318 1 AN ACT concerning State government.
419 2 Be it enacted by the People of the State of Illinois,
520 3 represented in the General Assembly:
621 4 Section 5. The 2-1-1 Service Act is amended by changing
722 5 Sections 5, 10, 20, 30, 45, 55, and 60 as follows:

924 7 Sec. 5. Findings. The General Assembly finds that the
1025 8 implementation of a single, easy to use telephone number,
1126 9 2-1-1, for public access to information and referral for
1227 10 health and human services and information about access to
1328 11 services after a natural or non-natural disaster will benefit
1429 12 the residents citizens of this State by providing easier
1530 13 access to available health and human services, by reducing
1631 14 inefficiencies in connecting people with the desired service
1732 15 providers, and by reducing duplication of efforts.

3388 1 "Department" means the Department of Human Services.
3489 2 "Lead entity" means an Illinois 501(c)(3) non-profit
3590 3 agency or organization designated by the Department to manage
3691 4 use of the 2-1-1 dialing code for the purpose of providing the
3792 5 public access to information about health and human services.
3893 6 "Approved 2-1-1 service provider" means a public or
3994 7 nonprofit agency or other organization designated by the lead
4095 8 entity to provide 2-1-1 services and to be an authorized user
4196 9 of the 2-1-1 dialing code in a 2-1-1 service area.
4297 10 "2-1-1 service area" means an area of Illinois identified
4398 11 by the lead entity as an area within which an approved a
4499 12 recognized 2-1-1 service provider is authorized to provide
45100 13 2-1-1 services.
46101 14 "2-1-1 services" means information and referral services
47102 15 provided through the use of 2-1-1 and intended to promote and
48103 16 provide access to human services, and to aid in disaster
49104 17 response and recovery.
50105 18 "Recognized 2-1-1 service provider" means an organization
51106 19 recognized by the lead entity as an appropriate administrator
52107 20 and authorized user of the 2-1-1 dialing code in a 2-1-1
53108 21 service area.
54109 22 "Human services" means services provided by government,
55110 23 nonprofit, or other designated faith-based organizations to
56111 24 ensure the health and well-being of Illinois residents. "Human
57112 25 services" includes services designed to provide relief or
58113 26 assistance after a natural or non-natural disaster.

69124 1 "Pay telephone" means any coin, coinless, or credit card
70125 2 reader telephone, provided that the end user pays or arranges
71126 3 to pay for exchange and interexchange, intraMSA, and interMSA
72127 4 calls from such instrument on an individual call basis.
73128 5 "Private branch exchange" or "PBX" means a private
74129 6 telephone system and associated equipment located on the
75130 7 user's property that provides communications between stations
76131 8 and external networks.
77132 9 "Telecommunications carrier" has the same meaning ascribed
78133 10 to that term in Section 13-202 of the Public Utilities Act.

81136 13 Sec. 20. Designation of lead entity for 2-1-1.
82137 14 (a) Subject to subsection (e) of this Section, the
83138 15 Department is authorized to identify, designate, and enter
84139 16 into a contract with a lead entity to provide governance and
85140 17 oversight, including the ability to design, implement,
86141 18 support, and coordinate a State-wide 2-1-1 system.
87142 19 (b) Qualifications for designation of the lead entity
88143 20 shall include:
89144 21 (1) a public or private governance structure with
90145 22 representation from and active collaboration with State
91146 23 health and human service departments, specifically the
92147 24 Department, the Department of Healthcare and Family

104159 1 Rights, the Department of Public Health, the Illinois
105160 2 Emergency Management Agency, the Illinois Commerce
106161 3 Commission, and non-governmental entity stakeholders;
107162 4 non-governmental entity stakeholders shall constitute a
108163 5 minimum of two-thirds of the representatives;
109164 6 (2) demonstrated expertise or experience, or both, in
110165 7 planning, supporting, and overseeing administration of for
111166 8 a State-wide information and referral system; and
112167 9 (3) demonstrated support from community partners,
113168 10 including local 2-1-1 service providers; .
114169 11 (4) demonstrated expertise in providing access to
115170 12 health and human services; and
116171 13 (5) a demonstrated track record of securing
117172 14 diversified funding sources, and evidence of existing
118173 15 diversified funding sources, in order to support
119174 16 sustainable operation of 2-1-1.
120175 17 (c) The lead entity shall encourage the orderly and
121176 18 efficient use of 2-1-1 to:
122177 19 (1) provide referrals and access to human services;
123178 20 and
124179 21 (2) collect needed information about the demand for
125180 22 human services and the delivery of human services in
126181 23 Illinois.
127182 24 (d) The lead entity shall establish standards consistent
128183 25 with prevailing national standards established for providing

140195 1 2-1-1 callers. The standards shall prescribe the technology or
141196 2 manner of delivering 2-1-1 calls and shall not exceed any
142197 3 requirements for 2-1-1 systems set by the Federal
143198 4 Communications Commission. The standards shall be consistent
144199 5 with the Americans with Disabilities Act, ensuring
145200 6 accessibility for users of Teletypewriters for the Deaf (TTY).
146201 7 (e) (d) The lead entity shall provide periodic
147202 8 programmatic and fiscal reports on activities,
148203 9 accomplishments, and other issues to the Department, as
149204 10 outlined in Section 60.
150205 11 (f) (e) In awarding the contract under subsection (a) of
151206 12 this Section, the Department shall ensure that the 2-1-1 lead
152207 13 entity has the organizational capacity to carry out the terms
153208 14 of the contract and that the contract is cost-neutral to the
154209 15 Department.

157212 18 Sec. 30. 2-1-1 services. Only a service provider approved
158213 19 by the lead entity may provide 2-1-1 telephone services. The
159214 20 lead entity shall approve 2-1-1 service providers, after
160-21 considering all of the following, and such approval shall be
161-22 contingent upon 2-1-1 service providers continuing to meet
162-23 minimum qualifications as determined by the lead entity:
163-24 (1) the ability of the proposed 2-1-1 service provider
164-25 to meet the prevailing national 2-1-1 standards and

185-11 The lead entity may remove an approved 2-1-1 service
186-12 provider for failure to meet minimum qualifications, or for
187-13 failure to perform activities required in this Act or its
188-14 contract with the lead entity.

191-17 Sec. 45. Liability of 2-1-1 providers or
