1313 1 AN ACT concerning victims of violence.
1414 2 Be it enacted by the People of the State of Illinois,
1515 3 represented in the General Assembly:
1616 4 Section 5. The Code of Criminal Procedure of 1963 is
1717 5 amended by changing Section 112A-23 as follows:

1919 7 Sec. 112A-23. Enforcement of protective orders.
2020 8 (a) When violation is crime. A violation of any protective
2121 9 order, whether issued in a civil, quasi-criminal proceeding or
2222 10 by a military judge, shall be enforced by a criminal court
2323 11 when:
2424 12 (1) The respondent commits the crime of violation of a
2525 13 domestic violence order of protection pursuant to Section
2626 14 12-3.4 or 12-30 of the Criminal Code of 1961 or the
2727 15 Criminal Code of 2012, by having knowingly violated:
2828 16 (i) remedies described in paragraph (1), (2), (3),
2929 17 (14), or (14.5) of subsection (b) of Section 112A-14
3030 18 of this Code,
3131 19 (ii) a remedy, which is substantially similar to
3232 20 the remedies authorized under paragraph (1), (2), (3),
3333 21 (14), or (14.5) of subsection (b) of Section 214 of the
3434 22 Illinois Domestic Violence Act of 1986, in a valid

7676 3 (iii) any other remedy when the act constitutes a

7979 6 Prosecution for a violation of a domestic violence
8080 7 order of protection shall not bar concurrent prosecution
8181 8 for any other crime, including any crime that may have
8282 9 been committed at the time of the violation of the
8383 10 domestic violence order of protection; or
8484 11 (2) The respondent commits the crime of child
8585 12 abduction pursuant to Section 10-5 of the Criminal Code of
8686 13 1961 or the Criminal Code of 2012, by having knowingly
8787 14 violated:
8888 15 (i) remedies described in paragraph (5), (6), or
8989 16 (8) of subsection (b) of Section 112A-14 of this Code,
9090 17 or
9191 18 (ii) a remedy, which is substantially similar to
9292 19 the remedies authorized under paragraph (1), (5), (6),
9393 20 or (8) of subsection (b) of Section 214 of the Illinois
9494 21 Domestic Violence Act of 1986, in a valid domestic
9595 22 violence order of protection, which is authorized
9696 23 under the laws of another state, tribe, or United
9797 24 States territory.
9898 25 (3) The respondent commits the crime of violation of a

110110 1 Section 12-3.8 of the Criminal Code of 2012. Prosecution
111111 2 for a violation of a civil no contact order shall not bar
112112 3 concurrent prosecution for any other crime, including any
113113 4 crime that may have been committed at the time of the
114114 5 violation of the civil no contact order.
115115 6 (4) The respondent commits the crime of violation of a
116116 7 stalking no contact order when the respondent violates
117117 8 Section 12-3.9 of the Criminal Code of 2012. Prosecution
118118 9 for a violation of a stalking no contact order shall not
119119 10 bar concurrent prosecution for any other crime, including
120120 11 any crime that may have been committed at the time of the
121121 12 violation of the stalking no contact order.
122122 13 (b) When violation is contempt of court. A violation of
123123 14 any valid protective order, whether issued in a civil or
124124 15 criminal proceeding or by a military judge, may be enforced
125125 16 through civil or criminal contempt procedures, as appropriate,
126126 17 by any court with jurisdiction, regardless where the act or
127127 18 acts which violated the protective order were committed, to
128128 19 the extent consistent with the venue provisions of this
129129 20 Article. Nothing in this Article shall preclude any Illinois
130130 21 court from enforcing any valid protective order issued in
131131 22 another state. Illinois courts may enforce protective orders
132132 23 through both criminal prosecution and contempt proceedings,
133133 24 unless the action which is second in time is barred by
134134 25 collateral estoppel or the constitutional prohibition against
135135 26 double jeopardy.

146146 1 (1) In a contempt proceeding where the petition for a
147147 2 rule to show cause sets forth facts evidencing an
148148 3 immediate danger that the respondent will flee the
149149 4 jurisdiction, conceal a child, or inflict physical abuse
150150 5 on the petitioner or minor children or on dependent adults
151151 6 in petitioner's care, the court may order the attachment
152152 7 of the respondent without prior service of the rule to
153153 8 show cause or the petition for a rule to show cause. Bond
154154 9 shall be set unless specifically denied in writing.
155155 10 (2) A petition for a rule to show cause for violation
156156 11 of a protective order shall be treated as an expedited
157157 12 proceeding.
158158 13 (c) Violation of custody, allocation of parental
159159 14 responsibility, or support orders. A violation of remedies
160160 15 described in paragraph (5), (6), (8), or (9) of subsection (b)
161161 16 of Section 112A-14 of this Code may be enforced by any remedy
162162 17 provided by Section 607.5 of the Illinois Marriage and
163163 18 Dissolution of Marriage Act. The court may enforce any order
164164 19 for support issued under paragraph (12) of subsection (b) of
165165 20 Section 112A-14 of this Code in the manner provided for under
166166 21 Parts V and VII of the Illinois Marriage and Dissolution of
167167 22 Marriage Act.
168168 23 (d) Actual knowledge. A protective order may be enforced
169169 24 pursuant to this Section if the respondent violates the order
170170 25 after the respondent has actual knowledge of its contents as

188188 7 (e) The enforcement of a protective order in civil or
189189 8 criminal court shall not be affected by either of the
190190 9 following:
191191 10 (1) The existence of a separate, correlative order
192192 11 entered under Section 112A-15 of this Code.
193193 12 (2) Any finding or order entered in a conjoined
194194 13 criminal proceeding.
195195 14 (e-5) If a civil no contact order entered under subsection
196196 15 (6) of Section 112A-20 of the Code of Criminal Procedure of
197197 16 1963 conflicts with an order issued pursuant to the Juvenile
198198 17 Court Act of 1987 or the Illinois Marriage and Dissolution of
199199 18 Marriage Act, the conflicting order issued under subsection
200200 19 (6) of Section 112A-20 of the Code of Criminal Procedure of
201201 20 1963 shall be void.
202202 21 (f) Circumstances. The court, when determining whether or
203203 22 not a violation of a protective order has occurred, shall not
204204 23 require physical manifestations of abuse on the person of the
205205 24 victim.
206206 25 (g) Penalties.
207207 26 (1) Except as provided in paragraph (3) of this

218218 1 subsection (g), where the court finds the commission of a
219219 2 crime or contempt of court under subsection (a) or (b) of
220220 3 this Section, the penalty shall be the penalty that
221221 4 generally applies in such criminal or contempt
222222 5 proceedings, and may include one or more of the following:
223223 6 incarceration, payment of restitution, a fine, payment of
224224 7 attorneys' fees and costs, or community service.
225225 8 (2) The court shall hear and take into account
226226 9 evidence of any factors in aggravation or mitigation
227227 10 before deciding an appropriate penalty under paragraph (1)
228228 11 of this subsection (g).
229229 12 (3) To the extent permitted by law, the court is
230230 13 encouraged to:
231231 14 (i) increase the penalty for the knowing violation
232232 15 of any protective order over any penalty previously
233233 16 imposed by any court for respondent's violation of any
234234 17 protective order or penal statute involving petitioner
235235 18 as victim and respondent as defendant;
236236 19 (ii) impose a minimum penalty of 48 24 hours
237237 20 imprisonment for respondent's first violation of any
238238 21 protective order; and
239239 22 (iii) impose a minimum penalty of 96 48 hours
240240 23 imprisonment for respondent's second or subsequent
241241 24 violation of a protective order
242242 25 unless the court explicitly finds that an increased
243243 26 penalty or that period of imprisonment would be manifestly

255255 2 (4) In addition to any other penalties imposed for a
256256 3 violation of a protective order, a criminal court may
257257 4 consider evidence of any violations of a protective order:
258258 5 (i) to modify the conditions of pretrial release
259259 6 on an underlying criminal charge pursuant to Section
260260 7 110-6 of this Code;
261261 8 (ii) to revoke or modify an order of probation,
262262 9 conditional discharge, or supervision, pursuant to
263263 10 Section 5-6-4 of the Unified Code of Corrections;
264264 11 (iii) to revoke or modify a sentence of periodic
265265 12 imprisonment, pursuant to Section 5-7-2 of the Unified
266266 13 Code of Corrections.

274274 21 (a) Nothing in this Act shall preclude any Illinois court
275275 22 from enforcing a valid protective order issued in another

292292 5 (b-1) The court shall not hold a school district or
293293 6 private or non-public school or any of its employees in civil
294294 7 or criminal contempt unless the school district or private or
295295 8 non-public school has been allowed to intervene.
296296 9 (b-2) The court may hold the parents, guardian, or legal
297297 10 custodian of a minor respondent in civil or criminal contempt
298298 11 for a violation of any provision of any order entered under
299299 12 this Act for conduct of the minor respondent in violation of
300300 13 this Act if the parents, guardian, or legal custodian
301301 14 directed, encouraged, or assisted the respondent minor in such
302302 15 conduct.
303303 16 (c) Criminal prosecution. A violation of any civil no
304304 17 contact order, whether issued in a civil or criminal
305305 18 proceeding or by a military judge, shall be enforced by a
306306 19 criminal court when the respondent commits the crime of
307307 20 violation of a civil no contact order pursuant to Section 219
308308 21 by having knowingly violated:
309309 22 (1) remedies described in Section 213 and included in
310310 23 a civil no contact order; or
311311 24 (2) a provision of an order, which is substantially
312312 25 similar to provisions of Section 213, in a valid civil no
313313 26 contact order which is authorized under the laws of

325325 2 Prosecution for a violation of a civil no contact order

329329 6 (d) Contempt of court. A violation of any valid Illinois
330330 7 civil no contact order, whether issued in a civil or criminal
331331 8 proceeding, may be enforced through civil or criminal contempt
332332 9 procedures, as appropriate, by any court with jurisdiction,
333333 10 regardless of where the act or acts which violated the civil no
334334 11 contact order were committed, to the extent consistent with
335335 12 the venue provisions of this Act.
336336 13 (1) In a contempt proceeding where the petition for a
337337 14 rule to show cause or petition for adjudication of
338338 15 criminal contempt sets forth facts evidencing an immediate
339339 16 danger that the respondent will flee the jurisdiction or
340340 17 inflict physical abuse on the petitioner or minor children
341341 18 or on dependent adults in the petitioner's care, the court
342342 19 may order the attachment of the respondent without prior
343343 20 service of the petition for a rule to show cause, the rule
344344 21 to show cause, the petition for adjudication of criminal
345345 22 contempt or the adjudication of criminal contempt.
346346 23 Conditions of release shall be set unless specifically
347347 24 denied in writing.
348348 25 (2) A petition for a rule to show cause or a petition

360360 1 civil no contact order shall be treated as an expedited
361361 2 proceeding.
362362 3 (e) Actual knowledge. A civil no contact order may be
363363 4 enforced pursuant to this Section if the respondent violates
364364 5 the order after the respondent has actual knowledge of its
365365 6 contents as shown through one of the following means:
366366 7 (1) by service, delivery, or notice under Section 208;
367367 8 (2) by notice under Section 218;
368368 9 (3) by service of a civil no contact order under
369369 10 Section 218; or
370370 11 (4) by other means demonstrating actual knowledge of
371371 12 the contents of the order.
372372 13 (f) The enforcement of a civil no contact order in civil or
373373 14 criminal court shall not be affected by either of the
374374 15 following:
375375 16 (1) the existence of a separate, correlative order,
376376 17 entered under Section 202; or
377377 18 (2) any finding or order entered in a conjoined
378378 19 criminal proceeding.

420420 25 explicitly finds that an increased penalty or that
421421 26 period of imprisonment would be manifestly unjust.

450450 19 (a) When violation is crime. A violation of any order of
451451 20 protection, whether issued in a civil or criminal proceeding
452452 21 or by a military judge, shall be enforced by a criminal court
453453 22 when:
454454 23 (1) The respondent commits the crime of violation of
455455 24 an order of protection pursuant to Section 12-3.4 or 12-30

467467 2 by having knowingly violated:
468468 3 (i) remedies described in paragraphs (1), (2),
469469 4 (3), (14), or (14.5) of subsection (b) of Section 214
470470 5 of this Act; or
471471 6 (ii) a remedy, which is substantially similar to
472472 7 the remedies authorized under paragraphs (1), (2),
473473 8 (3), (14), and (14.5) of subsection (b) of Section 214
474474 9 of this Act, in a valid order of protection which is
475475 10 authorized under the laws of another state, tribe, or
476476 11 United States territory; or
477477 12 (iii) any other remedy when the act constitutes a
478478 13 crime against the protected parties as defined by the
479479 14 Criminal Code of 1961 or the Criminal Code of 2012.
480480 15 Prosecution for a violation of an order of protection
481481 16 shall not bar concurrent prosecution for any other crime,
482482 17 including any crime that may have been committed at the
483483 18 time of the violation of the order of protection; or
484484 19 (2) The respondent commits the crime of child
485485 20 abduction pursuant to Section 10-5 of the Criminal Code of
486486 21 1961 or the Criminal Code of 2012, by having knowingly
487487 22 violated:
488488 23 (i) remedies described in paragraphs (5), (6) or
489489 24 (8) of subsection (b) of Section 214 of this Act; or
490490 25 (ii) a remedy, which is substantially similar to
491491 26 the remedies authorized under paragraphs (5), (6), or

502502 1 (8) of subsection (b) of Section 214 of this Act, in a
503503 2 valid order of protection which is authorized under
504504 3 the laws of another state, tribe, or United States
505505 4 territory.
506506 5 (b) When violation is contempt of court. A violation of
507507 6 any valid Illinois order of protection, whether issued in a
508508 7 civil or criminal proceeding or by a military judge, may be
509509 8 enforced through civil or criminal contempt procedures, as
510510 9 appropriate, by any court with jurisdiction, regardless where
511511 10 the act or acts which violated the order of protection were
512512 11 committed, to the extent consistent with the venue provisions
513513 12 of this Act. Nothing in this Act shall preclude any Illinois
514514 13 court from enforcing any valid order of protection issued in
515515 14 another state. Illinois courts may enforce orders of
516516 15 protection through both criminal prosecution and contempt
517517 16 proceedings, unless the action which is second in time is
518518 17 barred by collateral estoppel or the constitutional
519519 18 prohibition against double jeopardy.
520520 19 (1) In a contempt proceeding where the petition for a
521521 20 rule to show cause sets forth facts evidencing an
522522 21 immediate danger that the respondent will flee the
523523 22 jurisdiction, conceal a child, or inflict physical abuse
524524 23 on the petitioner or minor children or on dependent adults
525525 24 in petitioner's care, the court may order the attachment
526526 25 of the respondent without prior service of the rule to
527527 26 show cause or the petition for a rule to show cause.

538538 1 Conditions of release shall be set unless specifically
539539 2 denied in writing.
540540 3 (2) A petition for a rule to show cause for violation
541541 4 of an order of protection shall be treated as an expedited
542542 5 proceeding.
543543 6 (b-1) The court shall not hold a school district or
544544 7 private or non-public school or any of its employees in civil
545545 8 or criminal contempt unless the school district or private or
546546 9 non-public school has been allowed to intervene.
547547 10 (b-2) The court may hold the parents, guardian, or legal
548548 11 custodian of a minor respondent in civil or criminal contempt
549549 12 for a violation of any provision of any order entered under
550550 13 this Act for conduct of the minor respondent in violation of
551551 14 this Act if the parents, guardian, or legal custodian
552552 15 directed, encouraged, or assisted the respondent minor in such
553553 16 conduct.
554554 17 (c) Violation of custody or support orders or temporary or
555555 18 final judgments allocating parental responsibilities. A
556556 19 violation of remedies described in paragraphs (5), (6), (8),
557557 20 or (9) of subsection (b) of Section 214 of this Act may be
558558 21 enforced by any remedy provided by Section 607.5 of the
559559 22 Illinois Marriage and Dissolution of Marriage Act. The court
560560 23 may enforce any order for support issued under paragraph (12)
561561 24 of subsection (b) of Section 214 in the manner provided for
562562 25 under Parts V and VII of the Illinois Marriage and Dissolution

574574 1 (d) Actual knowledge. An order of protection may be
575575 2 enforced pursuant to this Section if the respondent violates
576576 3 the order after the respondent has actual knowledge of its
577577 4 contents as shown through one of the following means:
578578 5 (1) By service, delivery, or notice under Section 210.
579579 6 (2) By notice under Section 210.1 or 211.
580580 7 (3) By service of an order of protection under Section
581581 8 222.
582582 9 (4) By other means demonstrating actual knowledge of
583583 10 the contents of the order.
584584 11 (e) The enforcement of an order of protection in civil or
585585 12 criminal court shall not be affected by either of the
586586 13 following:
587587 14 (1) The existence of a separate, correlative order,
588588 15 entered under Section 215.
589589 16 (2) Any finding or order entered in a conjoined
590590 17 criminal proceeding.
591591 18 (f) Circumstances. The court, when determining whether or
592592 19 not a violation of an order of protection has occurred, shall
593593 20 not require physical manifestations of abuse on the person of
594594 21 the victim.
595595 22 (g) Penalties.
596596 23 (1) Except as provided in paragraph (3) of this
597597 24 subsection, where the court finds the commission of a
598598 25 crime or contempt of court under subsections (a) or (b) of
599599 26 this Section, the penalty shall be the penalty that

610610 1 generally applies in such criminal or contempt
611611 2 proceedings, and may include one or more of the following:
612612 3 incarceration, payment of restitution, a fine, payment of
613613 4 attorneys' fees and costs, or community service.
614614 5 (2) The court shall hear and take into account
615615 6 evidence of any factors in aggravation or mitigation
616616 7 before deciding an appropriate penalty under paragraph (1)
617617 8 of this subsection.
618618 9 (3) To the extent permitted by law, the court is
619619 10 encouraged to:
620620 11 (i) increase the penalty for the knowing violation
621621 12 of any order of protection over any penalty previously
622622 13 imposed by any court for respondent's violation of any
623623 14 order of protection or penal statute involving
624624 15 petitioner as victim and respondent as defendant;
625625 16 (ii) impose a minimum penalty of 48 24 hours
626626 17 imprisonment for respondent's first violation of any
627627 18 order of protection; and
628628 19 (iii) impose a minimum penalty of 96 48 hours
629629 20 imprisonment for respondent's second or subsequent
630630 21 violation of an order of protection
631631 22 unless the court explicitly finds that an increased
632632 23 penalty or that period of imprisonment would be manifestly
633633 24 unjust.
634634 25 (4) In addition to any other penalties imposed for a
635635 26 violation of an order of protection, a criminal court may
