311 1 AN ACT concerning regulation.
412 2 Be it enacted by the People of the State of Illinois,
513 3 represented in the General Assembly:
614 4 Section 5. The Illinois Explosives Act is amended by
715 5 changing Sections 1003, 2000, 2001, 2005, 2011, 3001, 3004,
816 6 4003, 5001, 5010, and 5011 and by adding Article 6 as follows:

1018 8 Sec. 1003. Definitions. As used in this Act:
1119 9 (a) "Person" means any individual, corporation, company,
1220 10 association, partnership, or other legal entity.
1321 11 (b) "Explosive materials" means explosives, blasting
1422 12 agents, water gels, and detonators, and all items included
1523 13 with the "List of Explosive Materials" located in 27 CFR
1624 14 555.23.
1725 15 (c) "Explosive" means any chemical compound, mixture, or
1826 16 device (1) the primary or common purpose of which is to
1927 17 function by explosion and (2) that is or can be classified as a
2028 18 Division 1.1, 1.2, or 1.3 material under 49 CFR 173.50 or items
2129 19 included within the "List of Explosive Materials" provided in
2230 20 27 CFR 555.23, as now or hereafter amended, renumbered, or
2331 21 succeeded. The term includes high and low explosives ,any
2432 22 explosive devices weighing over one quarter ounce of explosive
2533 23 material, and display fireworks. "Explosive" does not include

3468 1 consumer fireworks that have a bulk total gross weight of
3569 2 under 1,001 pounds.
3670 3 (d) "Blasting agent" means any material or mixture that
3771 4 (1) consists of a fuel and oxidizer intended for blasting, not
3872 5 otherwise defined as an explosive, provided that the finished
3973 6 product, as mixed and packaged for use or shipment, cannot be
4074 7 detonated by means of a No. 8 blasting cap, as defined by the
4175 8 Bureau of Alcohol, Tobacco, Firearms and Explosives, U.S.
4276 9 Department of Treasury, when unconfined and (2) is classified
4377 10 as a Division 1.5 material under 49 CFR 173.50, as now or
4478 11 hereafter amended, renumbered, or succeeded.
4579 12 (d-5) (Blank). "Crime punishable by imprisonment for a
4680 13 term exceeding one year" does not mean (1) any federal or state
4781 14 offenses pertaining to antitrust violations, unfair trade
4882 15 practices, restraint of trade, or similar offenses relating to
4983 16 the regulation of business practices as the Secretary of the
5084 17 Treasury may by regulation designate or (2) any State offense,
5185 18 other than one involving a firearm or explosive, classified by
5286 19 the laws of the State as a misdemeanor or punishable by a term
5387 20 of imprisonment of 2 years or less.
5488 21 (e) "Detonator" means any device that (1) contains any
5589 22 initiating or primary explosive that is used for initiating
5690 23 detonation and (2) is classified as Division 1.1 or 1.4

5892 25 renumbered, or succeeded. A detonator may not contain more

71105 2 (f) "Highway" means any public street, public road, or
72106 3 public alley and includes privately financed, constructed, or
73107 4 maintained roads that are regularly and openly traveled by the
74108 5 general public.
75109 6 (g) "Railroad" or "railway" means any public steam,
76110 7 electric or other railroad or rail system which carries
77111 8 passengers for hire, but shall not include auxiliary tracks,
78112 9 spurs and sidings installed and primarily used in serving any
79113 10 mine, quarry or plant.
80114 11 (h) "Building" means and includes any building regularly
81115 12 occupied, in whole or in part, as a habitation for human
82116 13 beings, and any church, schoolhouse, railway station or other
83117 14 building where people are accustomed to assemble, but does not
84118 15 mean or include any buildings of a mine or quarry or any of the
85119 16 buildings of a manufacturing plant where the business of
86120 17 manufacturing explosive materials is conducted.
87121 18 (i) "Factory building" means any building or other
88122 19 structure in which the manufacture or any part of the
89123 20 manufacture of explosive materials is conducted.
90124 21 (j) "Magazine" means any building or other structure or
91125 22 container, other than a factory building, used to store
92126 23 explosive materials. Where mobile or portable type 5 magazines
93127 24 are permissible and used, "magazine", for the purpose of
94128 25 obtaining certificates and calculating fees, means the site on
95129 26 which such magazines are located.

106140 1 (k) "Magazine keeper" means a qualified supervisory person
107141 2 with an Illinois Individual Explosives License licensed by the
108142 3 Department under Article 2 of this Act who is responsible for
109143 4 the acquisition, storage, use, possession, transfer, and
110144 5 disposal of explosive materials, including inventory and
111145 6 transaction records, and the proper maintenance of explosive
112146 7 materials, storage magazines, and surrounding areas.
113147 8 (l) "Black powder" means a deflagrating or low explosive
114148 9 compound of an intimate mixture of sulfur, charcoal and an
115149 10 alkali nitrate, usually potassium or sodium nitrate.
116150 11 (m) "Municipality" means cities, villages, incorporated
117151 12 towns, and townships.
118152 13 (n) "Fugitive from justice" means any individual who has
119153 14 fled from the jurisdiction of any court of record to avoid
120154 15 prosecution for any crime or to avoid giving testimony in any
121155 16 criminal proceeding. This term shall also include any
122156 17 individual who has been convicted of any crime and has fled to
123157 18 avoid imprisonment.
124158 19 (o) "Department" means the Department of Natural
125159 20 Resources.
126160 21 (p) (Blank).
127161 22 (q) "Director" means the Director of Natural Resources.
128162 23 (r) "Storage certificate" means the certificate issued by
129163 24 the Department under Article 3 of this Act that authorizes the
130164 25 holder to store explosive materials in the magazine for which

142176 1 (s) "License" or "Illinois Individual Explosives License"
143177 2 means a that license that is issued by the Department under
144178 3 Article 2 of this Act authorizing the holder to possess, use,
145179 4 purchase, transfer or dispose of, but not to store, explosive

147181 6 (t) "Transfer" of explosive materials means to sell, give,
148182 7 distribute, or otherwise dispose of explosive materials.
149183 8 (u) "Use" of explosive materials means the detonation,
150184 9 ignition, deflagration, manufacturing, handling, or any other
151185 10 means of initiating explosive materials.
152186 11 (v) "Disposal" of explosive materials means to render
153187 12 inert pursuant to manufacturer's recommendations or commonly
154188 13 accepted industry standards.
155189 14 (w) "BATFE" means the federal Bureau of Alcohol, Tobacco,
156190 15 Firearms and Explosives.
157191 16 (x) "Water gel" means an explosive or blasting agent that
158192 17 contains a substantial proportion of water.
159193 18 (y) "Consumer Fireworks" means any small fireworks device
160194 19 designed to produce visible effects by combustion and that
161195 20 must comply with the construction, chemical composition and
162196 21 labeling regulations of the U.S. Consumer Product Safety
163197 22 Commission (16 CFR 1500 and 1507). "Consumer fireworks"
164198 23 includes some small devices designed to produce audible
165199 24 effects, such as whistling devices, ground devices containing
166200 25 50 mg (0.77 grain) or less of explosive materials, and aerial

183217 6 (a) The license requirements of this Article apply to all
184218 7 explosive materials unless otherwise excepted under this
185219 8 Section or Section 1005 of this Act.
186220 9 (b) This Article does not apply to the purchase, receipt,
187221 10 possession, or use of black powder solely for sporting,
188222 11 recreational, or cultural purposes by an individual for his or
189223 12 her own use or for his or her immediate family living in the

196230 19 quarry, construction, demolition, manufacturing, or wholesale
197231 20 or retail explosive materials operations if (1) the person
198232 21 holds a storage certificate under Article 3 of this Act and (2)
199233 22 the acquisition, possession, use, transfer, or disposal of the
200234 23 explosive materials is limited to the purpose authorized by

247281 1 (a) No person shall qualify to hold a license who:
248282 2 (1) is under 21 years of age;
249283 3 (2) has been convicted in any court of a crime
250284 4 punishable by imprisonment for a term exceeding one year;
251285 5 (3) is under indictment for a crime punishable by
252286 6 imprisonment for a term exceeding one year;
253287 7 (4) is a fugitive from justice;
254288 8 (5) is an unlawful user of or addicted to alcohol or
255289 9 any controlled substance as defined in Section 102 of the
256290 10 federal Controlled Substances Act (21 U.S.C. Sec. 802 et
257291 11 seq.);
258292 12 (6) has been adjudicated a person with a mental
259293 13 disability as defined in Section 1.1 of the Firearm Owners
260294 14 Identification Card Act or the person's FOID card is
261295 15 suspended or revoked; or
262296 16 (7) is not a legal citizen of the United States or
263297 17 lawfully admitted for permanent residence.
264298 18 (b) A person who has been granted a "relief from
265299 19 disabilities" regarding criminal convictions and indictments,
266300 20 pursuant to the federal Safe Explosives Act (18 U.S.C. Sec.
267301 21 845) may receive a license provided all other qualifications
268302 22 under this Act are met.

282316 1 (a) Failure to satisfy the age or examination requirements
283317 2 of Sections 2004 and 2005(1) shall result in automatic license
284318 3 denial.
285319 4 (b) Subject to the provisions of Sections 5003 through
286320 5 5005 of this Act, the Department may suspend, revoke, or
287321 6 refuse to issue or renew a license and may take any other
288322 7 disciplinary action that the Department may deem proper,
289323 8 including the imposition of fines not to exceed $5,000 for
290324 9 each occurrence, if the person, applicant, or licensee fails
291325 10 to comply with or satisfy the requirements of any provision of
292326 11 this Act and for any of the following reasons:
293327 12 (1) Failure to meet or maintain the qualifications for
294328 13 licensure set forth in Section 2005.
295329 14 (2) Willful disregard or violation of this Act or its
296330 15 rules.
297331 16 (3) Willfully aiding or abetting another in the
298332 17 violation of this Act or its rules.
299333 18 (4) Allowing a license issued under this Act to be
300334 19 used by an unlicensed person.
301335 20 (5) Possession, use, acquisition, transfer, handling,

513-20 (l) To inform, advise, and assist the State's Attorney
514-21 of the county where any noncompliance with or violation of
515-22 this Act occurs when the State's Attorney is seeking

549-20 Act, or any permit, term, or condition of a permit.

567-3 (a) It is a violation of this Act for any Any person to:
568-4 subject to this Act who
569-5 (1) possesses an explosive material without having
570-6 obtained a valid license or certificate under this Act;
571-7 (2) store an explosive material without having
572-8 obtained a valid storage certificate issued pursuant to
573-9 this Act; is guilty of a Class 3 felony unless otherwise
574-10 exempted under Section 1005 or 2000 of this Act. Any
575-11 person subject to this Act
576-12 (3) transfer who transfers explosive material to a
577-13 person who does not possess a valid license or certificate
578-14 under this Act; or
579-15 (4) obtain control over stolen explosive material
580-16 knowing that the explosive material is stolen or under
581-17 such circumstances where a reasonable person would believe
582-18 the explosive material was stolen.
583-19 (b) A person convicted of a violation of paragraph (1),
584-20 (2), or (3) of subsection (a) is guilty of a Class 3 felony
585-21 unless otherwise exempted under Section 1005 or 2000 of this
586-22 Act. A person convicted of a violation of paragraph (4) of
587-23 subsection (a) is guilty of a Class 3 felony.

603-4 provision of this Act is guilty of a Class B misdemeanor. All
604-5 law enforcement officers and personnel of the State of
605-6 Illinois and the various units of local government are
606-7 responsible for assisting with the enforcement of this Act.
