36+plans. Requires before December 31, 2023, that each county shall
37+establish a county school safety commission. (Current law provides that
38+a county may establish a county school safety commission.) Requires
39+each school corporation and charter school to establish a safe school
40+committee. Requires the division of school building physical security
41+and safety of the department of education to establish and maintain
42+guidelines, in consultation with the department of homeland security
43+and institute for criminal justice, for developing and maintaining school
44+safety plans and assist the secured school safety board in conducting
45+the review and submitting certain reports. Provides that the governing
46+body of a school corporation or charter school organizer shall: (1)
47+approve or disapprove all school safety specialists chosen by the
48+superintendent of the school corporation or leadership of the charter
49+school; and (2) review the school safety plan. Makes changes to the
50+duties of a school resource officer. Makes changes to information
51+reported by a school corporation or charter school pertaining to a
52+school resource officer that is reported to the department of homeland
53+security. Requires the secured schools safety board to include certain
54+aggregate information relating to the number of school resource
55+officers employed by schools. Provides that an organizer of a charter
56+school shall require each charter school under the authority of the
57+organizer to conduct annual emergency preparedness drills. Makes
58+changes to distribution amounts from the state user fee fund. Makes
59+conforming amendments. Repeals provisions establishing the Indiana
60+safe schools fund, school safe haven programs, and existing provisions
61+relating to the establishment of school safety specialists, county school
62+safety commissions, school safety specialist training and safe school
63+programs. Defines various terms. Provides that a school corporation,
64+charter school, or accredited nonpublic school may receive a matching

81+A BILL FOR AN ACT to amend the Indiana Code concerning
82+education.
1383 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 5-2-10.1 IS REPEALED [EFFECTIVE JULY 1,
15-2023]. (Indiana Safe Schools Fund).
16-SECTION 2. IC 10-21-1-1, AS AMENDED BY P.L.92-2020,
17-SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
18-JULY 1, 2023]: Sec. 1. The following definitions apply throughout this
19-chapter:
20-(1) "Accredited nonpublic school" means a nonpublic school that:
21-(A) has voluntarily become accredited under IC 20-31-4.1; or
22-(B) is accredited by a national or regional accrediting agency
23-that is recognized by the state board of education.
24-(2) "Active event warning system" refers to a system that includes
25-services and technology that will notify available law enforcement
26-agencies in the area of a school building of a life threatening
27-emergency.
28-(3) "ADM" refers to average daily membership determined under
29-IC 20-43-4-2. In the case of a school corporation career and
30-technical education school described in IC 20-37-1-1, "ADM"
31-refers to the count on a full-time equivalency basis of students
32-attending the school on the date ADM is determined under
33-IC 20-43-4-2.
34-(4) "Board" refers to the secured school safety board established
35-by section 3 of this chapter.

37-(5) "Bullying prevention program" refers to a program that
38-must contain one (1) or more of the following components:
39-(A) Offers students and school personnel opportunities to
40-develop the skills and strategies to prevent bullying and
41-potential bullying situations in digital and physical spaces,
42-including the usage of research based models.
43-(B) Enables school personnel, including school safety
44-specialists, safe school committee members, and school
45-resource officers, to identify and acquire the programs,
46-technology software, resources, and training necessary
47-concerning the:
48-(i) development and implementation of bullying and
49-cyberbullying prevention programs and school violence,
50-human trafficking, and self-harm mitigation programs;
51-(ii) establishment of bullying and cyberbullying
52-investigation, intervention, and reporting procedures;
53-(iii) adoption of discipline rules that comply with
54-IC 20-33-8-13.5; and
55-(iv) integration of the program into wider school efforts,
56-including a school safety plan, to promote educational
57-progress and the physical safety and well-being of school
58-students, families, faculty, and staff.
59-(6) "County school safety commission" has the meaning set
60-forth in section 12 of this chapter.
61-(7) "Critical incidence digital mapping" means the digitized
62-mapping of a school building and school grounds to best assist
63-first responders in an emergency that must:
64-(A) include accurate floor plans overlaid on or current
65-aerial imagery of a school building or school plan with
66-surrounding school grounds;
67-(B) include site-specific labeling that matches:
68-(i) the structure of the school building, including room
69-labels, hallway names, room numbers, external doors,
70-interior doors, stairwell numbers, locations of hazardous
71-materials, key utility locations, key boxes, automated
72-external defibrillators, and trauma kits; and
73-(ii) the school grounds, including parking areas, athletic
74-fields, surrounding roads, and neighboring proprieties;
75-(C) be compatible with platforms and applications used by
76-local, state, and federal public safety agencies;
77-(D) be verified for accuracy through a walk through of a
78-school building and school grounds;

80-(E) not require the purchase of additional software for use;
81-(F) be accessible in a printable format;
82-(G) be shared with:
83-(i) the law enforcement agency and fire department that
84-have jurisdiction over the mapped school building; and
85-(ii) the statewide 911 system as described in
86-IC 36-8-16.7-22 through the public safety answer point,
87-or "PSAP", described in IC 36-8-16.7-20 that has
88-jurisdiction over the mapped school building; and
89-(H) be kept confidential and withheld from public
90-disclosure.
91-(5) (8) "Fund" refers to the Indiana secured school fund
92-established by section 2 of this chapter.
93-(6) (9) "Law enforcement agency" refers to a state, local, or
94-federal agency or department that would respond to an emergency
95-event at a school, including both on duty and off duty officers
96-within the agency or department.
97-(10) "Multi-disciplinary threat assessment team" means a
98-group of individuals with expertise in school physical security,
99-school administration, educational instruction, youth
100-counseling, mental health and behavioral health, and law
101-enforcement established by the leadership of the school
102-corporation or charter school that may serve one (1) or more
103-schools, that must meet the following requirements:
104-(A) Be comprised of at least:
105-(i) a school safety specialist or an individual designated
106-by the school safety committee;
107-(ii) a member of a safe school committee;
108-(iii) a school building level administrator;
109-(iv) a school resource officer, if one (1) is either employed
110-by or assigned to the school corporation or charter
111-school;
112-(v) an individual with expertise in special education; and
113-(vi) a school counselor or social worker.
114-(B) Conduct multi-disciplinary threat assessments that
115-shall:
116-(i) provide guidance to students, faculty, and staff
117-regarding the recognition of threatening or aberrant
118-behavior that may represent a threat to the community,
119-school, or self;
120-(ii) identify members of the school community to whom
121-threatening behavior should be reported;

123-(iii) establish procedures to assess, identify, and
124-intervene with individuals whose behavior may pose a
125-threat to the safety of school students, families, faculty,
126-and staff; and
127-(iv) inform the adoption, implementation, and updating
128-of policies adopted by the school corporation or charter
129-school, including school safety plans and the policies of
130-a safe school committee for a particular school.
131-(11) "Safe school committee" means a safe school committee
132-established under section 14 of this chapter.
133-(7) "Local plan" means the school safety plan described in
134-IC 20-26-18.2-2(b).
135-(8) (12) "School corporation or charter school" refers to an
136-individual school corporation, a school corporation career and
137-technical education school described in IC 20-37-1-1, or a charter
138-school but also includes:
139-(A) a coalition of school corporations;
140-(B) a coalition of charter schools; or
141-(C) a coalition of both school corporations and charter schools;
142-that intend to jointly employ a school resource officer or to jointly
143-apply for a matching grant under this chapter, unless the context
144-clearly indicates otherwise.
145-(9) (13) "School official" refers to an employee of a school
146-corporation, charter school, or accredited nonpublic school who
147-has access to an active event warning system.
148-(10) (14) "School resource officer" has the meaning set forth in
149-IC 20-26-18.2-1.
150-(15) "School safety plan" means the school safety plan
151-described in section 10 of this chapter.
152-(16) "School safety specialist" means a school safety specialist
153-designated under section 9 of this chapter.
154-(17) "Site vulnerability assessment" means an examination of
155-the physical safety, security, accessibility, and emergency
156-preparedness of buildings and grounds.
157-(18) "Student safety management technology" refers to an
158-information technology platform and related services to
159-improve student safety by mitigating cyberbullying, school
160-violence, human trafficking, and self-harm.
161-SECTION 3. IC 10-21-1-2, AS AMENDED BY P.L.139-2022,
162-SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
163-JULY 1, 2023]: Sec. 2. (a) The Indiana secured school fund is
164-established to provide:

166-(1) matching grants to enable school corporations, charter
167-schools, and accredited nonpublic schools to establish programs
168-under which a school corporation, charter school, or accredited
169-nonpublic school (or a coalition of schools) may: school
170-corporations, charter schools, and accredited nonpublic
171-schools, where the matching grants may be used to:
172-(A) employ a school resource officer, employ a law
173-enforcement officer, or enter into a contract or a memorandum
174-of understanding with a:
175-(i) local law enforcement agency;
176-(ii) private entity; or
177-(iii) nonprofit corporation;
178-to employ a school resource officer or a law enforcement
179-officer;
180-(B) conduct:
181-(i) a threat site vulnerability assessment of the buildings
182-within a school corporation or the buildings that are
183-operated by a charter school or accredited nonpublic school;
184-or
185-(ii) critical incident digital mapping of the buildings
186-within a school corporation or the buildings that are
187-operated by a charter school or accredited nonpublic
188-school;
189-(C) purchase equipment, hardware, materials, and
190-technology to:
191-(i) restrict access to school property and classrooms; or
192-(ii) assist with visitor management on school property;
193-(ii) (iii) expedite notification of first responders; or
194-(iv) expedite access to school property for first
195-responders;
196-(v) provide school staff with information about the open
197-or closed status of interior and exterior doors;
198-(vi) detect fire, chemical, visual, or audible threats;
199-(vii) enhance emergency communications inside the
200-building; or
201-(viii) assist with emergency medical response on school
202-property;
203-(D) implement a student and parent support services plan as
204-described in section 4(a)(6) of this chapter; and IC 20-34-9;
205-(E) purchase or provide training for a canine trained to

204+19 IC 20-26-18.2-2(b).
205+20 (8) (12) "School corporation or charter school" refers to an
206+21 individual school corporation, a school corporation career and
207+22 technical education school described in IC 20-37-1-1, or a charter
208+23 school but also includes:
209+24 (A) a coalition of school corporations;
210+25 (B) a coalition of charter schools; or
211+26 (C) a coalition of both school corporations and charter schools;
212+27 that intend to jointly employ a school resource officer or to jointly
213+28 apply for a matching grant under this chapter, unless the context
214+29 clearly indicates otherwise.
215+30 (9) (13) "School official" refers to an employee of a school
216+31 corporation, charter school, or accredited nonpublic school who

232+4 SECTION 3. IC 10-21-1-2, AS AMENDED BY P.L.139-2022,
233+5 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
234+6 JULY 1, 2023]: Sec. 2. (a) The Indiana secured school fund is
235+7 established to provide:
236+8 (1) matching grants to enable school corporations, charter
237+9 schools, and accredited nonpublic schools to establish programs
238+10 under which a school corporation, charter school, or accredited
239+11 nonpublic school (or a coalition of schools) may: school
240+12 corporations, charter schools, and accredited nonpublic
241+13 schools, where the matching grants may be used to:
242+14 (A) employ a school resource officer, employ a law
243+15 enforcement officer, or enter into a contract or a memorandum
244+16 of understanding with a:
245+17 (i) local law enforcement agency;
246+18 (ii) private entity; or
247+19 (iii) nonprofit corporation;
248+20 to employ a school resource officer or a law enforcement
249+21 officer;
250+22 (B) conduct:
251+23 (i) a threat site vulnerability assessment of the buildings
252+24 within a school corporation or the buildings that are
253+25 operated by a charter school or accredited nonpublic school;
254+26 or
255+27 (ii) critical incident digital mapping of the buildings
256+28 within a school corporation or the buildings that are
257+29 operated by a charter school or accredited nonpublic
258+30 school;
259+31 (C) purchase equipment, hardware, materials, and
260+32 technology to:
261+33 (i) restrict access to school property and classrooms; or
262+34 (ii) assist with visitor management on school property;
263+35 (ii) (iii) expedite notification of first responders; or
264+36 (iv) expedite access to school property for first
265+37 responders;
266+38 (v) provide school staff with information about the open
267+39 or closed status of interior and exterior doors;
268+40 (vi) detect fire, chemical, visual, or audible threats;
269+41 (vii) enhance emergency communications inside the
270+42 building; or

272+1 (viii) assist with emergency medical response on school
273+2 property;
274+3 (D) implement a student and parent support services plan as
275+4 described in section 4(a)(6) of this chapter; and IC 20-34-9;
276+5 (E) purchase or provide training for a canine trained to
277+6 detect drugs and illegal substances, explosives, or firearms,
278+7 or to otherwise provide protection for students and school
279+8 employees and the canine shall:
280+9 (i) be primarily assigned to a school corporation, charter
281+10 school, or accredited nonpublic school;
282+11 (ii) be primarily assigned to a school resource officer or
283+12 law enforcement officer described in clause (A) who has
284+13 received appropriate training for handling a canine
285+14 trained to detect drugs and illegal substances, explosives,
286+15 or firearms, or to otherwise provide protection for
287+16 students and school employees, including training
288+17 regarding handling a canine in a school setting; and
289+18 (iii) receive continuous training as appropriate;
290+19 (F) provide funding for school employees to receive
291+20 training, including expenses for per diem, travel, and
292+21 lodging, related to:
293+22 (i) site vulnerability assessments;
294+23 (ii) mental health or behavioral health threat
295+24 assessments;
296+25 (iii) multi-disciplinary threat assessment teams; or
297+26 (iv) emergency preparedness or response activities;
298+27 (G) provide funding for school resource officers or law
299+28 enforcement officers described in clause (A) to receive
300+29 training, including expenses for per diem, travel, and
301+30 lodging, related to handling a canine trained to detect
302+31 drugs and illegal substances, explosives, or firearms, or to
303+32 otherwise provide protection for students and school
304+33 employees;
305+34 (H) purchase student safety management technology;
306+35 (I) design and construct additions or renovations on school
307+36 property if the primary purpose of the construction project
308+37 is to enhance the physical security of the school building;
309+38 or
310+39 (J) implement a bullying prevention program; and
311+40 (2) one (1) time grants to enable school corporations, charter
312+41 schools, and accredited nonpublic schools with the sheriff for the
313+42 county in which the school corporation, charter school, or
314+EH 1492—LS 7255/DI 116 7
315+1 accredited nonpublic school is located, to provide the initial set up
316+2 costs for an active event warning system.
317+3 (b) A school corporation or charter school may use money received
318+4 under a matching grant for a purpose listed in subsection (a) to provide
319+5 a response to a threat in a manner that the school corporation or charter
320+6 school sees fit, including firearms training or other self-defense
321+7 training.
322+8 (c) The fund shall be administered by the department of homeland
323+9 security.
324+10 (d) The fund consists of:
325+11 (1) appropriations from the general assembly;
326+12 (2) grants from the Indiana safe schools fund established by
327+13 IC 5-2-10.1-2;
328+14 (3) (2) federal grants; and
329+15 (4) (3) amounts deposited from any other public or private source.
330+16 (e) The expenses of administering the fund shall be paid from
331+17 money in the fund.
332+18 (f) The treasurer of state shall invest the money in the fund not
333+19 currently needed to meet the obligations of the fund in the same
334+20 manner as other public money may be invested. Interest that accrues
335+21 from these investments shall be deposited in the fund.
336+22 (g) Money in the fund at the end of a state fiscal year does not revert
337+23 to the state general fund.
338+24 SECTION 4. IC 10-21-1-4, AS AMENDED BY P.L.139-2022,
339+25 SECTION 2, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
340+26 JULY 1, 2023]: Sec. 4. (a) The board may award a matching grant to
341+27 enable a school corporation, charter school, or accredited nonpublic
342+28 school (or a coalition of schools applying jointly) to:
343+29 (1) establish a program to employ a school resource officer;
344+30 (2) employ a law enforcement officer;
345+31 (3) provide school resource officer training described in
346+32 IC 20-26-18.2-1(c);
347+33 (4) conduct a threat assessment;
348+34 (5) purchase equipment to restrict access to the school or expedite
349+35 the notification of first responders; or
350+36 (6) implement a student and parent support services plan in the
351+37 manner set forth in IC 20-34-9;
352+38 (1) employ a school resource officer, employ a law
353+39 enforcement officer, or enter into a contract or memorandum
354+40 of understanding with a:
355+41 (A) local law enforcement agency;
356+42 (B) private entity; or

358+1 (C) nonprofit corporation;
359+2 to employ a school resource officer or a law enforcement
360+3 officer;
361+4 (2) conduct a site vulnerability assessment of the buildings
362+5 within a school corporation or the buildings that are operated
363+6 by a charter school or accredited nonpublic school;
364+7 (3) conduct critical incident digital mapping of the buildings
365+8 within a school corporation or the buildings that are operated
366+9 by a charter school or accredited nonpublic school;
367+10 (4) purchase equipment, hardware, materials, and technology
368+11 to:
369+12 (A) restrict access to school property and classrooms;
370+13 (B) assist with visitor management on school property;
371+14 (C) expedite notification of first responders;
372+15 (D) expedite access to school property for first responders;
373+16 (E) provide staff with information about open or closed
374+17 status of interior and exterior doors;
375+18 (F) detect fire, chemical, visual, or audible threats;
376+19 (G) enhance emergency communications inside the school
377+20 building; or
378+21 (H) assist with emergency medical response on school
379+22 property;
380+23 (5) implement a student and parent support services plan in
381+24 the manner set forth in IC 20-34-9;
382+25 (6) purchase or provide training for a canine trained to detect
383+26 drugs and illegal substances, explosives, or firearms, or to
384+27 otherwise provide protection for students and school
385+28 employees and the canine shall:
386+29 (A) be primarily assigned to a school corporation, charter
387+30 school, or accredited nonpublic school;
388+31 (B) be primarily assigned to a school resource officer or
389+32 law enforcement officer described in subdivision (1)(A)
390+33 who has received appropriate training for handling a
391+34 canine trained to detect drugs and illegal substances,
392+35 explosives, or firearms, or to otherwise provide protection
393+36 for students and school employees, including training
394+37 regarding handling a canine in a school setting; and
395+38 (C) receive continuous training as appropriate;
396+39 (7) provide funding for:
397+40 (A) school employees to receive training, including
398+41 expenses for per diem, travel, and lodging, related to:
399+42 (i) site vulnerability assessments;

401+1 (ii) mental health or behavioral health threat
402+2 assessments;
403+3 (iii) multi-disciplinary threat assessment teams; or
404+4 (iv) emergency preparedness or response activities; or
405+5 (B) school resource officers or law enforcement officers
406+6 described in subdivision (1)(A) to receive training,
407+7 including expenses for per diem, travel, and lodging,
408+8 related to handling a canine trained to detect drugs and
409+9 illegal substances, explosives, or firearms, or to otherwise
410+10 provide protection for students and school employees;
411+11 (8) design and construct additions or renovations on school
412+12 property if the primary purpose of the construction project is
413+13 to enhance the physical security of the school building;
414+14 (9) provide one (1) time grants to enable school corporations,
415+15 charter schools, and accredited nonpublic schools with the
416+16 sheriff for the county in which the school corporation, charter
417+17 school, or accredited nonpublic school is located to provide
418+18 the initial set up costs for an active event warning system;
419+19 (10) implement a bullying prevention program; or
420+20 (11) purchase student safety management technology;
421+21 in accordance with section 2(a) of this chapter.
422+22 (b) A matching grant awarded to a school corporation, charter
423+23 school, or accredited nonpublic school (or a coalition of schools
424+24 applying jointly) may not exceed the lesser of the following during a
425+25 two (2) year period beginning on or after May 1, 2013:
426+26 (1) The total cost of the program established by the school
427+27 corporation, charter school, or accredited nonpublic school (or the
428+28 coalition of schools applying jointly).
429+29 (2) Except as provided in subsection (d), the following amounts:
430+30 (A) Thirty-five thousand dollars ($35,000) per year, in the case
431+31 of a school corporation, charter school, or accredited
432+32 nonpublic school that:
433+33 (i) has an ADM of at least one (1) and less than one
434+34 thousand one (1,001) students; and
435+35 (ii) is not applying jointly with any other school corporation,
436+36 charter school, or accredited nonpublic school.
437+37 (B) Fifty thousand dollars ($50,000) per year, in the case of a
438+38 school corporation, charter school, or accredited nonpublic
439+39 school that:
440+40 (i) has an ADM of more than one thousand (1,000) and less
441+41 than five thousand one (5,001) students; and
442+42 (ii) is not applying jointly with any other school corporation,

444+1 charter school, or accredited nonpublic school.
445+2 (C) Seventy-five thousand dollars ($75,000) per year, in the
446+3 case of a school corporation, charter school, or accredited
447+4 nonpublic school that:
448+5 (i) has an ADM of more than five thousand (5,000) and less
449+6 than fifteen thousand one (15,001) students; and
450+7 (ii) is not applying jointly with any other school corporation,
451+8 charter school, or accredited nonpublic school.
452+9 (D) One hundred thousand dollars ($100,000) per year, in the
453+10 case of a school corporation, charter school, or accredited
454+11 nonpublic school that:
455+12 (i) has an ADM of more than fifteen thousand (15,000); and
456+13 (ii) is not applying jointly with any other school corporation,
457+14 charter school, or accredited nonpublic school.
458+15 (E) One hundred thousand dollars ($100,000) per year, in the
459+16 case of a coalition of schools applying jointly.
460+17 (c) Except as provided in subsection (d), the match requirement for
461+18 a grant under this chapter is based on the ADM for the school
462+19 corporation, charter school, or accredited nonpublic school (or
463+20 coalition of schools applying jointly) that is the subject of the grant
464+21 as follows:
465+22 (1) For a school corporation, charter school, or accredited
466+23 nonpublic school with an ADM of less than five hundred one
467+24 (501) students, the grant match must be twenty-five percent
468+25 (25%) of the grant amount described in subsection (b).
469+26 (2) For a school corporation, charter school, or accredited
470+27 nonpublic school with an ADM of more than five hundred (500)
471+28 and less than one thousand one (1,001) students, the grant match
472+29 must be fifty percent (50%) of the grant amount described in
473+30 subsection (b).
474+31 (3) For a school corporation, charter school, or accredited
475+32 nonpublic school with an ADM of more than one thousand
476+33 (1,000) students or a coalition of schools applying jointly, the
477+34 grant match must be one hundred percent (100%) of the grant
478+35 amount described in subsection (b).
479+36 (d) A school corporation, charter school, or accredited nonpublic
480+37 school may be eligible to receive a grant of up to:
481+38 (1) one hundred thousand dollars ($100,000) if:
482+39 (A) the school corporation, charter school, or accredited
483+40 nonpublic school receives a grant match of one hundred
484+41 percent (100%) of the requested grant amount; and
485+42 (B) the board approves the grant request; or

487+1 (2) for a school corporation, charter school, or accredited
488+2 nonpublic school described in subsection (c)(1) or (c)(2), a grant
489+3 of up to fifty thousand dollars ($50,000) if:
490+4 (A) the school corporation, charter school, or accredited
491+5 nonpublic school receives a grant match of fifty percent (50%)
492+6 of the requested grant amount; and
493+7 (B) the board approves the grant request.
494+8 (e) A school corporation, charter school, or accredited nonpublic
495+9 school may receive only one (1) matching grant under this section each
496+10 year.
497+11 (f) The board may not award a grant to a school corporation, charter
498+12 school, or accredited nonpublic school under this section unless the
499+13 school corporation, charter school, or accredited nonpublic school is in
500+14 a county that has a county school safety commission, as described in
501+15 IC 5-2-10.1-10. section 12 of this chapter.
502+16 SECTION 5. IC 10-21-1-4.5, AS ADDED BY P.L.50-2019,
503+17 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
504+18 JULY 1, 2023]: Sec. 4.5. (a) The board may award a grant to provide
505+19 for the initial set up costs for an active event warning system to a
506+20 school corporation, charter school, or accredited nonpublic school that
507+21 jointly applies with the sheriff for the county in which the school
508+22 corporation, charter school, or accredited nonpublic school is located.
509+23 The specifications for an active event warning system must include the
510+24 following:
511+25 (1) A two (2) phone application based system that includes school
512+26 officials as a sender within the system and law enforcement
513+27 agencies as a receiver within the system.
514+28 (2) An adjusted geofence to alert law enforcement agencies that
515+29 are within a certain geographic location, including settings based
516+30 on rural and urban locations, with an urban setting having a
517+31 reduced geofence and a rural setting having a broader geofence.
518+32 (3) The ability for students and the public to submit anonymous
519+33 tips through a free reporting application.
520+34 (4) The ability for information within the system to be
521+35 interoperable with 911 dispatch.
522+36 (5) The ability to display the school's address and location on a
523+37 map.
524+38 (6) The ability to provide notifications during emergencies and
525+39 nonemergencies.
526+40 (7) The ability to call 911 automatically when the system is
527+41 triggered.
528+42 (8) The ability to operate several individual school response

530+1 plans.
531+2 (b) A school corporation, charter school, or accredited nonpublic
532+3 school may receive only one (1) grant under this section.
533+4 (c) A sheriff for a county may receive multiple grants under this
534+5 section.
535+6 (d) The board may not award a grant to a school corporation or
536+7 charter school under this section unless the school corporation or
537+8 charter school is in a county that has a county school safety
538+9 commission, as described in IC 5-2-10.1-10. section 12 of this
539+10 chapter.
540+11 SECTION 6. IC 10-21-1-5, AS AMENDED BY P.L.170-2022,
541+12 SECTION 12, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
542+13 JULY 1, 2023]: Sec. 5. (a) A school corporation, charter school, or
543+14 accredited nonpublic school may annually apply to the board for a
544+15 matching grant from the fund for a program described in section
545+16 2(a)(1) of this chapter.
546+17 (b) The application must include the following:
547+18 (1) A concise description of the school corporation's, charter
548+19 school's, or accredited nonpublic school's security needs.
549+20 (2) The estimated cost of the program to the school corporation,
550+21 charter school, or accredited nonpublic school.
551+22 (3) The extent to which the school corporation, charter school, or
552+23 accredited nonpublic school has access to and support from a
553+24 nearby law enforcement agency and other first responder
554+25 services, if applicable.
555+26 (4) The ADM of the school corporation or charter school or the
556+27 equivalent for an accredited nonpublic school (or the combined
557+28 ADM of the coalition of schools applying jointly) that is the
558+29 subject of the grant application.
559+30 (5) Any other information required by the board.
560+31 (6) This subdivision applies to an application from a school
561+32 corporation or charter school (or coalition of public schools
562+33 applying jointly). A statement whether the school corporation or
563+34 charter school has completed a local school safety plan and has
564+35 filed the school safety plan with the county school safety
565+36 commission for the county in which the school corporation or
566+37 charter school is located. In the case of a charter school, each
567+38 charter school shall include a statement whether the charter
568+39 school has developed and filed with the county school safety
569+40 commission for the county in which the charter school is
570+41 located:
571+42 (A) a local school safety and emergency plan under
572+EH 1492—LS 7255/DI 116 13
573+1 IC 20-34-3-23(a); or
574+2 (B) not later than July 1, 2024, a school safety plan.
575+3 For a charter school in operation on July 1, 2023, the
576+4 information described in clauses (A) or (B) shall comply with
577+5 this subdivision on or before July 1, 2024.
578+6 (7) This subdivision applies to an application from a school
579+7 corporation or charter school (or coalition of public schools
580+8 applying jointly). A statement whether the school corporation or
581+9 charter school (or coalition of public schools applying jointly)
582+10 requests an advance under IC 20-49-10 in addition to a matching
583+11 grant under this chapter.
584+12 (8) If the application requests funding for school employee
585+13 training, the extent to which the school corporation, charter
586+14 school, or accredited nonpublic school has used or attempted
587+15 to use training offered at no cost, or a reduced cost, by law
588+16 enforcement, the department of homeland security, the
589+17 department of education, or the federal government,
590+18 including an explanation as to why grant funding is necessary
591+19 to fund any training expenses except for per diem, travel, and
592+20 lodging costs associated with training.
593+21 (9) If the application requests funding to employ a school
594+22 resource officer, a statement whether the school resource
595+23 officer information required under IC 20-26-18.2-5 has been,
596+24 if applicable, submitted to the department of homeland
597+25 security.
598+26 (10) This subdivision applies to an application from a school
599+27 corporation, charter school, or an accredited nonpublic school
600+28 (or coalition of public and accredited nonpublic schools
601+29 applying jointly). A statement of whether the school
602+30 corporation, charter school, or accredited nonpublic school
603+31 has:
604+32 (A) provided a copy of the floor plans for each building
605+33 located on the school's property to the law enforcement
606+34 agency and the fire department that have jurisdiction over
607+35 each school building that clearly indicates each entrance
608+36 and exit, the interior rooms and hallways, and the location
609+37 of any hazardous materials located in the building; or
610+38 (B) conducted critical incidence digital mapping as defined
611+39 in section 1 of this chapter for each school building,
612+40 including whether it has provided the critical incidence
613+41 digital mapping information to:
614+42 (i) the law enforcement agency and fire department that
615+EH 1492—LS 7255/DI 116 14
616+1 have jurisdiction over the mapped school buildings; and
617+2 (ii) the statewide 911 system described in IC 36-8-16.7-22
618+3 through the public safety answer point, or "PSAP", (as
619+4 described in IC 36-8-16.7-20) that has jurisdiction over
620+5 the mapped school buildings.
621+6 (c) This subsection applies to an application from a school
622+7 corporation, charter school, or accredited nonpublic school (or
623+8 coalition of public and accredited nonpublic schools applying
624+9 jointly). Each school corporation, charter school, or accredited
625+10 nonpublic school shall certify to the department of homeland security
626+11 that the school corporation, charter school, or accredited nonpublic
627+12 school has: conducted a threat assessment for each school building
628+13 used by the school corporation, charter school, or accredited nonpublic
629+14 school before applying for a grant under this chapter.
630+15 (1) conducted a site vulnerability assessment for each school
631+16 building used by the school corporation, charter school, or
632+17 accredited nonpublic school; and
633+18 (2) a memorandum of understanding in place with a
634+19 community mental health center established under IC 12-29-2
635+20 or provider certified or licensed by the state to provide mental
636+21 or behavioral health services to students before applying for
637+22 a grant under this chapter. A provider described in this
638+23 subdivision may be employed by the school corporation,
639+24 charter school, or accredited nonpublic school.
640+25 (d) This subsection applies to an application from a school
641+26 corporation or charter school (or coalition of public schools
642+27 applying jointly). Each school corporation shall certify to the
643+28 department of homeland security that the school safety plan of the
644+29 school corporation was reviewed by the governing body as
645+30 described in section 11 of this chapter. In the case of a charter
646+31 school, beginning July 1, 2024, each charter school shall certify to
647+32 the department of homeland security that the school safety plan of
648+33 the charter school was reviewed by the organizer as described in
649+34 section 11 of this chapter.
650+35 (d) Each school corporation, charter school, or accredited nonpublic
651+36 school shall certify to the department of homeland security that the
652+37 school corporation, charter school, or accredited nonpublic school has
653+38 a memorandum of understanding in place with a community mental
654+39 health center established under IC 12-29-2 or provider certified or
655+40 licensed by the state to provide mental or behavioral health services to
656+41 students before applying for a grant under this chapter. A provider
657+42 described in this subsection may be employed by the school

659+1 corporation, charter school, or accredited nonpublic school.
660+2 SECTION 7. IC 10-21-1-5.5, AS ADDED BY P.L.50-2019,
661+3 SECTION 7, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
662+4 JULY 1, 2023]: Sec. 5.5. (a) A school corporation, charter school, or
663+5 accredited nonpublic school and the sheriff for the county in which the
664+6 school corporation, charter school, or accredited nonpublic school is
665+7 located may jointly apply to the board for a one (1) time grant from the
666+8 fund to provide for the initial set up costs for an active event warning
667+9 system.
668+10 (b) The application must include the following:
669+11 (1) A concise description of the school corporation's, charter
670+12 school's, or accredited nonpublic school's security needs.
671+13 (2) Any other information required by the board.
672+14 (3) A statement whether the school corporation or charter school
673+15 has completed a local school safety plan and has filed the plan
674+16 with the county school safety commission for the county in which
675+17 the school corporation or charter school is located.
676+18 (4) A statement from the school corporation, charter school, or
677+19 accredited nonpublic school verifying that the active event
678+20 warning system meets the specifications listed under section
679+21 4.5(a) of this chapter.
680+22 SECTION 8. IC 10-21-1-6, AS AMENDED BY P.L.211-2019,
681+23 SECTION 14, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
682+24 JULY 1, 2023]: Sec. 6. A school corporation, charter school, or
683+25 accredited nonpublic school that is awarded a grant under this chapter
684+26 is not required to repay or reimburse the board or fund the amount of
685+27 the grant.
686+28 SECTION 9. IC 10-21-1-8, AS ADDED BY P.L.211-2018(ss),
687+29 SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
688+30 JULY 1, 2023]: Sec. 8. On or before December 1, 2018, and
689+31 periodically thereafter, Not later than November 1, 2023, and each
690+32 November 1 thereafter, the board shall conduct a review and submit
691+33 a report to the governor and legislative council in an electronic format
692+34 under IC 5-14-6. The report:
693+35 (1) must provide an overview of the current status of school safety
694+36 across the state; and
695+37 (2) must include information concerning grants awarded
696+38 under this chapter since the establishment of this chapter;
697+39 (3) must include the aggregate statewide school resource
698+40 officer information specified and collected under
699+41 IC 20-26-18.2-5(d); and
700+42 (2) (4) may make recommendations to improve the safety of
701+EH 1492—LS 7255/DI 116 16
702+1 elementary and secondary school students.
703+2 SECTION 10. IC 10-21-1-9 IS ADDED TO THE INDIANA CODE
704+3 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
705+4 1, 2023]: Sec. 9. (a) Each school corporation shall designate at least
706+5 one (1) individual who is not a school resource officer as described
707+6 in IC 20-26-18.2-2 to serve as the school safety specialist for the
708+7 school corporation.
709+8 (b) Each charter school shall designate at least one (1) individual
710+9 who is not a school resource officer as described in IC 20-26-18.2-2
711+10 to serve as the school safety specialist for the charter school. A
712+11 charter school in operation on July 1, 2023, shall comply with this
713+12 subsection on or before July 1, 2024.
714+13 (c) All school safety specialists shall be chosen by the
715+14 superintendent of the school corporation or leadership of the
716+15 charter school with the approval of the governing body or
717+16 organizer.
718+17 (d) A school safety specialist shall perform the following duties:
719+18 (1) Serve on the county school safety commission with
720+19 jurisdiction over the school corporation if that individual
721+20 school safety specialist is chosen by the superintendent of the
722+21 school corporation with the approval of the governing body.
723+22 Except as provided in section 12 of this chapter, the school
724+23 safety specialists of charter schools do not serve on a county
725+24 school safety commission.
726+25 (2) Participate each year in a number of days of school safety
727+26 training that the department of education determines
728+27 necessary under section 13 of this chapter.
729+28 (3) With the assistance of the county school safety commission
730+29 with jurisdiction over the school corporation or charter
731+30 school, develop, implement, and improve a school safety plan
732+31 for each school building in the school corporation or charter
733+32 school.
734+33 (4) Coordinate the school safety plans of each school building
735+34 in the school corporation or charter school as required under
736+35 this chapter and under rules adopted by the Indiana state
737+36 board of education.
738+37 (5) Act as a resource for the school corporation's or charter
739+38 school's safe school committees and other individuals in the
740+39 school corporation or charter school on issues related to
741+40 school discipline, safety, and security.
742+41 (6) Serve as a liaison for the school corporation or charter
743+42 school regarding school safety matters with the board, the
744+EH 1492—LS 7255/DI 116 17
745+1 department of homeland security, the department of
746+2 education, the Indiana criminal justice institute, and other
747+3 state agencies, as applicable.
748+4 SECTION 11. IC 10-21-1-10 IS ADDED TO THE INDIANA
749+5 CODE AS A NEW SECTION TO READ AS FOLLOWS
750+6 [EFFECTIVE JULY 1, 2023]: Sec. 10. (a) A school corporation shall
751+7 develop a school safety plan in accordance with subsection (c) for
752+8 review as described in section 11 of this chapter.
753+9 (b) Each charter school shall develop a school safety plan in
754+10 accordance with subsection (c) for review as described in section
755+11 11 of this chapter. A charter school in operation on July 1, 2023,
756+12 shall comply with this subsection on or before July 1, 2024.
757+13 (c) The school safety plan:
758+14 (1) must be developed by a school safety specialist and the
759+15 school's safe school committee, including a school resource
760+16 officer if one (1) is employed by the school corporation or
761+17 charter school, in consultation with the:
762+18 (A) law enforcement agency; and
763+19 (B) fire department;
764+20 that have jurisdiction over the particular school building;
765+21 (2) must:
766+22 (A) protect against outside and internal threats to the
767+23 physical safety of students, faculty, staff, and the public,
768+24 including unsafe conditions, crime prevention, school
769+25 violence, bullying and cyberbullying, criminal organization
770+26 activity, child abuse and child sexual abuse, mental health
771+27 and behavioral health, suicide awareness and prevention,
772+28 and other issues that prevent the maintenance of a safe
773+29 school;
774+30 (B) prevent unauthorized access to school property and
775+31 interior areas or rooms, including the management of
776+32 authorized visitors on school property, before, during, and
777+33 after regular school hours;
778+34 (C) secure schools against natural and manmade disasters,
779+35 including all emergency preparedness drill requirements
780+36 set forth in IC 20-34-3-20;
781+37 (D) include a site vulnerability assessment for each school
782+38 building;
783+39 (E) not later than July 1, 2025, include the establishment of
784+40 a multi-disciplinary threat assessment team;
785+41 (F) include measures to expedite notification of first
786+42 responders and access to school property for first
787+EH 1492—LS 7255/DI 116 18
788+1 responders; and
789+2 (G) include any additional requirements required by the
790+3 Indiana state board of education;
791+4 (3) must be provided to a member of the board if a member
792+5 requests the school safety plan;
793+6 (4) must be available for inspection by the department of
794+7 education's division of school building physical security and
795+8 safety (as established by IC 20-19-3-14);
796+9 (5) must be provided to the law enforcement agency and the
797+10 fire department that have jurisdiction over the school
798+11 corporation or charter school;
799+12 (6) must include an attestation that:
800+13 (A) a copy of the floor plans for each building located on
801+14 the school's property were provided to the law
802+15 enforcement agency and the fire department that have
803+16 jurisdiction over the school corporation or charter school
804+17 that clearly indicates each entrance and exit, the interior
805+18 rooms and hallways, and the location of any hazardous
806+19 materials located in the building; or
807+20 (B) the school corporation or charter school has conducted
808+21 critical incidence digital mapping for each school building
809+22 within the school corporation or the buildings that are
810+23 operated by a charter school, including providing the
811+24 critical incidence digital mapping information to:
812+25 (i) the law enforcement agency and fire department that
813+26 have jurisdiction over the mapped school buildings; and
814+27 (ii) the statewide 911 system described in IC 36-8-16.7-22
815+28 through the public safety answer point, or "PSAP",
816+29 described in IC 36-8-16.7-20 that has jurisdiction over
817+30 the mapped school buildings; and
818+31 (7) must be filed with the county school safety commission
819+32 under section 12 of this chapter having jurisdiction over the
820+33 school corporation or charter school.
821+34 (d) For purposes of IC 5-14-3, the entities specified in subsection
822+35 (c) that receive information under this section shall keep the
823+36 information compiled and retained under this section confidential
824+37 and shall withhold the information from public disclosure.
825+38 SECTION 12. IC 10-21-1-11 IS ADDED TO THE INDIANA
826+39 CODE AS A NEW SECTION TO READ AS FOLLOWS
827+40 [EFFECTIVE JULY 1, 2023]: Sec. 11. (a) Before the school safety
828+41 plan developed under section 10 of this chapter is provided to or
829+42 filed with the entities specified under this chapter, the
830+EH 1492—LS 7255/DI 116 19
831+1 superintendent (or the equivalent for a charter school) or a school
832+2 safety specialist of the school corporation or charter school shall
833+3 present the proposed school safety plan to the governing body or,
834+4 if applicable, the charter school organizer, in executive session.
835+5 (b) The governing body or organizer may meet in executive
836+6 session to receive school safety updates from the superintendent, a
837+7 school safety specialist, a school resource officer, or a member of
838+8 a safe school committee under section 14 of this chapter.
839+9 (c) Notwithstanding the requirement to submit the school safety
840+10 plan to certain entities under state law, the school corporation or
841+11 charter school shall keep the school safety plan confidential and
842+12 withhold it from public disclosure.
843+13 SECTION 13. IC 10-21-1-12 IS ADDED TO THE INDIANA
844+14 CODE AS A NEW SECTION TO READ AS FOLLOWS
845+15 [EFFECTIVE JULY 1, 2023]: Sec. 12. (a) Not later than December
846+16 31, 2023, a county shall establish a county school safety
847+17 commission. Unless otherwise specified in subsection (b)(1) through
848+18 (b)(11), the members described in subsection (b) are appointed by
849+19 the school corporation having the largest ADM (as defined in
850+20 IC 20-18-2-2), as determined in the fall count of ADM in the school
851+21 year ending in the current calendar year.
852+22 (b) The members of the commission are as follows:
853+23 (1) A school safety specialist for each school corporation
854+24 located in whole or in part in the county.
855+25 (2) The judge of the court having juvenile jurisdiction in the
856+26 county or the judge's designee.
857+27 (3) The sheriff of the county or the sheriff's designee.
858+28 (4) The chief officer of every other law enforcement agency in
859+29 the county, or the chief officer's designee.
860+30 (5) A representative of the juvenile probation system,
861+31 appointed by the judge described in subdivision (2).
862+32 (6) Representatives of community agencies that work with
863+33 children within the county.
864+34 (7) A representative of the Indiana state police district that
865+35 serves the county, appointed by the Indiana state police.
866+36 (8) A representative of the prosecuting attorneys council of
867+37 Indiana who specializes in the prosecution of juveniles.
868+38 (9) A school safety specialist of a charter school representing
869+39 the interests and viewpoints of charter schools within the
870+40 commission's jurisdiction if at least one (1) charter school
871+41 within the commission's jurisdiction requests to participate.
872+42 (10) A school safety specialist of an accredited nonpublic

874+1 school representing the interests and viewpoints of accredited
875+2 nonpublic schools within the commission's jurisdiction if at
876+3 least one (1) accredited nonpublic school requests to
877+4 participate.
878+5 (11) Other appropriate individuals selected by the
879+6 commission.
880+7 (c) Once a commission is established, the school safety specialist
881+8 of the school corporation having the largest ADM (as defined in
882+9 IC 20-18-2-2), as determined in the fall count of ADM in the school
883+10 year ending in the current calendar year, in the county shall
884+11 convene the initial meeting of the commission.
885+12 (d) The members shall annually elect a chairperson.
886+13 (e) A commission shall perform the following duties:
887+14 (1) Periodically perform a cumulative analysis of school safety
888+15 needs within the county.
889+16 (2) Coordinate and make recommendations for the following:
890+17 (A) Prevention of juvenile offenses and improving the
891+18 reporting of juvenile offenses within the schools.
892+19 (B) Proposals for identifying and assessing children who
893+20 are at high risk of experiencing a mental health or
894+21 behavioral health crisis or becoming juvenile offenders.
895+22 (C) Methods to meet the educational needs of children who
896+23 have been detained as juvenile offenders.
897+24 (D) Methods to improve communications among agencies
898+25 that work with children.
899+26 (E) Methods to improve school security and emergency
900+27 preparedness.
901+28 (F) Additional equipment or personnel that are necessary
902+29 to carry out school safety plans.
903+30 (G) Pooling resources, combining purchases, using shared
904+31 administrative services, or collaborating among
905+32 participating school corporations, school corporation
906+33 career and technical education schools described in
907+34 IC 20-37-1-1, and charter schools to improve the
908+35 maintenance of safe schools.
909+36 (H) Implementing best practices and procedures to use
910+37 critical incidence digital mapping in the event of an
911+38 emergency within the county.
912+39 (I) Any other topic the commission considers necessary to
913+40 improve school safety within the commission's jurisdiction.
914+41 (3) Provide assistance to school safety specialists and school
915+42 resource officers within the commission's jurisdiction in

917+1 developing and:
918+2 (A) implementing school safety plans; and
919+3 (B) requesting grants from the fund.
920+4 (4) Assist accredited nonpublic schools within the
921+5 commission's jurisdiction that voluntarily submit a school
922+6 safety plan or a local school safety and emergency plan
923+7 (described in IC 20-34-3-23) to the commission seeking
924+8 assistance in carrying out the school safety plan.
925+9 (f) The affirmative votes of a majority of the voting members of
926+10 the commission are required for the commission to take action on
927+11 a measure.
928+12 (g) A commission shall receive the school safety plans for the
929+13 school corporations and charter schools located in the county.
930+14 (h) A commission may receive from an accredited nonpublic
931+15 school within the commission's jurisdiction a school safety plan or
932+16 a local school safety and emergency plan described in
933+17 IC 20-34-3-23.
934+18 (i) The commission shall keep the school safety plans compiled
935+19 and retained under this section confidential and shall withhold the
936+20 information from public disclosure.
937+21 (j) The commission may share the school safety plans under
938+22 subsections (g) and (h) with law enforcement and first responder
939+23 agencies that have jurisdiction over the school corporation, charter
940+24 school, or accredited nonpublic school. For the purposes of
941+25 IC 5-14-3, the entities receiving a school safety plan under this
942+26 subsection shall keep information compiled and retained under
943+27 subsections (g) and (h) confidential and shall withhold the
944+28 information from public disclosure.
945+29 (k) A commission shall annually submit to the board on a date
946+30 established by the board:
947+31 (1) meeting minutes;
948+32 (2) any meeting agenda materials directly related to taking
949+33 action on a measure under this section; and
950+34 (3) a brief annual summary of its activities and
951+35 accomplishments.
952+36 SECTION 14. IC 10-21-1-13 IS ADDED TO THE INDIANA
953+37 CODE AS A NEW SECTION TO READ AS FOLLOWS
954+38 [EFFECTIVE JULY 1, 2023]: Sec. 13. (a) The school safety specialist
955+39 training and certification program is established.
956+40 (b) The school safety specialist training and certification
957+41 program shall provide:
958+42 (1) annual training sessions, which may be conducted through

960+1 distance learning or at regional centers; and
961+2 (2) information concerning best practices and available
962+3 resources;
963+4 for school safety specialists and county school safety commissions.
964+5 (c) The department of education, in consultation with the board,
965+6 shall do the following:
966+7 (1) Assemble an advisory group of school safety specialists
967+8 from around the state to make recommendations concerning
968+9 the curriculum and standards for school safety specialist
969+10 training.
970+11 (2) Develop an appropriate curriculum and the standards for
971+12 the school safety specialist training and certification program.
972+13 The department of education may consult with national school
973+14 safety experts in developing the curriculum and standards.
974+15 The curriculum developed under this subdivision must
975+16 include training in:
976+17 (A) identifying, preventing, and intervening in bullying and
977+18 cyberbullying;
978+19 (B) identifying, preventing, and intervening in criminal
979+20 organization activity;
980+21 (C) identifying, preventing, and intervening in actions by
981+22 a person who is present on school property with the intent
982+23 to harm another person;
983+24 (D) developing and implementing a school safety plan in
984+25 accordance with this chapter;
985+26 (E) using a county school safety commission to improve
986+27 school safety and emergency preparedness; and
987+28 (F) using safe school committees to improve safety and
988+29 emergency preparedness for each school building.
989+30 (3) Administer the school safety specialist training and
990+31 certification program, including the following duties:
991+32 (A) Establish a school safety specialist certificate for
992+33 candidates eligible under section 9 of this chapter who
993+34 have successfully completed the training program.
994+35 (B) Review the qualifications of each candidate, determine
995+36 their eligibility for certification, and present a certificate
996+37 to each school safety specialist eligible for certification.
997+38 SECTION 15. IC 10-21-1-14 IS ADDED TO THE INDIANA
998+39 CODE AS A NEW SECTION TO READ AS FOLLOWS
999+40 [EFFECTIVE JULY 1, 2023]: Sec. 14. (a) Each school operated by
1000+41 a school corporation shall establish a safe school committee. The
1001+42 committee may be a subcommittee of the committee that develops
1002+EH 1492—LS 7255/DI 116 23
1003+1 the strategic and continuous school improvement and achievement
1004+2 plan under IC 20-31-5. Each committee may include at least one (1)
1005+3 member who is a member of the support staff of the school or
1006+4 school corporation career and technical education school.
1007+5 (b) Each school operated by a charter school shall establish a
1008+6 safe school committee. A charter school in operation on July 1,
1009+7 2023, shall comply with this subsection not later than July 1, 2024.
1010+8 (c) The safe school committee shall actively participate in and
1011+9 assist with the development of the school safety plan.
1012+10 (d) The department of education, the school corporation's or
1013+11 charter school's school safety specialist or specialists, and a school
1014+12 resource officer, if one (1) is employed by the school corporation or
1015+13 charter school, shall provide materials and guidelines to assist a
1016+14 safe school committee in developing a policy for a particular school
1017+15 that addresses the following issues:
1018+16 (1) Implementation of the school safety plan.
1019+17 (2) Addressing outside and internal threats to the physical
1020+18 safety of students, faculty, staff, and the public, including
1021+19 unsafe conditions, crime prevention, school violence, bullying
1022+20 and cyberbullying, criminal organization activity, child abuse
1023+21 and child sexual abuse, mental health and behavioral health,
1024+22 suicide awareness and prevention, and other issues that
1025+23 prevent the maintenance of a safe school.
1026+24 (3) Addressing the professional development needs for faculty
1027+25 and staff to implement methods that decrease problems
1028+26 identified under subdivision (2).
1029+27 (4) Identifying and implementing methods to encourage:
1030+28 (A) involvement by the community, families, and students;
1031+29 (B) development of relationships between students and
1032+30 school faculty and staff; and
1033+31 (C) use of problem solving teams.
1034+32 (e) The guidelines developed under subsection (d) must include
1035+33 age appropriate, research based information that assists school
1036+34 corporations or charter schools and safe school committees in:
1037+35 (1) developing and implementing bullying and cyberbullying
1038+36 prevention programs;
1039+37 (2) establishing investigation and reporting procedures
1040+38 related to bullying and cyberbullying; and
1041+39 (3) adopting discipline rules that comply with IC 20-33-8-13.5.
1042+40 (f) In addition to developing guidelines under subsection (d), the
1043+41 department of education shall establish categories of types of
1044+42 bullying incidents to allow school corporations to use the categories

1046+1 in making reports under IC 20-20-8-8 and IC 20-34-6-1.
1047+2 (g) The materials and guidelines provided under subsection (d)
1048+3 must include the model educational materials and model response
1049+4 policies and reporting procedures on child abuse and child sexual
1050+5 abuse developed or identified under IC 20-19-3-11.
1051+6 SECTION 16. IC 10-21-1-15 IS ADDED TO THE INDIANA
1052+7 CODE AS A NEW SECTION TO READ AS FOLLOWS
1053+8 [EFFECTIVE JULY 1, 2023]: Sec. 15. An accredited nonpublic
1054+9 school may do one (1) or more of the following:
1055+10 (1) Designate one (1) or more individuals to obtain school
1056+11 safety specialist certification under section 13 of this chapter
1057+12 to perform school safety specialist duties under this chapter.
1058+13 (2) Establish a school safety plan in accordance with section
1059+14 10 of this chapter.
1060+15 (3) Establish a safe school committee.
1061+16 (4) Submit a school safety plan to the county school safety
1062+17 commission having jurisdiction over the accredited nonpublic
1063+18 school.
1064+19 (5) Request to join the county school safety commission
1065+20 having jurisdiction over the accredited nonpublic school or be
1066+21 represented by another accredited nonpublic school's school
1067+22 safety specialist on the same commission.
1068+23 (6) Request general guidance relating to school safety matters
1069+24 from one (1) or more of the following:
1070+25 (A) The board.
1071+26 (B) The department of education.
1072+27 (C) The department of homeland security.
1073+28 (D) The county school safety commission having
1074+29 jurisdiction over the accredited nonpublic school.
1075+30 SECTION 17. IC 20-19-3-11.5, AS ADDED BY P.L.211-2018(ss),
1076+31 SECTION 6, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1077+32 JULY 1, 2023]: Sec. 11.5. (a) As used in this section, "cyberbullying"
1078+33 refers to bullying (as defined in IC 20-33-8-0.2) that occurs through the
1079+34 use of data or computer software that is accessed through a:
1080+35 (1) computer;
1081+36 (2) computer system;
1082+37 (3) computer network; or
1083+38 (4) cellular telephone or other wireless or cellular
1084+39 communications device.
1085+40 (b) The department shall maintain a link on the department's
1086+41 Internet web site website that provides parents and school officials
1087+42 with resources or best practices regarding the prevention and reporting
1088+EH 1492—LS 7255/DI 116 25
1089+1 of bullying and cyberbullying. The resources must include guidance on
1090+2 how to report to law enforcement agencies instances of bullying and
1091+3 cyberbullying that occur off campus. The department shall also include
1092+4 guidelines developed by the department under IC 5-2-10.1-12(d).
1093+5 IC 10-21-1-14(d).
1094+6 (c) The department shall consult with law enforcement agencies,
1095+7 school officials, and organizations that have expertise in the prevention
1096+8 or reporting of bullying or cyberbullying for purposes of developing or
1097+9 providing the resources or best practices described in subsection (b).
1098+10 (d) The following entities shall maintain a link on their Internet web
1099+11 sites websites to the Internet web site website described in subsection
1100+12 (b):
1101+13 (1) The state board.
1102+14 (2) A school corporation.
1103+15 SECTION 18. IC 20-19-3-14, AS ADDED BY P.L.36-2014,
1104+16 SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1105+17 JULY 1, 2023]: Sec. 14. (a) As used in this section, "division" refers to
1106+18 the division of school building physical security and safety established
1107+19 by subsection (c).
1108+20 (b) As used in this section, "physical security" refers to security
1109+21 measures that are designed to deny unauthorized access to a building
1110+22 or facility, including equipment and resources, and to protect
1111+23 individuals and property from damage or harm.
1112+24 (c) The division of school building physical security and safety is
1113+25 established within the department.
1114+26 (d) The division shall:
1115+27 (1) establish and maintain guidelines for using professional
1116+28 architectural and engineering services to integrate physical
1117+29 security improvements and safety practices in the construction,
1118+30 renovation, repair, or alteration of a school facility;
1119+31 (2) carry out the department's responsibilities with regards to the
1120+32 school safety specialist training and certification program
1121+33 established in IC 5-2-10.1-11; IC 10-21-1-13;
1122+34 (3) establish and maintain guidelines for establishing emergency
1123+35 response protocols in cooperation with other state agencies;
1124+36 (4) carry out the department's responsibilities to safe school
1125+37 committees under IC 5-2-10.1-12; IC 10-21-1-14;
1126+38 (5) coordinate the department's response and recovery assistance
1127+39 to a school in the event of a manmade or natural disaster;
1128+40 (6) provide information and guidance to assist school corporations
1129+41 or schools to establish mutual aid disaster assistance agreements
1130+42 with other schools or school corporations; and

1132+1 (7) study and collect information to integrate lessons learned from
1133+2 previous school disasters throughout the country into the
1134+3 curriculum of the school safety specialist training and certification
1135+4 program established in IC 5-2-10.1-11 IC 10-21-1-13 and
1136+5 guidelines established by the division under this subsection;
1137+6 (8) establish and maintain guidelines, in consultation with the
1138+7 department of homeland security and institute for criminal
1139+8 justice, for developing and maintaining school safety plans as
1140+9 described in IC 10-21-1-10 and IC 10-21-1-11; and
1141+10 (9) assist the secured school safety board established by
1142+11 IC 10-21-1-3 in conducting the review and submitting the
1143+12 report as described in IC 10-21-1-8.
1144+13 (e) The division may: upon request by a school corporation:
1145+14 (1) request a meeting with a school corporation or charter
1146+15 school to review a school safety plan as described in
1147+16 IC 10-21-1-10;
1148+17 (2) request to provide an onsite safety review for a school
1149+18 corporation or charter school; and
1150+19 (3) request to provide guidance or assistance relating to school
1151+20 safety matters to the a school corporation or charter school;
1152+21 (4) provide assistance or guidance relating to school safety
1153+22 matters upon request by a nonpublic school that has
1154+23 voluntarily become accredited under IC 20-31-4.1 or is
1155+24 accredited by a national or regional accrediting agency that
1156+25 is recognized by the state board; and
1157+26 (5) provide assistance or guidance relating to school safety
1158+27 matters upon request by a county school safety commission
1159+28 under IC 10-21-1-12.
1160+29 (f) The division shall maintain a secure Internet web site to provide
1161+30 school officials and public safety officials access to information that is
1162+31 considered classified under IC 5-14-3-4(b)(1), IC 5-14-3-4(b)(18), and
1163+32 IC 5-14-3-4(b)(19) or other sensitive information that may assist school
1164+33 officials and public safety officials in improving school safety or
1165+34 responding to a manmade or natural disaster.
1166+35 (g) The division shall maintain a public Internet web site website
1167+36 that contains:
1168+37 (1) the guidelines established by the division under subsection
1169+38 (d);
1170+39 (2) best practices pertaining to school safety; and
1171+40 (3) any other information the division determines may be
1172+41 necessary to carry out the division's duties or responsibilities
1173+42 under this section.

1175+1 SECTION 19. IC 20-26-5-42.7 IS ADDED TO THE INDIANA
1176+2 CODE AS A NEW SECTION TO READ AS FOLLOWS
1177+3 [EFFECTIVE JULY 1, 2023]: Sec. 42.7. (a) The governing body of
1178+4 a school corporation shall do the following:
1179+5 (1) Approve or disapprove all school safety specialists chosen
1180+6 by the superintendent of the school corporation under
1181+7 IC 10-21-1-9. The governing body of a school corporation
1182+8 shall also approve or disapprove the individual school safety
1183+9 specialist chosen by the superintendent of the school
1184+10 corporation to serve on the county school safety commission
1185+11 under IC 10-21-1-12.
1186+12 (2) Review a school safety plan described in IC 10-21-1-10
1187+13 following the procedures outlined in IC 10-21-1-11.
1188+14 (b) Not later than July 1, 2024, the organizer of a charter school
1189+15 shall do the following:
1190+16 (1) Approve or disapprove all school safety specialists chosen
1191+17 by leadership of the charter school under IC 10-21-1-9.
1192+18 (2) Review a school safety plan described in IC 10-21-1-10
1193+19 following the procedures outlined in IC 10-21-1-11.
1194+20 SECTION 20. IC 20-26-18.2-0.5 IS ADDED TO THE INDIANA
1195+21 CODE AS A NEW SECTION TO READ AS FOLLOWS
1196+22 [EFFECTIVE JULY 1, 2023]: Sec. 0.5. The following definitions
1197+23 apply throughout this chapter:
1198+24 (1) "Safe school committee" refers to the requirements set
1199+25 forth in IC 10-21-1-14.
1200+26 (2) "School safety plan" refers to the requirements set forth
1201+27 in IC 10-21-1-10.
1202+28 (3) "School safety specialist" refers to the requirements set
1203+29 forth in IC 10-21-1-9.
1204+30 SECTION 21. IC 20-26-18.2-1, AS AMENDED BY P.L.139-2022,
1205+31 SECTION 10, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1206+32 JULY 1, 2023]: Sec. 1. (a) As used in this chapter, "school resource
1207+33 officer" means a law enforcement officer who:
1208+34 (1) has completed the training described in subsection (b);
1209+35 (2) is assigned to one (1) or more school corporations or charter
1210+36 schools during school hours to:
1211+37 (A) assist the school safety specialist specialists and the safe
1212+38 school committees with the development and implementation
1213+39 of the school safety plan; as provided in section 2 of this
1214+40 chapter; and
1215+41 (B) carry out any additional responsibilities assigned to the
1216+42 school resource officer under the employment engagement,
1217+EH 1492—LS 7255/DI 116 28
1218+1 contract, or memorandum of understanding and to provide law
1219+2 enforcement services to:
1220+3 (i) protect against outside threats to the physical safety of
1221+4 students;
1222+5 (ii) prevent unauthorized access to school property; and
1223+6 (iii) secure schools against violence and natural disasters;
1224+7 and
1225+8 (3) is:
1226+9 (A) employed by a law enforcement agency;
1227+10 (B) appointed as a police reserve officer (as described in
1228+11 IC 36-8-3-20) or as a special deputy (as described in
1229+12 IC 36-8-10-10.6) if the police reserve officer or special deputy:
1230+13 (i) is subject to the direction of the sheriff or appointing law
1231+14 enforcement agency;
1232+15 (ii) is required to obey the rules and orders of the sheriff's
1233+16 department or appointing law enforcement agency;
1234+17 (iii) is required to complete all training required of regular
1235+18 full-time law enforcement officers employed by the sheriff's
1236+19 department or appointing law enforcement agency; and
1237+20 (iv) may be removed by the sheriff or appointing law
1238+21 enforcement agency at any time, with or without cause; or
1239+22 (C) a school corporation police officer appointed under
1240+23 IC 20-26-16-3.
1241+24 The term does not include a law enforcement officer who is assigned
1242+25 to a school to provide security outside a school building for protection
1243+26 from outside threats, traffic duty, or other duties not consistent with the
1244+27 duties of a school resource officer.
1245+28 (b) Before being appointed as a school resource officer, an
1246+29 individual must have successfully completed the minimum training
1247+30 requirements established for law enforcement officers under
1248+31 IC 5-2-1-9.
1249+32 (c) The law enforcement officer appointed as a school resource
1250+33 officer must receive at least forty (40) hours of school resource officer
1251+34 training through:
1252+35 (1) the Indiana law enforcement training board established by
1253+36 IC 5-2-1-3;
1254+37 (2) the National Association of School Resource Officers; or
1255+38 (3) another school resource officer training program approved by
1256+39 the Indiana law enforcement training board;
1257+40 within one hundred eighty (180) days from the date the individual is
1258+41 initially assigned the duties of a school resource officer. However, if
1259+42 the current ADM of a school corporation is less than one thousand

1261+1 (1,000) students, the individual shall complete the school resource
1262+2 officer training within three hundred sixty-five (365) days of the date
1263+3 the individual is initially assigned the duties of a school resource
1264+4 officer.
1265+5 (d) Training described in subsection (c) must include instruction
1266+6 regarding skills, tactics, and strategies necessary to address the special
1267+7 nature of:
1268+8 (1) school campuses; and
1269+9 (2) school building security needs and characteristics.
1270+10 SECTION 22. IC 20-26-18.2-2, AS AMENDED BY P.L.139-2022,
1271+11 SECTION 11, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1272+12 JULY 1, 2023]: Sec. 2. (a) A school resource officer may be employed:
1273+13 (1) by one (1) or more school corporations or charter schools
1274+14 through a contract between a local law enforcement agency and
1275+15 the school corporation or school corporations or the charter school
1276+16 or charter schools;
1277+17 (2) by one (1) or more school corporations or charter schools;
1278+18 (3) by a local law enforcement agency that assigns the school
1279+19 resource officer to one (1) or more school corporations or charter
1280+20 schools through a memorandum of understanding between the
1281+21 local law enforcement agency and the school corporation or
1282+22 school corporations or the charter school or charter schools; or
1283+23 (4) through a contract between an Indiana business that employs
1284+24 persons who meet the qualifications of a school resource officer
1285+25 and the school corporation or school corporations or the charter
1286+26 school or charter schools.
1287+27 (b) This subsection does not apply to a school corporation that only
1288+28 has full-time school resource officers who are either employees of the
1289+29 school corporation's school police department or are employees of the
1290+30 school corporation who have successfully completed the law
1291+31 enforcement basic training requirements described in IC 5-2-1-9(d).
1292+32 After June 30, 2023, if a school corporation or charter school enters
1293+33 into a contract for a school resource officer, the school corporation or
1294+34 charter school must enter into a memorandum of understanding with
1295+35 the law enforcement agency that employs or appointed the law
1296+36 enforcement officer who will perform the duties of a school resource
1297+37 officer. The memorandum of understanding must state the nature and
1298+38 scope of a school resource officer's duties and responsibilities. A school
1299+39 resource officer's duties and responsibilities include the duty to assist
1300+40 the school corporation's or charter school's school safety specialist
1301+41 specialists and safe school committees with the development and
1302+42 implementation of a school safety plans. plan that does the following:

1304+1 (1) Protects against outside threats to the physical safety of
1305+2 students.
1306+3 (2) Prevents unauthorized access to school property.
1307+4 (3) Secures schools against violence and natural disasters.
1308+5 (4) On or before July 1, 2020, identifies the location of bleeding
1309+6 control kits (as defined in IC 20-34-3-24(a)).
1310+7 (c) A school resource officer shall consult with local law
1311+8 enforcement officials and first responders when assisting the school
1312+9 corporation's or charter school's school safety specialist specialists
1313+10 and safe school committees in the development of the school safety
1314+11 plan.
1315+12 (d) A school resource officer shall participate in the development
1316+13 and implementation of programs designed to identify, assess, and
1317+14 provide assistance to troubled youth. youth who are at high risk of
1318+15 experiencing a mental health crisis or becoming juvenile offenders.
1319+16 (e) A school resource officer may not be reassigned to other duties
1320+17 by the school corporation.
1321+18 SECTION 23. IC 20-26-18.2-5, AS ADDED BY P.L.57-2020,
1322+19 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1323+20 JULY 1, 2023]: Sec. 5. (a) Beginning on September 1, 2023, and
1324+21 each September 1 thereafter, each A school corporation or charter
1325+22 school served by a school resource officer employed for the protection
1326+23 of the school corporation or charter school under section 2 of this
1327+24 chapter shall annually report on a form prescribed by the
1328+25 department of homeland security:
1329+26 (1) the number of school resource officers serving the school
1330+27 corporation or charter school;
1331+28 (2) the amount budgeted and the sources of the funds to
1332+29 employ a school resource officer or school resource officers to
1333+30 serve the school corporation or charter school;
1334+31 (3) the number of school resource officers serving the school
1335+32 corporation or charter school employed by one (1) or more
1336+33 school corporations or charter schools;
1337+34 (4) an attestation that the school resource officers employed
1338+35 by the school corporation or charter school have met the
1339+36 training requirements under section 1 of this chapter;
1340+37 (5) the number of school resource officers serving the school
1341+38 corporation or charter school through a contract or
1342+39 memorandum of understanding with a local law enforcement
1343+40 agency or an Indiana business that employs persons who meet
1344+41 the qualifications of a school resource officer under section 2
1345+42 of this chapter; and

1347+1 (6) if applicable, the number of law enforcement officers who
1348+2 are not school resource officers also serving the school
1349+3 corporation or charter school through a contract or
1350+4 memorandum of understanding with a local law enforcement
1351+5 agency;
1352+6 to the department of homeland security. before September 1.
1353+7 (b) The department of homeland security shall:
1354+8 (1) annually compile the information reported under subsection
1355+9 (a); and
1356+10 (2) retain the information reported under subsection (a).
1357+11 (c) For purposes of IC 5-14-3, the department of homeland security
1358+12 shall keep information compiled and retained under subsection (b)
1359+13 confidential and shall withhold the information from public disclosure.
1360+14 (d) The secured school safety board established by IC 10-21-1-3
1361+15 shall include the following aggregate level information in the
1362+16 review and report submitted to the governor and legislative council
1363+17 as required under IC 10-21-1-8:
1364+18 (1) The total number of school resource officers employed:
1365+19 (A) in Indiana, including the number of unique school
1366+20 corporations and charter schools employing a school
1367+21 resource officer;
1368+22 (B) exclusively by a school corporation;
1369+23 (C) by one (1) or more school corporations;
1370+24 (D) exclusively by a charter school;
1371+25 (E) by a coalition of charter schools; and
1372+26 (F) by a combination of one (1) or more school
1373+27 corporations and one (1) or more charter schools.
1374+28 (2) A statewide overview of how school corporations and
1375+29 charter schools are budgeting for the employment of school
1376+30 resource officers and the employment of law enforcement
1377+31 officers.
1378+32 SECTION 24. IC 20-30-5-5.5, AS ADDED BY P.L.285-2013,
1379+33 SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1380+34 JULY 1, 2023]: Sec. 5.5. (a) Not later than October 15 of each year,
1381+35 each public school shall provide age appropriate, research based
1382+36 instruction as provided under IC 5-2-10.1-12(d)(1) IC 10-21-1-14(d)
1383+37 focusing on bullying prevention for all students in grades 1 through 12.
1384+38 (b) The department, in consultation with school safety specialists
1385+39 and school counselors, shall prepare outlines or materials for the
1386+40 instruction described in subsection (a) and incorporate the instruction
1387+41 in grades 1 through 12.
1388+42 (c) Instruction on bullying prevention may be delivered by a school

1390+1 safety specialist, school counselor, or any other person with training
1391+2 and expertise in the area of bullying prevention and intervention.
1392+3 SECTION 25. IC 20-34-3-20, AS AMENDED BY P.L.92-2020,
1393+4 SECTION 82, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1394+5 JULY 1, 2023]: Sec. 20. (a) The governing body of a school
1395+6 corporation and an organizer of a charter school shall require each
1396+7 school in the governing body's jurisdiction or organizer's
1397+8 responsibility to conduct periodic emergency preparedness drills
1398+9 during the school year in compliance with rules adopted under
1399+10 IC 4-22-2 by the state board.
1400+11 (b) Each school and attendance center shall conduct at least:
1401+12 (1) one (1) tornado preparedness drill; and
1402+13 (2) one (1) manmade occurrence disaster drill;
1403+14 during each semester.
1404+15 (c) At least one (1) manmade occurrence disaster drill required
1405+16 under subsection (b) must be an active shooter drill and must be
1406+17 conducted within ninety (90) calendar days after the beginning of the
1407+18 school year.
1408+19 (d) Each:
1409+20 (1) state accredited nonpublic school; and
1410+21 (2) charter school;
1411+22 must conduct at least one (1) active shooter drill during each school
1412+23 year.
1413+24 (e) Notwithstanding rules established by the state fire marshal under
1414+25 IC 12-17-12-19, a drill conducted under subsection (b) may be
1415+26 conducted instead of a periodic or monthly fire evacuation drill
1416+27 requirement established by the state fire marshal. However, a drill
1417+28 conducted under subsection (b) may not be made:
1418+29 (1) instead of more than two (2) periodic or monthly fire
1419+30 evacuation drills in a particular school semester; and
1420+31 (2) in two (2) consecutive months.
1421+32 (f) The governing body of a school corporation or an organizer of
1422+33 a charter school may direct schools to conduct emergency
1423+34 preparedness drills in addition to those required under subsection (b).
1424+35 (g) The governing body of a school corporation or organizer of a
1425+36 charter school shall require each principal to file a certified statement
1426+37 that all drills have been conducted as required under this section.
1427+38 SECTION 26. IC 20-34-3-23, AS AMENDED BY P.L.92-2020,
1428+39 SECTION 83, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1429+40 JULY 1, 2023]: Sec. 23. (a) Each charter school and state accredited
1430+41 nonpublic school shall adopt a local school safety and emergency plan
1431+42 that includes:

1433+1 (1) safety and emergency training and educational opportunities
1434+2 for school employees; and
1435+3 (2) periodic safety and emergency preparedness and evacuation
1436+4 drills.
1437+5 (b) Each charter school and state accredited nonpublic school shall
1438+6 provide a copy of the floor plans for each building located on the
1439+7 school's property that clearly indicates each exit, the interior rooms and
1440+8 hallways, and the location of any hazardous materials located in the
1441+9 building to the law enforcement agency and the fire department that
1442+10 have jurisdiction over the school.
1443+11 (c) If a charter school or state accredited nonpublic school has
1444+12 conducted critical incidence digital mapping as described in
1445+13 IC 10-21-1-1 for each school building located on the school's
1446+14 property, it may provide the critical incidence digital mapping
1447+15 information to:
1448+16 (1) the law enforcement agency and fire department that have
1449+17 jurisdiction over the mapped school buildings; and
1450+18 (2) the statewide 911 system described in IC 36-8-16.7-22
1451+19 through the public safety answer point, or "PSAP", described
1452+20 in IC 36-8-16.7-20 that has jurisdiction over the mapped
1453+21 school buildings;
1454+22 to satisfy the requirement of subsection (b).
1455+23 (d) Once a charter school develops a school safety plan under
1456+24 IC 10-21-1-10, the charter school has satisfied the requirements of
1457+25 this section.
1458+26 SECTION 27. IC 20-34-9-1, AS AMENDED BY P.L.156-2020,
1459+27 SECTION 79, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1460+28 JULY 1, 2023]: Sec. 1. This chapter does not apply to a virtual charter
1461+29 school (as defined in IC 20-24-1-10) or a virtual state accredited
1462+30 nonpublic school.
1463+31 SECTION 28. IC 20-34-9-1.1 IS ADDED TO THE INDIANA
1464+32 CODE AS A NEW SECTION TO READ AS FOLLOWS
1465+33 [EFFECTIVE JULY 1, 2023]: Sec. 1.1. As used in ths chapter,
1466+34 "accredited nonpublic school" means a nonpublic school that:
1467+35 (1) has voluntarily become accredited under IC 20-31-4.1; or
1468+36 (2) is accredited by a national or regional accrediting agency
1469+37 that is recognized by the state board.
1470+38 SECTION 29. IC 20-34-9-4, AS AMENDED BY P.L.92-2020,
1471+39 SECTION 92, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1472+40 JULY 1, 2023]: Sec. 4. Beginning after June 30, 2020, and subject to
1473+41 available funding, a school corporation, a charter school, and a state an
1474+42 accredited nonpublic school are eligible for a grant under this chapter

1476+1 if the school corporation, charter school, or state accredited nonpublic
1477+2 school meets the requirements of this chapter.
1478+3 SECTION 30. IC 20-34-9-5, AS AMENDED BY P.L.92-2020,
1479+4 SECTION 93, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1480+5 JULY 1, 2023]: Sec. 5. (a) The student and parent support services
1481+6 grant program is established to provide grants to school corporations,
1482+7 charter schools, and state accredited nonpublic schools for the
1483+8 development and implementation of student and parent support
1484+9 services plans to support parents caring for at-risk students.
1485+10 (b) The department, in coordination with the division of mental
1486+11 health and addiction, shall administer the program.
1487+12 SECTION 31. IC 20-34-9-6, AS AMENDED BY P.L.92-2020,
1488+13 SECTION 94, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1489+14 JULY 1, 2023]: Sec. 6. A school corporation, a charter school, or a
1490+15 state an accredited nonpublic school must do the following to
1491+16 participate in the program:
1492+17 (1) Apply to the department to participate in the program.
1493+18 (2) Submit to the department a student and parent support
1494+19 services plan that the school corporation, charter school, or state
1495+20 accredited nonpublic school intends to implement and that
1496+21 includes the following:
1497+22 (A) A process for a teacher or school employee to notify a
1498+23 school official to contact a student's parent if the student
1499+24 demonstrates a repeated pattern of aberrant or abnormal
1500+25 behavior. The parental notification process described in this
1501+26 clause must also include that the school will hold a conference
1502+27 with the student and the student's parent.
1503+28 (B) A requirement that the conference described in clause (A)
1504+29 must address the student's potential need for and benefit from:
1505+30 (i) school based treatment services; or
1506+31 (ii) treatment services provided by an outside professional
1507+32 care provider that is contracted and paid for by the school
1508+33 corporation, charter school, or state accredited nonpublic
1509+34 school.
1510+35 (C) A procedure for a parent who chooses to seek services for
1511+36 the student to follow that includes granting written parental
1512+37 consent for the student to receive services by a service
1513+38 provider described under clause (B).
1514+39 (D) A requirement to ensure that a school shall maintain the
1515+40 confidentiality of any medical records that result from a
1516+41 student's participation in any treatment described in clause (B).
1517+42 The school must adopt a policy that prohibits the school from:

1519+1 (i) sharing any reports or notes resulting from the provision
1520+2 of school based treatment services described in clause (B)(i)
1521+3 with other school officials; and
1522+4 (ii) maintaining any reports, notes, diagnosis, or
1523+5 appointments that result from a student's participation in any
1524+6 treatment described in clause (B)(i) through (B)(ii) in the
1525+7 student's permanent educational file.
1526+8 SECTION 32. IC 20-34-9-7, AS AMENDED BY P.L.92-2020,
1527+9 SECTION 95, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1528+10 JULY 1, 2023]: Sec. 7. (a) Before June 30, 2020, and before each June
1529+11 30 thereafter, the department shall evaluate and prepare a report
1530+12 concerning development and implementation of the following:
1531+13 (1) The program.
1532+14 (2) The plans submitted and implemented by school corporations,
1533+15 charter schools, and state accredited nonpublic schools.
1534+16 (b) The department shall submit the report described in subsection
1535+17 (a) to the legislative council in an electronic format under IC 5-14-6.
1536+18 SECTION 33. IC 20-40-2-10, AS ADDED BY P.L.161-2019,
1537+19 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1538+20 JULY 1, 2023]: Sec. 10. (a) After the department completes the school
1539+21 corporation notice requirement under section 9 of this chapter, the
1540+22 department shall notify the state board, fiscal and qualitative indicators
1541+23 committee, and Indiana education employment relations board as soon
1542+24 as possible of all school corporations that received a notice stating they
1543+25 were on the excessive education fund transfer list for the immediately
1544+26 preceding calendar year.
1545+27 (b) Upon receipt of the department notice to a school corporation
1546+28 under section 9 of this chapter, the school corporation's superintendent
1547+29 and financial personnel, including the school's business officer, shall
1548+30 prepare and submit explanatory documentation within ninety (90) days,
1549+31 explaining the following:
1550+32 (1) How and why the school corporation's leadership believes the
1551+33 school corporation failed to meet the education fund transfer
1552+34 target percentage.
1553+35 (2) The steps the school corporation's leadership is planning or
1554+36 actively taking to budget and spend during the next calendar year
1555+37 to meet the education fund transfer target percentage for the next
1556+38 calendar year.
1557+39 (c) The school corporation's superintendent shall submit the
1558+40 explanatory documentation to the department and the fiscal and
1559+41 qualitative indicators committee.
1560+42 (d) Upon submission of the explanatory documentation under
1561+EH 1492—LS 7255/DI 116 36
1562+1 subsection (b), the school corporation's superintendent shall present the
1563+2 explanatory documentation to the school corporation's governing body
1564+3 at its next public meeting. The governing body shall enter both the
1565+4 actual documentation and corresponding discussion into its official
1566+5 minutes for that meeting.
1567+6 (e) Upon the completion of the duties under subsection (d), the
1568+7 school corporation shall publish the explanatory documentation
1569+8 alongside any further notices and related reports from the department
1570+9 on its Internet web site website within thirty (30) days.
1571+10 (f) Upon receipt of a school corporation's explanatory
1572+11 documentation, the fiscal and qualitative indicators committee shall
1573+12 officially acknowledge receipt of the documentation at its next public
1574+13 meeting and enter the receipt into its official minutes for that meeting.
1575+14 (g) Upon receipt of the explanatory documentation, the department,
1576+15 in collaboration with the fiscal and qualitative indicators committee,
1577+16 shall review the documentation within sixty (60) days to make a
1578+17 preliminary determination of whether the documentation satisfactorily
1579+18 demonstrates that the school corporation's leadership has outlined and
1580+19 begun a corrective action plan to make progress in meeting the
1581+20 education fund transfer target percentage for the next calendar year.
1582+21 (h) If the department determines the explanatory documentation is
1583+22 not satisfactory, the department may contact the superintendent and
1584+23 financial personnel, including the school business officer, of the school
1585+24 corporation to schedule as soon as possible an appearance before the
1586+25 fiscal and qualitative indicators committee at a public meeting to
1587+26 provide an opportunity to explain the details within the explanatory
1588+27 documentation, and to explain to the fiscal and qualitative indicators
1589+28 committee the school corporation's budgeting and compensation levels
1590+29 in relation to the following for the school corporation:
1591+30 (1) How and why the education fund transfer target percentage
1592+31 was not met during the previous calendar year.
1593+32 (2) Total combined expenditures.
1594+33 (3) Student instructional expenditures.
1595+34 (4) Noninstructional expenditures.
1596+35 (5) Full-time teacher compensation expenditures.
1597+36 (6) Nonteaching, full-time administrative personnel compensation
1598+37 expenditures.
1599+38 (7) Nonteaching staff personnel compensation expenditures.
1600+39 (8) Any prior or planned attempts to seek the assistance available
1601+40 under this chapter from the Indiana education employment
1602+41 relations board and the department's division of finance.
1603+42 (9) Any prior or planned pooling of resources, combined
1604+EH 1492—LS 7255/DI 116 37
1605+1 purchases, usage of shared administrative services, or
1606+2 collaboration with contiguous school corporations in reducing
1607+3 noninstructional expenditures as described under IC 20-42.5-2-1.
1608+4 (10) Any prior or planned participation in a county school safety
1609+5 commission under IC 5-2-10.1-10 IC 10-21-1-12 to assist and
1610+6 reduce school safety expenditures.
1611+7 (11) Any prior or planned consideration of meeting the
1612+8 requirements of and applying for school corporation efficiency
1613+9 incentive grants under IC 36-1.5-6.
1614+10 (i) The fiscal and qualitative indicators committee may contact the
1615+11 superintendent and financial personnel, including the school's business
1616+12 officer, of a school corporation that has been included on the
1617+13 department's excessive education fund transfer list for at least two (2)
1618+14 immediately preceding calendar years to provide the school corporation
1619+15 an opportunity to explain to the fiscal and qualitative indicators
1620+16 committee in a public meeting the school corporation's budgeting and
1621+17 compensation levels in relation to the items listed in subsection (h).
1622+18 (j) After the fiscal and qualitative indicators committee receives the
1623+19 school corporation's explanation under this section, the fiscal and
1624+20 qualitative indicators committee may issue an official recommendation
1625+21 to the school corporation to perform a review and improve its
1626+22 budgeting procedures in consultation with any state agencies the fiscal
1627+23 and qualitative indicators committee considers appropriate. The state
1628+24 agencies specified by the fiscal and qualitative indicators committee
1629+25 shall assist the school corporation before and during its next collective
1630+26 bargaining period with the goal of meeting or making progress toward
1631+27 the education fund transfer target percentage. If the fiscal and
1632+28 qualitative indicators committee issues an official recommendation to
1633+29 a school corporation, the school corporation's governing body shall
1634+30 officially acknowledge receipt of the recommendation at its next public
1635+31 meeting and enter into the school corporation governing body's minutes
1636+32 for that meeting acknowledgment of receipt of the recommendation. In
1637+33 addition, the school corporation shall publish the official
1638+34 recommendation on the school corporation's Internet web site. website.
1639+35 (k) The school corporation shall publish the most recent notices
1640+36 from the department, relevant individual reports prepared by the
1641+37 department, explanatory documentation by the school corporation, and
1642+38 official recommendations by the fiscal and qualitative indicators
1643+39 committee on the school corporation's Internet web site.
1644+40 (l) The school corporation may remove the notice, its explanatory
1645+41 documentation, and the fiscal and qualitative indicators committee's
1646+42 official recommendation from its Internet web site website if the

1648+1 department determines that the school corporation met its education
1649+2 fund transfer target percentage and is no longer on the excessive
1650+3 education fund transfer list.
1651+4 SECTION 34. IC 33-37-9-4, AS AMENDED BY P.L.55-2022,
1652+5 SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1653+6 JULY 1, 2023]: Sec. 4. (a) The treasurer of state shall distribute
1654+7 semiannually one million two hundred eighty-eight thousand dollars
1655+8 ($1,288,000) of the amounts transferred to the state fund under section
1656+9 3 of this chapter as follows:
1657+10 (1) Fourteen and ninety-eight hundredths percent (14.98%) shall
1658+11 be deposited into the alcohol and drug countermeasures fund
1659+12 established by IC 9-27-2-11.
1660+13 (2) Eight and forty-two hundredths percent (8.42%) shall be
1661+14 deposited into the drug interdiction fund established by
1662+15 IC 10-11-7-1.
1663+16 (3) Four and sixty-eight hundredths percent (4.68%) shall be
1664+17 deposited into the substance abuse prosecution fund established
1665+18 by IC 33-39-8-6.
1666+19 (4) Five and sixty-two hundredths percent (5.62%) shall be
1667+20 deposited into the corrections drug abuse fund established by
1668+21 IC 11-8-2-11.
1669+22 (5) Twenty-two and forty-seven hundredths percent (22.47%)
1670+23 shall be deposited into the state drug free communities fund
1671+24 established by IC 5-2-10-2.
1672+25 (6) Seven and ninety-eight hundredths percent (7.98%) shall be
1673+26 distributed to the Indiana department of transportation for use
1674+27 under IC 8-23-2-15.
1675+28 (7) Twenty and thirty-two hundredths percent (20.32%) shall be
1676+29 deposited in the family violence and victim assistance fund
1677+30 established by IC 5-2-6.8-3.
1678+31 (8) Fifteen and fifty-three hundredths percent (15.53%) shall be
1679+32 deposited in the Indiana safe schools fund established by
1680+33 IC 5-2-10.1. Indiana secured school fund established by
1681+34 IC 10-21-1-2.
1682+35 (b) The treasurer of state shall distribute semiannually the amount
1683+36 remaining after the distributions are made under subsection (a) to the
1684+37 court technology fund established by IC 33-24-6-12.

356-(1) The total cost of the program established by the school
357-corporation, charter school, or accredited nonpublic school (or the
358-coalition of schools applying jointly).
359-(2) Except as provided in subsection (d), the following amounts:
360-(A) Thirty-five thousand dollars ($35,000) per year, in the case
361-of a school corporation, charter school, or accredited
362-nonpublic school that:
363-(i) has an ADM of at least one (1) and less than one
364-thousand one (1,001) students; and
365-(ii) is not applying jointly with any other school corporation,
366-charter school, or accredited nonpublic school.
367-(B) Fifty thousand dollars ($50,000) per year, in the case of a
368-school corporation, charter school, or accredited nonpublic
369-school that:
370-(i) has an ADM of more than one thousand (1,000) and less
371-than five thousand one (5,001) students; and
372-(ii) is not applying jointly with any other school corporation,
373-charter school, or accredited nonpublic school.
374-(C) Seventy-five thousand dollars ($75,000) per year, in the
375-case of a school corporation, charter school, or accredited
376-nonpublic school that:
377-(i) has an ADM of more than five thousand (5,000) and less
378-than fifteen thousand one (15,001) students; and
379-(ii) is not applying jointly with any other school corporation,

381-charter school, or accredited nonpublic school.
382-(D) One hundred thousand dollars ($100,000) per year, in the
383-case of a school corporation, charter school, or accredited
384-nonpublic school that:
385-(i) has an ADM of more than fifteen thousand (15,000); and
386-(ii) is not applying jointly with any other school corporation,
387-charter school, or accredited nonpublic school.
388-(E) One hundred thousand dollars ($100,000) per year, in the
389-case of a coalition of schools applying jointly.
390-(c) Except as provided in subsection (d), the match requirement for
391-a grant under this chapter is based on the ADM for the school
392-corporation, charter school, or accredited nonpublic school (or
393-coalition of schools applying jointly) that is the subject of the grant
394-as follows:
395-(1) For a school corporation, charter school, or accredited
396-nonpublic school with an ADM of less than five hundred one
397-(501) students, the grant match must be twenty-five percent
398-(25%) of the grant amount described in subsection (b).
399-(2) For a school corporation, charter school, or accredited
400-nonpublic school with an ADM of more than five hundred (500)
401-and less than one thousand one (1,001) students, the grant match
402-must be fifty percent (50%) of the grant amount described in
403-subsection (b).
404-(3) For a school corporation, charter school, or accredited
405-nonpublic school with an ADM of more than one thousand
406-(1,000) students or a coalition of schools applying jointly, the
407-grant match must be one hundred percent (100%) of the grant
408-amount described in subsection (b).
409-(d) A school corporation, charter school, or accredited nonpublic
410-school may be eligible to receive a grant of up to:
411-(1) one hundred thousand dollars ($100,000) if:
412-(A) the school corporation, charter school, or accredited
413-nonpublic school receives a grant match of one hundred
414-percent (100%) of the requested grant amount; and
415-(B) the board approves the grant request; or
416-(2) for a school corporation, charter school, or accredited
417-nonpublic school described in subsection (c)(1) or (c)(2), a grant
418-of up to fifty thousand dollars ($50,000) if:
419-(A) the school corporation, charter school, or accredited
420-nonpublic school receives a grant match of fifty percent (50%)
421-of the requested grant amount; and
422-(B) the board approves the grant request.

424-(e) A school corporation, charter school, or accredited nonpublic
425-school may receive only one (1) matching grant under this section each
426-year.
427-(f) The board may not award a grant to a school corporation, charter
428-school, or accredited nonpublic school under this section unless the
429-school corporation, charter school, or accredited nonpublic school is in
430-a county that has a county school safety commission, as described in
431-IC 5-2-10.1-10. section 12 of this chapter.
432-SECTION 5. IC 10-21-1-4.5, AS ADDED BY P.L.50-2019,
433-SECTION 5, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
434-JULY 1, 2023]: Sec. 4.5. (a) The board may award a grant to provide
435-for the initial set up costs for an active event warning system to a
436-school corporation, charter school, or accredited nonpublic school that
437-jointly applies with the sheriff for the county in which the school
438-corporation, charter school, or accredited nonpublic school is located.
439-The specifications for an active event warning system must include the
440-following:
441-(1) A two (2) phone application based system that includes school
442-officials as a sender within the system and law enforcement
443-agencies as a receiver within the system.
444-(2) An adjusted geofence to alert law enforcement agencies that
445-are within a certain geographic location, including settings based
446-on rural and urban locations, with an urban setting having a
447-reduced geofence and a rural setting having a broader geofence.
448-(3) The ability for students and the public to submit anonymous
449-tips through a free reporting application.
450-(4) The ability for information within the system to be
451-interoperable with 911 dispatch.
452-(5) The ability to display the school's address and location on a
453-map.
454-(6) The ability to provide notifications during emergencies and
455-nonemergencies.
456-(7) The ability to call 911 automatically when the system is
457-triggered.
458-(8) The ability to operate several individual school response
459-plans.
460-(b) A school corporation, charter school, or accredited nonpublic
461-school may receive only one (1) grant under this section.
462-(c) A sheriff for a county may receive multiple grants under this
463-section.
464-(d) The board may not award a grant to a school corporation or
465-charter school under this section unless the school corporation or
466-HEA 1492 — Concur 12
467-charter school is in a county that has a county school safety
468-commission, as described in IC 5-2-10.1-10. section 12 of this
469-chapter.
470-SECTION 6. IC 10-21-1-5, AS AMENDED BY P.L.170-2022,
471-SECTION 12, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
472-JULY 1, 2023]: Sec. 5. (a) A school corporation, charter school, or
473-accredited nonpublic school may annually apply to the board for a
474-matching grant from the fund for a program described in section
475-2(a)(1) of this chapter.
476-(b) The application must include the following:
477-(1) A concise description of the school corporation's, charter
478-school's, or accredited nonpublic school's security needs.
479-(2) The estimated cost of the program to the school corporation,
480-charter school, or accredited nonpublic school.
481-(3) The extent to which the school corporation, charter school, or
482-accredited nonpublic school has access to and support from a
483-nearby law enforcement agency and other first responder
484-services, if applicable.
485-(4) The ADM of the school corporation or charter school or the
486-equivalent for an accredited nonpublic school (or the combined
487-ADM of the coalition of schools applying jointly) that is the
488-subject of the grant application.
489-(5) Any other information required by the board.
490-(6) This subdivision applies to an application from a school
491-corporation or charter school (or coalition of public schools
492-applying jointly). A statement whether the school corporation or
493-charter school has completed a local school safety plan and has
494-filed the school safety plan with the county school safety
495-commission for the county in which the school corporation or
496-charter school is located. In the case of a charter school, each
497-charter school shall include a statement whether the charter
498-school has developed and filed with the county school safety
499-commission for the county in which the charter school is
500-located:
501-(A) a local school safety and emergency plan under
502-IC 20-34-3-23(a); or
503-(B) not later than July 1, 2024, a school safety plan.
504-For a charter school in operation on July 1, 2023, the
505-information described in clauses (A) or (B) shall comply with
506-this subdivision on or before July 1, 2024.
507-(7) This subdivision applies to an application from a school
508-corporation or charter school (or coalition of public schools
509-HEA 1492 — Concur 13
510-applying jointly). A statement whether the school corporation or
511-charter school (or coalition of public schools applying jointly)
512-requests an advance under IC 20-49-10 in addition to a matching
513-grant under this chapter.
514-(8) If the application requests funding for school employee
515-training, the extent to which the school corporation, charter
516-school, or accredited nonpublic school has used or attempted
517-to use training offered at no cost, or a reduced cost, by law
518-enforcement, the department of homeland security, the
519-department of education, or the federal government,
520-including an explanation as to why grant funding is necessary
521-to fund any training expenses except for per diem, travel, and
522-lodging costs associated with training.
523-(9) If the application requests funding to employ a school
524-resource officer, a statement whether the school resource
525-officer information required under IC 20-26-18.2-5 has been,
526-if applicable, submitted to the department of homeland
527-security.
528-(10) This subdivision applies to an application from a school
529-corporation, charter school, or an accredited nonpublic school
530-(or coalition of public and accredited nonpublic schools
531-applying jointly). A statement of whether the school
532-corporation, charter school, or accredited nonpublic school
533-has:
534-(A) provided a copy of the floor plans for each building
535-located on the school's property to the law enforcement
536-agency and the fire department that have jurisdiction over
537-each school building that clearly indicates each entrance
538-and exit, the interior rooms and hallways, and the location
539-of any hazardous materials located in the building; or
540-(B) conducted critical incidence digital mapping as defined
541-in section 1 of this chapter for each school building,
542-including whether it has provided the critical incidence
543-digital mapping information to:
544-(i) the law enforcement agency and fire department that
545-have jurisdiction over the mapped school buildings; and
546-(ii) the statewide 911 system described in IC 36-8-16.7-22
547-through the public safety answer point, or "PSAP", (as
548-described in IC 36-8-16.7-20) that has jurisdiction over
549-the mapped school buildings.
550-(c) This subsection applies to an application from a school
551-corporation, charter school, or accredited nonpublic school (or
552-HEA 1492 — Concur 14
553-coalition of public and accredited nonpublic schools applying
554-jointly). Each school corporation, charter school, or accredited
555-nonpublic school shall certify to the department of homeland security
556-that the school corporation, charter school, or accredited nonpublic
557-school has: conducted a threat assessment for each school building
558-used by the school corporation, charter school, or accredited nonpublic
559-school before applying for a grant under this chapter.
560-(1) conducted a site vulnerability assessment for each school
561-building used by the school corporation, charter school, or
562-accredited nonpublic school; and
563-(2) a memorandum of understanding in place with a
564-community mental health center established under IC 12-29-2
565-or provider certified or licensed by the state to provide mental
566-or behavioral health services to students before applying for
567-a grant under this chapter. A provider described in this
568-subdivision may be employed by the school corporation,
569-charter school, or accredited nonpublic school.
570-(d) This subsection applies to an application from a school
571-corporation or charter school (or coalition of public schools
572-applying jointly). Each school corporation shall certify to the
573-department of homeland security that the school safety plan of the
574-school corporation was reviewed by the governing body as
575-described in section 11 of this chapter. In the case of a charter
576-school, beginning July 1, 2024, each charter school shall certify to
577-the department of homeland security that the school safety plan of
578-the charter school was reviewed by the organizer as described in
579-section 11 of this chapter.
580-(d) Each school corporation, charter school, or accredited nonpublic
581-school shall certify to the department of homeland security that the
582-school corporation, charter school, or accredited nonpublic school has
583-a memorandum of understanding in place with a community mental
584-health center established under IC 12-29-2 or provider certified or
585-licensed by the state to provide mental or behavioral health services to
586-students before applying for a grant under this chapter. A provider
587-described in this subsection may be employed by the school
588-corporation, charter school, or accredited nonpublic school.
589-SECTION 7. IC 10-21-1-5.5, AS ADDED BY P.L.50-2019,
590-SECTION 7, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
591-JULY 1, 2023]: Sec. 5.5. (a) A school corporation, charter school, or

1829+(2) In addition to the requirements described in subdivision
1830+(1), if the local law enforcement agency applies for a matching
1831+grant with a school corporation, charter school, or an
1832+accredited nonpublic school, the school corporation, charter
1833+school, or accredited nonpublic school must:
1834+(A) provide a statement as described in subsection (b)(9),
1835+if applicable;
1836+(B) provide a statement as described in subsection (b)(10);
1837+and
1838+(C) provide a certification to the department of homeland
1839+security as described in subsection (c).".

632-SECTION 10. IC 10-21-1-9 IS ADDED TO THE INDIANA CODE
633-AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
634-1, 2023]: Sec. 9. (a) Each school corporation shall designate at least
635-one (1) individual who is not a school resource officer as described
636-in IC 20-26-18.2-2 to serve as the school safety specialist for the
637-school corporation.

639-(b) Each charter school shall designate at least one (1) individual
640-who is not a school resource officer as described in IC 20-26-18.2-2
641-to serve as the school safety specialist for the charter school. A
642-charter school in operation on July 1, 2023, shall comply with this
643-subsection on or before July 1, 2024.
644-(c) All school safety specialists shall be chosen by the
645-superintendent of the school corporation or leadership of the
646-charter school with the approval of the governing body or
647-organizer.
648-(d) A school safety specialist shall perform the following duties:
649-(1) Serve on the county school safety commission with
650-jurisdiction over the school corporation if that individual
651-school safety specialist is chosen by the superintendent of the
652-school corporation with the approval of the governing body.
653-Except as provided in section 12 of this chapter, the school
654-safety specialists of charter schools do not serve on a county
655-school safety commission.
656-(2) Participate each year in a number of days of school safety
657-training that the department of education determines
658-necessary under section 13 of this chapter.
659-(3) With the assistance of the county school safety commission
660-with jurisdiction over the school corporation or charter
661-school, develop, implement, and improve a school safety plan
662-for each school building in the school corporation or charter
663-school.
664-(4) Coordinate the school safety plans of each school building
665-in the school corporation or charter school as required under
666-this chapter and under rules adopted by the Indiana state
667-board of education.
668-(5) Act as a resource for the school corporation's or charter
669-school's safe school committees and other individuals in the
670-school corporation or charter school on issues related to
671-school discipline, safety, and security.
672-(6) Serve as a liaison for the school corporation or charter
673-school regarding school safety matters with the board, the
674-department of homeland security, the department of
675-education, the Indiana criminal justice institute, and other
676-state agencies, as applicable.
677-SECTION 11. IC 10-21-1-10 IS ADDED TO THE INDIANA
678-CODE AS A NEW SECTION TO READ AS FOLLOWS
679-[EFFECTIVE JULY 1, 2023]: Sec. 10. (a) A school corporation shall
680-develop a school safety plan in accordance with subsection (c) for
681-HEA 1492 — Concur 17
682-review as described in section 11 of this chapter.
683-(b) Each charter school shall develop a school safety plan in
684-accordance with subsection (c) for review as described in section
685-11 of this chapter. A charter school in operation on July 1, 2023,
686-shall comply with this subsection on or before July 1, 2024.
687-(c) The school safety plan:
688-(1) must be developed by a school safety specialist and the
689-school's safe school committee, including a school resource
690-officer if one (1) is employed by the school corporation or
691-charter school, in consultation with the:
692-(A) law enforcement agency; and
693-(B) fire department;
694-that have jurisdiction over the particular school building;
695-(2) must:
696-(A) protect against outside and internal threats to the
697-physical safety of students, faculty, staff, and the public,
698-including unsafe conditions, crime prevention, school
699-violence, bullying and cyberbullying, criminal organization
700-activity, child abuse and child sexual abuse, mental health
701-and behavioral health, suicide awareness and prevention,
702-and other issues that prevent the maintenance of a safe
703-school;
704-(B) prevent unauthorized access to school property and
705-interior areas or rooms, including the management of
706-authorized visitors on school property, before, during, and
707-after regular school hours;
708-(C) secure schools against natural and manmade disasters,
709-including all emergency preparedness drill requirements
710-set forth in IC 20-34-3-20;
711-(D) include a site vulnerability assessment for each school
712-building;
713-(E) not later than July 1, 2025, include the establishment of
714-a multi-disciplinary threat assessment team;
715-(F) include measures to expedite notification of first
716-responders and access to school property for first
717-responders; and
718-(G) include any additional requirements required by the
719-Indiana state board of education;
720-(3) must be provided to a member of the board if a member
721-requests the school safety plan;
722-(4) must be available for inspection by the department of
723-education's division of school building physical security and
724-HEA 1492 — Concur 18
725-safety (as established by IC 20-19-3-14);
726-(5) must be provided to the law enforcement agency and the
727-fire department that have jurisdiction over the school
728-corporation or charter school;
729-(6) must include an attestation that:
730-(A) a copy of the floor plans for each building located on
731-the school's property were provided to the law
732-enforcement agency and the fire department that have
733-jurisdiction over the school corporation or charter school
734-that clearly indicates each entrance and exit, the interior
735-rooms and hallways, and the location of any hazardous
736-materials located in the building; or
737-(B) the school corporation or charter school has conducted
738-critical incidence digital mapping for each school building
739-within the school corporation or the buildings that are
740-operated by a charter school, including providing the
741-critical incidence digital mapping information to:
742-(i) the law enforcement agency and fire department that
743-have jurisdiction over the mapped school buildings; and
744-(ii) the statewide 911 system described in IC 36-8-16.7-22
745-through the public safety answer point, or "PSAP",
746-described in IC 36-8-16.7-20 that has jurisdiction over
747-the mapped school buildings; and
748-(7) must be filed with the county school safety commission
749-under section 12 of this chapter having jurisdiction over the
750-school corporation or charter school.
751-(d) For purposes of IC 5-14-3, the entities specified in subsection
752-(c) that receive information under this section shall keep the
753-information compiled and retained under this section confidential
754-and shall withhold the information from public disclosure.
755-SECTION 12. IC 10-21-1-11 IS ADDED TO THE INDIANA
756-CODE AS A NEW SECTION TO READ AS FOLLOWS
757-[EFFECTIVE JULY 1, 2023]: Sec. 11. (a) Before the school safety
758-plan developed under section 10 of this chapter is provided to or
759-filed with the entities specified under this chapter, the
760-superintendent (or the equivalent for a charter school) or a school
761-safety specialist of the school corporation or charter school shall
762-present the proposed school safety plan to the governing body or,
763-if applicable, the charter school organizer, in executive session.
764-(b) The governing body or organizer may meet in executive
765-session to receive school safety updates from the superintendent, a
766-school safety specialist, a school resource officer, or a member of
767-HEA 1492 — Concur 19
768-a safe school committee under section 14 of this chapter.
769-(c) Notwithstanding the requirement to submit the school safety
770-plan to certain entities under state law, the school corporation or
771-charter school shall keep the school safety plan confidential and
772-withhold it from public disclosure.
773-SECTION 13. IC 10-21-1-12 IS ADDED TO THE INDIANA
774-CODE AS A NEW SECTION TO READ AS FOLLOWS
775-[EFFECTIVE JULY 1, 2023]: Sec. 12. (a) Not later than December
776-31, 2023, a county shall establish a county school safety
777-commission. Unless otherwise specified in subsection (b)(1) through
778-(b)(11), the members described in subsection (b) are appointed by
779-the school corporation having the largest ADM (as defined in
780-IC 20-18-2-2), as determined in the fall count of ADM in the school
781-year ending in the current calendar year.
782-(b) The members of the commission are as follows:
783-(1) A school safety specialist for each school corporation
784-located in whole or in part in the county.
785-(2) The judge of the court having juvenile jurisdiction in the
786-county or the judge's designee.
787-(3) The sheriff of the county or the sheriff's designee.
788-(4) The chief officer of every other law enforcement agency in
789-the county, or the chief officer's designee.
790-(5) A representative of the juvenile probation system,
791-appointed by the judge described in subdivision (2).
792-(6) Representatives of community agencies that work with
793-children within the county.
794-(7) A representative of the Indiana state police district that
795-serves the county, appointed by the Indiana state police.
796-(8) A representative of the prosecuting attorneys council of
797-Indiana who specializes in the prosecution of juveniles.
798-(9) A school safety specialist of a charter school representing
799-the interests and viewpoints of charter schools within the
800-commission's jurisdiction if at least one (1) charter school
801-within the commission's jurisdiction requests to participate.
802-(10) A school safety specialist of an accredited nonpublic
803-school representing the interests and viewpoints of accredited
804-nonpublic schools within the commission's jurisdiction if at
805-least one (1) accredited nonpublic school requests to
806-participate.
807-(11) Other appropriate individuals selected by the
808-commission.
809-(c) Once a commission is established, the school safety specialist
810-HEA 1492 — Concur 20
811-of the school corporation having the largest ADM (as defined in
812-IC 20-18-2-2), as determined in the fall count of ADM in the school
813-year ending in the current calendar year, in the county shall
814-convene the initial meeting of the commission.
815-(d) The members shall annually elect a chairperson.
816-(e) A commission shall perform the following duties:
817-(1) Periodically perform a cumulative analysis of school safety
818-needs within the county.
819-(2) Coordinate and make recommendations for the following:
820-(A) Prevention of juvenile offenses and improving the
821-reporting of juvenile offenses within the schools.
822-(B) Proposals for identifying and assessing children who
823-are at high risk of experiencing a mental health or
824-behavioral health crisis or becoming juvenile offenders.
825-(C) Methods to meet the educational needs of children who
826-have been detained as juvenile offenders.
827-(D) Methods to improve communications among agencies
828-that work with children.
829-(E) Methods to improve school security and emergency
830-preparedness.
831-(F) Additional equipment or personnel that are necessary
832-to carry out school safety plans.
833-(G) Pooling resources, combining purchases, using shared
834-administrative services, or collaborating among
835-participating school corporations, school corporation
836-career and technical education schools described in
837-IC 20-37-1-1, and charter schools to improve the
838-maintenance of safe schools.
839-(H) Implementing best practices and procedures to use
840-critical incidence digital mapping in the event of an
841-emergency within the county.
842-(I) Any other topic the commission considers necessary to
843-improve school safety within the commission's jurisdiction.
844-(3) Provide assistance to school safety specialists and school
845-resource officers within the commission's jurisdiction in
846-developing and:
847-(A) implementing school safety plans; and
848-(B) requesting grants from the fund.
849-(4) Assist accredited nonpublic schools within the
850-commission's jurisdiction that voluntarily submit a school
851-safety plan or a local school safety and emergency plan
852-(described in IC 20-34-3-23) to the commission seeking
853-HEA 1492 — Concur 21
854-assistance in carrying out the school safety plan.
855-(f) The affirmative votes of a majority of the voting members of
856-the commission are required for the commission to take action on
857-a measure.
858-(g) A commission shall receive the school safety plans for the
859-school corporations and charter schools located in the county.
860-(h) A commission may receive from an accredited nonpublic
861-school within the commission's jurisdiction a school safety plan or
862-a local school safety and emergency plan described in
863-IC 20-34-3-23.
864-(i) The commission shall keep the school safety plans compiled
865-and retained under this section confidential and shall withhold the
866-information from public disclosure.
867-(j) The commission may share the school safety plans under
868-subsections (g) and (h) with law enforcement and first responder
869-agencies that have jurisdiction over the school corporation, charter
870-school, or accredited nonpublic school. For the purposes of
871-IC 5-14-3, the entities receiving a school safety plan under this
872-subsection shall keep information compiled and retained under
873-subsections (g) and (h) confidential and shall withhold the
874-information from public disclosure.
875-(k) A commission shall annually submit to the board on a date
876-established by the board:
877-(1) meeting minutes;
878-(2) any meeting agenda materials directly related to taking
879-action on a measure under this section; and
880-(3) a brief annual summary of its activities and
881-accomplishments.
882-SECTION 14. IC 10-21-1-13 IS ADDED TO THE INDIANA
883-CODE AS A NEW SECTION TO READ AS FOLLOWS
884-[EFFECTIVE JULY 1, 2023]: Sec. 13. (a) The school safety specialist
885-training and certification program is established.
886-(b) The school safety specialist training and certification
887-program shall provide:
888-(1) annual training sessions, which may be conducted through
889-distance learning or at regional centers; and
890-(2) information concerning best practices and available
891-resources;
892-for school safety specialists and county school safety commissions.
893-(c) The department of education, in consultation with the board,
894-shall do the following:
895-(1) Assemble an advisory group of school safety specialists
896-HEA 1492 — Concur 22
897-from around the state to make recommendations concerning
898-the curriculum and standards for school safety specialist
899-training.
900-(2) Develop an appropriate curriculum and the standards for
901-the school safety specialist training and certification program.
902-The department of education may consult with national school
903-safety experts in developing the curriculum and standards.
904-The curriculum developed under this subdivision must
905-include training in:
906-(A) identifying, preventing, and intervening in bullying and
907-cyberbullying;
908-(B) identifying, preventing, and intervening in criminal
909-organization activity;
910-(C) identifying, preventing, and intervening in actions by
911-a person who is present on school property with the intent
912-to harm another person;
913-(D) developing and implementing a school safety plan in
914-accordance with this chapter;
915-(E) using a county school safety commission to improve
916-school safety and emergency preparedness; and
917-(F) using safe school committees to improve safety and
918-emergency preparedness for each school building.
919-(3) Administer the school safety specialist training and
920-certification program, including the following duties:
921-(A) Establish a school safety specialist certificate for
922-candidates eligible under section 9 of this chapter who
923-have successfully completed the training program.
924-(B) Review the qualifications of each candidate, determine
925-their eligibility for certification, and present a certificate
926-to each school safety specialist eligible for certification.
927-SECTION 15. IC 10-21-1-14 IS ADDED TO THE INDIANA
928-CODE AS A NEW SECTION TO READ AS FOLLOWS
929-[EFFECTIVE JULY 1, 2023]: Sec. 14. (a) Each school operated by
930-a school corporation shall establish a safe school committee. The
931-committee may be a subcommittee of the committee that develops
932-the strategic and continuous school improvement and achievement
933-plan under IC 20-31-5. Each committee may include at least one (1)
934-member who is a member of the support staff of the school or
935-school corporation career and technical education school.
936-(b) Each school operated by a charter school shall establish a
937-safe school committee. A charter school in operation on July 1,
938-2023, shall comply with this subsection not later than July 1, 2024.

940-(c) The safe school committee shall actively participate in and
941-assist with the development of the school safety plan.
942-(d) The department of education, the school corporation's or
943-charter school's school safety specialist or specialists, and a school
944-resource officer, if one (1) is employed by the school corporation or
945-charter school, shall provide materials and guidelines to assist a
946-safe school committee in developing a policy for a particular school
947-that addresses the following issues:
948-(1) Implementation of the school safety plan.
949-(2) Addressing outside and internal threats to the physical
950-safety of students, faculty, staff, and the public, including
951-unsafe conditions, crime prevention, school violence, bullying
952-and cyberbullying, criminal organization activity, child abuse
953-and child sexual abuse, mental health and behavioral health,
954-suicide awareness and prevention, and other issues that
955-prevent the maintenance of a safe school.
956-(3) Addressing the professional development needs for faculty
957-and staff to implement methods that decrease problems
958-identified under subdivision (2).
959-(4) Identifying and implementing methods to encourage:
960-(A) involvement by the community, families, and students;
961-(B) development of relationships between students and
962-school faculty and staff; and
963-(C) use of problem solving teams.
964-(e) The guidelines developed under subsection (d) must include
965-age appropriate, research based information that assists school
966-corporations or charter schools and safe school committees in:
967-(1) developing and implementing bullying and cyberbullying
968-prevention programs;
969-(2) establishing investigation and reporting procedures
970-related to bullying and cyberbullying; and
971-(3) adopting discipline rules that comply with IC 20-33-8-13.5.
972-(f) In addition to developing guidelines under subsection (d), the
973-department of education shall establish categories of types of
974-bullying incidents to allow school corporations to use the categories
975-in making reports under IC 20-20-8-8 and IC 20-34-6-1.
976-(g) The materials and guidelines provided under subsection (d)
977-must include the model educational materials and model response
978-policies and reporting procedures on child abuse and child sexual
979-abuse developed or identified under IC 20-19-3-11.
980-SECTION 16. IC 10-21-1-15 IS ADDED TO THE INDIANA
981-CODE AS A NEW SECTION TO READ AS FOLLOWS

983-[EFFECTIVE JULY 1, 2023]: Sec. 15. An accredited nonpublic
984-school may do one (1) or more of the following:
985-(1) Designate one (1) or more individuals to obtain school
986-safety specialist certification under section 13 of this chapter
987-to perform school safety specialist duties under this chapter.
988-(2) Establish a school safety plan in accordance with section
989-10 of this chapter.
990-(3) Establish a safe school committee.
991-(4) Submit a school safety plan to the county school safety
992-commission having jurisdiction over the accredited nonpublic
993-school.
994-(5) Request to join the county school safety commission
995-having jurisdiction over the accredited nonpublic school or be
996-represented by another accredited nonpublic school's school
997-safety specialist on the same commission.
998-(6) Request general guidance relating to school safety matters
999-from one (1) or more of the following:
1000-(A) The board.
1001-(B) The department of education.
1002-(C) The department of homeland security.
1003-(D) The county school safety commission having
1004-jurisdiction over the accredited nonpublic school.
1005-SECTION 17. IC 20-19-3-11.5, AS ADDED BY P.L.211-2018(ss),
1006-SECTION 6, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1007-JULY 1, 2023]: Sec. 11.5. (a) As used in this section, "cyberbullying"
1008-refers to bullying (as defined in IC 20-33-8-0.2) that occurs through the
1009-use of data or computer software that is accessed through a:
1010-(1) computer;
1011-(2) computer system;
1012-(3) computer network; or
1013-(4) cellular telephone or other wireless or cellular
1014-communications device.
1015-(b) The department shall maintain a link on the department's
1016-Internet web site website that provides parents and school officials
1017-with resources or best practices regarding the prevention and reporting
1018-of bullying and cyberbullying. The resources must include guidance on
1019-how to report to law enforcement agencies instances of bullying and
1020-cyberbullying that occur off campus. The department shall also include
1021-guidelines developed by the department under IC 5-2-10.1-12(d).

1023-(c) The department shall consult with law enforcement agencies,
1024-school officials, and organizations that have expertise in the prevention

1026-or reporting of bullying or cyberbullying for purposes of developing or
1027-providing the resources or best practices described in subsection (b).
1028-(d) The following entities shall maintain a link on their Internet web
1029-sites websites to the Internet web site website described in subsection
1030-(b):
1031-(1) The state board.
1032-(2) A school corporation.
1033-SECTION 18. IC 20-19-3-14, AS ADDED BY P.L.36-2014,
1034-SECTION 1, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1035-JULY 1, 2023]: Sec. 14. (a) As used in this section, "division" refers to
1036-the division of school building physical security and safety established
1037-by subsection (c).
1038-(b) As used in this section, "physical security" refers to security
1039-measures that are designed to deny unauthorized access to a building
1040-or facility, including equipment and resources, and to protect
1041-individuals and property from damage or harm.
1042-(c) The division of school building physical security and safety is
1043-established within the department.
1044-(d) The division shall:
1045-(1) establish and maintain guidelines for using professional
1046-architectural and engineering services to integrate physical
1047-security improvements and safety practices in the construction,
1048-renovation, repair, or alteration of a school facility;
1049-(2) carry out the department's responsibilities with regards to the
1050-school safety specialist training and certification program
1051-established in IC 5-2-10.1-11; IC 10-21-1-13;
1052-(3) establish and maintain guidelines for establishing emergency
1053-response protocols in cooperation with other state agencies;
1054-(4) carry out the department's responsibilities to safe school
1055-committees under IC 5-2-10.1-12; IC 10-21-1-14;
1056-(5) coordinate the department's response and recovery assistance
1057-to a school in the event of a manmade or natural disaster;
1058-(6) provide information and guidance to assist school corporations
1059-or schools to establish mutual aid disaster assistance agreements
1060-with other schools or school corporations; and
1061-(7) study and collect information to integrate lessons learned from
1062-previous school disasters throughout the country into the
1063-curriculum of the school safety specialist training and certification
1064-program established in IC 5-2-10.1-11 IC 10-21-1-13 and
1065-guidelines established by the division under this subsection;
1066-(8) establish and maintain guidelines, in consultation with the
1067-department of homeland security and institute for criminal
1068-HEA 1492 — Concur 26
1069-justice, for developing and maintaining school safety plans as
1070-described in IC 10-21-1-10 and IC 10-21-1-11; and
1071-(9) assist the secured school safety board established by
1072-IC 10-21-1-3 in conducting the review and submitting the
1073-report as described in IC 10-21-1-8.
1074-(e) The division may: upon request by a school corporation:
1075-(1) request a meeting with a school corporation or charter
1076-school to review a school safety plan as described in
1077-IC 10-21-1-10;
1078-(2) request to provide an onsite safety review for a school
1079-corporation or charter school; and
1080-(3) request to provide guidance or assistance relating to school
1081-safety matters to the a school corporation or charter school;
1082-(4) provide assistance or guidance relating to school safety
1083-matters upon request by a nonpublic school that has
1084-voluntarily become accredited under IC 20-31-4.1 or is
1085-accredited by a national or regional accrediting agency that
1086-is recognized by the state board; and
1087-(5) provide assistance or guidance relating to school safety
1088-matters upon request by a county school safety commission
1089-under IC 10-21-1-12.
1090-(f) The division shall maintain a secure Internet web site to provide
1091-school officials and public safety officials access to information that is
1092-considered classified under IC 5-14-3-4(b)(1), IC 5-14-3-4(b)(18), and
1093-IC 5-14-3-4(b)(19) or other sensitive information that may assist school
1094-officials and public safety officials in improving school safety or
1095-responding to a manmade or natural disaster.
1096-(g) The division shall maintain a public Internet web site website
1097-that contains:
1098-(1) the guidelines established by the division under subsection
1099-(d);
1100-(2) best practices pertaining to school safety; and
1101-(3) any other information the division determines may be
1102-necessary to carry out the division's duties or responsibilities
1103-under this section.
1104-SECTION 19. IC 20-26-5-42.7 IS ADDED TO THE INDIANA
1105-CODE AS A NEW SECTION TO READ AS FOLLOWS
1106-[EFFECTIVE JULY 1, 2023]: Sec. 42.7. (a) The governing body of
1107-a school corporation shall do the following:
1108-(1) Approve or disapprove all school safety specialists chosen
1109-by the superintendent of the school corporation under
1110-IC 10-21-1-9. The governing body of a school corporation

1112-shall also approve or disapprove the individual school safety
1113-specialist chosen by the superintendent of the school
1114-corporation to serve on the county school safety commission
1115-under IC 10-21-1-12.
1116-(2) Review a school safety plan described in IC 10-21-1-10
1117-following the procedures outlined in IC 10-21-1-11.
1118-(b) Not later than July 1, 2024, the organizer of a charter school
1119-shall do the following:
1120-(1) Approve or disapprove all school safety specialists chosen
1121-by leadership of the charter school under IC 10-21-1-9.
1122-(2) Review a school safety plan described in IC 10-21-1-10
1123-following the procedures outlined in IC 10-21-1-11.
1124-SECTION 20. IC 20-26-18.2-0.5 IS ADDED TO THE INDIANA
1125-CODE AS A NEW SECTION TO READ AS FOLLOWS
1126-[EFFECTIVE JULY 1, 2023]: Sec. 0.5. The following definitions
1127-apply throughout this chapter:
1128-(1) "Safe school committee" refers to the requirements set
1129-forth in IC 10-21-1-14.
1130-(2) "School safety plan" refers to the requirements set forth
1131-in IC 10-21-1-10.
1132-(3) "School safety specialist" refers to the requirements set
1133-forth in IC 10-21-1-9.
1134-SECTION 21. IC 20-26-18.2-1, AS AMENDED BY P.L.139-2022,
1135-SECTION 10, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1136-JULY 1, 2023]: Sec. 1. (a) As used in this chapter, "school resource
1137-officer" means a law enforcement officer who:
1138-(1) has completed the training described in subsection (b);
1139-(2) is assigned to one (1) or more school corporations or charter
1140-schools during school hours to:
1141-(A) assist the school safety specialist specialists and the safe
1142-school committees with the development and implementation
1143-of the school safety plan; as provided in section 2 of this
1144-chapter; and
1145-(B) carry out any additional responsibilities assigned to the
1146-school resource officer under the employment engagement,
1147-contract, or memorandum of understanding and to provide law
1148-enforcement services to:
1149-(i) protect against outside threats to the physical safety of
1150-students;
1151-(ii) prevent unauthorized access to school property; and
1152-(iii) secure schools against violence and natural disasters;
1153-and

1155-(3) is:
1156-(A) employed by a law enforcement agency;
1157-(B) appointed as a police reserve officer (as described in
1158-IC 36-8-3-20) or as a special deputy (as described in
1159-IC 36-8-10-10.6) if the police reserve officer or special deputy:
1160-(i) is subject to the direction of the sheriff or appointing law
1161-enforcement agency;
1162-(ii) is required to obey the rules and orders of the sheriff's
1163-department or appointing law enforcement agency;
1164-(iii) is required to complete all training required of regular
1165-full-time law enforcement officers employed by the sheriff's
1166-department or appointing law enforcement agency; and
1167-(iv) may be removed by the sheriff or appointing law
1168-enforcement agency at any time, with or without cause; or
1169-(C) a school corporation police officer appointed under
1170-IC 20-26-16-3.
1171-The term does not include a law enforcement officer who is assigned
1172-to a school to provide security outside a school building for protection
1173-from outside threats, traffic duty, or other duties not consistent with the
1174-duties of a school resource officer.
1175-(b) Before being appointed as a school resource officer, an
1176-individual must have successfully completed the minimum training
1177-requirements established for law enforcement officers under
1178-IC 5-2-1-9.
1179-(c) The law enforcement officer appointed as a school resource
1180-officer must receive at least forty (40) hours of school resource officer
1181-training through:
1182-(1) the Indiana law enforcement training board established by
1183-IC 5-2-1-3;
1184-(2) the National Association of School Resource Officers; or
1185-(3) another school resource officer training program approved by
1186-the Indiana law enforcement training board;
1187-within one hundred eighty (180) days from the date the individual is
1188-initially assigned the duties of a school resource officer. However, if
1189-the current ADM of a school corporation is less than one thousand
1190-(1,000) students, the individual shall complete the school resource
1191-officer training within three hundred sixty-five (365) days of the date
1192-the individual is initially assigned the duties of a school resource
1193-officer.
1194-(d) Training described in subsection (c) must include instruction
1195-regarding skills, tactics, and strategies necessary to address the special
1196-nature of:

1198-(1) school campuses; and
1199-(2) school building security needs and characteristics.
1200-SECTION 22. IC 20-26-18.2-2, AS AMENDED BY P.L.139-2022,
1201-SECTION 11, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1202-JULY 1, 2023]: Sec. 2. (a) A school resource officer may be employed:
1203-(1) by one (1) or more school corporations or charter schools
1204-through a contract between a local law enforcement agency and
1205-the school corporation or school corporations or the charter school
1206-or charter schools;
1207-(2) by one (1) or more school corporations or charter schools;
1208-(3) by a local law enforcement agency that assigns the school
1209-resource officer to one (1) or more school corporations or charter
1210-schools through a memorandum of understanding between the
1211-local law enforcement agency and the school corporation or
1212-school corporations or the charter school or charter schools; or
1213-(4) through a contract between an Indiana business that employs
1214-persons who meet the qualifications of a school resource officer
1215-and the school corporation or school corporations or the charter
1216-school or charter schools.
1217-(b) This subsection does not apply to a school corporation that only
1218-has full-time school resource officers who are either employees of the
1219-school corporation's school police department or are employees of the
1220-school corporation who have successfully completed the law
1221-enforcement basic training requirements described in IC 5-2-1-9(d).
1222-After June 30, 2023, if a school corporation or charter school enters
1223-into a contract for a school resource officer, the school corporation or
1224-charter school must enter into a memorandum of understanding with
1225-the law enforcement agency that employs or appointed the law
1226-enforcement officer who will perform the duties of a school resource
1227-officer. The memorandum of understanding must state the nature and
1228-scope of a school resource officer's duties and responsibilities. A school
1229-resource officer's duties and responsibilities include the duty to assist
1230-the school corporation's or charter school's school safety specialist
1231-specialists and safe school committees with the development and
1232-implementation of a school safety plans. plan that does the following:
1233-(1) Protects against outside threats to the physical safety of
1234-students.
1235-(2) Prevents unauthorized access to school property.
1236-(3) Secures schools against violence and natural disasters.
1237-(4) On or before July 1, 2020, identifies the location of bleeding
1238-control kits (as defined in IC 20-34-3-24(a)).
1239-(c) A school resource officer shall consult with local law

1241-enforcement officials and first responders when assisting the school
1242-corporation's or charter school's school safety specialist specialists
1243-and safe school committees in the development of the school safety
1244-plan.
1245-(d) A school resource officer shall participate in the development
1246-and implementation of programs designed to identify, assess, and
1247-provide assistance to troubled youth. youth who are at high risk of
1248-experiencing a mental health crisis or becoming juvenile offenders.
1249-(e) A school resource officer may not be reassigned to other duties
1250-by the school corporation.
1251-SECTION 23. IC 20-26-18.2-5, AS ADDED BY P.L.57-2020,
1252-SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1253-JULY 1, 2023]: Sec. 5. (a) Beginning on September 1, 2023, and
1254-each September 1 thereafter, each A school corporation or charter
1255-school served by a school resource officer employed for the protection
1256-of the school corporation or charter school under section 2 of this
1257-chapter shall annually report on a form prescribed by the
1258-department of homeland security:
1259-(1) the number of school resource officers serving the school
1260-corporation or charter school;
1261-(2) the amount budgeted and the sources of the funds to
1262-employ a school resource officer or school resource officers to
1263-serve the school corporation or charter school;
1264-(3) the number of school resource officers serving the school
1265-corporation or charter school employed by one (1) or more
1266-school corporations or charter schools;
1267-(4) an attestation that the school resource officers employed
1268-by the school corporation or charter school have met the
1269-training requirements under section 1 of this chapter;
1270-(5) the number of school resource officers serving the school
1271-corporation or charter school through a contract or
1272-memorandum of understanding with a local law enforcement
1273-agency or an Indiana business that employs persons who meet
1274-the qualifications of a school resource officer under section 2
1275-of this chapter; and
1276-(6) if applicable, the number of law enforcement officers who
1277-are not school resource officers also serving the school
1278-corporation or charter school through a contract or
1279-memorandum of understanding with a local law enforcement
1280-agency;
1281- to the department of homeland security. before September 1.
1282-(b) The department of homeland security shall:

1284-(1) annually compile the information reported under subsection
1285-(a); and
1286-(2) retain the information reported under subsection (a).
1287-(c) For purposes of IC 5-14-3, the department of homeland security
1288-shall keep information compiled and retained under subsection (b)
1289-confidential and shall withhold the information from public disclosure.
1290-(d) The secured school safety board established by IC 10-21-1-3
1291-shall include the following aggregate level information in the
1292-review and report submitted to the governor and legislative council
1293-as required under IC 10-21-1-8:
1294-(1) The total number of school resource officers employed:
1295-(A) in Indiana, including the number of unique school
1296-corporations and charter schools employing a school
1297-resource officer;
1298-(B) exclusively by a school corporation;
1299-(C) by one (1) or more school corporations;
1300-(D) exclusively by a charter school;
1301-(E) by a coalition of charter schools; and
1302-(F) by a combination of one (1) or more school
1303-corporations and one (1) or more charter schools.
1304-(2) A statewide overview of how school corporations and
1305-charter schools are budgeting for the employment of school
1306-resource officers and the employment of law enforcement
1307-officers.
1308-SECTION 24. IC 20-30-5-5.5, AS ADDED BY P.L.285-2013,
1309-SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1310-JULY 1, 2023]: Sec. 5.5. (a) Not later than October 15 of each year,
1311-each public school shall provide age appropriate, research based
1312-instruction as provided under IC 5-2-10.1-12(d)(1) IC 10-21-1-14(d)
1313-focusing on bullying prevention for all students in grades 1 through 12.
1314-(b) The department, in consultation with school safety specialists
1315-and school counselors, shall prepare outlines or materials for the
1316-instruction described in subsection (a) and incorporate the instruction
1317-in grades 1 through 12.
1318-(c) Instruction on bullying prevention may be delivered by a school
1319-safety specialist, school counselor, or any other person with training
1320-and expertise in the area of bullying prevention and intervention.
1321-SECTION 25. IC 20-34-3-20, AS AMENDED BY P.L.92-2020,
1322-SECTION 82, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1323-JULY 1, 2023]: Sec. 20. (a) The governing body of a school
1324-corporation and an organizer of a charter school shall require each
1325-school in the governing body's jurisdiction or organizer's

1327-responsibility to conduct periodic emergency preparedness drills
1328-during the school year in compliance with rules adopted under
1329-IC 4-22-2 by the state board.
1330-(b) Each school and attendance center shall conduct at least:
1331-(1) one (1) tornado preparedness drill; and
1332-(2) one (1) manmade occurrence disaster drill;
1333-during each semester.
1334-(c) At least one (1) manmade occurrence disaster drill required
1335-under subsection (b) must be an active shooter drill and must be
1336-conducted within ninety (90) calendar days after the beginning of the
1337-school year.
1338-(d) Each:
1339-(1) state accredited nonpublic school; and
1340-(2) charter school;
1341-must conduct at least one (1) active shooter drill during each school
1342-year.
1343-(e) Notwithstanding rules established by the state fire marshal under
1344-IC 12-17-12-19, a drill conducted under subsection (b) may be
1345-conducted instead of a periodic or monthly fire evacuation drill
1346-requirement established by the state fire marshal. However, a drill
1347-conducted under subsection (b) may not be made:
1348-(1) instead of more than two (2) periodic or monthly fire
1349-evacuation drills in a particular school semester; and
1350-(2) in two (2) consecutive months.
1351-(f) The governing body of a school corporation or an organizer of
1352-a charter school may direct schools to conduct emergency
1353-preparedness drills in addition to those required under subsection (b).
1354-(g) The governing body of a school corporation or organizer of a
1355-charter school shall require each principal to file a certified statement
1356-that all drills have been conducted as required under this section.
1357-SECTION 26. IC 20-34-3-23, AS AMENDED BY P.L.92-2020,
1358-SECTION 83, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1359-JULY 1, 2023]: Sec. 23. (a) Each charter school and state accredited
1360-nonpublic school shall adopt a local school safety and emergency plan
1361-that includes:
1362-(1) safety and emergency training and educational opportunities
1363-for school employees; and
1364-(2) periodic safety and emergency preparedness and evacuation
1365-drills.
1366-(b) Each charter school and state accredited nonpublic school shall
1367-provide a copy of the floor plans for each building located on the
1368-school's property that clearly indicates each exit, the interior rooms and

1370-hallways, and the location of any hazardous materials located in the
1371-building to the law enforcement agency and the fire department that
1372-have jurisdiction over the school.
1373-(c) If a charter school or state accredited nonpublic school has
1374-conducted critical incidence digital mapping as described in
1375-IC 10-21-1-1 for each school building located on the school's
1376-property, it may provide the critical incidence digital mapping
1377-information to:
1378-(1) the law enforcement agency and fire department that have
1379-jurisdiction over the mapped school buildings; and
1380-(2) the statewide 911 system described in IC 36-8-16.7-22
1381-through the public safety answer point, or "PSAP", described
1382-in IC 36-8-16.7-20 that has jurisdiction over the mapped
1383-school buildings;
1384-to satisfy the requirement of subsection (b).
1385-(d) Once a charter school develops a school safety plan under
1386-IC 10-21-1-10, the charter school has satisfied the requirements of
1387-this section.
1388-SECTION 27. IC 20-34-9-1, AS AMENDED BY P.L.156-2020,
1389-SECTION 79, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1390-JULY 1, 2023]: Sec. 1. This chapter does not apply to a virtual charter
1391-school (as defined in IC 20-24-1-10) or a virtual state accredited
1392-nonpublic school.
1393-SECTION 28. IC 20-34-9-1.1 IS ADDED TO THE INDIANA
1394-CODE AS A NEW SECTION TO READ AS FOLLOWS
1395-[EFFECTIVE JULY 1, 2023]: Sec. 1.1. As used in ths chapter,
1396-"accredited nonpublic school" means a nonpublic school that:
1397-(1) has voluntarily become accredited under IC 20-31-4.1; or
1398-(2) is accredited by a national or regional accrediting agency
1399-that is recognized by the state board.
1400-SECTION 29. IC 20-34-9-4, AS AMENDED BY P.L.92-2020,
1401-SECTION 92, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1402-JULY 1, 2023]: Sec. 4. Beginning after June 30, 2020, and subject to
1403-available funding, a school corporation, a charter school, and a state an
1404-accredited nonpublic school are eligible for a grant under this chapter
1405-if the school corporation, charter school, or state accredited nonpublic
1406-school meets the requirements of this chapter.
1407-SECTION 30. IC 20-34-9-5, AS AMENDED BY P.L.92-2020,
1408-SECTION 93, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1409-JULY 1, 2023]: Sec. 5. (a) The student and parent support services
1410-grant program is established to provide grants to school corporations,
1411-charter schools, and state accredited nonpublic schools for the
1412-HEA 1492 — Concur 34
1413-development and implementation of student and parent support
1414-services plans to support parents caring for at-risk students.
1415-(b) The department, in coordination with the division of mental
1416-health and addiction, shall administer the program.
1417-SECTION 31. IC 20-34-9-6, AS AMENDED BY P.L.92-2020,
1418-SECTION 94, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1419-JULY 1, 2023]: Sec. 6. A school corporation, a charter school, or a
1420-state an accredited nonpublic school must do the following to
1421-participate in the program:
1422-(1) Apply to the department to participate in the program.
1423-(2) Submit to the department a student and parent support
1424-services plan that the school corporation, charter school, or state
1425-accredited nonpublic school intends to implement and that
1426-includes the following:
1427-(A) A process for a teacher or school employee to notify a
1428-school official to contact a student's parent if the student
1429-demonstrates a repeated pattern of aberrant or abnormal
1430-behavior. The parental notification process described in this
1431-clause must also include that the school will hold a conference
1432-with the student and the student's parent.
1433-(B) A requirement that the conference described in clause (A)
1434-must address the student's potential need for and benefit from:
1435-(i) school based treatment services; or
1436-(ii) treatment services provided by an outside professional
1437-care provider that is contracted and paid for by the school
1438-corporation, charter school, or state accredited nonpublic
1439-school.
1440-(C) A procedure for a parent who chooses to seek services for
1441-the student to follow that includes granting written parental
1442-consent for the student to receive services by a service
1443-provider described under clause (B).
1444-(D) A requirement to ensure that a school shall maintain the
1445-confidentiality of any medical records that result from a
1446-student's participation in any treatment described in clause (B).
1447-The school must adopt a policy that prohibits the school from:
1448-(i) sharing any reports or notes resulting from the provision
1449-of school based treatment services described in clause (B)(i)
1450-with other school officials; and
1451-(ii) maintaining any reports, notes, diagnosis, or
1452-appointments that result from a student's participation in any
1453-treatment described in clause (B)(i) through (B)(ii) in the
1454-student's permanent educational file.

1456-SECTION 32. IC 20-34-9-7, AS AMENDED BY P.L.92-2020,
1457-SECTION 95, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1458-JULY 1, 2023]: Sec. 7. (a) Before June 30, 2020, and before each June
1459-30 thereafter, the department shall evaluate and prepare a report
1460-concerning development and implementation of the following:
1461-(1) The program.
1462-(2) The plans submitted and implemented by school corporations,
1463-charter schools, and state accredited nonpublic schools.
1464-(b) The department shall submit the report described in subsection
1465-(a) to the legislative council in an electronic format under IC 5-14-6.
1466-SECTION 33. IC 20-40-2-10, AS ADDED BY P.L.161-2019,
1467-SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1468-JULY 1, 2023]: Sec. 10. (a) After the department completes the school
1469-corporation notice requirement under section 9 of this chapter, the
1470-department shall notify the state board, fiscal and qualitative indicators
1471-committee, and Indiana education employment relations board as soon
1472-as possible of all school corporations that received a notice stating they
1473-were on the excessive education fund transfer list for the immediately
1474-preceding calendar year.
1475-(b) Upon receipt of the department notice to a school corporation
1476-under section 9 of this chapter, the school corporation's superintendent
1477-and financial personnel, including the school's business officer, shall
1478-prepare and submit explanatory documentation within ninety (90) days,
1479-explaining the following:
1480-(1) How and why the school corporation's leadership believes the
1481-school corporation failed to meet the education fund transfer
1482-target percentage.
1483-(2) The steps the school corporation's leadership is planning or
1484-actively taking to budget and spend during the next calendar year
1485-to meet the education fund transfer target percentage for the next
1486-calendar year.
1487-(c) The school corporation's superintendent shall submit the
1488-explanatory documentation to the department and the fiscal and
1489-qualitative indicators committee.
1490-(d) Upon submission of the explanatory documentation under
1491-subsection (b), the school corporation's superintendent shall present the
1492-explanatory documentation to the school corporation's governing body
1493-at its next public meeting. The governing body shall enter both the
1494-actual documentation and corresponding discussion into its official
1495-minutes for that meeting.
1496-(e) Upon the completion of the duties under subsection (d), the
1497-school corporation shall publish the explanatory documentation
1498-HEA 1492 — Concur 36
1499-alongside any further notices and related reports from the department
1500-on its Internet web site website within thirty (30) days.
1501-(f) Upon receipt of a school corporation's explanatory
1502-documentation, the fiscal and qualitative indicators committee shall
1503-officially acknowledge receipt of the documentation at its next public
1504-meeting and enter the receipt into its official minutes for that meeting.
1505-(g) Upon receipt of the explanatory documentation, the department,
1506-in collaboration with the fiscal and qualitative indicators committee,
1507-shall review the documentation within sixty (60) days to make a
1508-preliminary determination of whether the documentation satisfactorily
1509-demonstrates that the school corporation's leadership has outlined and
1510-begun a corrective action plan to make progress in meeting the
1511-education fund transfer target percentage for the next calendar year.
1512-(h) If the department determines the explanatory documentation is
1513-not satisfactory, the department may contact the superintendent and
1514-financial personnel, including the school business officer, of the school
1515-corporation to schedule as soon as possible an appearance before the
1516-fiscal and qualitative indicators committee at a public meeting to
1517-provide an opportunity to explain the details within the explanatory
1518-documentation, and to explain to the fiscal and qualitative indicators
1519-committee the school corporation's budgeting and compensation levels
1520-in relation to the following for the school corporation:
1521-(1) How and why the education fund transfer target percentage
1522-was not met during the previous calendar year.
1523-(2) Total combined expenditures.
1524-(3) Student instructional expenditures.
1525-(4) Noninstructional expenditures.
1526-(5) Full-time teacher compensation expenditures.
1527-(6) Nonteaching, full-time administrative personnel compensation
1528-expenditures.
1529-(7) Nonteaching staff personnel compensation expenditures.
1530-(8) Any prior or planned attempts to seek the assistance available
1531-under this chapter from the Indiana education employment
1532-relations board and the department's division of finance.
1533-(9) Any prior or planned pooling of resources, combined
1534-purchases, usage of shared administrative services, or
1535-collaboration with contiguous school corporations in reducing
1536-noninstructional expenditures as described under IC 20-42.5-2-1.
1537-(10) Any prior or planned participation in a county school safety
1538-commission under IC 5-2-10.1-10 IC 10-21-1-12 to assist and
1539-reduce school safety expenditures.
1540-(11) Any prior or planned consideration of meeting the
1541-HEA 1492 — Concur 37
1542-requirements of and applying for school corporation efficiency
1543-incentive grants under IC 36-1.5-6.
1544-(i) The fiscal and qualitative indicators committee may contact the
1545-superintendent and financial personnel, including the school's business
1546-officer, of a school corporation that has been included on the
1547-department's excessive education fund transfer list for at least two (2)
1548-immediately preceding calendar years to provide the school corporation
1549-an opportunity to explain to the fiscal and qualitative indicators
1550-committee in a public meeting the school corporation's budgeting and
1551-compensation levels in relation to the items listed in subsection (h).
1552-(j) After the fiscal and qualitative indicators committee receives the
1553-school corporation's explanation under this section, the fiscal and
1554-qualitative indicators committee may issue an official recommendation
1555-to the school corporation to perform a review and improve its
1556-budgeting procedures in consultation with any state agencies the fiscal
1557-and qualitative indicators committee considers appropriate. The state
1558-agencies specified by the fiscal and qualitative indicators committee
1559-shall assist the school corporation before and during its next collective
1560-bargaining period with the goal of meeting or making progress toward
1561-the education fund transfer target percentage. If the fiscal and
1562-qualitative indicators committee issues an official recommendation to
1563-a school corporation, the school corporation's governing body shall
1564-officially acknowledge receipt of the recommendation at its next public
1565-meeting and enter into the school corporation governing body's minutes
1566-for that meeting acknowledgment of receipt of the recommendation. In
1567-addition, the school corporation shall publish the official
1568-recommendation on the school corporation's Internet web site. website.
1569-(k) The school corporation shall publish the most recent notices
1570-from the department, relevant individual reports prepared by the
1571-department, explanatory documentation by the school corporation, and
1572-official recommendations by the fiscal and qualitative indicators
1573-committee on the school corporation's Internet web site.
1574-(l) The school corporation may remove the notice, its explanatory
1575-documentation, and the fiscal and qualitative indicators committee's
1576-official recommendation from its Internet web site website if the
1577-department determines that the school corporation met its education
1578-fund transfer target percentage and is no longer on the excessive
1579-education fund transfer list.
1580-SECTION 34. IC 33-37-9-4, AS AMENDED BY P.L.55-2022,
1581-SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
1582-JULY 1, 2023]: Sec. 4. (a) The treasurer of state shall distribute
1583-semiannually one million two hundred eighty-eight thousand dollars
1584-HEA 1492 — Concur 38
1585-($1,288,000) of the amounts transferred to the state fund under section
1586-3 of this chapter as follows:
1587-(1) Fourteen and ninety-eight hundredths percent (14.98%) shall
1588-be deposited into the alcohol and drug countermeasures fund
1589-established by IC 9-27-2-11.
1590-(2) Eight and forty-two hundredths percent (8.42%) shall be
1591-deposited into the drug interdiction fund established by
1592-IC 10-11-7-1.
1593-(3) Four and sixty-eight hundredths percent (4.68%) shall be
1594-deposited into the substance abuse prosecution fund established
1595-by IC 33-39-8-6.
1596-(4) Five and sixty-two hundredths percent (5.62%) shall be
1597-deposited into the corrections drug abuse fund established by
1598-IC 11-8-2-11.
1599-(5) Twenty-two and forty-seven hundredths percent (22.47%)
1600-shall be deposited into the state drug free communities fund
1601-established by IC 5-2-10-2.
1602-(6) Seven and ninety-eight hundredths percent (7.98%) shall be
1603-distributed to the Indiana department of transportation for use
1604-under IC 8-23-2-15.
1605-(7) Twenty and thirty-two hundredths percent (20.32%) shall be
1606-deposited in the family violence and victim assistance fund
1607-established by IC 5-2-6.8-3.
