53+A BILL FOR AN ACT to amend the Indiana Code concerning
54+human services.
1355 Be it enacted by the General Assembly of the State of Indiana:
14-SECTION 1. IC 12-14-30-8 IS ADDED TO THE INDIANA CODE
15-AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY
16-1, 2023]: Sec. 8. (a) As used in this section, "eligible individual"
17-means an individual who:
18-(1) is:
19-(A) sixty (60) years of age or older; or
20-(B) a person with a disability, as determined under rules
21-adopted by the division; and
22-(2) resides in a household every resident of which is:
23-(A) sixty (60) years of age or older; or
24-(B) a person with a disability, as determined under rules
25-adopted by the division.
26-(b) The division shall develop and implement simplified
27-requirements by which an eligible individual may certify or
28-recertify the individual's eligibility for SNAP benefits.
29-(c) The simplified requirements under subsection (b) must:
30-(1) simplify and reduce the number of verification
31-requirements for certifying and recertifying an eligible
32-individual's eligibility to receive SNAP benefits, including by
33-use of a shortened application form;
34-(2) allow an eligible individual to waive recertification
35-interview requirements; and

37-(3) allow an eligible individual who certifies or recertifies the
38-individual's eligibility to receive SNAP benefits under the
39-simplified requirements to remain eligible for SNAP benefits
40-for thirty-six (36) months after the certification or
41-recertification.
42-(d) An eligible individual who certifies or recertifies the
43-individual's eligibility to receive SNAP benefits under the
44-simplified requirements under subsection (b) must:
45-(1) submit to the division a change reporting form not less
46-than once every twelve (12) months during the thirty-six (36)
47-month eligibility period described in subsection (c)(3); and
48-(2) notify the division, in accordance with federal law, if the
49-individual's income increases.
50-(e) The division shall, in a manner that complies with federal
51-law, use data matching to:
52-(1) identify; and
53-(2) provide information regarding SNAP eligibility to;
54-eligible individuals who are receiving Medicaid and are eligible for
55-SNAP benefits.
56-SECTION 2. [EFFECTIVE JULY 1, 2023] (a) Not later than
57-December 31, 2023, the office of the secretary of family and social
58-services shall submit to the United States Department of
59-Agriculture any state plan amendment necessary to implement
60-IC 12-14-30-8, as added by this act.
61-(b) This SECTION expires January 1, 2024.
