312 1 AN ACT concerning education.
413 2 Be it enacted by the People of the State of Illinois,
514 3 represented in the General Assembly:
615 4 Section 5. The Mental Health Early Action on Campus Act is
716 5 amended by changing Sections 30 and 40 as follows:

918 7 Sec. 30. Training.
1019 8 (a) The board of trustees of each public college or
1120 9 university must designate an expert panel to develop and
1221 10 implement policies and procedures that (i) advise students,
1322 11 faculty, and staff on the proper procedures for identifying
1423 12 and addressing the needs of students exhibiting symptoms of
1524 13 mental health conditions, (ii) promote understanding of the
1625 14 rules of Section 504 of the federal Rehabilitation Act of 1973
1726 15 and the federal Americans with Disabilities Act of 1990 to
1827 16 increase knowledge and understanding of student protections
1928 17 under the law, and (iii) provide training if appropriate.
2029 18 The expert panel shall be comprised of at least 2
2130 19 administrators, 2 members of faculty, and one mental health
2231 20 professional.
2332 21 (b) The Technical Assistance Center under Section 45 shall
2433 22 set initial standards for policies and procedures referenced
2534 23 in subsection (a) to ensure statewide consistency.

3471 1 (c) All resident assistants in a student housing facility,
3572 2 advisors, and campus security of a public college or
3673 3 university must participate in a national Mental Health First
3774 4 Aid training course or a similar program prior to the
3875 5 commencement of their duties. Training must include the
3976 6 policies and procedures developed by the public college or
4077 7 university referenced under subsection (a).

4380 10 Sec. 40. Local partnerships.
4481 11 (a) Each public college or university must form strategic
4582 12 partnerships with local mental health service providers to
4683 13 improve overall campus mental wellness and augment on-campus
4784 14 capacity. The strategic partnerships must include linkage
4885 15 agreements with off-campus mental health service providers
4986 16 that establish a foundation for referrals for students when
5087 17 needs cannot be met on campus due to capacity or preference of
5188 18 the student. The strategic partnerships must also include (i)
5289 19 avenues for on-campus and off-campus mental health service
5390 20 providers to increase visibility to students via marketing and
5491 21 outreach, (ii) opportunities to engage the student body
5592 22 through student outreach initiatives like mindfulness
5693 23 workshops or campus-wide wellness fairs, and (iii)
5794 24 opportunities to support awareness and training requirements
5895 25 under this Act.

69106 1 (b) Through a combination of on-campus capacity,
70107 2 off-campus linkage agreements with mental health service
71108 3 providers, and contracted telehealth therapy services, each
72109 4 public college or university shall attempt to meet a benchmark
73110 5 ratio of one clinical, non-student staff member to 1,250
74111 6 students. However, each public college or university shall
75-7 provide at least 3 licensed mental health professionals or
76-8 less than 3 if the benchmark ratio falls under 3. The mental
77-9 health professionals must be employed by the public college or
78-10 university. Service hours for the mental health professionals
79-11 should be informed by campus utilization data and may include
80-12 in-person and telehealth modalities to ensure access to the
81-13 mental health professionals. If linkage agreements are used,
82-14 the agreements must include the capacity of students providers
83-15 are expected to serve within the agency. Two years after the
84-16 effective date of this Act, and once every 5 years thereafter,
85-17 the Technical Assistance Center developed under Section 45
86-18 must propose to the General Assembly an updated ratio based on
87-19 actual ratios in this State and any new information related to
88-20 appropriate benchmarks for clinician-to-student ratios. The
89-21 updated benchmark must represent a ratio of no less than one
90-22 clinical, non-student staff member to 1,250 students.
91-23 (c) Each public college or university must work with local
92-24 resources, such as on-campus mental health counseling centers
93-25 or wellness centers, local mental health service providers, or
94-26 non-providers, such as affiliates of the National Alliance on
