1717 1 AN ACT concerning criminal law.
1818 2 Be it enacted by the People of the State of Illinois,
1919 3 represented in the General Assembly:

2828 12 Sec. 21.4-2. Definitions. In this Article:
2929 13 "Critical infrastructure facility" means one of the

3131 15 (1) a petroleum or alumina refinery;
3232 16 (2) an electrical power generating facility,
3333 17 substation, switching station, electrical control center,
3434 18 or electric power lines and associated equipment
3535 19 infrastructure;
3636 20 (3) a chemical, polymer or rubber manufacturing

9595 12 (10) a transmission facility used by a federally
9696 13 licensed radio or television station;
9797 14 (11) a steelmaking facility that uses an electric arc
9898 15 furnace to make steel;
9999 16 (12) a facility identified and regulated by the United
100100 17 States Department of Homeland Security Chemical Facility
101101 18 Anti-Terrorism Standards (CFATS) program;
102102 19 (13) a dam that is regulated by the State or federal
103103 20 government;
104104 21 (14) a natural gas distribution utility facility,
105105 22 including, but not limited to, pipeline interconnections,
106106 23 a city gate or town border station, metering station,
107107 24 below-or above-ground pipeline or piping and truck loading
108108 25 or offloading facility, a natural gas storage facility, a
109109 26 natural gas transmission facility, or a natural gas

120120 1 utility distribution facility;
121121 2 (15) a crude oil or refined products storage and
122122 3 distribution facility, including, but not limited to, a
123123 4 valve site, pipeline interconnection, pump station,
124124 5 metering station, below-or above-ground pipeline or
125125 6 piping, and truck loading or offloading facility;
126126 7 (16) a military facility, including a national guard
127127 8 facility and equipment storage area where non-military
128128 9 personnel are prohibited;
129129 10 (17) a Department of Transportation facility and a
130130 11 location near or on a roads or highway where the public is
131131 12 prohibited;
132132 13 (18) a health care facility;
133133 14 (19) any above-ground portion of an oil, gas,
134134 15 hazardous liquid or chemical pipeline, tank, or other
135135 16 storage facility that is enclosed by a fence, other
136136 17 physical barrier, or is clearly marked with signs
137137 18 prohibiting trespassing, that are obviously designed to
138138 19 exclude intruders; or
139139 20 (20) a commercial service airport as defined by the
140140 21 Federal Aviation Administration.

142142 23 Sec. 21.4-3. Criminal offenses; conspiracy; receipt of
143143 24 stolen property; felonies; misdemeanors; fines; imprisonment.

155155 1 vandalizes, defaces, tampers with, or steals equipment or
156156 2 assets of or in a critical infrastructure facility (including
157157 3 copper or other valuable metal) is guilty of a Class 4 felony
158158 4 if the value of the property is under $500, a Class 3 felony if
159159 5 the value of the property is between $500 and $10,000, and a
160160 6 Class 2 felony if the value of the property exceeds $10,000
161161 7 and, upon conviction for the offense, shall be fined not less
162162 8 than $5,000 nor more than $20,000.
163163 9 (b) Any person who conspires with any person to violate
164164 10 this Article is guilty of a Class 3 felony and, upon conviction
165165 11 for the offense, shall be fined not less than $5,000 nor more
166166 12 than $10,000.
167167 13 (c) Any person who receives stolen property, including
168168 14 copper or other valuable metal, who knows or has reason to know
169169 15 that it has been stolen from a critical infrastructure
170170 16 facility, is guilty of a Class 4 felony if the value of the
171171 17 property is under $500, a Class 3 felony if the value of the
172172 18 property is between $500 and $10,000, and a Class 2 felony for
173173 19 any amount over $10,000 and, upon conviction for the offense,
174174 20 shall be fined not less than $5,000 nor more than $10,000.

176176 22 Sec. 21.4-5. Civil liability.
177177 23 (a) Any person who violates this Article is liable to the
178178 24 owner of the property for compensatory damages and, in
179179 25 addition, for punitive damages in an amount not less than 3

196196 7 of the compensatory damages. It is an affirmative defense to
197197 8 this subsection (b) that the defendant was a bona fide
198198 9 purchaser for value who did not know, or have reason to know,

201201 12 Sec. 21.4-6. Forfeiture.
202202 13 (a) All items of personal property that are used, have
203203 14 been used, or are intended for use, in perpetration of theft or
204204 15 damage to a critical infrastructure facility are subject to
205205 16 forfeiture. This forfeiture includes all conveyances,
206206 17 including aircraft, vehicles, or vessels, except that:
207207 18 (1) a conveyance used by any person as a common
208208 19 carrier in the transaction of business as a common carrier
209209 20 may not be forfeited under this Section unless it appears
210210 21 that the person owning the conveyance is a consenting
211211 22 party or privy to a violation of this Article;
212212 23 (2) a conveyance may not be forfeited under the
213213 24 provisions of this Article if the person owning the
214214 25 conveyance establishes that he or she neither knew nor had

225225 1 reason to know that the conveyance was being employed or
226226 2 was likely to be employed in a violation of this Article;

228228 4 (3) a bona fide security interest or other valid lien
229229 5 in any conveyance may not be forfeited under the
230230 6 provisions of this Article, unless the State proves by a
231231 7 preponderance of the evidence that the holder of the
232232 8 security interest or lien either knew or had reason to
233233 9 know that the conveyance was being used or was likely to be
234234 10 used in a violation of this Article.
235235 11 (b) All procedures relating to the seizure and disposition
236236 12 of property subject to forfeiture under this Article shall be
237237 13 governed by the same provisions applicable to the seizure and
238238 14 disposition of property under the Drug Asset Forfeiture
239239 15 Procedure Act.

241241 17 Sec. 21.4-7. Exceptions. The provisions of this Article do
242242 18 not apply to:
243243 19 (1) any person or organization monitoring or attentive
244244 20 to compliance with public or worker safety laws, or, wage
245245 21 and hour requirements;
246246 22 (2) the right to free speech or assembly, including,
247247 23 but not limited to, protesting and picketing;
248248 24 (3) the owner of a critical infrastructure facility
