Provides that the Department of Public Health shall establish a simple, efficient, and effective process to ensure oversight of and accountability for training to support informed decisions and accurate completion of the Department of Public Health Uniform POLST form at all hospitals, healthcare facilities, and other facilities and providers that use the Department of Public Health Uniform POLST form. Provides that, in consultation with various organizations, the Department of Public Health shall adopt rules implementing these policies no later than 2 years after the effective date of this amendatory Act. 311 1 AN ACT concerning State government.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Department of Public Health Powers and
715 5 Duties Law of the Civil Administrative Code of Illinois is
816 6 amended by changing Section 2310-600 as follows:

1018 8 Sec. 2310-600. Advance directive information.
1119 9 (a) The Department of Public Health shall prepare and
1220 10 publish the summary of advance directives law, as required by
1321 11 the federal Patient Self-Determination Act, and related forms.
1422 12 Publication may be limited to the World Wide Web. The summary
1523 13 required under this subsection (a) must include the Department
1624 14 of Public Health Uniform POLST form.
1725 15 (b) The Department of Public Health shall publish Spanish
1826 16 language versions of the following:
1927 17 (1) The statutory Living Will Declaration form.
2028 18 (2) The Illinois Statutory Short Form Power of
2129 19 Attorney for Health Care.
2230 20 (3) The statutory Declaration of Mental Health
2331 21 Treatment Form.
2432 22 (4) The summary of advance directives law in Illinois.

4175 8 nurses, and emergency medical systems, and a statewide
4276 9 organization representing hospitals, the Department of Public
4377 10 Health shall develop and publish a uniform form for
4478 11 practitioner cardiopulmonary resuscitation (CPR) or
4579 12 life-sustaining treatment orders that may be utilized in all
4680 13 settings. The form shall meet the published minimum
4781 14 requirements to nationally be considered a practitioner orders
4882 15 for life-sustaining treatment form, or POLST, and may be
4983 16 referred to as the Department of Public Health Uniform POLST
5084 17 form. An electronic version of the Uniform POLST form under
5185 18 this Act may be created, signed, or revoked electronically
5286 19 using a generic, technology-neutral system in which each user
5387 20 is assigned a unique identifier that is securely maintained
5488 21 and in a manner that meets the regulatory requirements for a
5589 22 digital or electronic signature. Compliance with the standards
5690 23 defined in the Uniform Electronic Transactions Act or the
5791 24 implementing rules of the Hospital Licensing Act for medical
5892 25 record entry authentication for author validation of the
5993 26 documentation, content accuracy, and completeness meets this

78112 9 nurses, and emergency medical systems, a statewide bar
79113 10 association, a national bar association with an Illinois
80114 11 chapter that concentrates in elder and disability law, a
81115 12 not-for-profit organ procurement organization that coordinates
82116 13 organ and tissue donation, a statewide committee or group
83117 14 responsible for stakeholder education about POLST issues, and
84118 15 a statewide organization representing hospitals, the
85119 16 Department of Public Health shall study the feasibility of
86120 17 creating a statewide registry of advance directives and POLST
87121 18 forms. The registry would allow residents of this State to
88122 19 submit the forms and for the forms to be made available to
89123 20 health care providers and professionals in a timely manner for
90124 21 the provision of care or services. This study must be filed
91125 22 with the General Assembly on or before January 1, 2021.
92-23 (b-15) The Department of Public Health shall approve
93-24 training resources to support informed decisions and accurate
94-25 completion of the Department of Public Health Uniform POLST
95-26 form. The Department of Public Health shall post approved

106-1 POLST training material to the Department of Public Health's
107-2 website. The Department of Public Health shall establish a
108-3 simple, efficient, and effective process to make available
109-4 yearly training to support informed decisions and accurate
110-5 completion of the Department of Public Health Uniform POLST
111-6 form for personnel employed by or contracted with facilities
112-7 licensed and classified to provide intermediate care or
113-8 skilled nursing care under the Nursing Home Care Act and other
114-9 health care providers that use the Department of Public Health
115-10 Uniform POLST form.

117-12 (d) The Department of Public Health shall publish the
118-13 Department of Public Health Uniform POLST form reflecting the
119-14 changes made by this amendatory Act of the 98th General
120-15 Assembly no later than January 1, 2015.
