311 1 AN ACT concerning conservation.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Open Space Lands Acquisition and
715 5 Development Act is amended by adding Section 5.5 as follows:
816 6 (525 ILCS 35/5.5 new)
9-7 Sec. 5.5. Accessibility; universal design elements. The
10-8 Department shall prioritize projects that incorporate
11-9 universal design elements. The Department shall adopt rules to
12-10 establish the priorities and scoring matrix under this Section
13-11 within its grant application review process under this Act. In
14-12 this Section, "universal design elements" includes, but is not
15-13 limited to, the following elements:
16-14 (1) poured-in-place rubber surfacing or synthetic turf
17-15 for enhanced mobility and continuously accessible
18-16 surfacing routes;
19-17 (2) multiple access points and routes suitable for
20-18 wheelchairs, including additional ramps for seamless entry
21-19 to play equipment;
22-20 (3) a variety of ground-level and elevated play
23-21 components accessible to individuals with diverse physical
24-22 abilities;
25-23 (4) inclusive swings and seating;
17+7 Sec. 5.5. Accessibility. The Department shall, in
18+8 conjunction with the priorities set forth in Section 5,
19+9 prioritize projects that incorporate construction, materials,
20+10 designs, products, or technologies that increase accessibility
21+11 and usability beyond the highest standards established under
22+12 the federal Americans with Disabilities Act (ADA) or federal
23+13 regulations promulgated under that Act. The Department shall
24+14 adopt rules to establish this priority within its grant
25+15 application review process under this Act.

40-7 Section 99. Effective date. This Act takes effect upon
41-8 becoming law.
