Summary of Legislation: The bill adds an investigator for the Inspector General to the definition of "police
officer" for purposes of the statute providing a sentence enhancement for individuals who point or discharge
a firearm at a police officer while committing certain crimes.
Effective Date:  July 1, 2022.
Explanation of State Expenditures: Department of Correction (DOC)– This bill would likely result in a
minimal, if any, increase on DOC expenditures. Under current law, an offender who was given an
enhancement under this provision would face an additional sentence of between 5 and 20 years. If the
enhancement were  20 years, the additional marginal cost to the DOC would be approximately $86,600 for
a single offender (based on the current DOC annual marginal cost for an offender to stay in a DOC facility).
Inspector General– The bill would not increase expenditures or workload for the Office of the Inspector
General.
Additional Information– The marginal cost for an offender in a DOC facility for medical care, food, and
clothing is approximately $4,333 annually or $11.87 daily. About three offenders per year are committed to
a DOC facility for Felony 6 pointing a firearm at a person. As of October 2021, the Office of the Inspector
General had 12 employees.
