SENATE BILL No. 195
A BILL FOR AN ACT concerning property.
Be it enacted by the General Assembly of the State of Indiana:
1 SECTION 1. [EFFECTIVE UPON PASSAGE] (a) The legislative
2 council is urged to assign to an appropriate interim study
3 committee during the 2023 legislative interim the task of studying
4 issues pertaining to homeowners associations, including the
5 following:
6 (1) Reviewing the practice of levying and enforcing fines by
7 homeowners associations.
8 (2) Reviewing the accounting and fiduciary responsibilities of
9 homeowners associations.
10 (3) Issues related to funds collected by a homeowners
11 association if the homeowners association ceases to exist.
12 (4) Issues related to a homeowners association entering into
13 maintenance and utility contracts if the homeowners
14 association ceases to exist.
15 (b) This SECTION expires January 1, 2024.
16 SECTION 2. An emergency is declared for this act.

COMMITTEE REPORT
Madam President: The Senate Committee on Judiciary, to which
was referred Senate Bill No. 195, has had the same under consideration
and begs leave to report the same back to the Senate with the
recommendation that said bill be AMENDED as follows:
