1212 1 AN ACT concerning State government.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 1. Short title. This Act may be cited as the
1616 5 Department of Government Efficiency Act.
1717 6 Section 5. Findings and purpose. The General Assembly
1818 7 finds that:
1919 8 (1) The government of the State of Illinois lacks
2020 9 efficiency, which costs taxpayers money.
2121 10 (2) The government of the State of Illinois has
2222 11 enacted at least some unnecessary or redundant laws, which
2323 12 make conducting business in this State more difficult than
2424 13 necessary.
2525 14 (3) The government of the State of Illinois has
2626 15 adopted at least some unnecessary or redundant
2727 16 administrative rules, which make conducting business in
2828 17 this State more difficult than necessary.
2929 18 (4) The government of the State of Illinois contains
3030 19 at least some parts of State agencies that are unnecessary
3131 20 or redundant, which costs taxpayers money.
3232 21 Therefore, the General Assembly directs the establishment
3333 22 of a Department of Government Efficiency to provide advice to
3434 23 policymakers to help save taxpayers in this State money and to

7272 2 Section 10. Definitions. In this Act, unless the context
7373 3 requires otherwise:
7474 4 "Board of Directors" or "Board" means the Board of
7575 5 Directors of the Department of Government Efficiency
7676 6 established under this Act.
7777 7 "Chairperson" means the Chairperson of the Board of
7878 8 Directors of the Department of Government Efficiency
7979 9 established under this Act.
8080 10 "Confidential information" means information that may not
8181 11 be publicly disclosed by State or federal law, rule, or
8282 12 regulation.
8383 13 "Department" means the Department of Government Efficiency
8484 14 established in the Office of the Auditor General under this
8585 15 Act.
8686 16 "Director" means a director on the Board of Directors of
8787 17 the Department of Government Efficiency established under this
8888 18 Act.
8989 19 "Member" means a member of the Department of Government
9090 20 Efficiency established under this Act, as appointed by the
9191 21 Board of Directors under Section 25 of this Act.
9292 22 "State agency" means:
9393 23 (1) each officer, board, commission, and agency
9494 24 created by the Constitution in the executive branch of

106106 1 (2) each officer, department, board, commission,
107107 2 agency, institution, authority, university, and body
108108 3 politic and corporate in the executive branch of State
109109 4 government;
110110 5 (3) each administrative unit or corporate outgrowth in
111111 6 the executive branch of State government that is created
112112 7 by or pursuant to statute;
113113 8 (4) each administrative unit or corporate outgrowth of
114114 9 an entity described in paragraph (1), (2), or (3); and
115115 10 (5) each administrative unit or corporate outgrowth as
116116 11 may be created by executive order of the Governor.
117117 12 "State agency head" means the director of a State agency
118118 13 or the individual or group of individuals in whom the ultimate
119119 14 legal authority for a State agency is vested by any provision
120120 15 of law.
121121 16 "State leader" means a State agency head or a member of the
122122 17 General Assembly.
123123 18 Section 15. Department of Government Efficiency.
124124 19 (a) The Department of Government Efficiency is established
125125 20 in the Office of the Auditor General to serve as an advisory
126126 21 and consulting organization to provide recommendations or
127127 22 strategies for State leaders for the following purposes:
128128 23 (1) regulatory rescissions;
129129 24 (2) administrative reductions; and
130130 25 (3) cost savings.

141141 1 (b) The Office of the Auditor General shall provide
142142 2 administrative and other support to the Department.
143143 3 (c) The Department may advise the Office of the Auditor
144144 4 General regarding audits and investigations under Section 30
145145 5 of this Act for the purposes described in Section 5 and
146146 6 subsection (a) of this Section.
147147 7 Section 20. Board of Directors.
148148 8 (a) The Department shall be led by a Board of Directors,
149149 9 which shall be chaired by a Chairperson who shall be elected
150150 10 annually at the first meeting of the year from among the
151151 11 directors. The Board shall make decisions and take actions by
152152 12 majority vote. The directors on the Board shall be as follows:
153153 13 (1) the Auditor General or the Auditor General's
154154 14 designee, who shall serve as Chairperson until the first
155155 15 meeting under this Act;
156156 16 (2) one director, appointed by the President of the
157157 17 Senate;
158158 18 (3) one director, appointed by the Speaker of the
159159 19 House;
160160 20 (4) one director, appointed by the Minority Leader of
161161 21 the Senate; and
162162 22 (5) one director, appointed by the Minority Leader of
163163 23 the House of Representatives.
164164 24 (b) Each director appointed under paragraph (2), (3), (4),
165165 25 or (5) of subsection (a) may serve for a period of 2 years and

176176 1 may be reappointed to the position or a new appointment may be
177177 2 made under subsection (a) of this Section. A director
178178 3 appointed under paragraph (2), (3), (4), or (5) of subsection
179179 4 (a) may be discharged and removed by the Board. A director may
180180 5 resign before the end of the director's term. A vacancy may be
181181 6 filled by appointment under subsection (a) at any time.
182182 7 (c) The Board shall convene and meet at the call of the
183183 8 Chairperson and shall meet as frequently as necessary to carry
184184 9 out its duties as required by this Act.
185185 10 (d) The Board may obtain and review information from a
186186 11 State agency under subsection (a) of Section 30.
187187 12 (e) The directors shall serve without compensation but
188188 13 shall be reimbursed for their reasonable and necessary
189189 14 expenses from funds appropriated for that purpose.
190190 15 Section 25. Members.
191191 16 (a) The Board may appoint members in the Department who
192192 17 shall serve under the Board. Each member appointed shall be:
193193 18 (1) an expert with training or experience as a
194194 19 corporate efficiency consultant, organizational
195195 20 effectiveness consultant, management consultant, or the
196196 21 equivalent;
197197 22 (2) an expert with academic or teaching experience in
198198 23 government, economics, political science, or a similar
199199 24 discipline;
200200 25 (3) an expert with significant experience with

212212 2 (4) an expert with significant experience with
213213 3 government management.
214214 4 (b) The members shall assist the Board in advising,
215215 5 consulting, and providing recommendations or strategies for
216216 6 State leaders. The members may assist the Board in advising
217217 7 the Office of the Auditor General regarding audits and
218218 8 investigations under Section 30, in reviewing information
219219 9 obtained by the Board under subsection (a) of Section 30, in
220220 10 drafting and publishing reports under Section 35, or in any
221221 11 other task assigned by the Board. The members serve at the will
222222 12 of the Board, and members may be discharged and removed by the
223223 13 Board without cause.
224224 14 (c) One or more members shall convene and meet at the call
225225 15 of any director and shall meet as frequently as necessary to
226226 16 carry out duties as assigned by any director.
227227 17 (d) The members of the Department shall serve without
228228 18 compensation but shall be reimbursed for their reasonable and
229229 19 necessary expenses from funds appropriated for that purpose.
230230 20 Section 30. Powers; audits and investigations; rulemaking.
231231 21 (a) At the request of the Board, a State agency head shall
232232 22 provide all information requested by the Board and possessed
233233 23 by the State agency to the Board, except as otherwise
234234 24 prohibited by law.
235235 25 (b) The Department may advise the Office of the Auditor

247247 2 for the purposes described in Section 5 and subsection (a) of
248248 3 Section 15 of this Act.
249249 4 (c) The Office of the Auditor General may consult with the
250250 5 Department under Section 6-2 of the Illinois State Auditing
251251 6 Act regarding audits and investigations of State agencies.
252252 7 (d) The Department may adopt rules implementing this Act,
253253 8 including rules to provide for policies and procedures for the
254254 9 Board, policies and procedures for members, policies and
255255 10 procedures for reports, and other policies and procedures to
256256 11 otherwise accomplish the purposes of this Act.
257257 12 Section 35. Reports. The Department shall identify issues
258258 13 and make recommendations by issuing quarterly reports to the
259259 14 Governor and the General Assembly. The Department may also
260260 15 address reports to a State agency head at the discretion of the
261261 16 Board. The substance of each report shall identify issues and
262262 17 make recommendations based on the purposes described in
263263 18 Section 5 and subsection (a) of Section 15 of this Act.
264264 19 Section 40. The Illinois State Auditing Act is amended by
265265 20 adding Section 6-2 as follows:
