12	12	1 AN ACT concerning revenue.
13	13	2 Be it enacted by the People of the State of Illinois,
14	14	3 represented in the General Assembly:
15	15	4 Section 5. The Tobacco Products Tax Act of 1995 is amended
16	16	5 by adding Sections 10-100 and 10-100.5 as follows:
17	17	6 (35 ILCS 143/10-100 new)
18	18	7 Sec. 10-100. Cannabinoid hemp products; prohibited areas.
19	19	8 (a) As used in this Section:
20	20	9 "Cannabinoid hemp product" means hemp or any product
21	21	10 manufactured or derived from hemp, including hemp derived
22	22	11 terpenes, in its final form, that is: (1) used for human
23	23	12 consumption, including by ingestion, inhalation, or otherwise;
24	24	13 and (2) capable of producing a psychoactive effect in a person
25	25	14 who consumes it. "Cannabinoid hemp product" shall not include
26	26	15 products intended for topical use.
27	27	16 "Concealment" means to deliberately hide to prevent or
28	28	17 evade discovery.
29	29	18 "Hemp" means the plant Cannabis sativa L. and any part of
30	30	19 such plant, including the seeds thereof and all derivatives,
31	31	20 extracts, cannabinoids, isomers, acids, salts, and salts of
32	32	21 isomers, whether growing or not, that is not cannabis
33	33	22 regulated under the Compassionate Use of Medical Cannabis
34	34	23 Program Act or the Cannabis Regulation and Tax Act.

71	71	1 "Licensed premises" means the premises or location
72	72	2 licensed or required to be licensed under this Act. The term
73	73	3 "licensed premises" includes (1) the building where the
74	74	4 licensed premises is located; (2) all grounds, areas, and
75	75	5 facilities on, in or immediately adjacent to the licensed
76	76	6 premises used by, or held out for use by, the licensee or their
77	77	7 agent or employee, including, but not limited to, the licensed
78	78	8 premises' parking facility; and (3) all vehicles used by the
79	79	9 licensee or his agent or employee to conduct the activity
80	80	10 licensed or required to be licensed under this Section.
81	81	11 "Midway Residential Area" means that portion of the City
82	82	12 of Chicago bounded as follows: Beginning at the intersection
83	83	13 of 65th Street and Harlem Avenue, thence north on Harlem
84	84	14 Avenue to Illinois Central Railroad, thence northeast along
85	85	15 the Illinois Central Railroad to 51st Street, thence east on
86	86	16 51st Street to Laramie Avenue, thence north on Laramie Avenue
87	87	17 to 50th Street, thence east on 50th Street to Cicero Avenue,
88	88	18 thence south on Cicero Avenue to 51st Street, thence east on
89	89	19 51st Street to Kolin Avenue, thence south on Kolin Avenue to
90	90	20 Archer Avenue, thence northeast on Archer Avenue to Kildare
91	91	21 Avenue, thence south on Kildare Avenue to 51st Street, thence
92	92	22 east on 51st Street to Harding Avenue, thence south on Harding

119	119	13 (b) No licensee under this Act or the licensee's agent or
120	120	14 employee shall possess, sell, offer for sale, give away,
121	121	15 barter, exchange, or otherwise furnish on the licensed
122	122	16 premises any cannabinoid hemp products, or engage in an act of
123	123	17 concealment of cannabinoid hemp products on any licensed
124	124	18 premises, within the Midway Residential Area.
125	125	19 (c) Except as otherwise provided in this Act, any person
126	126	20 who violates any of the requirements of this Section or any
127	127	21 rule adopted under this Section shall be fined not less than
128	128	22 $2,000 nor more than $5,000 for each offense. Each day that a
129	129	23 violation continues shall constitute a separate and distinct
130	130	24 offense to which a separate fine shall apply.
131	131	25 (d) Any violation of this Section or any rule adopted
