Creates a waiver exception. 11	11	1 AN ACT concerning education.
12	12	2 Be it enacted by the People of the State of Illinois,
13	13	3 represented in the General Assembly:
14	14	4 Section 5. The School Code is amended by adding Section
15	15	5 22-80.5 as follows:
16	16	6 (105 ILCS 5/22-80.5 new)
17	17	7 Sec. 22-80.5. Student athletes; medical evaluation and
18	18	8 electrocardiogram.
19	19	9 (a) Definitions. In this Section:
20	20	10 "Athletic trainer" means an athletic trainer licensed
21	21	11 under the Illinois Athletic Trainers Practice Act who is
22	22	12 working under the supervision of a physician.
23	23	13 "Coach" means any volunteer or employee of a school who is
24	24	14 responsible for organizing and supervising students to teach
25	25	15 them or train them in the fundamental skills of an
26	26	16 interscholastic athletic activity. "Coach" refers to both head
27	27	17 coaches and assistant coaches.
28	28	18 "Interscholastic athletic activity" means any organized
29	29	19 school-sponsored or school-sanctioned activity for students,
30	30	20 generally outside of school instructional hours, under the
31	31	21 direction of a coach, athletic director, or band leader,
32	32	22 including, but not limited to, baseball, basketball,
33	33	23 cheerleading, cross country, fencing, field hockey, football,

68	68	1 golf, gymnastics, ice hockey, lacrosse, marching band, rugby,
69	69	2 soccer, skating, softball, swimming and diving, tennis, track
70	70	3 (indoor and outdoor), ultimate frisbee, volleyball, water
71	71	4 polo, and wrestling. All interscholastic athletics are deemed
72	72	5 to be interscholastic activities.
73	73	6 "Licensed health care professional" means a person who is
74	74	7 a nurse, a physical therapist licensed under the Illinois
75	75	8 Physical Therapy Act, an occupational therapist licensed under
76	76	9 the Illinois Occupational Therapy Practice Act, a physician
77	77	10 assistant, or an athletic trainer.
78	78	11 "Nurse" means a person who is employed by or volunteers at
79	79	12 a school and is licensed under the Nurse Practice Act as a
80	80	13 registered nurse, practical nurse, or advanced practice
81	81	14 registered nurse.
82	82	15 "Physician" means a physician licensed to practice
83	83	16 medicine in all of its branches under the Medical Practice Act
84	84	17 of 1987.
85	85	18 "Physician assistant" means a physician assistant licensed
86	86	19 under the Physician Assistant Practice Act of 1987.
87	87	20 "School" means any public or private elementary or
88	88	21 secondary school, including a charter school.
89	89	22 "Student" means an adolescent or child enrolled in a
90	90	23 school.
91	91	24 (b) Students in grades 9 through 12 must satisfactorily
92	92	25 pass a medical evaluation each year and, if applicable,
93	93	26 receive an electrocardiogram before participating in an

104	104	1 interscholastic athletic activity. The electrocardiogram may
105	105	2 be waived if a parent or guardian of the student objects to the
106	106	3 procedure based on religious tenets or practices or submits a
107	107	4 written request to waive the requirement.
108	108	5 A student in any grade who participates in an
109	109	6 interscholastic athletic activity or who is a candidate for an
110	110	7 interscholastic athletic activity's team must satisfactorily
111	111	8 pass a medical evaluation each year before participating in
112	112	9 the interscholastic athletic activity or engaging in any
113	113	10 practice, tryout, workout, conditioning, or other physical
114	114	11 activity associated with the student's candidacy for the
115	115	12 interscholastic athletic activity, including activities that
116	116	13 occur outside of the school year. The medical evaluation may
117	117	14 be administered only by a licensed health care professional or
118	118	15 a physician.
119	119	16 (c) After a medical evaluation of a student, the licensed
120	120	17 health care professional or the physician performing the
121	121	18 evaluation must complete a preparticipation physical
122	122	19 evaluation form. The evaluation form must incorporate the
123	123	20 recommendations of the American Heart Association for
124	124	21 participation in cardiovascular screening and include all of
125	125	22 the following:
126	126	23 (1) a place for the signature of the licensed health
127	127	24 care professional or the physician performing the
128	128	25 evaluation with an attestation that each examination
129	129	26 procedure listed on the form was performed by the licensed

140	140	1 health care professional or the physician or by someone
141	141	2 under the direct supervision of the licensed health care
142	142	3 professional or the physician;
143	143	4 (2) a place for the licensed health care professional
144	144	5 or the physician to indicate if a referral to another
145	145	6 practitioner was made instead of the completion of a
146	146	7 certain examination procedure;
147	147	8 (3) if applicable, a place for the practitioner to
148	148	9 whom the student was referred to complete the remaining
149	149	10 sections and attest to that portion of the examination;
150	150	11 and
151	151	12 (4) a section advising students to complete a
152	152	13 cardiovascular assessment and informing students of
153	153	14 information concerning alternative cardiovascular
154	154	15 evaluation and diagnostic tests.
155	155	16 (d) Results of a medical evaluation of a student must be
156	156	17 provided to the student's school.
