	36	+	A BILL FOR AN ACT to amend the Indiana Code concerning
	37	+	gaming.
13	38		Be it enacted by the General Assembly of the State of Indiana:
14		-	SECTION 1. IC 4-32.3-5-16, AS AMENDED BY P.L.145-2021,
15		-	SECTION 10, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
16		-	JULY 1, 2023]: Sec. 16. (a) The total prizes awarded for one (1) pull
17		-	tab, punchboard, or tip board game may not exceed fifteen thousand
18		-	dollars ($15,000).
19		-	(b) A single prize awarded:
20		-	(1) for one (1) winning ticket in a pull tab, punchboard, or tip
21		-	board game may not exceed five hundred ninety-nine dollars
22		-	($599);
23		-	(2) in a game using a seal card may not exceed one thousand
24		-	dollars ($1,000); and
25		-	(3) in a progressive or carryover pull tab game may not exceed
26		-	fifteen thousand dollars ($15,000).

	60	+	4 (b) A single prize awarded for one (1) winning ticket in a type II
	61	+	5 pull tab, punchboard, or tip board gambling game may not exceed five
	62	+	6 hundred ninety-nine dollars ($599).
	63	+	7 (c) A single prize awarded for one (1) winning ticket on a seal card
	64	+	8 in a type II pull tab gambling game may not exceed one thousand
	65	+	9 dollars ($1,000).
	66	+	10 (d) A single prize awarded for one (1) winning ticket on a
	67	+	11 progressive or carryover pull tab game in a type II gambling game may
	68	+	12 not exceed five thousand dollars ($5,000).
	69	+	13 (e) The selling price for one (1) ticket for a type II gambling game
	70	+	14 may not exceed one dollar ($1). five dollars ($5). Tickets sold for less
	71	+	15 than one dollar ($1) must be sold for a price specified in section 6(b)
	72	+	16 of this chapter.
	73	+	17 SECTION 3. IC 4-36-5-6, AS AMENDED BY P.L.108-2009,
	74	+	18 SECTION 20, IS AMENDED TO READ AS FOLLOWS [EFFECTIVE
	75	+	19 JULY 1, 2023]: Sec. 6. (a) Except as provided in subsection (b), A type
	76	+	20 II gambling game in which tickets are sold for at least one dollar
	77	+	21 ($1) but not more than five dollars ($5) must pay out at least
	78	+	22 seventy-five percent (75%) and not more than one hundred percent
	79	+	23 (100%) of the amount wagered.
	80	+	24 (b) This subsection applies only to a type II gambling game ticket
	81	+	25 that is sold for less than one dollar ($1). A type II gambling game
	82	+	26 subject to this subsection must comply with the following minimum
	83	+	27 payout percentages:
	84	+	28 Purchase Price Minimum Payout Percentage
	85	+	29 $0.10 60%
	86	+	30 $0.25 65%
	87	+	31 Three (3) tickets for 65%
	88	+	32 one dollar ($1)
	89	+	33 $0.50 70%
	90	+	34 (c) A type II gambling game's payout percentage must be stated on
	91	+	35 the ticket or on the accompanying flare.

	94	+	Madam President: The Senate Committee on Public Policy, to which
	95	+	was referred Senate Bill No. 172, has had the same under consideration
	96	+	and begs leave to report the same back to the Senate with the
	97	+	recommendation that said bill be AMENDED as follows:

51	120		II gambling game in which tickets are sold for at least one dollar
52	121		($1) but not more than five dollars ($5) must pay out at least
53	122		seventy-five percent (75%) and not more than one hundred percent
54	123		(100%) of the amount wagered.
55	124		(b) This subsection applies only to a type II gambling game ticket
56	125		that is sold for less than one dollar ($1). A type II gambling game
57	126		subject to this subsection must comply with the following minimum
58	127		payout percentages:
