1111 1 AN ACT concerning education.
1212 2 Be it enacted by the People of the State of Illinois,
1313 3 represented in the General Assembly:
1414 4 Section 5. The School Code is amended by changing Section
1515 5 13A-8 as follows:

1717 7 Sec. 13A-8. Funding.
1818 8 (a) The State of Illinois shall provide funding for the
1919 9 alternative school programs within each educational service
2020 10 region and within the Chicago public school system by line
2121 11 item appropriation made to the State Board of Education for
2222 12 that purpose. This money, when appropriated, shall be provided
2323 13 to the regional superintendent and to the Chicago Board of
2424 14 Education, who shall establish a budget, including salaries,
2525 15 for their alternative school programs. Each program shall
2626 16 receive funding in the amount of $30,000, except that in any
2727 17 fiscal year in which the funding allocation is at or above
2828 18 $22,730,000, each program shall receive $100,000 for that
2929 19 fiscal year, plus an amount based on the ratio of the region's
3030 20 or Chicago's average student enrollment best 3 months' average
3131 21 daily attendance in grades pre-kindergarten through 12 to the
3232 22 statewide totals of these amounts. For purposes of this

6868 1 average daily attendance for each region or Chicago shall be
6969 2 calculated by adding to the average student enrollment best 3
7070 3 months' average daily attendance the number of low-income
7171 4 students identified in the most recently available federal
7272 5 census multiplied by one-half times the percentage of the
7373 6 region's or Chicago's low-income students to the State's total
7474 7 low-income students. The State Board of Education shall retain
7575 8 up to 1.1% of the appropriation to be used to provide technical
7676 9 assistance, professional development, and evaluations for the
7777 10 programs.
7878 11 (a-5) Notwithstanding any other provisions of this
7979 12 Section, for the 1998-1999 fiscal year, the total amount
8080 13 distributed under subsection (a) for an alternative school
8181 14 program shall be not less than the total amount that was
8282 15 distributed under that subsection for that alternative school
8383 16 program for the 1997-1998 fiscal year. If an alternative
8484 17 school program is to receive a total distribution under
8585 18 subsection (a) for the 1998-1999 fiscal year that is less than
8686 19 the total distribution that the program received under that
8787 20 subsection for the 1997-1998 fiscal year, that alternative
8888 21 school program shall also receive, from a separate
8989 22 appropriation made for purposes of this subsection (a-5), a
9090 23 supplementary payment equal to the amount by which its total
9191 24 distribution under subsection (a) for the 1997-1998 fiscal
9292 25 year exceeds the amount of the total distribution that the
9393 26 alternative school program receives under that subsection for

104104 1 the 1998-1999 fiscal year. If the amount appropriated for
105105 2 supplementary payments to alternative school programs under
106106 3 this subsection (a-5) is insufficient for that purpose, those
107107 4 supplementary payments shall be prorated among the alternative
108108 5 school programs entitled to receive those supplementary
109109 6 payments according to the aggregate amount of the
110110 7 appropriation made for purposes of this subsection (a-5).
111111 8 (b) An alternative school program shall be entitled to
112112 9 receive general State aid as calculated in subsection (K) of
113113 10 Section 18-8.05 or evidence-based funding as calculated in
114114 11 subsection (g) of Section 18-8.15 upon filing a claim as
115115 12 provided therein. Any time that a student who is enrolled in an
116116 13 alternative school program spends in work-based learning,
117117 14 community service, or a similar alternative educational
118118 15 setting shall be included in determining the student's minimum
119119 16 number of clock hours of daily school work that constitute a
120120 17 day of attendance for purposes of calculating general State
121121 18 aid or evidence-based funding.
122122 19 (c) An alternative school program may receive additional
123123 20 funding from its school districts in such amount as may be
124124 21 agreed upon by the parties and necessary to support the
125125 22 program. In addition, an alternative school program is
126126 23 authorized to accept and expend gifts, legacies, and grants,
127127 24 including but not limited to federal grants, from any source
128128 25 for purposes directly related to the conduct and operation of
