1212 1 AN ACT concerning safety.
1313 2 Be it enacted by the People of the State of Illinois,
1414 3 represented in the General Assembly:
1515 4 Section 5. The Smoke Detector Act is amended by changing
1616 5 Section 4 and by adding Section 3.1 as follows:
1717 6 (425 ILCS 60/3.1 new)
1818 7 Sec. 3.1. Non-approved smoke detectors banned. It is
1919 8 unlawful for any person to sell, offer for sale, or give as a
2020 9 gift any smoke detector that is not designed to receive
2121 10 primary power from the building wiring or does not meet the
2222 11 battery requirements of subsection (e) of Section 3 of this
2323 12 Act.
2424 13 (425 ILCS 60/4) (from Ch. 127 1/2, par. 804)
2525 14 Sec. 4. (a) Except as provided in subsection (c), willful
2626 15 failure to install or maintain in operating condition any
2727 16 smoke detector required by this Act shall be a Class B
2828 17 misdemeanor.
2929 18 (b) Except as provided in subsection (c), tampering with,
3030 19 removing, destroying, disconnecting or removing the batteries
3131 20 from any installed smoke detector, except in the course of
3232 21 inspection, maintenance or replacement of the detector, shall
3333 22 be a Class A misdemeanor in the case of a first conviction, and
