1212 1 AN ACT concerning revenue.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Tobacco Products Tax Act of 1995 is amended
1616 5 by adding Sections 10-100 and 10-100.5 as follows:
1717 6 (35 ILCS 143/10-100 new)
1818 7 Sec. 10-100. Cannabinoid hemp products; prohibited areas.
1919 8 (a) As used in this Section:
2020 9 "Cannabinoid hemp product" means hemp or any product
2121 10 manufactured or derived from hemp, including hemp derived
2222 11 terpenes, in its final form, that is: (1) used for human
2323 12 consumption, including by ingestion, inhalation, or otherwise;
2424 13 and (2) capable of producing a psychoactive effect in a person
2525 14 who consumes it. "Cannabinoid hemp product" shall not include
2626 15 products intended for topical use.
2727 16 "Concealment" means to deliberately hide to prevent or
2828 17 evade discovery.
2929 18 "Hemp" means the plant Cannabis sativa L. and any part of
3030 19 such plant, including the seeds thereof and all derivatives,
3131 20 extracts, cannabinoids, isomers, acids, salts, and salts of
3232 21 isomers, whether growing or not, that is not cannabis
3333 22 regulated under the Compassionate Use of Medical Cannabis
3434 23 Program Act or the Cannabis Regulation and Tax Act.

7171 1 "Licensed premises" means the premises or location
7272 2 licensed or required to be licensed under this Act. The term
7373 3 "licensed premises" includes (1) the building where the
7474 4 licensed premises is located; (2) all grounds, areas, and
7575 5 facilities on, in or immediately adjacent to the licensed
7676 6 premises used by, or held out for use by, the licensee or their
7777 7 agent or employee, including, but not limited to, the licensed
7878 8 premises' parking facility; and (3) all vehicles used by the
7979 9 licensee or his agent or employee to conduct the activity
8080 10 licensed or required to be licensed under this Section.
8181 11 "Midway Residential Area" means that portion of the City
8282 12 of Chicago bounded as follows: Beginning at the intersection
8383 13 of 65th Street and Harlem Avenue, thence north on Harlem
8484 14 Avenue to Illinois Central Railroad, thence northeast along
8585 15 the Illinois Central Railroad to 51st Street, thence east on
8686 16 51st Street to Laramie Avenue, thence north on Laramie Avenue
8787 17 to 50th Street, thence east on 50th Street to Cicero Avenue,
8888 18 thence south on Cicero Avenue to 51st Street, thence east on
8989 19 51st Street to Kolin Avenue, thence south on Kolin Avenue to
9090 20 Archer Avenue, thence northeast on Archer Avenue to Kildare
9191 21 Avenue, thence south on Kildare Avenue to 51st Street, thence
9292 22 east on 51st Street to Harding Avenue, thence south on Harding
9393 23 Avenue to the alley south of 51st Street, thence east on the

119119 13 (b) No licensee under this Act or the licensee's agent or
120120 14 employee shall possess, sell, offer for sale, give away,
121121 15 barter, exchange, or otherwise furnish on the licensed
122122 16 premises any cannabinoid hemp products, or engage in an act of
123123 17 concealment of cannabinoid hemp products on any licensed
124124 18 premises, within the Midway Residential Area.
125125 19 (c) Except as otherwise provided in this Act, any person
126126 20 who violates any of the requirements of this Section or any
127127 21 rule adopted under this Section shall be fined not less than
128128 22 $2,000 nor more than $5,000 for each offense. Each day that a
129129 23 violation continues shall constitute a separate and distinct
130130 24 offense to which a separate fine shall apply.
131131 25 (d) Any violation of this Section or any rule adopted
