3128 A BILL FOR AN ACT concerning property.
3229 Be it enacted by the General Assembly of the State of Indiana:
3330 1 SECTION 1. [EFFECTIVE UPON PASSAGE] (a) The legislative
3431 2 council is urged to assign to an appropriate interim study
3532 3 committee during the 2023 legislative interim the task of studying
3633 4 issues pertaining to homeowners associations, including the
3734 5 following:
3835 6 (1) Reviewing the practice of levying and enforcing fines by
3936 7 homeowners associations.
40-8 (2) Reviewing the accounting and fiduciary responsibilities of
41-9 homeowners associations.
42-10 (3) Issues related to funds collected by a homeowners
43-11 association if the homeowners association ceases to exist.
44-12 (4) Issues related to a homeowners association entering into
45-13 maintenance and utility contracts if the homeowners
46-14 association ceases to exist.
47-15 (b) This SECTION expires January 1, 2024.
48-16 SECTION 2. An emergency is declared for this act.
