3	11		1 AN ACT concerning transportation.
4	12		2 Be it enacted by the People of the State of Illinois,
5	13		3 represented in the General Assembly:
6	14		4 Section 5. The Illinois Vehicle Code is amended by
7	15		5 changing Section 3-413 as follows:
8	16		6 (625 ILCS 5/3-413) (from Ch. 95 1/2, par. 3-413)
9	17		7 Sec. 3-413. Display of registration plates or digital
10	18		8 registration plates, registration stickers or digital
11	19		9 registration stickers, and drive-away permits; registration
12	20		10 plate or digital registration plate covers.
13	21		11 (a) Registration plates or digital registration plates
14	22		12 issued for a motor vehicle other than a motorcycle, autocycle,
15	23		13 trailer, semitrailer, truck-tractor, apportioned bus, or
16	24		14 apportioned truck shall be attached thereto, one in the
17	25		15 frontmost and one in the rearmost. The registration plate or
18	26		16 digital registration plate issued for a motorcycle, autocycle,
19	27		17 trailer or semitrailer required to be registered hereunder and
20	28		18 any apportionment plate issued to a bus under the provisions
21	29		19 of this Code shall be attached to the rearmost thereof. The
22	30		20 registration plate or digital registration plate issued for a
23	31		21 truck-tractor or an apportioned truck required to be
24	32		22 registered hereunder shall be attached to the frontmost
25	33		23 thereof.

34	68		1 (b) Except for vehicles with rear loaded motorized
35	69		2 forklifts, every registration plate or digital registration
36	70		3 plate shall at all times be securely fastened in a horizontal
37	71		4 position to the vehicle for which it is issued so as to prevent
38	72		5 the plate from swinging and at a height of not less than 5
39	73		6 inches from the ground, measuring from the bottom of such
40	74		7 plate, in a place and position to be clearly visible and shall
41	75		8 be maintained in a condition to be clearly legible, free from
42	76		9 any materials that would obstruct the visibility of the plate.
43	77		10 A registration plate or digital registration plate on a
44	78		11 motorcycle may be mounted vertically as long as it is
45	79		12 otherwise clearly visible. Registration stickers or digital
46	80		13 registration stickers issued as evidence of renewed annual
47	81		14 registration shall be attached to registration plates or
48	82		15 displayed on digital registration plates as required by the
49	83		16 Secretary of State, and be clearly visible at all times and
50	84		17 displayed as prescribed in subsection (k). For those vehicles
51	85		18 with rear loaded motorized forklifts, if the rear plate is
52	86		19 securely fastened in a horizontal position as prescribed, the
53	87		20 plate and registration sticker shall not be required to be
54	88		21 clearly visible at all times as a result of the rear mounted
55	89		22 motorized forklift obstructing the view.
56	90		23 (c) Every drive-away permit issued pursuant to this Code
57	91		24 shall be firmly attached to the motor vehicle in the manner
58	92		25 prescribed by the Secretary of State. If a drive-away permit

70	104		1 shall be void and of no effect.
71	105		2 (d) The Illinois prorate decal issued to a foreign
72	106		3 registered vehicle part of a fleet prorated or apportioned
73	107		4 with Illinois, shall be displayed on a registration plate or
74	108		5 digital registration plate and displayed on the frontmost of
75	109		6 such vehicle in the same manner as an Illinois registration
76	110		7 plate or digital registration plate.
77	111		8 (e) The registration plate or digital registration plate
78	112		9 issued for a camper body mounted on a truck displaying
79	113		10 registration plates or digital registration plates shall be
80	114		11 attached to the rearmost of the camper body.
81	115		12 (f) No person shall operate a vehicle, nor permit the
82	116		13 operation of a vehicle, upon which is displayed an Illinois
83	117		14 registration plate or plates or digital registration plate or
84	118		15 plates or registration stickers or digital registration
85	119		16 stickers, except as provided for in subsection (b) of Section
86	120		17 3-701 of this Code, after the termination of the registration
87	121		18 period for which issued or after the expiration date set
88	122		19 pursuant to Sections 3-414 and 3-414.1 of this Code.
89	123		20 (g) A person may not operate any motor vehicle that is
90	124		21 equipped with registration plate or digital registration plate
91	125		22 covers. A violation of this subsection (g) or a similar
92	126		23 provision of a local ordinance is an offense against laws and
93	127		24 ordinances regulating the movement of traffic.
94	128		25 (h) A person may not sell or offer for sale a registration
95	129		26 plate or digital registration plate cover. A violation of this

106	140		1 subsection (h) is a business offense.
107	141		2 (i) A person may not advertise for the purpose of
108	142		3 promoting the sale of registration plate or digital
109	143		4 registration plate covers. A violation of this subsection (i)
110	144		5 is a business offense.
111	145		6 (j) A person may not modify the original manufacturer's
112	146		7 mounting location of the rear registration plate or digital
113	147		8 registration plate on any vehicle so as to conceal the
114	148		9 registration or to knowingly cause it to be obstructed in an
115	149		10 effort to hinder a peace officer from obtaining the
116	150		11 registration for the enforcement of a violation of this Code,
117	151		12 Section 27.1 of the Toll Highway Act concerning toll evasion,
118	152		13 or any municipal ordinance. Modifications prohibited by this
119	153		14 subsection (j) include but are not limited to the use of an
120	154		15 electronic device. A violation of this subsection (j) is a
121	155		16 Class A misdemeanor.
122	156		17 (k) Registration stickers issued as evidence of renewed
123	157		18 registration by the Secretary shall be displayed on the upper
124	158		19 right corner of the rear registration plate or in a manner
125	159		20 otherwise provided by the Secretary. However, registration
126	160		21 stickers issued to truck-tractors shall be displayed on the
127	161		22 upper right corner of the front registration plate or in a
128	162		23 manner otherwise provided by the Secretary.
129	163		24 (l) No person shall affix to any registration plate,
130	164		25 temporary registration plate, digital registration plate,

142		-	1 by the Secretary any medallion, insignia, sticker, tape, or
