48+higher education and to make an appropriation.
1449 Be it enacted by the General Assembly of the State of Indiana:
15-SECTION 1. IC 21-13-1-4, AS AMENDED BY P.L.63-2021,
16-SECTION 4, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
17-JULY 1, 2023]: Sec. 4. "Eligible student", for purposes of section 8 of
18-this chapter, means a person who:
19-(1) is a member of the Indiana National Guard:
20-(A) in active drilling status; and
21-(B) who has not been absent without leave within the twelve
22-(12) months immediately preceding the date the person applies
23-for a tuition scholarship under this chapter;
24-(2) possesses the requisite academic qualifications; and
25-(3) meets the requirements of the state educational institution in
26-which the person is enrolled or will enroll; and
27-(4) (3) meets all other eligibility requirements as determined by
28-the commission.
29-SECTION 2. IC 21-13-1-7, AS ADDED BY P.L.2-2007, SECTION
30-254, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE JULY
31-1, 2023]: Sec. 7. "Scholarship", for purposes of IC 21-13-4, means
32-financial assistance provided to a student to offset the educational costs
33-incurred by the student in attending a state educational institution or an
34-approved postsecondary educational institution listed in
35-IC 21-7-13-6(a)(1)(C)(i) through IC 21-7-13-6(a)(1)(C)(xxx) as

38-SECTION 3. IC 21-13-1-8, AS AMENDED BY P.L.217-2015,

40-JULY 1, 2023]: Sec. 8. "Scholarship applicant", for purposes of
41-IC 21-13-4, means a person who:
42-(1) is an eligible student;
43-(2) has been accepted to attend a state educational institution or
44-an approved postsecondary educational institution listed in
45-IC 21-7-13-6(a)(1)(C)(i) through IC 21-7-13-6(a)(1)(C)(xxx) as
46-a full-time or part-time student;
47-(3) has been certified to have met all National Guard
48-requirements; and
49-(4) according to commission requirements, has timely filed an
50-application for and, if applicable, used any federal and state
51-financial assistance available to the person. to attend a state
52-educational institution.
53-SECTION 4. IC 21-13-4-1, AS AMENDED BY P.L.234-2007,

55-JULY 1, 2023]: Sec. 1. (a) The National Guard tuition supplement
56-program fund is established to provide the financial resources
57-necessary to award the tuition scholarships authorized under the
58-program.
59-(b) The commission shall administer the fund.
60-(c) The expenses of administering the fund shall be paid from
61-money in the fund.
62-(d) Money in the fund at the end of a state fiscal year does not revert
63-to the state general fund but remains available to be used for providing
64-money for national guard tuition supplement scholarships under this
65-chapter.
66-(e) Money in the fund may not be expended, removed, or
67-transferred from the fund by the state board of finance, the budget
68-agency, the commission, or any other state agency for any purpose
69-except for the purposes specified in this chapter.

107+40 JULY 1, 2023]: Sec. 2. Money in the National Guard tuition
108+41 supplement program fund shall be used to provide annual scholarships
109+42 to scholarship applicants in an amount that is equal to one (1) of the

111+1 following amounts: under this chapter. Annual scholarships shall be
112+2 awarded in the following amounts:
113+3 (1) A scholarship applicant who attends a state educational
114+4 institution shall receive a scholarship under this chapter in an
115+5 amount that is equal to one (1) of the following:
116+6 (A) If the scholarship applicant does not receive other
117+7 financial assistance specifically designated for educational
118+8 costs, the amount equal to a full undergraduate tuition
119+9 scholarship, regardless as to whether the student uses the
120+10 scholarship for undergraduate or graduate educational costs,
121+11 to attend the state educational institution.
122+12 (2) (B) If the scholarship applicant receives other financial
123+13 assistance specifically designated for educational costs, the
124+14 amount:
125+15 (A) (i) equal to the balance required to attend the state
126+16 educational institution; and
127+17 (B) (ii) not to exceed the amount described in subdivision
128+18 (1). clause (A).
129+19 (2) A scholarship applicant who attends an approved
130+20 postsecondary educational institution listed in
131+21 IC 21-7-13-6(a)(1)(C)(i) through IC 21-7-13-6(a)(1)(C)(xxx)
132+22 shall receive a scholarship under this chapter in an amount
133+23 equal to the lesser of the following:
134+24 (A) If the scholarship applicant receives other financial
135+25 assistance specifically designated for educational costs, the
136+26 amount equal to the balance required to attend the
137+27 approved postsecondary educational institution.
138+28 (B) Five thousand dollars ($5,000).
139+29 SECTION 6. IC 21-13-5-1, AS ADDED BY P.L.144-2007,
140+30 SECTION 21, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
141+31 JULY 1, 2023]: Sec. 1. (a) The National Guard scholarship extension
142+32 fund is established to provide the financial resources necessary to
143+33 award tuition scholarships to scholarship extension applicants.
144+34 (b) The commission shall administer the fund. The expenses of
145+35 administering the fund shall be paid from money in the fund.
146+36 (c) The fund consists of money transferred to the fund from the
147+37 National Guard scholarship program reserves.
148+38 (d) Money in the fund at the end of a state fiscal year does not revert
149+39 to the state general fund.
150+40 (e) Money in the fund may not be expended, removed, or
151+41 transferred from the fund by the state board of finance, the budget
152+42 agency, the commission, or any other state agency for any purpose

154+1 except for the purposes specified in this chapter.
155+2 SECTION 7. IC 21-14-1-2.5 IS ADDED TO THE INDIANA CODE
156+3 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
157+4 1, 2023]: Sec. 2.5. For purposes of IC 21-14-4, "approved
158+5 postsecondary educational institution" refers to an approved
159+6 postsecondary educational institution listed in
160+7 IC 21-7-13-6(a)(1)(C)(i) through IC 21-7-13-6(a)(1)(C)(xxx).
161+8 SECTION 8. IC 21-14-4-1, AS AMENDED BY P.L.112-2019,
162+9 SECTION 8, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
163+10 JULY 1, 2023]: Sec. 1. (a) This chapter applies to the following
164+11 persons:
165+12 (1) A person who:
166+13 (A) is a pupil at the Soldiers' and Sailors' Children's Home;
167+14 and
168+15 (B) was admitted to the Soldiers' and Sailors' Children's Home
169+16 because the person was related to a member of the armed
170+17 forces of the United States.
171+18 (2) A person whose mother or father:
172+19 (A) served in the armed forces of the United States;
173+20 (B) received the Purple Heart decoration or was wounded as
174+21 a result of enemy action;
175+22 (C) received a discharge or separation from the armed forces
176+23 other than a dishonorable discharge; and
177+24 (D) either designated Indiana as home of record at the time of
178+25 enlistment in the armed forces of the United States or resided
179+26 in Indiana at least five (5) years before the person first applies
180+27 for an exemption under this chapter.
181+28 (3) A person whose mother or father:
182+29 (A) served in the armed forces of the United States during a
183+30 war or performed duty equally hazardous that was recognized
184+31 by the award of a service or campaign medal of the United
185+32 States;
186+33 (B) suffered a service connected death or disability as
187+34 determined by the United States Department of Veterans
188+35 Affairs;
189+36 (C) received any discharge or separation from the armed
190+37 forces other than a dishonorable discharge; and
191+38 (D) either listed Indiana as home of record at the time of
192+39 enlistment in the armed forces of the United States or resided
193+40 in Indiana at least five (5) years before the person first applies
194+41 for an exemption under this chapter.
195+42 (4) A person who:

197+1 (A) enters active duty service from a permanent home address
198+2 in Indiana;
199+3 (B) received a discharge or separation from the armed forces
200+4 of the United States other than a dishonorable discharge; and
201+5 (C) received the Purple Heart decoration or was wounded as
202+6 a result of enemy action.
203+7 (5) A person whose mother, father, or spouse:
204+8 (A) served as a public safety officer; and
205+9 (B) was killed in the line of duty.
206+10 (6) A person whose mother, father, or spouse:
207+11 (A) is a member of the 1977 fund;
208+12 (B) sustained a catastrophic physical personal injury in the line
209+13 of duty; and
210+14 (C) qualifies for benefits under IC 36-8-8-13.3(f) or
211+15 IC 36-8-8-13.5(m).
212+16 (7) A person whose mother, father, or spouse:
213+17 (A) was a member of the Indiana National Guard; and
214+18 (B) suffered a service connected death while serving on state
215+19 active duty (as described in IC 10-16-7-7).
216+20 (8) A person whose mother, father, or spouse:
217+21 (A) was a state police officer; and
218+22 (B) suffered a permanent and total disability from a
219+23 catastrophic personal injury that was sustained in the line of
220+24 duty and permanently prevents the state police officer from
221+25 performing any gainful work.
222+26 (b) In addition to the eligibility requirements under subsection (a),
223+27 an individual must meet the following to be eligible for an educational
224+28 costs exemption under this chapter:
225+29 (1) The individual meets one (1) of the following:
226+30 (A) If the individual will attend a state educational
227+31 institution, the individual is eligible to pay the resident
228+32 tuition rate at the state educational institution the individual
229+33 will attend, as determined by the state educational institution.
230+34 (B) If the individual will attend an approved postsecondary
231+35 educational institution, the individual is a resident of
232+36 Indiana.
233+37 (2) If the individual:
234+38 (A) qualifies for an exemption under this chapter based on the
235+39 service of the individual's mother or father; and
236+40 (B) was adopted by the individual's mother or father described
237+41 in clause (A);
238+42 the individual was adopted before the individual was eighteen

240+1 (18) years of age.
241+2 (3) If the individual qualifies for an exemption under this chapter
242+3 based on the service of the individual's mother or father, the
243+4 individual is not more than thirty-two (32) years of age when the
244+5 individual first applies and becomes eligible for the exemption
245+6 under this chapter.
246+7 (4) The individual is, after high school graduation, pursuing a
247+8 prescribed course of study at the state educational institution or
248+9 approved postsecondary educational institution.
249+10 (5) After July 1, 2020, The individual maintains satisfactory
250+11 academic progress, as determined by the state educational
251+12 institution or approved postsecondary educational institution.
252+13 SECTION 9. IC 21-14-4-8, AS AMENDED BY P.L.112-2019,
253+14 SECTION 13, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
254+15 JULY 1, 2023]: Sec. 8. (a) This section applies only to an eligible
255+16 applicant who attends a state educational institution.
256+17 (b) The amount of the exemptions under this chapter is equal to one
257+18 (1) of the following amounts:
258+19 (1) If the applicant does not receive financial assistance
259+20 specifically designated for educational costs, the amount
260+21 determined under sections 2 through 6 of this chapter.
261+22 (2) If the applicant receives any financial assistance, including
262+23 federal assistance, specifically designated for educational costs:
263+24 (A) the amount determined under sections 2 through 6 of this
264+25 chapter; minus
265+26 (B) the financial assistance specifically designated for
266+27 educational costs.
267+28 SECTION 10. IC 21-14-4-9, AS ADDED BY P.L.191-2017,
268+29 SECTION 11, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
269+30 JULY 1, 2023]: Sec. 9. (a) The tuition and fee exemption
270+31 reimbursement fund is established to provide reimbursement to state
271+32 educational institutions and approved postsecondary educational
272+33 institutions for tuition and fee remissions listed in IC 21-12-13-1 that
273+34 were provided to eligible applicants.
274+35 (b) The fund consists of the following:
275+36 (1) Appropriations made by the general assembly.
276+37 (2) Gifts, grants, devises, or bequests made to the state to achieve
277+38 the purposes of the fund.
278+39 (c) The fund shall be administered by the commission.
279+40 (d) The expenses of administering the fund shall be paid from
280+41 money in the fund.
281+42 (e) The treasurer of state shall invest the money in the fund not

283+1 currently needed to meet the obligations of the fund in the same
284+2 manner as other public funds are invested.
285+3 (f) Money in the fund at the end of a state fiscal year does not revert
286+4 to the state general fund but remains available to be used for providing
287+5 reimbursement for tuition and fee remissions as provided under
288+6 subsection (a).
289+7 SECTION 11. IC 21-14-4-10 IS ADDED TO THE INDIANA
290+8 CODE AS A NEW SECTION TO READ AS FOLLOWS
291+9 [EFFECTIVE JULY 1, 2023]: Sec. 10. (a) An applicant who attends
292+10 an approved postsecondary educational institution qualifies for an
293+11 annual award under this chapter if the applicant:
294+12 (1) attends an approved postsecondary educational institution
295+13 listed in IC 21-7-13-6(a)(1)(C)(i) through
296+14 IC 21-7-13-6(a)(1)(C)(xxx);
297+15 (2) meets the qualification requirements under section 1 of
298+16 this chapter;
299+17 (3) graduated from high school after January 1, 2023; and
300+18 (4) has not received an award toward one hundred
301+19 twenty-four (124) semester credit hours or its equivalent as
302+20 determined by the commission.
303+21 (b) An award under this section must be in an amount equal to
304+22 the lesser of the following:
305+23 (1) If the scholarship applicant receives other financial
306+24 assistance specifically designated for educational costs, the
307+25 amount equal to the balance required to attend the approved
308+26 postsecondary educational institution.
309+27 (2) Five thousand dollars ($5,000).

312+Mr. Speaker: Your Committee on Education, to which was referred
313+House Bill 1511, has had the same under consideration and begs leave
314+to report the same back to the House with the recommendation that said
315+bill be amended as follows:

89-amount:

324+(1) If the scholarship applicant attends a state educational
325+institution for the academic year and:
326+(A) does not receive other financial assistance specifically
327+designated for educational costs, the amount equal to a full
328+undergraduate tuition scholarship, regardless as to whether the
329+student uses the scholarship for undergraduate or graduate
330+educational costs, to attend the state educational institution; or
331+(2) If the scholarship applicant
332+(B) receives other financial assistance specifically designated
333+for educational costs, the amount:
90334 (A) (i) equal to the balance required to attend the state
91335 educational institution; and
92336 (B) (ii) not to exceed the amount described in subdivision
93-(1). clause (A).
94-(2) A scholarship applicant who attends an approved
95-postsecondary educational institution listed in
96-IC 21-7-13-6(a)(1)(C)(i) through IC 21-7-13-6(a)(1)(C)(xxx)
97-shall receive a scholarship under this chapter in an amount
98-equal to the lesser of the following:
99-(A) If the scholarship applicant receives other financial
100-assistance specifically designated for educational costs, the
101-amount equal to the balance required to attend the
102-approved postsecondary educational institution.
103-(B) Five thousand dollars ($5,000).

178451 (A) was a member of the Indiana National Guard; and
179452 (B) suffered a service connected death while serving on state
180453 active duty (as described in IC 10-16-7-7).
181454 (8) A person whose mother, father, or spouse:
182455 (A) was a state police officer; and
183456 (B) suffered a permanent and total disability from a
184457 catastrophic personal injury that was sustained in the line of
185458 duty and permanently prevents the state police officer from
186459 performing any gainful work.
187460 (b) In addition to the eligibility requirements under subsection (a),
188461 an individual must meet the following to be eligible for an educational
189462 costs exemption under this chapter:
190-(1) The individual meets one (1) of the following:
191-(A) If the individual will attend a state educational
192-institution, the individual is eligible to pay the resident
193-tuition rate at the state educational institution the individual
194-will attend, as determined by the state educational institution.
195-(B) If the individual will attend an approved postsecondary
196-educational institution, the individual is a resident of
197-Indiana.
463+(1) The individual is eligible to pay the resident tuition rate at the
464+state educational institution or approved postsecondary
465+educational institution the individual will attend, as determined
466+by the state educational institution or approved postsecondary

268836 (b) An award under this section must be in an amount equal to

270838 (1) If the scholarship applicant receives other financial
271839 assistance specifically designated for educational costs, the
272840 amount equal to the balance required to attend the approved
273841 postsecondary educational institution.
