1111 1 AN ACT concerning government.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The State Officials and Employees Ethics Act is
1515 5 amended by changing Section 70-5 as follows:

1717 7 Sec. 70-5. Adoption by governmental entities.
1818 8 (a) Within 6 months after the effective date of this Act,
1919 9 each governmental entity other than a community college
2020 10 district, and each community college district within 6 months
2121 11 after the effective date of this amendatory Act of the 95th
2222 12 General Assembly, shall adopt an ordinance or resolution that
2323 13 regulates, in a manner no less restrictive than Section 5-15
2424 14 and Article 10 of this Act, (i) the political activities of
2525 15 officers and employees of the governmental entity and (ii) the
2626 16 soliciting and accepting of gifts by and the offering and
2727 17 making of gifts to officers and employees of the governmental
2828 18 entity. No later than 60 days after the effective date of this
2929 19 amendatory Act of the 100th General Assembly, each
3030 20 governmental unit shall adopt an ordinance or resolution
3131 21 establishing a policy to prohibit sexual harassment. The
3232 22 policy shall include, at a minimum: (i) a prohibition on
3333 23 sexual harassment; (ii) details on how an individual can

6868 1 report an allegation of sexual harassment, including options
6969 2 for making a confidential report to a supervisor, ethics
7070 3 officer, Inspector General, or the Department of Human Rights;
7171 4 (iii) a prohibition on retaliation for reporting sexual
7272 5 harassment allegations, including availability of
7373 6 whistleblower protections under this Act, the Whistleblower
7474 7 Act, and the Illinois Human Rights Act; and (iv) the
7575 8 consequences of a violation of the prohibition on sexual
7676 9 harassment and the consequences for knowingly making a false
7777 10 report. Within 6 months after the effective date of this
7878 11 amendatory Act of the 101st General Assembly, each
7979 12 governmental unit that is not subject to the jurisdiction of a
8080 13 State or local Inspector General shall adopt an ordinance or
8181 14 resolution amending its sexual harassment policy to provide
8282 15 for a mechanism for reporting and independent review of
8383 16 allegations of sexual harassment made against an elected
8484 17 official of the governmental unit by another elected official
8585 18 of a governmental unit.
8686 19 (b) Within 3 months after the effective date of this
8787 20 amendatory Act of the 93rd General Assembly, the Attorney
8888 21 General shall develop model ordinances and resolutions for the
8989 22 purpose of this Article. The Attorney General shall advise
9090 23 governmental entities on their contents and adoption.
9191 24 (c) As used in this Article, (i) an "officer" means an
9292 25 elected or appointed official; regardless of whether the
9393 26 official is compensated, and (ii) an "employee" means a
