1515 1 AN ACT concerning State government.
1616 2 Be it enacted by the People of the State of Illinois,
1717 3 represented in the General Assembly:
1818 4 Section 5. The Department of Natural Resources
1919 5 (Conservation) Law of the Civil Administrative Code of
2020 6 Illinois is amended by changing Section 805-72 as follows:

2222 8 Sec. 805-72. Lyme Disease Innovation Program.
2323 9 (a) The Department shall consult with the Department of
2424 10 Agriculture, the Department of Public Health, and members of
2525 11 the University of Illinois' INHS Medical Entomology Program to
2626 12 establish the Lyme Disease Innovation Program no later than
2727 13 one year after the effective date of this amendatory Act of the
2828 14 103rd General Assembly. The Department shall contract with an
2929 15 Illinois not-for-profit organization whose purpose is to raise
3030 16 awareness of tick-borne diseases with the public and the
3131 17 medical community to operate the Program. The Program's
3232 18 purpose is to raise awareness with the public and to assist
3333 19 persons at risk of Lyme disease and other tick-borne diseases
3434 20 with education and awareness materials and campaigns while
3535 21 developing evidence-based approaches that are cost-effective.
3636 22 (b) The Program shall implement a statewide interagency
3737 23 and multipronged approach to combat Lyme disease and other

8080 1 tick-borne diseases in Illinois, including adopting an
8181 2 evidence-based model that recognizes the key roles that
8282 3 patients, advocates, and not-for-profit organizations have in
8383 4 fighting Lyme disease and tick-borne diseases. The Program's
8484 5 objectives include issuing grants, subject to the approval of
8585 6 the Department, to State agencies and Illinois not-for profit
8686 7 organizations from moneys in the Lyme Disease Awareness Fund,
8787 8 which is hereby established as a special fund in the State
8888 9 treasury, and other appropriations for the following purposes:
8989 10 (1) Bringing awareness of Lyme disease and tick-borne
9090 11 diseases by any one or more of the following methods:
9191 12 (A) creating innovative ideas and collaborations
9292 13 for raising awareness about risks and prevention;
9393 14 (B) amplifying and improving access to essential
9494 15 information supporting innovations in prevention,
9595 16 education, and care with open data and science;
9696 17 (C) fostering the development of new,
9797 18 community-based education and prevention efforts; and
9898 19 (D) using programs, website advertising,
9999 20 pamphlets, or other methods to increase the awareness
100100 21 of Lyme disease and tick-borne diseases;
101101 22 (2) Engaging stakeholders to facilitate
102102 23 patient-centered innovations by (i) building trust among
103103 24 stakeholders through listening sessions, roundtables, and
104104 25 other learning approaches that ground innovations in lived
105105 26 experience, (ii) engaging stakeholders in identifying

121121 6 (3) Advancing stakeholder driven interdisciplinary and
122122 7 interagency collaborations by providing resources to
123123 8 not-for-profit organizations whose purpose is to raise
124124 9 awareness of tick-borne diseases with the public and the
125125 10 medical community in order to (i) facilitate the
126126 11 stakeholder engagement and collaborations and
127127 12 patient-centered innovations and support groups, (ii)
128128 13 identify ways to better collect and share data while
129129 14 raising awareness of tick-borne illnesses, and (iii)
130130 15 assist with the development of outreach and education
131131 16 materials and approaches for State agencies.
132132 17 (4) The University of Illinois' INHS Medical
133133 18 Entomology Program maintaining a passive tick and
134134 19 tick-borne pathogen surveillance program, based on ticks
135135 20 contributed by the Illinois public, and including tick
136136 21 identifications and disease-agent testing of a subset of
137137 22 identified ticks; compiling evidence and conducting
138138 23 research on tick bite prevention and risk of tick and
139139 24 tick-borne pathogen exposure; and providing evidence,
140140 25 results, and analysis and insight from both the passive
141141 26 surveillance program, on tick species and tick-borne

154154 3 prevention, to support the Lyme Disease Innovation Program
155155 4 objectives.
156156 5 (c) The Program shall be funded through moneys deposited
157157 6 into the Lyme Disease Awareness Fund, including revenue from
158158 7 the Lyme Disease Innovation scratch-off game, and other
159159 8 appropriations. The not-for-profit organization contracted
160160 9 with to operate the Program shall be paid, subject to the
161161 10 approval of the Department, for its operation of the Program
162162 11 from moneys deposited into the Fund or from other
163163 12 appropriations.
164164 13 The University of Illinois' Prairie Research Institute
165165 14 shall be paid, subject to the approval of the Department, for
166166 15 the INHS Medical Entomology Program's operation of a passive
167167 16 tick surveillance and research program from moneys deposited
168168 17 into the Fund or from other appropriations.
169169 18 (d) The Department must adopt rules to implement this
170170 19 Section.
171171 20 (e) The requirements of this Section are subject to
172172 21 appropriation by the General Assembly being made to the
173173 22 Department to implement the requirements.

189189 3 Sec. 9.3. Expenditure and distribution of lottery
190190 4 proceeds.
191191 5 (a) Beginning July 1, 2022, except as provided in Sections
192192 6 21.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.13,
193193 7 21.15, and 21.16, and 21.16.5 of this Law and Section 25-70 of
194194 8 the Sports Wagering Act, the Department shall distribute all
195195 9 proceeds of lottery tickets and shares sold in the following
196196 10 priority and manner:
197197 11 (1) The payment of prizes and retailer bonuses.
198198 12 (2) The payment of costs incurred in the operation and
199199 13 administration of the Lottery, including the payment of
200200 14 sums due to the private manager under the management
201201 15 agreement with the Department and including costs of
202202 16 administering the Lottery sports wagering program pursuant
203203 17 to Section 25-70 of the Sports Wagering Act.
204204 18 (3) On the last day of each month or as soon thereafter
205205 19 as possible, the State Comptroller shall direct and the
206206 20 State Treasurer shall transfer from the State Lottery Fund
207207 21 to the Common School Fund the Department's estimate of net
208208 22 lottery proceeds.
209209 23 (4) If an amount in excess of the annual net lottery
210210 24 proceeds is transferred for a fiscal year, then the
211211 25 Department shall offset the monthly transfers of estimated

222222 1 net lottery proceeds during the following fiscal year by
223223 2 that excess amount. If an amount less than the annual net
224224 3 lottery proceeds is transferred for a fiscal year, then
225225 4 after the related annual fiscal year audit is completed
226226 5 following such fiscal year, the Department shall direct
227227 6 the deposit of any remaining annual net lottery proceeds
228228 7 from such fiscal year, subject to payments under
229229 8 paragraphs (1) and (2), into the Common School Fund as
230230 9 soon thereafter as possible.
231231 10 (b) The net lottery proceeds shall be determined by
232232 11 deducting from total annual lottery proceeds the expenditures
233233 12 required by paragraphs (1) and (2) of subsection (a). The
234234 13 total annual lottery proceeds and annual net lottery proceeds
235235 14 shall be determined according to generally accepted accounting
236236 15 principles for governmental entities and verified by an annual
237237 16 fiscal year audit.

240240 19 Sec. 20. State Lottery Fund.
241241 20 (a) There is created in the State Treasury a special fund
242242 21 to be known as the State Lottery Fund. Such fund shall consist
243243 22 of all revenues received from (1) the sale of lottery tickets
244244 23 or shares, (net of commissions, fees representing those
245245 24 expenses that are directly proportionate to the sale of
246246 25 tickets or shares at the agent location, and prizes of less

303303 11 Sec. 21.4. Joint Special Instant Scratch-off game.
304304 12 (a) The Department shall offer a joint special instant
305305 13 scratch-off game for the benefit of the special causes
306306 14 identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10,
307307 15 21.11, 21.13, 21.15, and 21.16, and 21.16.5. The operation of
308308 16 the game shall be governed by this Section and any rules
309309 17 adopted by the Department. The game shall commence on January
310310 18 1, 2024 or as soon thereafter, at the discretion of the
311311 19 Director, as is reasonably practical and shall be discontinued
312312 20 on January 1, 2027. If any provision of this Section is
313313 21 inconsistent with any other provision in the Act, then this
314314 22 Section governs.
315315 23 (b) Once the joint special instant scratch-off game is
316316 24 used to fund a special cause, the game will be used to fund the
317317 25 special cause for the remainder of the special causes'

329329 2 (c) New specialty tickets and causes authorized by this
330330 3 Act shall be funded by the joint special instant scratch-off
331331 4 game. New specialty tickets and causes after February 1, 2024
332332 5 must have a sunset date. The Department shall be limited to
333333 6 supporting no more than 10 causes in total at any given time.
334334 7 (d) Net revenue received from the sale of the joint
335335 8 special instant scratch-off game for the purposes of this
336336 9 Section shall be divided equally among the special causes the
337337 10 game benefits. At the direction of the Department, the State
338338 11 Comptroller shall direct and the State Treasurer shall
339339 12 transfer from the State Lottery Fund the net revenue to the
340340 13 specific fund identified for each special cause in accordance
341341 14 with the special cause's respective Section in this Act. As
342342 15 used in this Section, "net revenue" means the total amount for
343343 16 which tickets have been sold less the sum of the amount paid
344344 17 out in prizes and to retailers, and direct and estimated
345345 18 administrative expenses incurred in operation of the ticket.

348348 21 Sec. 21.16.5. Scratch-off for Lyme Disease Innovation.
349349 22 (a) The Department shall offer a special Lyme Disease
350350 23 Innovation instant scratch-off game for the benefit of the
351351 24 Illinois-based Lyme Disease Innovation Program. The net

363363 1 shall be deposited into the Lyme Disease Awareness Fund, a
364364 2 special fund in the State treasury, for the purposes set forth
365365 3 in Section 805-72 of the Department of Natural Resources
366366 4 (Conservation) Law of the Civil Administrative Code of
367367 5 Illinois. The game shall commence on January 1, 2026, or as
368368 6 soon thereafter as is reasonably practical, and shall be
369369 7 discontinued on December 31, 2035. The Department shall
370370 8 consult with the Department of Natural Resources regarding the
371371 9 design and promotion of the game. The Department shall offer
372372 10 the game enumerated under this Section upon the
373373 11 discontinuation of the first game that is discontinued within
374374 12 the Joint Special Instant Scratch-Off game that is created
375375 13 under Section 21.4 of this law.
376376 14 (b) The operation of any games under this Section shall be
377377 15 governed by this Act and any rules adopted by the Department
378378 16 under this Act.
379379 17 (c) In this Section, "net revenue" means the total amount
380380 18 for which tickets have been sold less the sum of the amount
381381 19 paid out in prizes and the actual administrative expenses of
382382 20 the Department solely related to the Lyme Disease Innovation
383383 21 scratch-off game.
384384 22 (d) During the time that tickets are sold for the Lyme
385385 23 Disease Innovation scratch-off game, the Department shall not
386386 24 unreasonably diminish the efforts devoted to marketing any
387387 25 other instant scratch-off lottery game.
388388 26 (e) The Department may adopt any rules necessary to
