318 1 AN ACT concerning conservation.
419 2 Be it enacted by the People of the State of Illinois,
520 3 represented in the General Assembly:
621 4 Section 5. The Wildlife Code is amended by changing
722 5 Sections 2.38, 3.1-5, 3.2, 3.5, and 3.36 as follows:

924 7 Sec. 2.38. No person shall at any time:
1025 8 (1) falsify, alter or change in any manner, or provide
1126 9 deceptive or false information required for, any license,
1227 10 permit or tag issued under the provisions hereof;
1328 11 (2) falsify any record required by this Act;
1429 12 (3) counterfeit any form of license, permit or tag
1530 13 provided for by this Act;
1631 14 (4) loan or transfer to another person any license,
1732 15 permit, or tag issued under this Act; or
1833 16 (5) use in the field any license, permit, or tag
1934 17 issued to another person.
2035 18 It is unlawful to possess any license, permit or tag
2136 19 issued under the provisions of this Act which was fraudulently
2237 20 obtained, or which the possessor knew, or should have known,
2338 21 was falsified, altered, changed in any manner or fraudulently

3893 5 Sec. 3.1-5. Apprentice Hunter License Program.
3994 6 (a) The Department shall establish an Apprentice Hunter
4095 7 License Program. The purpose of this Program shall be to
4196 8 extend limited hunting privileges, in lieu of obtaining a
4297 9 valid hunting license, to persons interested in learning about
4398 10 hunting sports.
4499 11 (b) Any resident or nonresident may apply to the
45100 12 Department for an Apprentice Hunter License. The Apprentice
46101 13 Hunter License shall be a non-renewable license that shall
47102 14 expire on the March 31 following the date of issuance.
48103 15 (c) The Apprentice Hunter License shall entitle the
49104 16 licensee to hunt on private property while supervised by a
50105 17 validly licensed resident or nonresident hunter who is 21
51106 18 years of age or older.
52107 19 (c-5) The Apprentice Hunter License shall entitle the
53108 20 licensee to hunt on public property while supervised by a
54109 21 validly licensed resident or nonresident who is 21 years of
55110 22 age or older and has a hunter education certificate.
56111 23 (d) In order to be approved for the Apprentice Hunter
57112 24 License, the applicant must request an Apprentice Hunter

80135 12 Before the Department or any county, city, village, township,
81136 13 incorporated town clerk or the clerk's his duly designated

84139 16 license to any person, the person shall file the person's his

104159 1 appointed. No duly designated agent is authorized to furnish

106161 3 establishment. Each application shall be executed and sworn to

110165 7 after January 1, 1980 unless that person he presents the
111166 8 person who is authorized to issue the license evidence that
112167 9 the person seeking the license he has held a hunting license
113168 10 issued by the State of Illinois or another state in a prior
114169 11 year, or a certificate of competency as provided in this
115170 12 Section. Persons under 18 years of age may be issued a Lifetime
116171 13 Hunting or Sportsmen's Combination License as provided under
117172 14 Section 20-45 of the Fish and Aquatic Life Code but shall not
118173 15 be entitled to hunt alone, without the supervision of an adult
119174 16 age 21 or older, unless they have a certificate of competency
120175 17 as provided in this Section and the certificate is in their
121176 18 possession while hunting.
122177 19 The Department of Natural Resources shall authorize
123178 20 personnel of the Department or certified volunteer instructors
124179 21 to conduct courses, of not less than 10 hours in length, in
125180 22 firearms and hunter safety, which may include training in bow
126181 23 and arrow safety, at regularly specified intervals throughout
127182 24 the State. Persons successfully completing the course shall
128183 25 receive a certificate of competency. The Department of Natural

141196 2 has as one of its objectives the promotion of safety in the
142197 3 handling of firearms or bow and arrow.
143198 4 The Department of Natural Resources shall designate any
144199 5 person found by it to be competent to give instruction in the
145200 6 handling of firearms, hunter safety, and bow and arrow. The
146201 7 persons so appointed shall give the course of instruction and
147202 8 upon the successful completion shall issue to the person
148203 9 instructed a certificate of competency in the safe handling of

150205 11 made for any course of instruction except for materials or
151206 12 ammunition consumed. The Department of Natural Resources shall
152207 13 furnish information on the requirements of hunter safety
153208 14 education programs to be distributed free of charge to
154209 15 applicants for hunting licenses by the persons appointed and
155210 16 authorized to issue licenses. Funds for the conducting of
156211 17 firearms and hunter safety courses shall be taken from the fee
157212 18 charged for the Firearm Owners Identification Card.
158213 19 The fee for a hunting license to hunt all species for a
159214 20 resident of Illinois is $12. For residents age 65 or older,
160215 21 and, commencing with the 2012 license year, resident veterans
161216 22 of the United States Armed Forces after returning from service
162217 23 abroad or mobilization by the President of the United States
163218 24 as an active duty member of the United States Armed Forces, the
164219 25 Illinois National Guard, or the Reserves of the United States

177232 2 Illinois. Veterans must provide to the Department acceptable
178233 3 verification of their service. The Department shall establish
179234 4 by administrative rule the procedure by which such
180235 5 verification of service shall be made to the Department for
181236 6 the purpose of issuing resident veterans hunting licenses at a
182237 7 reduced fee. The fee for a hunting license to hunt all species
183238 8 shall be $1 for residents over 75 years of age. Nonresidents
184239 9 shall be charged $57 for a hunting license.
185240 10 Residents of this State may obtain a 3-year hunting
186241 11 license to hunt all species as described in Section 3.1 for 3
187242 12 times the annual fee. For residents age 65 or older and
188243 13 resident veterans of the United States Armed Forces after
189244 14 returning from service abroad or mobilization by the President
190245 15 of the United States, the fee is one-half of the fee charged
191246 16 for a 3-year hunting license to hunt all species as described
192247 17 in Section 3.1 for a resident of this State. Veterans must
193248 18 provide to the Department, per administrative rule,
194249 19 verification of their service. The Department shall establish
195250 20 what constitutes suitable verification of service for the
196251 21 purpose of issuing resident veterans 3-year hunting licenses
197252 22 at a reduced fee.
198253 23 Nonresidents may be issued a nonresident hunting license
199254 24 for a period not to exceed 10 consecutive days' hunting in the
200255 25 State and shall be charged a fee of $35.

212267 1 nonresident to take game birds by hunting on a game breeding

214269 3 3.27, shall be issued upon proper application being made and

216271 5 The expiration date of this license shall be on the same date
217272 6 each year that game breeding and hunting preserve area

219274 8 Each applicant for a State Migratory Waterfowl Stamp,
220275 9 regardless of the applicant's his residence or other
221276 10 condition, shall pay a fee of $15 and shall receive a stamp.
222277 11 The fee for a State Migratory Waterfowl Stamp shall be waived
223278 12 for residents over 75 years of age. Except as provided under
224279 13 Section 20-45 of the Fish and Aquatic Life Code, the stamp
225280 14 shall be signed by the person or affixed to the person's his
226281 15 license or permit in a space designated by the Department for
227282 16 that purpose.
228283 17 Each applicant for a State Habitat Stamp, regardless of
229284 18 the applicant's his residence or other condition, shall pay a
230285 19 fee of $5 and shall receive a stamp. The fee for a State
231286 20 Habitat Stamp shall be waived for residents over 75 years of
232287 21 age. Except as provided under Section 20-45 of the Fish and
233288 22 Aquatic Life Code, the stamp shall be signed by the person or
234289 23 affixed to the person's his license or permit in a space
235290 24 designated by the Department for that purpose.
236291 25 Nothing in this Section shall be construed as to require

367422 13 (6) A disposition of probation is considered to be a
368423 14 conviction for the purposes of imposing the conditions of
369424 15 probation, for appeal, and for administrative revocation
370425 16 and suspension of licenses and privileges; however,
371426 17 discharge and dismissal under this Section is not a
372427 18 conviction for purposes of disqualification or
373428 19 disabilities imposed by law upon conviction of a crime.
374429 20 (7) Discharge and dismissal under this Section may
375430 21 occur only once with respect to any person.
376431 22 (8) If a person is convicted of an offense under this
377432 23 Act within 5 years subsequent to a discharge and dismissal
378433 24 under this Section, the discharge and dismissal under this
379434 25 Section shall be admissible in the sentencing proceeding
380435 26 for that conviction as a factor in aggravation.

407462 17 of land in which remote control hunting occurs, a computer
408463 18 programmer who designs a program or software to facilitate
409464 19 remote control hunting, or a person who provides weapons or
410465 20 equipment to facilitate remote control hunting, is guilty of a
411466 21 Class A misdemeanor.
412467 22 Any person who violates any of the provisions of Sections
413468 23 1.22, 2.2a, 2.3, 2.4, 2.36, and 2.38, including administrative
414469 24 rules, shall be guilty of a Class A misdemeanor. Any second or
415470 25 subsequent violations of Sections 2.4 and 2.36 shall be a

439494 13 Any person who operates without a permit in violation of
440495 14 subsection (b) of Section 2.37 is guilty of a Class A
441496 15 misdemeanor and subject to a fine of not less than $500. Any
442497 16 other violation of subsection (b) of Section 2.37, including
443498 17 administrative rules, is a Class B misdemeanor.
444499 18 Any person who violates any other of the provisions of
445500 19 this Act including administrative rules, unless otherwise
446501 20 stated, shall be guilty of a petty offense. Offenses committed
447502 21 by minors under the direct control or with the consent of a
448503 22 parent or guardian may subject the parent or guardian to the
449504 23 penalties prescribed in this Section.
450505 24 In addition to any fines imposed pursuant to the
451506 25 provisions of this Section or as otherwise provided in this

548603 15 be in such form as prescribed by the Department. The
549604 16 information required on each license shall be completed
550605 17 thereon by the issuing agent or his sub-agent at the time of
551606 18 issuance and each license shall be signed by the licensee, or
552607 19 initialed by the designated purchaser and then signed
553608 20 immediately upon receipt by the licensee, and countersigned by
554609 21 the issuing agent or his sub-agent at the time of issuance. All
555610 22 such licenses shall be supplied by the Department, subject to
556611 23 such rules and regulations as the Department may prescribe.
557612 24 Any license not properly prepared, obtained and signed as
558613 25 required by this Act shall be void.
559614 26 (e) A person whose license or permit to engage in any

583638 14 (g) Any person whose license, stamps, permits, or any
584639 15 other privilege issued by the Department has been suspended or
585640 16 revoked shall immediately return proof of such privileges to
586641 17 the Department. The Department, or any law enforcement entity,
587642 18 is authorized to take possession of any proof of privileges.
588643 19 Any person failing to comply with this subsection by
589644 20 possessing a suspended or revoked license, stamp, or permit
590645 21 issued by the Department after having received written notice
591646 22 from the Department or any other State agency or department of
592647 23 such suspension or revocation is guilty of a Class A
593648 24 misdemeanor.

626681 21 police officers may seize and impound, at the owner's expense,
627682 22 any snowmobile involved in an accident or a violation of
628683 23 subsection B of Section 5-1 or of Section 5-7 of this Act.

654709 15 released by the arresting law enforcement agency without
655710 16 impoundment, or may be released prior to the end of the
656711 17 impoundment period, however, if:
657712 18 (1) the snowmobile was not owned by the person under
658713 19 arrest, and the lawful owner requesting release of the
659714 20 snowmobile possesses proof of ownership, and would not, as
660715 21 determined by the arresting law enforcement agency: (i)
661716 22 indicate a lack of ability to operate a snowmobile in a
662717 23 safe manner, or (ii) otherwise, by operating the
663718 24 snowmobile, be in violation of this Act; or
664719 25 (2) the snowmobile is owned by the person under

823878 7 investigation of any law enforcement office, that information
824879 8 and information identifying the juvenile may be retained
825880 9 within an intelligence file until the investigation is
826881 10 terminated or the disciplinary action, including appeals, has
827882 11 been completed, whichever is later. Retention of a portion of
828883 12 a juvenile's law enforcement record does not disqualify the
829884 13 remainder of a juvenile's record from immediate automatic
830885 14 expungement.
831886 15 (0.3)(a) Upon an adjudication of delinquency based on any
832887 16 offense except a disqualified offense, the juvenile court
833888 17 shall automatically order the expungement of the juvenile
834889 18 court and law enforcement records 2 years after the juvenile's
835890 19 case was closed if no delinquency or criminal proceeding is
836891 20 pending and the person has had no subsequent delinquency
837892 21 adjudication or criminal conviction. On the date that the
838893 22 minor's sentence ends or the date that the court enters an
839894 23 order committing the minor to the Department of Juvenile

940995 16 an offense, and that person's juvenile law enforcement and
941996 17 juvenile court records are not eligible for automatic
