Synopsis:  Acceptance of WIC/SNAP at farmers' markets. Requires a
farmers' market administrator or representative who is responsible for
managing a farmers' market that has qualified retailers to accept
electronic benefit transfer (EBT) payments and coupons from
participants in the following food assistance programs: (1) The federal
Supplemental Nutrition Assistance Program (SNAP). (2) The women,
infants, and children nutrition program (WIC). (3) The WIC farmers'
market nutrition program (FMNP).
Effective:  July 1, 2022.

SENATE BILL No. 161
A BILL FOR AN ACT to amend the Indiana Code concerning
human services.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. IC 12-13-14-13, AS AMENDED BY P.L.13-2013,
2 SECTION 45, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
3 JULY 1, 2022]: Sec. 13. (a) The division shall implement a program
4 that provides a farmers' market administrator or a retailer who sells
5 food at a farmers' market with a wired or wireless point of sale terminal
6 that is connected to the EBT system.
7 (b) A farmers' market administrator or representative who is
8 responsible for managing a farmers' market that has retailers who:
9 (1) sell food that qualifies for sale under the EBT program;
10 and
11 (2) meet the requirements of IC 16-42-5-29;
12 shall operate a wired or wireless point of sale terminal that is
13 connected to the EBT system to allow SNAP participants to
14 purchase eligible food.
15 (c) Nothing in subsection (b) prohibits a retailer at a farmers'
16 market from operating the retailer's own wired or wireless point
17 of sale terminal that is connected to the EBT system.

1 SECTION 2. IC 16-35-1.5-8 IS ADDED TO THE INDIANA CODE
2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
3 1, 2022]: Sec. 8. (a) A farmers' market administrator or
4 representative who is responsible for managing a farmers' market
5 that has the minimum number of WIC approved retailers who:
6 (1) sell food that qualifies for sale under the:
7 (A) WIC program; or
8 (B) WIC farmers' market nutrition program (FMNP); and
9 (2) meet the requirements of IC 16-42-5-29;
10 shall accept farmers' market nutrition program coupons and
11 operate a wired or wireless point of sale terminal that accepts a
12 food instrument to allow WIC participants to purchase eligible
13 food.
14 (b) Nothing in subsection (a) prohibits a retailer at a farmers'
15 market from accepting farmers' market nutrition program
16 coupons or operating the retailer's own wired or wireless point of
17 sale terminal that accepts a food instrument.
