313 1 AN ACT concerning criminal law.
414 2 Be it enacted by the People of the State of Illinois,
515 3 represented in the General Assembly:
616 4 Section 5. The Sex Offender Registration Act is amended by
717 5 changing Sections 5-10, 8, and 11 as follows:

919 7 Sec. 5-10. Verification Nonforwardable verification
1020 8 letters. The Illinois State Police shall send mail a quarterly
1121 9 nonforwardable verification letter or an electronic
1222 10 verification letter to each registered person who has been
1323 11 adjudicated to be sexually dangerous or is a sexually violent
1424 12 person and is later released, or found to be no longer sexually
1525 13 dangerous or no longer a sexually violent person and
1626 14 discharged, beginning 90 days from the date of his or her last
1727 15 registration. The person who is to receive the verification
1828 16 letter shall notify the Illinois State Police as to which
1929 17 method of notification the registered person receives. To any
2030 18 other person registered under this Article, the Illinois State
2131 19 Police shall send mail an annual nonforwardable verification
2232 20 letter or an electronic verification letter, beginning one
2333 21 year from the date of his or her last registration. A person

4383 10 Sec. 8. Registration and DNA submission requirements.
4484 11 (a) Registration. Registration as required by this Article
4585 12 shall consist of a statement in writing signed by the person
4686 13 giving the information that is required by the Illinois State
47-14 Police, which may include the fingerprints and shall must
48-15 include a current photograph of the person, which shall to be
49-16 updated annually. If the sex offender is a child sex offender
50-17 as defined in Section 11-9.3 or 11-9.4 of the Criminal Code of
51-18 1961 or the Criminal Code of 2012, he or she shall sign a
52-19 statement that he or she understands that according to
53-20 Illinois law as a child sex offender he or she may not reside
54-21 within 500 feet of a school, park, or playground. The offender
55-22 may also not reside within 500 feet of a facility providing
56-23 services directed exclusively toward persons under 18 years of
57-24 age unless the sex offender meets specified exemptions. The
58-25 registration information must include whether the person is a

110+2 Offender Community Notification Law. Within 3 days, the
111+3 registering law enforcement agency shall forward any required
112+4 information to the Illinois State Police. The registering law
113+5 enforcement agency shall enter the information into the
114+6 Illinois State Police Sex Offender database Law Enforcement
115+7 Agencies Data System (LEADS) as provided in Sections 6 and 7 of
116+8 the Intergovernmental Missing Child Recovery Act of 1984.
77117 9 (b) DNA submission. Every person registering as a sex
78118 10 offender pursuant to this Act, regardless of the date of
79119 11 conviction or the date of initial registration who is required
80120 12 to submit specimens of blood, saliva, or tissue for DNA
81121 13 analysis as required by subsection (a) of Section 5-4-3 of the
82122 14 Unified Code of Corrections shall submit the specimens as
83123 15 required by that Section. Registered sex offenders who have
84124 16 previously submitted a DNA specimen which has been uploaded to
85125 17 the Illinois DNA database shall not be required to submit an
86126 18 additional specimen pursuant to this Section.

89129 21 Sec. 11. Offender Registration Fund. There is created the

104144 1 Youth Registration Act, and for purposes as authorized under
105145 2 this Section. Moneys in the Fund shall be allocated pursuant
106146 3 to Section 3 of this Act and Section 10 of the Murderer and
107147 4 Violent Offender Against Youth Registration Act, respectively.
108148 5 The Illinois State Police shall establish and promulgate rules
109149 6 and procedures regarding the administration of this Fund.
110150 7 Fifty percent of the moneys in the Fund shall be allocated by
111151 8 the Department for sheriffs' offices and police departments.
112152 9 The remaining moneys in the Fund received under Public Act
113153 10 101-571 shall be allocated to the Illinois State Police for
114154 11 education and administration of the Act.
