33-A BILL FOR AN ACT concerning human services.
31+A BILL FOR AN ACT to amend the Indiana Code concerning
32+human services.
3433 Be it enacted by the General Assembly of the State of Indiana:
35-1 SECTION 1. [EFFECTIVE JULY 1, 2022] (a) As used in this
36-2 section, "child care" has the meaning set forth in IC 12-7-2-28.2.
37-3 (b) The legislative council is urged to assign to an appropriate
38-4 interim study committee, for study during the 2022 legislative
39-5 interim, the topic of availability and affordability of child care
40-6 services in Indiana.
41-7 (c) The interim study committee to which the topic described in
42-8 subsection (b) is assigned shall:
43-9 (1) consider means by which the availability and affordability
44-10 of child care services in Indiana can be increased, including
45-11 through use of funds received by the office of the secretary of
46-12 family and social services under the American Rescue Plan
47-13 Act of 2021 (P.L. 117-2, 135 Stat. 4); and
48-14 (2) not later than November 1, 2022, submit to the general
49-15 assembly, in an electronic format under IC 5-14-6, a strategic
50-16 plan for increasing the availability and affordability of child
51-17 care services in Indiana.

56-Madam President: The Senate Committee on Family and Children
57-Services, to which was referred Senate Bill No. 404, has had the same

34+1 SECTION 1. IC 2-5-36-9.3 IS ADDED TO THE INDIANA CODE
35+2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
36+3 1, 2022]: Sec. 9.3. (a) As used in this section, "child care" has the
37+4 meaning set forth in IC 12-7-2-28.2.
38+5 (b) As used in this section, "child care desert" means a
39+6 geographic area in which child care services are insufficiently
40+7 available or insufficiently affordable to meet the child care needs
41+8 of residents of the area.
42+9 (c) The commission shall develop and submit to the general
43+10 assembly in an electronic format under IC 5-14-6 a strategic plan
44+11 to use funds received by the office of the secretary of family and
45+12 social services under the American Rescue Plan Act of 2021 (P.L.
46+13 117-2, 135 Stat. 4) to reduce and eliminate child care deserts.
47+14 (d) In developing the strategic plan under subsection (c), the
48+15 commission shall consider the following:
49+16 (1) Use of Early Learning Indiana's:
50+17 (A) Early Learning Access Index; and

52+1 (B) report regarding the Early Learning Access Index;
53+2 in making determinations regarding awarding of grants to
54+3 communities to address child care deserts.
55+4 (2) Providing for parity between:
56+5 (A) child care centers licensed under IC 12-17.2-4; and
57+6 (B) family child care providers;
58+7 with regard to voucher payments under the federal Child
59+8 Care and Development Fund.
60+9 (3) Establishment of a loan forgiveness program for all child
61+10 care providers in Indiana.
62+11 (4) Provision of subsidies to low-income, working parents
63+12 using funds from federal Child Care Development Fund block
64+13 grants.
65+14 (5) Changing Indiana tax law to:
66+15 (A) reflect the total cost, including both direct and indirect
67+16 costs, of child care; and
68+17 (B) increase the amount of pre-tax income that parents
69+18 may set aside through the child and dependent care credit.
70+19 (6) Workforce development initiatives to address shortages of
71+20 child care workers.
72+21 (7) Expanding the capacity of child care providers, improving
73+22 the quality of child care services, and making child care
74+23 services more affordable.
