2828 A BILL FOR AN ACT to amend the Indiana Code concerning
2929 human services.
3030 Be it enacted by the General Assembly of the State of Indiana:
3131 1 SECTION 1. IC 12-17.2-7.7 IS ADDED TO THE INDIANA CODE
3232 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE
3333 3 JULY 1, 2023]:
3434 4 Chapter 7.7. Military Child Care Grant Program
3535 5 Sec. 1. As used in this chapter, "fund" refers to the military
3636 6 child care grant fund established by section 3 of this chapter.
3737 7 Sec. 2. As used in this chapter, "MCCYN program" refers to the
3838 8 Military Child Care in Your Neighborhood fee assistance program
3939 9 of a branch of the armed forces of the United States.
4040 10 Sec. 3. (a) The military child care grant fund is established to
4141 11 provide grants to child care centers for the purpose of assisting a
4242 12 child care center in obtaining the national accreditation necessary
4343 13 to participate in an MCCYN program.
4444 14 (b) The office of the secretary shall administer the fund.
4545 15 (c) The fund consists of:
4646 16 (1) money appropriated to the fund by the general assembly;
4747 17 (2) federal funding allocated to the fund by the office of the

4949 1 secretary; and
5050 2 (3) gifts, grants, devises, bequests, and other donations made
5151 3 to the fund.
5252 4 (d) The expenses of administering the fund shall be paid from
5353 5 money in the fund.
5454 6 (e) Money in the fund at the end of a state fiscal year does not
5555 7 revert to the state general fund.
5656 8 Sec. 4. (a) To the extent sufficient money is available in the fund,
5757 9 the office of the secretary shall provide a grant from the fund to a
5858 10 child care center that:
5959 11 (1) applies for a grant in the form and manner specified by the
6060 12 office of the secretary; and
6161 13 (2) is determined by the office of the secretary to be:
6262 14 (A) licensed under IC 12-17.2-4; and
6363 15 (B) located not more than thirty (30) miles from an active
6464 16 military base (as defined in IC 36-1-4-20).
6565 17 (b) The office of the secretary shall calculate the amount of a
6666 18 grant to a child care center under subsection (a) based on:
6767 19 (1) the available balance in the fund; and
6868 20 (2) an assessment by the office of the secretary of the actions
6969 21 needed to be taken by the child care center to attain eligibility
7070 22 for the MCCYN program of one (1) or more branches of the
7171 23 armed forces of the United States whose personnel serve at
7272 24 the active military base near which the child care center is
7373 25 located as determined under subsection (a)(2)(B).
7474 26 (c) A child care center that receives a grant under this section
7575 27 shall use the grant funds solely to defray expenses associated with
7676 28 taking the actions identified by the office of the secretary under
7777 29 subsection (b)(2).
7878 30 Sec. 5. The office of the secretary shall adopt rules under
7979 31 IC 4-22-2 necessary to implement this chapter.
