SENATE BILL No. 367 A BILL FOR AN ACT to amend the Indiana Code concerning human services. Be it enacted by the General Assembly of the State of Indiana: 1 SECTION 1. IC 12-17.2-7.7 IS ADDED TO THE INDIANA CODE 2 AS A NEW CHAPTER TO READ AS FOLLOWS [EFFECTIVE 3 JULY 1, 2023]: 4 Chapter 7.7. Military Child Care Grant Program 5 Sec. 1. As used in this chapter, "fund" refers to the military 6 child care grant fund established by section 3 of this chapter. 7 Sec. 2. As used in this chapter, "MCCYN program" refers to the 8 Military Child Care in Your Neighborhood fee assistance program 9 of a branch of the armed forces of the United States. 10 Sec. 3. (a) The military child care grant fund is established to 11 provide grants to child care centers for the purpose of assisting a 12 child care center in obtaining the national accreditation necessary 13 to participate in an MCCYN program. 14 (b) The office of the secretary shall administer the fund. 15 (c) The fund consists of: 16 (1) money appropriated to the fund by the general assembly; 17 (2) federal funding allocated to the fund by the office of the 2023 IN 367—LS 7053/DI 119 2 1 secretary; and 2 (3) gifts, grants, devises, bequests, and other donations made 3 to the fund. 4 (d) The expenses of administering the fund shall be paid from 5 money in the fund. 6 (e) Money in the fund at the end of a state fiscal year does not 7 revert to the state general fund. 8 Sec. 4. (a) To the extent sufficient money is available in the fund, 9 the office of the secretary shall provide a grant from the fund to a 10 child care center that: 11 (1) applies for a grant in the form and manner specified by the 12 office of the secretary; and 13 (2) is determined by the office of the secretary to be: 14 (A) licensed under IC 12-17.2-4; and 15 (B) located not more than thirty (30) miles from an active 16 military base (as defined in IC 36-1-4-20). 17 (b) The office of the secretary shall calculate the amount of a 18 grant to a child care center under subsection (a) based on: 19 (1) the available balance in the fund; and 20 (2) an assessment by the office of the secretary of the actions 21 needed to be taken by the child care center to attain eligibility 22 for the MCCYN program of one (1) or more branches of the 23 armed forces of the United States whose personnel serve at 24 the active military base near which the child care center is 25 located as determined under subsection (a)(2)(B). 26 (c) A child care center that receives a grant under this section 27 shall use the grant funds solely to defray expenses associated with 28 taking the actions identified by the office of the secretary under 29 subsection (b)(2). 30 Sec. 5. The office of the secretary shall adopt rules under 31 IC 4-22-2 necessary to implement this chapter. 2023 IN 367—LS 7053/DI 119
