1414 1 AN ACT concerning education.
1515 2 Be it enacted by the People of the State of Illinois,
1616 3 represented in the General Assembly:
1717 4 Section 5. The School Code is amended by adding Section
1818 5 2-3.118a and by changing Sections 10-20.74 and 27-13.3 as

2323 10 (a) The State Board of Education shall establish a State
2424 11 Instructional Technology Advisory Board, which shall

2626 13 guidance, integration, oversight, and evaluation of education
2727 14 technologies, including, but not limited to, artificial
2828 15 intelligence technologies.
2929 16 (b) The Advisory Board shall consist of the following

3131 18 (1) the State Superintendent of Education or his or
3232 19 her designee, who shall serve as chairperson of the
3333 20 Advisory Board;
3434 21 (2) 3 representatives appointed by a statewide
3535 22 association representing teachers;

9494 16 Superintendent of Education.
9595 17 The members of the Advisory Board shall serve 2-year
9696 18 terms, as long as they continue to meet the criteria under
9797 19 which they were appointed, and may be reappointed without
9898 20 limitation to additional 2-year terms.
9999 21 (c) The State Board of Education shall, in consultation
100100 22 with the Advisory Board, develop standards concerning safety,
101101 23 transparency, data privacy, and educational quality for any
102102 24 artificial intelligence technology that may be used in
103103 25 schools.
104104 26 (1) The State Board of Education shall adopt rules

115115 1 necessary to create these standards and to develop and use
116116 2 a rubric or other method to evaluate artificial
117117 3 intelligence tools and applications against these
118118 4 standards.
119119 5 (2) No later than December 31, 2025 and no later than
120120 6 July 1 of each subsequent calendar year, the State Board
121121 7 of Education shall make a reasonable effort to identify
122122 8 and evaluate the artificial intelligence tools and
123123 9 applications most commonly used in schools in this State,
124124 10 which includes making available a means for educators to
125125 11 request an evaluation of specific tools.
126126 12 (3) No later than December 31, 2025 and no later than
127127 13 July 1 of each subsequent calendar year, the State Board
128128 14 of Education shall publish and provide to school districts
129129 15 a list of technology tools employing artificial
130130 16 intelligence that have been evaluated against these
131131 17 standards and the results of that evaluation. The State
132132 18 Board of Education may update this list from time to time
133133 19 in addition to the required annual publication. This list
134134 20 shall be provided only as an informational resource and
135135 21 may not be used to prohibit or require the use of any
136136 22 artificial intelligence technology by districts. The
137137 23 inclusion of a tool on this list does not constitute an
138138 24 endorsement by the State Board of Education.
139139 25 (d) The State Board of Education shall, in collaboration
140140 26 with the Advisory Board, develop guidance for school districts

152152 2 education. This guidance shall include, but is not limited to:
153153 3 (1) explanations of basic artificial intelligence
154154 4 concepts, including machine learning, natural language
155155 5 processing, and computer vision;
156156 6 (2) specific ways artificial intelligence can be used
157157 7 at the district, school, classroom, and individual level
158158 8 to enhance teaching and learning while preserving the
159159 9 human relationships essential to effective teaching and
160160 10 learning;
161161 11 (3) how districts and individual educators can
162162 12 evaluate and address bias, privacy, and transparency in
163163 13 artificial intelligence technologies and applications,
164164 14 including how they can access the results of evaluations
165165 15 performed by the State Board of Education;
166166 16 (4) best practices for selecting, implementing, and
167167 17 evaluating the use of artificial intelligence technologies
168168 18 and applications;
169169 19 (5) best practices for developing student literacy in
170170 20 artificial intelligence and engaging students in
171171 21 age-appropriate discussions on the responsible and ethical
172172 22 use of artificial intelligence; and
173173 23 (6) best practices for making artificial intelligence
174174 24 technologies and applications available and accessible to
175175 25 all students.
176176 26 (e) The State Board of Education shall provide this

190190 4 The State Board of Education shall develop and offer both
191191 5 synchronous and asynchronous professional development
192192 6 opportunities designed to help educators understand and
193193 7 implement this guidance effectively.
194194 8 The State Board of Education shall review and update the
195195 9 guidance for educators on the use of artificial intelligence
196196 10 in education from time to time as needed and no less than once
197197 11 per year.

199199 13 Sec. 10-20.74. Educational technology capacity and
200200 14 policies; report. School districts shall submit to the State
201201 15 Board of Education, or its designee, an annual report that
202202 16 shall include, at a minimum, information regarding educational
203203 17 technology capacity and policies, including device
204204 18 availability for students, school-based access and
205205 19 infrastructure, professional learning and training
206206 20 opportunities, and documentation of developmentally
207207 21 appropriate computer literacy instruction embedded in the
208208 22 district's curriculum at each grade level, and student,
209209 23 teacher, and district use of artificial intelligence.
