155	13 alternative provisional superintendent endorsement on
156	156	14 an Educator License with Stipulations entitles the
157	157	15 holder to serve only as a superintendent or assistant
158	158	16 superintendent in a school district's central office.
159	159	17 This endorsement may only be issued to an applicant
160	160	18 who, at the time of applying for the endorsement, has
161	161	19 done all of the following:
162	162	20 (i) Graduated from a regionally accredited
163	163	21 college or university with a minimum of a master's
164	164	22 degree in a management field other than education.
165	165	23 (ii) Been employed for a period of at least 5
166	166	24 years in a management level position in a field
167	167	25 other than education.
168	168	26 (iii) Successfully completed the first phase

184	184	6 The endorsement is valid for 2 fiscal years in
185	185	7 order to complete one full year of serving as a
186	186	8 superintendent or assistant superintendent.
187	187	9 (D) (Blank).
188	188	10 (E) Career and technical educator. A career and
189	189	11 technical educator endorsement on an Educator License
190	190	12 with Stipulations may be issued to an applicant who
191	191	13 has a minimum of 60 semester hours of coursework from a
192	192	14 regionally accredited institution of higher education
193	193	15 or an accredited trade and technical institution and
194	194	16 has a minimum of 2,000 hours of experience outside of
195	195	17 education in each area to be taught.
196	196	18 The career and technical educator endorsement on
197	197	19 an Educator License with Stipulations is valid until
198	198	20 June 30 immediately following 5 years of the
199	199	21 endorsement being issued and may be renewed.
200	200	22 An individual who holds a valid career and
201	201	23 technical educator endorsement on an Educator License
202	202	24 with Stipulations but does not hold a bachelor's
203	203	25 degree may substitute teach in career and technical

216	216	2 (G) Transitional bilingual educator. A
217	217	3 transitional bilingual educator endorsement on an
218	218	4 Educator License with Stipulations may be issued for
219	219	5 the purpose of providing instruction in accordance
220	220	6 with Article 14C of this Code to an applicant who
221	221	7 provides satisfactory evidence that he or she meets
222	222	8 all of the following requirements:
223	223	9 (i) Possesses adequate speaking, reading, and
224	224	10 writing ability in the language other than English
225	225	11 in which transitional bilingual education is
226	226	12 offered.
227	227	13 (ii) Has the ability to successfully
228	228	14 communicate in English.
229	229	15 (iii) Either possessed, within 5 years
230	230	16 previous to his or her applying for a transitional
231	231	17 bilingual educator endorsement, a valid and
232	232	18 comparable teaching certificate or comparable
233	233	19 authorization issued by a foreign country or holds
234	234	20 a degree from an institution of higher learning in
235	235	21 a foreign country that the State Educator
236	236	22 Preparation and Licensure Board determines to be
237	237	23 the equivalent of a bachelor's degree from a
238	238	24 regionally accredited institution of higher
239	239	25 learning in the United States.
240	240	26 A transitional bilingual educator endorsement

252	252	2 is valid until June 30 immediately following 5 years
253	253	3 of the endorsement being issued, and shall not be
254	254	4 renewed.
255	255	5 Persons holding a transitional bilingual educator
256	256	6 endorsement shall not be employed to replace any
257	257	7 presently employed teacher who otherwise would not be
258	258	8 replaced for any reason.
259	259	9 (H) Language endorsement. In an effort to
260	260	10 alleviate the shortage of teachers speaking a language
261	261	11 other than English in the public schools, an
262	262	12 individual who holds an Educator License with
263	263	13 Stipulations may also apply for a language
264	264	14 endorsement, provided that the applicant provides
265	265	15 satisfactory evidence that he or she meets all of the
266	266	16 following requirements:
267	267	17 (i) Holds a transitional bilingual
268	268	18 endorsement.
269	269	19 (ii) Has demonstrated proficiency in the
270	270	20 language for which the endorsement is to be issued
271	271	21 by passing the applicable language content test
272	272	22 required by the State Board of Education.
273	273	23 (iii) Holds a bachelor's degree or higher from
274	274	24 a regionally accredited institution of higher
275	275	25 education or, for individuals educated in a
276	276	26 country other than the United States, holds a

294	294	8 A language endorsement on an Educator License with
295	295	9 Stipulations is valid for prekindergarten through
296	296	10 grade 12 for the same validity period as the
297	297	11 individual's transitional bilingual educator
298	298	12 endorsement on the Educator License with Stipulations
299	299	13 and shall not be renewed.
300	300	14 (I) Visiting international educator. A visiting
301	301	15 international educator endorsement on an Educator
302	302	16 License with Stipulations may be issued to an
303	303	17 individual who is being recruited by a particular
304	304	18 school district that conducts formal recruitment
305	305	19 programs outside of the United States to secure the
306	306	20 services of qualified teachers and who meets all of
307	307	21 the following requirements:
308	308	22 (i) Holds the equivalent of a minimum of a
309	309	23 bachelor's degree issued in the United States.
310	310	24 (ii) Has been prepared as a teacher at the
311	311	25 grade level for which he or she will be employed.
312	312	26 (iii) Has adequate content knowledge in the

338	338	16 years and shall not be renewed.
339	339	17 (J) Paraprofessional educator. A paraprofessional
340	340	18 educator endorsement on an Educator License with
341	341	19 Stipulations may be issued to an applicant who holds a
342	342	20 high school diploma or its recognized equivalent and
343	343	21 (i) holds an associate's degree or a minimum of 60
344	344	22 semester hours of credit from a regionally accredited
345	345	23 institution of higher education; (ii) has passed a
346	346	24 paraprofessional competency test under subsection
347	347	25 (c-5) of Section 21B-30; or (iii) is at least 18 years
348	348	26 of age and will be using the Educator License with

359	359	1 Stipulations exclusively for grades prekindergarten
360	360	2 through grade 8, until the individual reaches the age
361	361	3 of 19 years and otherwise meets the criteria for a
362	362	4 paraprofessional educator endorsement pursuant to this
363	363	5 subparagraph (J). The paraprofessional educator
364	364	6 endorsement is valid until June 30 immediately
365	365	7 following 5 years of the endorsement being issued and
366	366	8 may be renewed through application and payment of the
367	367	9 appropriate fee, as required under Section 21B-40 of
368	368	10 this Code. An individual who holds only a
369	369	11 paraprofessional educator endorsement is not subject
370	370	12 to additional requirements in order to renew the
371	371	13 endorsement.
372	372	14 (K) Chief school business official. A chief school
373	373	15 business official endorsement on an Educator License
374	374	16 with Stipulations may be issued to an applicant who
375	375	17 qualifies by having a master's degree or higher, 2
376	376	18 years of full-time administrative experience in school
377	377	19 business management or 2 years of university-approved
378	378	20 practical experience, and a minimum of 24 semester
379	379	21 hours of graduate credit in a program approved by the
380	380	22 State Board of Education for the preparation of school
381	381	23 business administrators and by passage of the
382	382	24 applicable State tests, including an applicable
383	383	25 content area test.

408	408	14 June 30 immediately following 5 years of the
409	409	15 endorsement being issued and may be renewed if the
410	410	16 license holder completes renewal requirements as
411	411	17 required for individuals who hold a Professional
412	412	18 Educator License endorsed for chief school business
413	413	19 official under Section 21B-45 of this Code and such
414	414	20 rules as may be adopted by the State Board of
415	415	21 Education.
416	416	22 The State Board of Education shall adopt any rules
417	417	23 necessary to implement Public Act 100-288.
418	418	24 (L) Provisional in-state educator. A provisional
419	419	25 in-state educator endorsement on an Educator License
420	420	26 with Stipulations may be issued to a candidate who has

436	436	6 (i) Holds at least a bachelor's degree.
437	437	7 (ii) Has completed an approved educator
438	438	8 preparation program at an Illinois institution.
439	439	9 (iii) Has passed an applicable content area
440	440	10 test, as required by Section 21B-30 of this Code.
441	441	11 (iv) Has attempted an evidence-based
442	442	12 assessment of teacher effectiveness and received a
443	443	13 minimum score on that assessment, as established
444	444	14 by the State Board of Education in consultation
445	445	15 with the State Educator Preparation and Licensure
446	446	16 Board.
447	447	17 A provisional in-state educator endorsement on an
448	448	18 Educator License with Stipulations is valid for one
449	449	19 full fiscal year after the date of issuance and may not
450	450	20 be renewed.
451	451	21 (M) (Blank).
452	452	22 (N) Specialized services. A specialized services
453	453	23 endorsement on an Educator License with Stipulations
454	454	24 may be issued as defined and specified by rule.
455	455	25 (3) Substitute Teaching License. A Substitute Teaching
456	456	26 License may be issued to qualified applicants for

1043	1043	2 board. If, however, there is no licensed teacher under
1044	1044	3 contract because of an emergency situation, then a
1045	1045	4 district may employ a substitute teacher for no longer
1046	1046	5 than 30 calendar days per each vacant position in the
1047	1047	6 district if the district notifies the appropriate regional
1048	1048	7 office of education within 5 business days after the
1049	1049	8 employment of the substitute teacher in that vacant
1050	1050	9 position. A district may continue to employ that same
1051	1051	10 substitute teacher in that same vacant position for 90
1052	1052	11 calendar days or until the end of the semester, whichever
1053	1053	12 is greater, if, prior to the expiration of the
1054	1054	13 30-calendar-day period then current, the district files a
1055	1055	14 written request with the appropriate regional office of
1056	1056	15 education for a 30-calendar-day extension on the basis
1057	1057	16 that the position remains vacant and the district
1058	1058	17 continues to actively seek qualified candidates and
1059	1059	18 provides documentation that it has provided training
1060	1060	19 specific to the position, including training on meeting
1061	1061	20 the needs of students with disabilities and English
1062	1062	21 learners if applicable. Each extension request shall be
1063	1063	22 granted in writing by the regional office of education. An
1064	1064	23 emergency situation is one in which an unforeseen vacancy
1065	1065	24 has occurred and (i) a teacher is unexpectedly unable to
1066	1066	25 fulfill his or her contractual duties or (ii) teacher
1067	1067	26 capacity needs of the district exceed previous indications

1079	1079	2 candidates, and the district is actively engaged in
1080	1080	3 advertising to hire a fully licensed teacher for the

1082	1082	5 There is no limit on the number of days that a
1083	1083	6 substitute teacher may teach in a single school district,
1084	1084	7 provided that no substitute teacher may teach for longer
1085	1085	8 than 120 days beginning with the 2021-2022 school year
1086	1086	9 through the 2022-2023 school year, otherwise 90 school
1087	1087	10 days for any one licensed teacher under contract in the
1088	1088	11 same school year. A substitute teacher who holds a
1089	1089	12 Professional Educator License or Educator License with
1090	1090	13 Stipulations shall not teach for more than 120 school days
1091	1091	14 for any one licensed teacher under contract in the same
1092	1092	15 school year. The limitations in this paragraph (3) on the
1093	1093	16 number of days a substitute teacher may be employed do not
1094	1094	17 apply to any school district operating under Article 34 of
1095	1095	18 this Code.
1096	1096	19 A school district may not require an individual who
1097	1097	20 holds a valid Professional Educator License or Educator
1098	1098	21 License with Stipulations to seek or hold a Substitute
1099	1099	22 Teaching License to teach as a substitute teacher. A
1100	1100	23 school district may not require an individual who retired
1101	1101	24 within the last 5 years while holding a valid Professional

1191	1191	7 retirement. If the application for a Substitute Teaching
1192	1192	8 License is made and granted after July 1, 2017, the
1193	1193	9 licensee may apply for a refund of the application fee
1194	1194	10 within 18 months of issuance of the new license and shall
1195	1195	11 be issued that refund by the State Board of Education if
1196	1196	12 the licensee provides evidence to the State Board of
1197	1197	13 Education that the licensee has taught pursuant to the
1198	1198	14 Substitute Teaching License at least 10 full school days
1199	1199	15 within one year of issuance.
1200	1200	16 (1.7) A $25 application fee for a Short-Term
1201	1201	17 Substitute Teaching License. The Short-Term Substitute
1202	1202	18 Teaching License must be registered in at least one region
1203	1203	19 in this State, but does not require a registration fee.
1204	1204	20 The licensee may apply for a refund of the application fee
1205	1205	21 within 18 months of issuance of the new license and shall
1206	1206	22 be issued that refund by the State Board of Education if
1207	1207	23 the licensee provides evidence to the State Board of

1221	1221	1 fee for a Short-Term Substitute Teaching License shall be
1222	1222	2 waived when the Governor has declared a disaster due to a
1223	1223	3 public health emergency pursuant to Section 7 of the
1224	1224	4 Illinois Emergency Management Agency Act.
1225	1225	5 (2) A $150 application fee for individuals who have
1226	1226	6 not been entitled by an Illinois-approved educator
1227	1227	7 preparation program at an Illinois institution of higher
1228	1228	8 education and are seeking any of the licenses set forth in
1229	1229	9 subdivision (1) of this subsection (a).
1230	1230	10 (3) A $50 application fee for each endorsement or
1231	1231	11 approval.
1232	1232	12 (4) A $10 per year registration fee for the course of
1233	1233	13 the validity cycle to register the license, which shall be
1234	1234	14 paid to the regional office of education having
1235	1235	15 supervision and control over the school in which the
1236	1236	16 individual holding the license is to be employed. If the
1237	1237	17 individual holding the license is not yet employed, then
1238	1238	18 the license may be registered in any county in this State.
1239	1239	19 The registration fee must be paid in its entirety the
1240	1240	20 first time the individual registers the license for a
1241	1241	21 particular validity period in a single region. No
1242	1242	22 additional fee may be charged for that validity period
1243	1243	23 should the individual subsequently register the license in
1244	1244	24 additional regions. An individual must register the
1245	1245	25 license (i) immediately after initial issuance of the
1246	1246	26 license and (ii) at the beginning of each renewal cycle if

1261	1261	5 License may apply for a reimbursement of the registration
1262	1262	6 fee within 18 months of renewal and shall be issued that
1263	1263	7 reimbursement by the State Board of Education from funds
1264	1264	8 appropriated for that purpose if the licensee provides
1265	1265	9 evidence to the State Board of Education that the licensee
1266	1266	10 has taught pursuant to the Substitute Teaching License at
1267	1267	11 least 10 full school days within one year of renewal.
1268	1268	12 (5) The license renewal fee for an Educator License
1269	1269	13 with Stipulations with a paraprofessional educator
1270	1270	14 endorsement is $25.
1271	1271	15 (b) All application fees paid pursuant to subdivisions (1)
1272	1272	16 through (3) of subsection (a) of this Section shall be
1273	1273	17 deposited into the Teacher Certificate Fee Revolving Fund and
1274	1274	18 shall be used, subject to appropriation, by the State Board of
1275	1275	19 Education to provide the technology and human resources
1276	1276	20 necessary for the timely and efficient processing of
1277	1277	21 applications and for the renewal of licenses. Funds available
1278	1278	22 from the Teacher Certificate Fee Revolving Fund may also be
1279	1279	23 used by the State Board of Education to support the
1280	1280	24 recruitment and retention of educators, to support educator
1281	1281	25 preparation programs as they seek national accreditation, and
1282	1282	26 to provide professional development aligned with the

1294	1294	2 majority of the funds in the Teacher Certificate Fee Revolving
1295	1295	3 Fund must be dedicated to the timely and efficient processing
1296	1296	4 of applications and for the renewal of licenses. The Teacher
1297	1297	5 Certificate Fee Revolving Fund is not subject to
1298	1298	6 administrative charge transfers, authorized under Section 8h
1299	1299	7 of the State Finance Act, from the Teacher Certificate Fee
1300	1300	8 Revolving Fund into any other fund of this State, and moneys in
1301	1301	9 the Teacher Certificate Fee Revolving Fund shall not revert
1302	1302	10 back to the General Revenue Fund at any time.
1303	1303	11 The regional superintendent of schools shall deposit the
1304	1304	12 registration fees paid pursuant to subdivision (4) of
1305	1305	13 subsection (a) of this Section into the institute fund
1306	1306	14 established pursuant to Section 3-11 of this Code.
1307	1307	15 (c) The State Board of Education and each regional office
1308	1308	16 of education are authorized to charge a service or convenience
1309	1309	17 fee for the use of credit cards for the payment of license
1310	1310	18 fees. This service or convenience fee shall not exceed the
1311	1311	19 amount required by the credit card processing company or
1312	1312	20 vendor that has entered into a contract with the State Board or
1313	1313	21 regional office of education for this purpose, and the fee
1314	1314	22 must be paid to that company or vendor.
1315	1315	23 (d) If, at the time a certificate issued under Article 21
1316	1316	24 of this Code is exchanged for a license issued under this
1317	1317	25 Article, a person has paid registration fees for any years of
1318	1318	26 the validity period of the certificate and these years have
