17+enrolled in a public high school may retake a virtual course that was
18+previously completed by the student at the same public high school
19+under certain conditions. Provides that if a student elects to retake a

1360 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 20-19-3-30 IS ADDED TO THE INDIANA CODE
15-AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
16-1, 2023]: Sec. 30. (a) Not later than October 1, 2023, each public
17-elementary school, including a charter school, and state accredited
18-nonpublic elementary school shall provide to the department the
19-following information:

78+1 SECTION 2. IC 20-19-3-31 IS ADDED TO THE INDIANA CODE
79+2 AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
80+3 1, 2023]: Sec. 31. (a) This section applies to a public school.
81+4 (b) As used in this section, "virtual course" refers to a high
82+5 school course offered at a public high school in which more than
83+6 fifty percent (50%) of the course instruction was provided to
84+7 students in an interactive learning environment created through
85+8 technology in which the student is separated from the teacher by
86+9 time, space, or both.
87+10 (c) The state board, in collaboration with the department, shall
88+11 create a process to allow a student who is presently enrolled in
89+12 grade 9 through grade 12 at a public high school to retake a virtual
90+13 course that the student previously completed in grade 9 through
91+14 grade 12 at the same public high school if the following conditions
92+15 are met:
93+16 (1) The student was enrolled in grade 9 through grade 12
94+17 during the 2019 through 2022 school years at the time the
95+18 student completed the virtual course.
96+19 (2) The student completed the virtual course as a result of a
97+20 state or federal executive order concerning the public health
98+21 emergency caused by the coronavirus disease (COVID-19)
99+22 pandemic.
100+23 (3) The student has not yet graduated or completed high
101+24 school.
102+25 (d) If a student elects to retake a virtual course under subsection
103+26 (c) the:
104+27 (1) retaken course must provide instruction regarding the
105+28 same subject matter and content as the previously completed
106+29 virtual course;
107+30 (2) retaken course must not be a virtual course;
108+31 (3) student must receive full credit for the retaken course
109+32 upon completion; and
110+33 (4) grade received by the student upon completion of the
111+34 retaken course must replace the grade received by the student
112+35 in the previously completed virtual course.
113+36 (e) If a student retook and completed a course under the
114+37 conditions described in subsection (c) prior to July 1, 2023, the
115+38 student must receive full credit for the course completion.
116+39 (f) The state board and the department may adopt rules under
117+40 IC 4-22-2 to implement this section.
118+41 SECTION 3. IC 20-31-3-3, AS AMENDED BY P.L.168-2022,
119+42 SECTION 19, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE

121+1 JULY 1, 2023]: (a) Sec. 3. The department shall revise and update
122+2 academic standards:
123+3 (1) for each grade level from kindergarten through grade 12; and
124+4 (2) in each subject area listed in section 2 of this chapter;
125+5 at least once every six (6) years in addition to the requirements
126+6 described in section 1(c) and 1(d) of this chapter. This revision must
127+7 occur on a cyclical basis.
128+8 (b) The department, in revising and updating academic
129+9 standards under subsection (a), shall do the following:
130+10 (1) Consider the skills, knowledge, and practices:
131+11 (A) that are necessary to understand and utilize emerging
132+12 technologies; and
133+13 (B) that may be rendered obsolete by emerging
134+14 technologies.
135+15 (2) Consider for removal any academic standards that may be
136+16 obsolete as a result of emerging technologies.
137+17 (3) Provide support to school corporations regarding the
138+18 implementation of revised and updated academic standards
139+19 that have an emerging technologies component.
