In provisions concerning funding, provides that in any fiscal year in which the State funding allocation is at or above $22,730,000, each alternative school program shall receive $100,000 for that fiscal year (instead of receiving funding in the amount of $30,000), plus an amount based on the ratio of an educational service region's or the Chicago public school system's average student enrollment (instead of best 3 months' average daily attendance in grades pre-kindergarten through 12) to the statewide totals of these amounts. 1  AN ACT concerning education.
2  Be it enacted by the People of the State of Illinois,
3  represented in the General Assembly:
4  Section 5. The School Code is amended by changing Section
5  13A-8 as follows:
6  (105 ILCS 5/13A-8)
7  Sec. 13A-8. Funding.
8  (a) The State of Illinois shall provide funding for the
9  alternative school programs within each educational service
10  region and within the Chicago public school system by line
11  item appropriation made to the State Board of Education for
12  that purpose. This money, when appropriated, shall be provided
13  to the regional superintendent and to the Chicago Board of
14  Education, who shall establish a budget, including salaries,
15  for their alternative school programs. Each program shall
16  receive funding in the amount of $30,000, except that in any
17  fiscal year in which the funding allocation is at or above
18  $22,730,000, each program shall receive $100,000 for that
19  fiscal year, plus an amount based on the ratio of the region's
20  or Chicago's average student enrollment best 3 months' average
21  daily attendance in grades pre-kindergarten through 12 to the
22  statewide totals of these amounts. For purposes of this
23  calculation, average student enrollment the best 3 months'

1  average daily attendance for each region or Chicago shall be
2  calculated by adding to the average student enrollment best 3
3  months' average daily attendance the number of low-income
4  students identified in the most recently available federal
5  census multiplied by one-half times the percentage of the
6  region's or Chicago's low-income students to the State's total
7  low-income students. The State Board of Education shall retain
8  up to 1.1% of the appropriation to be used to provide technical
9  assistance, professional development, and evaluations for the
10  programs.
11  (a-5) Notwithstanding any other provisions of this
12  Section, for the 1998-1999 fiscal year, the total amount
13  distributed under subsection (a) for an alternative school
14  program shall be not less than the total amount that was
15  distributed under that subsection for that alternative school
16  program for the 1997-1998 fiscal year. If an alternative
17  school program is to receive a total distribution under
18  subsection (a) for the 1998-1999 fiscal year that is less than
19  the total distribution that the program received under that
20  subsection for the 1997-1998 fiscal year, that alternative
21  school program shall also receive, from a separate
22  appropriation made for purposes of this subsection (a-5), a
23  supplementary payment equal to the amount by which its total
24  distribution under subsection (a) for the 1997-1998 fiscal
25  year exceeds the amount of the total distribution that the
26  alternative school program receives under that subsection for

1  the 1998-1999 fiscal year. If the amount appropriated for
2  supplementary payments to alternative school programs under
3  this subsection (a-5) is insufficient for that purpose, those
4  supplementary payments shall be prorated among the alternative
5  school programs entitled to receive those supplementary
6  payments according to the aggregate amount of the
7  appropriation made for purposes of this subsection (a-5).
8  (b) An alternative school program shall be entitled to
9  receive general State aid as calculated in subsection (K) of
10  Section 18-8.05 or evidence-based funding as calculated in
11  subsection (g) of Section 18-8.15 upon filing a claim as
12  provided therein. Any time that a student who is enrolled in an
13  alternative school program spends in work-based learning,
14  community service, or a similar alternative educational
15  setting shall be included in determining the student's minimum
16  number of clock hours of daily school work that constitute a
17  day of attendance for purposes of calculating general State
18  aid or evidence-based funding.
19  (c) An alternative school program may receive additional
20  funding from its school districts in such amount as may be
21  agreed upon by the parties and necessary to support the
22  program. In addition, an alternative school program is
23  authorized to accept and expend gifts, legacies, and grants,
24  including but not limited to federal grants, from any source
25  for purposes directly related to the conduct and operation of
26  the program.
