DIGEST OF INTRODUCED BILL
Citations Affected:  IC 21-18-9-12; IC 21-27.
Synopsis:  Tuition caps. Provides that the commission for higher
education shall determine a tuition rate and mandatory fee cost of
living adjustment for specified postsecondary educational institutions.
Requires that, except for cost of living adjustments, the tuition rate and
mandatory fees at specified postsecondary educational institutions may
not increase from the time the student initially enrolls until the student
graduates for an undergraduate student who is an Indiana resident.
Effective:  July 1, 2022.

A BILL FOR AN ACT to amend the Indiana Code concerning
higher education.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 21-18-9-12 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2022]: Sec. 12. For the purposes of:
4 (1) IC 21-27-3-6;
5 (2) IC 21-27-4-5;
6 (3) IC 21-27-5-5;
7 (4) IC 21-27-6-8;
8 (5) IC 21-27-7-7;
9 (6) IC 21-27-8-8; and
10 (7) IC 21-27-9-7;
11 the commission shall determine a tuition rate and mandatory fee
12 cost of living adjustment based on the Consumer Price Index as
13 prepared by the United States Department of Labor.
14 SECTION 2. IC 21-27-3-6 IS ADDED TO THE INDIANA CODE
15 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
16 1, 2022]: Sec. 6. (a) For purposes of this section, an undergraduate
17 student includes a student enrolled in:

1 (1) a bachelor's degree program; or
2 (2) any degree program or specialized degree program that is
3 attainable by a student who has completed undergraduate
4 work prior to admission into the degree program or
5 specialized degree program but is not required to obtain an
6 associate or bachelor's degree in order to enroll in the degree
7 program or specialized degree program.
8 (b) Except as provided in subsection (d) and subject to
9 subsection (c), the tuition rate and mandatory fees charged by Ball
10 State University for an undergraduate student who is an Indiana
11 resident may not increase from the tuition rate and mandatory fees
12 charged by Ball State University at the time the student initially
13 enrolled at Ball State University.
14 (c) To qualify under subsection (b), the undergraduate student
15 must remain enrolled in Ball State University.
16 (d) Tuition rates and mandatory fees charged by Ball State
17 University under subsection (b) may be increased as a result of a
18 cost of living adjustment as determined by the commission under
19 IC 21-18-9-12.
20 SECTION 3. IC 21-27-4-5 IS ADDED TO THE INDIANA CODE
21 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
22 1, 2022]: Sec. 5. (a) For purposes of this section, an undergraduate
23 student includes a student enrolled in:
24 (1) a bachelor's degree program; or
25 (2) any degree program or specialized degree program that is
26 attainable by a student who has completed undergraduate
27 work prior to admission into the degree program or
28 specialized degree program but is not required to obtain an
29 associate or bachelor's degree in order to enroll in the degree
30 program or specialized degree program.
31 (b) Except as provided in subsection (d) and subject to
32 subsection (c), the tuition rate and mandatory fees charged by
33 Indiana University for an undergraduate student who is an Indiana
34 resident may not increase from the tuition rate and mandatory fees
35 charged by Indiana University at the time the student initially
36 enrolled at Indiana University.
37 (c) To qualify under subsection (b), the undergraduate student
38 must remain enrolled in Indiana University.
39 (d) Tuition rates and mandatory fees charged by Indiana
40 University under subsection (b) may be increased as a result of a
41 cost of living adjustment as determined by the commission under
42 IC 21-18-9-12.

2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2022]: Sec. 5. (a) For purposes of this section, an undergraduate
4 student includes a student enrolled in:
5 (1) a bachelor's degree program; or
6 (2) any degree program or specialized degree program that is

24 SECTION 5. IC 21-27-6-8 IS ADDED TO THE INDIANA CODE
25 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
26 1, 2022]: Sec. 8. (a) For purposes of this section, an undergraduate
27 student includes a student enrolled in:
28 (1) a bachelor's degree program; or
29 (2) any degree program or specialized degree program that is
30 attainable by a student who has completed undergraduate
31 work prior to admission into the degree program or
32 specialized degree program but is not required to obtain an
33 associate or bachelor's degree in order to enroll in the degree
34 program or specialized degree program.
35 (b) Except as provided by subsection (d) and subject to
36 subsection (c), the tuition rate and mandatory fees charged by Ivy
37 Tech Community College for an undergraduate student who is an
38 Indiana resident may not increase from the tuition rate and
39 mandatory fees charged by Ivy Tech Community College at the
40 time the student initially enrolled at Ivy Tech Community College.
41 (c) To qualify under subsection (b), the undergraduate student
42 must remain enrolled in Ivy Tech Community College.

1 (d) Tuition rates and mandatory fees charged by Ivy Tech
2 Community College under subsection (b) may be increased as a
3 result of a cost of living adjustment as determined by the
4 commission under IC 21-18-9-12.
5 SECTION 6. IC 21-27-7-7 IS ADDED TO THE INDIANA CODE
6 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
7 1, 2022]: Sec. 7. (a) For purposes of this section, an undergraduate
8 student includes a student enrolled in:
9 (1) a bachelor's degree program; or
10 (2) any degree program or specialized degree program that is
11 attainable by a student who has completed undergraduate
12 work prior to admission into the degree program or
13 specialized degree program but is not required to obtain an
14 associate or bachelor's degree in order to enroll in the degree
15 program or specialized degree program.
16 (b) Except as provided by subsection (d) and subject to
17 subsection (c), the tuition rate and mandatory fees charged by
18 Purdue University for an undergraduate student who is an Indiana
19 resident may not increase from the tuition rate and mandatory fees
20 charged by Purdue University at the time the student initially
21 enrolled at Purdue University.
22 (c) To qualify under subsection (b), the undergraduate student
23 must remain enrolled in Purdue University.
24 (d) Tuition rates and mandatory fees charged by Purdue
25 University under subsection (b) may be increased as a result of a
26 cost of living adjustment as determined by the commission under
27 IC 21-18-9-12.
28 SECTION 7. IC 21-27-8-8 IS ADDED TO THE INDIANA CODE
29 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
30 1, 2022]: Sec. 8. (a) For purposes of this section, an undergraduate
31 student includes a student enrolled in:
32 (1) a bachelor's degree program; or
33 (2) any degree program or specialized degree program that is
34 attainable by a student who has completed undergraduate
35 work prior to admission into the degree program or
36 specialized degree program but is not required to obtain an
37 associate or bachelor's degree in order to enroll in the degree
38 program or specialized degree program.
39 (b) Except as provided by subsection (d) and subject to
40 subsection (c), the tuition rate and mandatory fees charged by the
41 University of Southern Indiana for an undergraduate student who
42 is an Indiana resident may not increase from the tuition rate and

1 mandatory fees charged by the University of Southern Indiana at
2 the time the student initially enrolled at the University of Southern
3 Indiana.
4 (c) To qualify under subsection (b), the undergraduate student
5 must remain enrolled in the University of Southern Indiana.
6 (d) Tuition rates and mandatory fees charged by the University
7 of Southern Indiana under subsection (b) may be increased as a
8 result of a cost of living adjustment as determined by the
9 commission under IC 21-18-9-12.
10 SECTION 8. IC 21-27-9-7 IS ADDED TO THE INDIANA CODE
11 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
12 1, 2022]: Sec. 7. (a) For purposes of this section, an undergraduate
13 student includes a student enrolled in:
14 (1) a bachelor's degree program; or
15 (2) any degree program or specialized degree program that is
16 attainable by a student who has completed undergraduate
17 work prior to admission into the degree program or
18 specialized degree program but is not required to obtain an
19 associate or bachelor's degree in order to enroll in the degree
20 program or specialized degree program.
21 (b) Except as provided by subsection (d) and subject to
22 subsection (c), the tuition rate and mandatory fees charged by
23 Vincennes University for an undergraduate student who is an
24 Indiana resident may not increase from the tuition rate and
25 mandatory fees charged by Vincennes University at the time the
26 student initially enrolled at Vincennes University.
27 (c) To qualify under subsection (b), the undergraduate student
28 must remain enrolled in Vincennes University.
29 (d) Tuition rates and mandatory fees charged by Vincennes
30 University under subsection (b) may be increased as a result of a
31 cost of living adjustment as determined by the commission under
32 IC 21-18-9-12.
